TELAAH HISTORIS PONDOK PESANTREN SEBAGAI LEMBAGA PENDIDIKAN ISLAM
AbstractThis research is motivated by the nature and existence of Islamic boarding schools as educational institutions that are deeply rooted (indigenous) in Indonesian Muslim society, in its development Islamic boarding schools are able to maintain and preserve their sustainability (survival system). The purpose of this writing is to examine the background of Islamic education, especially in Indonesia and to examine the significance of Islamic boarding schools as one of the Islamic educational institutions. Document studies in the form of soft copies and written documents were used to collect data for this research which were then analyzed qualitatively. Based on the results of the study, the existence of Islamic boarding schools in Indonesia is increasingly well-known and increasingly varied. Islamic boarding schools are Islamic educational institutions that have an important role in the midst of society, covering at least three aspects, namely religious functions, social functions, and educational functions. Keywords: Historical Review, Islamic Boarding School, Islamic EducationÂ
“Leave No One Behind" Slogan On Street Children Empowerment By The Save Street Children Sidoarjo Community
This study aims to analyze the role of Save Street Children Sidoarjo (SSCS) in accelerating the Leave No One Behind Slogan through the street child empowerment program in Sidoarjo. Different from previous research, this study integrates the Leave No One Behind slogan within the framework of human development as a key conceptual approach. The research uses qualitative methods with a case study approach, as well as data collection techniques through in-depth interviews and direct observation. The results of the study show that SSCS actually implements the Leave No One Behind slogan by providing access to education and skills training for street children. These programs not only focus on meeting basic needs, but also encourage individual capacity building within the framework of human development. These findings confirm that the role of SSCS is aligned with the commitment to inclusive and sustainable development
Integrasi Nilai-Nilai Manajemen (Ajennangeng) dalam Naskah Lontara Latoa Tana Bone: Sebuah Pendekatan Teori Manajemen
"Integration of Management Values (Ajennangeng) in the Lontara Latoa Tana Bone Manuscript: A Management Theory Approach" aims to explore how the management values contained in the Lontara Latoa Tana Bone Manuscript can be integrated into modern management practices. This study uses a qualitative approach with descriptive analysis to understand the meaning and relevance of Ajennangeng's values in the current management context. The results of the study show that the values such as ethics, social responsibility, and collaboration contained in the Lontara Manuscript can serve as a guideline in more transparent and accountable managerial decision-making. In addition, this study also found that the integration of local values can increase stakeholder trust and strengthen people's cultural identity. Thus, this study recommends that a multidisciplinary approach that combines aspects of management, sociology, and anthropology can be adopted to better understand how management values (Ajennangeng) in the lontara Latoa Tana Bone manuscript can be integrated in a broader context
Childfree Phenomenon in Family Behavior: a Study of Maslahah Mursalah in Contemporary Social Context
The term childfree refers to individuals who deliberately choose not to have children—a decision that has sparked critical discourse in both social and religious contexts. This study explores the underlying motivations behind the childfree decision, examines family behavior patterns among Indonesian childfree couples, and analyzes this phenomenon through the lens of maslahah al-mursalah in Islamic legal theory. Employing a qualitative method with a normative-empirical approach, this research is based on field interviews with five members of the Indonesian Childfree Community. Findings indicate that the decision is driven primarily by personal autonomy, health considerations, and economic concerns. Notably, childfree couples exhibit distinct patterns in household role distribution, conflict management, and future planning in the absence of children. From the perspective of maslahah al-mursalah, the childfree lifestyle raises complex tensions between individual choice and the foundational aims (maqÄá¹£id al-sharī‘ah) of marriage and procreation in Islam. The study contributes to the emerging discourse on how Islamic legal reasoning can engage with evolving social behaviors in contemporary Muslim societies
Criminal Sanctions Against Perpetrators of the Commercial Sexual Exploitation of Children: A Comparative Study of Indonesian Positive Law and Islamic Criminal Law
The Commercial Sexual Exploitation of Children (CSEC) constitutes a serious violation of human rights and human dignity. In Medan City, CSEC practices occur in an organized and recurring manner, underscoring the need to evaluate the effectiveness of existing criminal sanctions. This study aims to compare criminal sanctions for CSEC offenders under Indonesian positive law and Islamic criminal law and to formulate normative contributions for strengthening child protection. Using a normative juridical and comparative legal approach, this research examines sanction provisions in the Indonesian Criminal Code (KUHP), Law No. 35 of 2014 on Child Protection, and Law No. 21 of 2007 on Human Trafficking, as well as the concepts of hudud and ta?z?r in Islamic criminal jurisprudence (fiqh jinayah). The findings reveal fundamental differences between the two systems: Indonesian positive law emphasizes legal certainty and rehabilitation through imprisonment and fines, while Islamic criminal law prioritizes moral deterrence through hudud and the flexibility of ta?z?r. This article contributes by proposing harmonization between the two systems through offense reformulation, strengthened sanctions, and the implementation of preventive policies grounded in religious values to enhance child protection against systemic sexual crimes
Enforcing Laws Against Illegal Gold Mining through the Lens of Islamic Criminal Law: A Case Study of Jambur Tarutung Kotanopan
Illegal gold mining (pertambangan emas tanpa izin, PETI) in Jambur Tarutung, Kotanopan, presents complex legal, socio-economic, and environmental challenges. This study examines the enforcement of criminal law against illegal gold mining in the region and explores how Islamic criminal law can provide a complementary framework for addressing such issues. Using an empirical juridical approach, this research integrates normative analysis of relevant legal provisions - particularly Law No. 3 of 2020 on Mineral and Coal Mining - with field data gathered through in-depth interviews, observations, and document analysis involving law enforcement officials, community leaders, religious scholars, and affected residents. Findings reveal that law enforcement remains largely ineffective due to weak supervision, limited institutional capacity, socio-political interference, and the dependence of local communities on illegal mining as an economic livelihood. From an Islamic criminal law perspective, these activities constitute jarimah ta?z?r involving fasad (corruption and destruction), warranting discretionary sanctions by the ulil amri that combine punitive and restorative measures. This study argues for an integrative enforcement model that merges positive law with maq??id al-shar??ah, emphasizing ecological restoration, community empowerment, and moral-spiritual reform. Such an approach promotes sustainable resource governance while fostering social justice and collective environmental responsibility
Penegakan Judi Online Dalam Perspektif Hukum Pidana dan Fiqih Jinayah: Studi Kasus di Polres Parepare
This study discusses law enforcement against online gambling practices within the jurisdiction of the Parepare Police Resort, viewed from the perspectives of positive criminal law and Islamic criminal law (fiqh jinayah). The increasing spread of online gambling has caused social unrest and created challenges for law enforcement in combating and prosecuting such activities. This research aims to analyze the effectiveness of the police in enforcing the law, the obstacles they encounter in the legal process, and the extent to which these efforts align with the principles of law. A qualitative method was used, with data collected through interviews, documentation, and direct observation. The findings show that law enforcement still faces several challenges, including limited digital facilities, lack of inter-agency cooperation, and low public legal awareness. In addition, the complexity of online gambling networks, which often involve cross-regional and international connections, further complicates police efforts. In fiqh jinayah, online gambling is classified as a jarimah ta’zir, where the punishment is determined by the authorities (ulil amri) to protect public interest and maintain social order. Therefore, synergy between positive legal approaches and Islamic legal principles is essential for effectively addressing online gambling, ensuring justice, and creating a strong deterrent effect for offenders while safeguarding society as a whole.
Penelitian ini membahas penegaka hukum terhadap praktik judi online dalam wilayah hukum Polres Parepare, ditinjau dari perspektif hukum pidana positif dan hukum pidana Islam (fiqih jinayah). Maraknya penyebaran judi online telah menimbulkan keresahan sosial dan menciptakan tantaga bagi aparat penegak hukum dalam memberantas dan menindak aktivitas tersebut. Penelitia ini bertujua untuk menganalisis efektivitas polisi dalam menegakkan hukum, hambatan yang mereka hadapi dalam proses hukum, dan sejauh mana upaya tersebut sesuai denga prinsip-prinsip hukum. Metode penelitian yang digunakan Adalah kualitatif, dengan data yang dikumpulkan melalui wawancara, dokumentasi, dan observasi langsung. Hasil penelitian menunjukkan bahwa penegakan hukum masih menghadapi berbagai tantangan, termasuk keterbatasan fasilitas digital, kurangnya kerja sama antarisntansi, dan rendahnya kesadaran hukum masyarakat. Selain itu, kompleksitas jaringan judi online yang sering melibatkan koneksi lintas daerah maupun internasional semakin memperumit upaya kepolisian. Dalam fiqih jinayah, judi online digolongkan sebagai jarima ta’zir, di mana bentuk hukuman ditentukan oleh pihak berwenang (ulil amri) untuk melindungi kepentingan umum dan menjaga ketertiban sosial. Oleh karena itu, sinergi antara pendekatan hukum positif dan prinsip hukum Islam sangat penting untuk secara efektif menegakkan keadilan, dan menciptakan efek jera yang kuat baik bagi pelaku, sekaligus melindungi masyarakat secara keseluruhan
HAK-HAK PEREMPUAN PASCA PERCERAIAN: PERBANDINGAN HUKUM KELUARGA ISLAM DI INDONESIA DAN MESIR
This research discusses women's rights after divorce by comparing Islamic family law in Indonesia and Egypt. The main focus of this research is to answer three questions: 1) how are women's rights post-divorce regulated in Indonesia, 2) how are the same arrangements in Egypt, and 3) comparative analysis between the two countries. The research uses a library method (research library) with a normative juridical approach and data collection techniques through document study. The research results show that in Indonesia, Islamic family law aims to protect women's rights through iddah, mut'ah and madhiyah livelihoods. However, enforcing these rights often faces challenges. In Egypt, Law no. 100 of 1985 provides similar protection, including the right to divorce and maintenance during the iddah period, although its implementation is hampered by social and cultural factors. A comparison between the two countries reveals similarities and differences in the arrangement of these rights. The husband's obligation to provide maintenance during the iddah period in Indonesia is flexible and determined by the court, whereas in Egypt it is more strict. Mut'ah in Indonesia is considered a respect that is not always required, while in Egypt it is the wife's right. In terms of joint assets, Indonesia considers all assets during a marriage to be jointly owned with division based on agreement, while Egypt considers the contribution of each party. This difference is influenced by economic factors, local culture, as well as regulations on interfaith marriages which are prohibited in Indonesia but exist in Egypt
DINAMIKA PENGGUNAAN ARTIFICIAL INTELLIGENCE (AI) DALAM PEMBELAJARAN PENDIDIKAN AGAMA ISLAM DI SMA
This study aims to analyze the dynamics of AI use in Islamic Religious Education (PAI) learning. This research employed a qualitative method with a case study approach. Data collection procedures used observation, interviews, and documentation, while data analysis procedures involved data condensation, data display, and conclusion drawing. The research findings indicate that the use of AI in PAI learning at SMAN 1 Gedeg has brought significant changes for both teachers and students. The main findings show that AI accelerates the creation of teaching materials, expands references, supports independent learning, and increases efficiency and interactivity in assignments and evaluations. The presence of AI also boosts students' confidence in seeking new knowledge and encourages them to explore information beyond conventional teaching materials. The adaptive and contextual use of AI has been proven to be adjustable to learning needs, although the role of the teacher remains crucial as a validator and gatekeeper of material, especially to maintain the authenticity of knowledge delivery in accordance with Islamic tradition. However, this study also identified several weaknesses, such as limited data on Quranic verses and hadith, difficulty in understanding complex religious concepts, and the potential for student dependence on AI, which can reduce critical thinking skills, self-reliance, and interest in reading. Additionally, there is a risk of decreased learning motivation and misuse of AI outside of the educational context. Other weaknesses noted include limited internet access and the need for supervision to ensure that information from AI remains aligned with Islamic values and appropriate religious education practices
LUKA WARISAN: IMPLIKASI BUDAYA PATRIARKI PADA KASUS KEKERASAN DALAM RUMAH TANGGA DI KABUPATEN BONE
The low status of women in a patriarchal culture renders them vulnerable to discrimination and violence within both the social and domestic spheres. The Bugis community maintains a wide range of cultural traditions, including a deeply rooted patriarchal paradigm. This imbalance of power relations significantly increases the likelihood of women experiencing violence, particularly domestic violence (KDRT). This article aims to analyze the implications of patriarchal culture in cases of domestic violence within the Bugis community residing in Bone Regency. The research employs an empirical legal method, examining law as written norms while also analyzing legal behavior within society. The findings reveal that the patriarchal culture of the Bugis community in Bone Regency has direct implications for domestic violence. Unequal power relations, restrictions on women’s participation in the social sphere, and the persistence of the siri’ concept, alongside conservative religious interpretations, sustain patriarchal behavior within Bugis society.Kedudukan perempuan yang rendah dalam budaya patriarki membuat nilainya dalam lingkup sosial dan rumah tangga menjadi rentan mendapatkan diskriminasi dan kekerasan. Masyarakat Bugis memiliki beragam budaya yang masih terus dilestarikan, termasuk paradigma patriarki yang masih kental. Relasi kuasa yang tidak seimbang mengakibatkan besarnya peluang perempuan mendapatkan kekerasan, terlebih kekerasan dalam rumah tangga (KDRT). Artikel ini bertujuan untuk menganalisis implikasi budaya patriarki pada kasus KDRT dalam Masyarakat Bugis yang berdomisili di Kabupaten Bone. Penelitian ini menggunakan metode penelitian hukum empiris dengan mengamati hukum sebagai norma tertulis, dan menganalisis perilaku hukum dalam masyarakat. Hasil penelitian menunjukkan bahwa budaya patriarki pada masyarakat Bugis di Kabupaten Bone memiliki implikasi terhadap KDRT, relasi kuasa yang timpang, pembatasan Perempuan dalam lingkup social serta konsepsi siri’ dan pemahaman agama yang konservatif memelihara perilaku patriarkal pada Masyarakat Bugis
