Legal Analysis of the Temporary Suspension of Notaries Serving a Period of Detention (Case Study in Bintan Regency)

    No full text
This study examines the temporary dismissal of a notary who is undergoing detention, focusing on the legal framework, administrative procedures, and juridical implications based on the case of Notary Ratu Aminah Gunawan in Bintan Regency. The research employs a normative–empirical legal method, combining analysis of legislation, legal doctrines, principles of administrative law, Islamic legal perspectives, criminal case documents (Indictment P-29, Prosecutor's Demand P-42, and the District Court Judgment of Tanjungpinang No. 35/Pid.B/2022/PN.Tpg), as well as interviews with members of the Supervisory Council and law enforcement officials. The findings demonstrate that the legal basis for temporary dismissal under Article 10 of the Notary Act (UUJN) and Government Regulation No. 37/2011 provides the Minister of Law and Human Rights with clear authority to impose temporary dismissal on a notary who is detained. The implementation of temporary dismissal in Bintan has complied with the multi-tiered supervisory mechanism (MPD–MPW–MPP), fulfilling the principles of legality, proportionality, and legal protection for the public. Juridically, deeds executed before the detention remain legally valid insofar as they meet the formal and material requirements of the Notary Act, while deeds declared defective by the court lose their evidentiary strength. Detention and temporary dismissal not only affect the continuity of notarial services but also necessitate the appointment of a Substitute Notary to ensure legal certainty. This study concludes that temporary dismissal is a legal and proportionate administrative mechanism essential for safeguarding the integrity of the notarial office and ensuring legal protection for service users

Criminal Responsibility for Narcotics Abuse from the Ultimum Remidium Perspective

    No full text
This research discusses the concept and strategies for criminal law enforcement against drug abuse in the future to better align with the principle of ultimum remedy. The background of this research is based on the fact that drug law enforcement policies in Indonesia are still repressive, with imprisonment as the primary means of combating drug abuse. Such an approach leads to various negative impacts such as overcapacity in correctional institutions, low effectiveness of rehabilitation, and the criminalization of users who are actually victims of addiction. The main issues of this research include: (1) criminal liability for drug abuse in Indonesia according to Law Number 35 of 2009 concerning Narcotics; (2) obstacles and problems in applying the principle of ultimum remedy to drug users in Indonesia today; and (3) the concept and strategy of criminal law enforcement against drug abuse in the future to better align with the principle of ultimum remedy. The research method used is a normative legal approach, using primary data in the form of laws and national policies, as well as secondary data such as literature, journals, and the results of comparative studies. The research findings indicate that the effectiveness of drug law policies is not determined by the severity of the sanctions, but rather by the legal system's ability to integrate legal, health, and social approaches. Therefore, the future direction of criminal law reform for narcotics needs to focus on applying the principle of ultimum remedy, strengthening rehabilitation mechanisms, establishing cross-sectoral institutions, and changing the paradigm of law enforcement officers to be more oriented toward corrective justice and social recovery. Background: Color evaluation is crucial to evaluate a material’s quality. One alternative method for evaluating material’s color is using photographs analysed by software. This research evaluates the use of digital imaging and software (ImageJ and Photoshop) to obtain color differences of tooth sample in-vitro. Method: The sample used is bovine teeth that were given tea-staining and brushing treatment using five tested toothpastes. Sample’s photographs for each toothpaste’s group (n=4) were taken before and after experiment. DLSR Nikon D90 was used with digital CCD censor, macro lens 105mm, manual setting (ISO 200, F-Stop 5, Shutter Speed 1/400) with distance to sample of 25cm. Sample was positioned in foldable mini-studio-box (24.5x24.5x22.5cm) with LED-lighting (6500-7000 color temperature). The photographs were taken in close room at 11.00am. Two software were used to obtain the color value from pre- and post-experimental photographs of the sample at the middle-third of the sample using CIE-Lab (Commision Internacional de l’Eclairage L*a*b) color system. The resulted color difference (ΔE) value of sample from the two-software were compared using independent T-test and evaluate the measurement accuracy using Pearson’s correlation (α=0.05). Result: ImageJ and Photoshop analyses of the sample photographs yield comparable ΔE values, as determined by an independent T-test (p=0.893). The Pearson correlation test reveals a positive correlation (R=0.904) between the two software. Conclusion: The use of digital photography and software to obtain ΔE values are accurate, representative, and recommended when taking into account the controlled procedure of photographing the sample and analysing the sample's color value

Background: Pilots are a very stressful job. As a consequence of stress, pilots practice bruxism. Common clinical manifestations due to bruxism are attrition and abfraction. To evaluate whether there is a relationship between pilot flight hours and job stress associated with the occurrence of bruxism, attrition and abfraction among domestic civil aviation pilots throughout Indonesia. Methods: The subjects of the study were 196 pilots who were undergoing routine annual dental examinations at the Aviation Health Center of the Directorate General of Transportation. The pilot's flying hours, pilot job stress, awareness of the occurrence of bruxism was evaluated using the questionnaires. Attrition and abfraction were calculated based on scoring. Results: Most of the research subjects had flight hours of 5,000 to 10,000 hours, namely 44.4% (n = 87). Pilots who experienced stress were represented with at least 56.1% depression (n = 110) and minimal anxiety 49% (n = 96). Bruxism was found in 16.8% (n = 33) of all subjects. The highest attrition measurement was in enamel 47.4% (n = 93) and the most abfraction occurred in posterior teeth 8.2% (n = 16). The results of the Spearman correlation test show that there is no significant relationship between pilot flying hours with stress, bruxism with stress and stress on attrition. Conclusion: The higher the pilot's flight hours, the lower the stress. The higher the pilot's stress, the lower the attrition. There is no relationship between bruxism and pilot stress. The attrition that occurs is not directly related to bruxism activity
