In the 2020 constitutional amendments in Algeria, the founders of the constitution approved the creation of an administrative appellate court, and thus the contract of the administrative judicial structure (administrative courts, administrative appellate courts, Council of State) was completed, as the legislator needed to redistribute judicial jurisdiction among the three judicial bodies, to ease the pressure on the Council of State, and devote itself to exercising its advisory and judicial powers, which prompted us to ask about the judicial jurisdiction of the Council of State in light of the latest legal amendments. To address these issues, we decided to divide the plan into two axes: On the first axis, we addressed the organization of the judicial bodies of the Council of State, while on the second axis, we addressed the judicial jurisdiction of the Council of State. This research uses a descriptive analytical approach, as well as an inductive approach, by extrapolating legal texts related to the judicial functions of the Council of State. The 2020 constitutional amendments and the accompanying legal amendments that will strengthen the principle of two-tier litigation in administrative matters, are considered one of the most important basic principles of the judiciary, and enshrine legal protection and supervision of the work of public institutions and administrative administration, and embody the principle of legitimacy. The establishment of administrative courts of appeal has significantly contributed to the harmonious redistribution of judicial jurisdiction among Algeria's administrative judicial structures. The research recommends the importance for the legislative authorities to amend the internal regulations of the Council of State, to adapt to recent legal amendments, including the 2020 constitutional amendments, Organic Law No. 22-11 amending and supplementing Law 98-01, and Law 22-13 amending and supplementing Law 08-09, including the Codes of Civil and Administrative Procedure

    No full text
The goal of law in Islam is to achieve the welfare of humanity. One of the ways to support the realization of justice is the use of forensic linguistics to assess the truth of testimony from defendants and witnesses in court. However, Indonesian legislation does not yet mandate the use of forensic linguistics in criminal cases. This study aims to analyze the application of maqÄá¹£id as-syar'iyyah in the use of forensic linguistics to assess the truth of testimony from defendants and witnesses. This is a normative legal research with a qualitative approach, focusing on primary data from the Indonesian Penal Code (KUHP) and court decisions that apply forensic linguistics methods. Data analysis was conducted using deductive reasoning based on the theory of maqÄá¹£id as-syar'iyyah. The findings show that the use of forensic linguistics to assess the truth of testimony from defendants and witnesses in criminal cases is part of the maslahat dharuriyyat. In particular, cases related to religion, murder, and corruption are crucial areas of maslahat dharuriyyat. Therefore, the presence of linguistic expert witnesses in court proceedings is an inevitability to ensure true justice

TELAAH KRITIS PASAL 209 KOMPILASI HUKUM ISLAM INDONESIA TENTANG WASIAT WAJIBAH PERSPEKTIF FIKIH ISLAM

This article examines Article 209 KHI in Indonesia, regarding the regulation of the share of assets for adopted children and/or adoptive parents. This research aims to explain the differences in giving inheritance or legacy assets intended for adopted children and adoptive parents in Islamic Jurisprudence and KHI in Indonesia. This research is normative research with qualitative descriptive analysis. The results of the research show that in Islamic jurisprudence, if the deceased (heir) does not leave a will for the adopted child or adoptive parents, then there is no will regarding the share of assets for the child or adoptive parents. However, in Article 209 KHI, the provisions for granting mandatory (automatic) wills apply to adopted children or adoptive parents with a maximum share of 1/3 of the testator's inheritance. Understanding the differences in provisions between KHI and Islamic jurisprudence can be analyzed by looking at the context of child adoption in the early days of Islam and the context of adoption in Indonesia. In the early days of Islam, adoption was only aimed at helping the child. However, current adoption practices in Indonesia emphasize the formal legality aspects of adoption. So in practice adoption is mandatory through a court process and has legal consequences, one of which is the share of the heir's inheritance through a mandatory will
