FENOMENA CHILDFREE DALAM RUMAH TANGGA MUSLIM: TINJAUAN HUKUM KELUARGA ISLAM DAN HAK REPRODUKSI
Get PDFThe childfree phenomenon, or the conscious decision to remain childless, has emerged in contemporary Muslim family discourse. This decision is often viewed as a form of individual rights recognition, yet it also raises controversy within the context of Islamic family law, which emphasizes the importance of offspring in marriage. This article aims to examine the childfree phenomenon from the perspective of Islamic family law and reproductive rights, and assess the extent to which this choice aligns with or contradicts the maqÄá¹£id al-syarī‘ah, particularly in the context of marriage objectives and the protection of lineage. This study employs a normative-qualitative approach by analyzing various sources of Islamic law, contemporary fiqh, and the views of scholars on reproductive rights and the purpose of marriage in Islam. The findings indicate that although Islam strongly emphasizes the importance of procreation through marriage, the decision not to have children (childfree) is not automatically contrary to Shari‘ah. Such a decision, when made with clear consideration of maslahat (public interest) and without harm to others, may be regarded as permissible within Islamic law. This research proposes the need for an adaptive and responsive Islamic legal approach to contemporary social dynamics, while still upholding deep ethical principles of Islam, particularly in safeguarding family and societal values. Thus, childfree can be understood as a legitimate choice if it aligns with the principles of maslahat in the context of Muslim family life

Get PDFThis study aims to analyze the effect of promotional strategies and service quality on customer satisfaction at BMT-UGT Nusantara Panji Branch, Situbondo in the perspective of Islamic economics. BMT as an Islamic microfinance institution has a strategic role in community economic empowerment, especially in areas that have not been reached by conventional banking services. Promotion strategy and service quality are important factors in creating customer satisfaction. This research uses a descriptive qualitative approach with data collection methods through documentation studies and non-participatory observation. The results showed that promotional strategies that include advertising, sales promotion, personal selling, and publicity have a significant role in attracting customer interest. Meanwhile, service quality measured through the five dimensions of SERVQUAL, namely tangibles, reliability, responsiveness, assurance, and empathy, contributes directly to customer satisfaction. Other factors such as product quality, adequate facilities, and social responsibility also influence the level of satisfaction. Get PDFDalam penelitian ini, dibahas peran komitmen dalam mengurangi risiko moral hazard pada skema pembiayaan mudharabah di Bank Jatim Syariah Capem Sampang. Moral hazard menjadi tantangan besar dalam pembiayaan mudharabah karena bank tidak memiliki kontrol langsung atas penggunaan dana oleh nasabah. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus. Data dikumpulkan melalui wawancara mendalam dan observasi langsung. Hasil penelitian menunjukkan bahwa komitmen bank dan nasabah menjadi kunci dalam meminimalkan risiko moral hazard. Pengendalian dana yang ketat, dukungan berkelanjutan dari bank, pendekatan personal dalam hubungan dengan nasabah, serta verifikasi usaha yang menyeluruh terbukti efektif dalam menciptakan ekosistem pembiayaan yang transparan dan akuntabel. Temuan ini memberikan kontribusi penting bagi pengembangan strategi mitigasi risiko pada pembiayaan mudharabah dan memberikan rekomendasi praktis bagi bank syariah dalam meningkatkan pengelolaan pembiayaan berbasis syariah
The Authority of the Constitutional Court to Adjudicate State Administrative Cases
Get PDFThe Constitutional Court (MK) is an institution that has the primary authority to interpret the 1945 Constitution. However, in practice, the Constitutional Court often handles cases related to Administrative Law (TUN), even though its authority normatively falls within the Administrative Court (PTUN) realm. This research aims to analyze the extent of the Constitutional Court's authority in adjudicating Administrative Law cases and the legal implications for the judicial system in Indonesia. This study uses a normative legal method with an approach to legislation, a case approach, and a conceptual approach. Data is obtained from primary legal sources in the form of legislation and Constitutional Court rulings, as well as secondary legal sources such as legal literature and relevant literature. Research results indicate that there is an overlap of authority between the Constitutional Court and the Administrative Court in several cases related to decisions of state organizers, disputes over election results, and legal norm testing that impacts state administration. This creates legal uncertainty and has the potential to undermine the principle of separation of powers within the Indonesian judicial system. Therefore, it is necessary to revise the Law on the Constitutional Court to clarify the boundaries of its authority so that it does not encroach on the realm of administrative law

No full textPemerintah telah menggunakan berbagai macam strategi selama ini untuk meningkatkan kualitas pendidik, termasuk program pendidikan dan pelatihan maupun program non-kependidikan. Namun strategi-strategi ini tidak berjalan dengan baik, sehingga diperlukan program profesional khusus untuk meningkatkan profesionalisme guru. Syarat yang terpenuhi tenaga pengajar di Indonesia saat ini harus menjadi seorang guru yang memiliki gelar sarjana (Spd) dan menempuh pendidikan profesi guru (PPG). Program PPG sangat penting untuk meningkatkan kompetensi dan profesionalitas guru termasuk guru Pendidikan Agama Islam (PAI). Profesionalitas guru PAI mencakup berbagai aspek, termasuk penguasaan materi, keterampilan, pedagogi, dan kemampuan untuk membangun karakter siswa sesuai dengan prinsip Islam. Melalui studi pustaka, penelitian ini mengkaji kompetensi yang harus dimiliki oleh guru PAI, peran PPG dalam meningkatkan kompetensi guru, serta dampak program ini terhadap profesionalitas mereka. Kajian ini mengacu pada berbagai sumber akademik, termasuk jurnal dan kebijakan pendidikan terkait PPG. Hasil dari penelitian menunjukkan program ini sangat signifikan dalam meningkatkan pemahaman pedagogik, penguasaan materi, keterampilan mengajar, serta kemampuan dalam membangun karakter pendidik yang profesional dan berintegritas sesuai dengan tuntutan kurikulum dan perkembangan zaman. This research uses a qualitativeapproach with descriptive analysis to identify and understand howthe value of honesty is internalized in Bugis character education. Thefindings show that Lontara Latoa functions not only as a culturaltext, but also as a source of educational values that teach theimportance of honesty in social interaction and national life. Thevalue of alempureng in it acts as a moral foundation that supportsthe formation of good character, in line with the teachings of theQur'an and Hadith. This research recommends the integration ofvalues of honesty into the educational curriculum in order to developindividuals with integrity and high morals. Thus, this researchcontributes to the development of local and religious values-basedcharacter education, as well as strengthening the understanding ofthe importance of honesty in the context of Islamic education.Â
Analysis of the Flexing Phenomenon "Mario Dandy Satriyo" in the Perspective of Islamic Communication Ethics
Get PDFThis research discusses the flexing phenomenon carried out by the son of official Mario Dandy Satriyo based on the perspective of Islamic communication ethics. This research aims to determine the ethical views of Islamic communication through 6 (six) qawlan on the flexing content of official Mario Dandy Satriyo's children on social media.The type of research used in this thesis is qualitative research, with library data collection techniques, namely observation and documentation, and analyzed using qualitative data analysis techniques proposed by Miles and Huberman.The results of this research show that the flexing phenomenon of Mario Dandy Satriyo who shows off his luxury vehicles on his social media platforms is contrary to the perspective of Islamic Communication Ethicsin 6 (six) forms or types of speaking styles (qawlan). The six qawlan (qawlan sadidan, qawlan baligha, qawlan ma'rufan, qawlan karima, and qawlan layyina) emphasize the importance of words or actions that are correct, effective, right on target, noble and gentle. Digital Da’wah: Content Analysis on the Instagram Platform @pesantrenal_junaidiyah
Get PDFThis study aims to analyze the da'wah message on the Instagram account @pesantren_aljunaidiyah, the official media of Pondok Pesantren Modern Al-Junaidiyah Biru, Bone Regency. The research uses a qualitative method with a content analysis approach to understand the themes and forms of da'wah messages uploaded in the form of photos, videos, and narratives of religious activities and pesantren education. Data was collected through literature study from various relevant secondary sources. The results showed that this account consistently presents educational, inspirational, and interactive da'wah content, with a focus on strengthening faith and building the character of students through the values of honesty, noble character, and trustworthiness. The visual approach and light narrative make the da'wah message easily accepted by the younger generation and the wider community.
