Modernization and Tradition: Kutai Kartanegara Government's Legal Policy in Maintaining the Existence of Erau Culture in the Era of Revolution 4.0
In the Industrial Revolution 4.0 era, technological advancements present challenges and opportunities for preserving local wisdom. This study examines the sustainability of the Erau tradition in Kutai Kartanegara, which faces pressures from modernization. Using a normative legal approach and library research methods, this research explores the intersection of law, local wisdom, and digital transformation in cultural preservation. The findings highlight that while modernization may threaten cultural authenticity, strategic digitalization and legal protection can safeguard traditions from excessive commercialization. Government regulations, including regional policies on cultural preservation, play a crucial role in balancing industrial development with cultural sustainability. Furthermore, public awareness and active community engagement are essential in integrating traditional values with contemporary technological frameworks. By emphasizing the role of legal frameworks and digital innovation, this study provides strategic insights for policymakers in fostering a sustainable cultural heritage amidst globalization
Food Security and Consumer Protection: An Analysis of Sanctions on the Sale of Expired Food Products from the Perspective of Islamic Criminal Law and Positive Law in Indonesia
The Sale of Expired Food Products: A Serious Violation That Poses Risks to Consumers' Physical and Psychological Health. This study aims to analyze the sanctions on selling expired food products from the perspective of Islamic Criminal Law and Law No. 8 of 1999 on Consumer Protection. Using a normative research method and comparative analysis, the study finds that Islamic Criminal Law emphasizes the moral aspect, such as the prohibition against causing harm to others (la darbar wa la dinar), with penalties adjusted according to intent and the impact of the violation, such as visas, diyat, or ta'zir. On the other hand, Law No. 8 of 1999 emphasizes legal certainty through criminal sanctions to protect consumers. The study highlights the similarities between the two legal systems in consumer protection but also notes the differing approaches, with Islamic Criminal Law focusing more on moral responsibility. Sanctions for Zina Perpetrators: A Review of Interfaith Couples from the Perspective of the Criminal Code and Fiqh Jinayah
This study analyzes the sanctions for adultery in interfaith marriages based on the Indonesian Criminal Code (KUHP) and Islamic criminal law (fikih jinayah). Using a normative legal method, this research applies both Islamic law and comparative law approaches to evaluate the differences in the regulation of adultery within the two legal systems. The data sources consist of primary legal materials (KUHP, Compilation of Islamic Law, the Book of Fikih Jinayah, and the Marriage Law) and secondary legal materials (academic literature and court decisions). The analysis is conducted descriptively-analytically using the triangulation of legal sources technique. The findings show that the KUHP only criminalizes adultery as infidelity within a marriage, whereas in fikih jinayah, any sexual relationship outside a lawful marriage is considered adultery. In Islam, interfaith marriage is not recognized. Thus, such a relationship is categorized as adultery. In contrast, under Indonesia's positive law, interfaith marriages can still be recognized through specific legal mechanisms. Additionally, apostasy (murtad) has different legal consequences: In fikih jinayah, the marriage is automatically annulled, while under the KUHP, the marital status remains valid until a court decision is made. This inconsistency presents challenges in harmonizing national criminal law. Legal reform is needed to balance social norms, state law, and the principles of Sharia to create a more inclusive legal system that is adaptive to the needs of Indonesian society
POLITIK HUKUM SEBAGAI ALAT PERLINDUNGAN MASYARAKAT: ANALISIS HUMANIORA TERHADAP SISTEM HUKUM DI INDONESIA
This study aims to explore the legal politics of societal protection tools, specifically analyzing the Indonesian legal system from a humanities perspective. The focus lies on the role of legal instruments in safeguarding citizens' rights and their implementation within the framework of Indonesian law. By examining historical, cultural, and social contexts, this analysis investigates how the legal system in Indonesia influences public protection policies, especially in addressing challenges such as human rights violations, social justice, and the balance between state authority and individual freedoms. Utilizing a humanistic approach, this paper highlights the critical need for reforms that can create a more inclusive, fair, and effective legal structure for society. Additionally, the study stresses the importance of legal education and advocacy in raising public awareness of legal protections and ensuring that laws remain aligned with the evolving needs and values of Indonesian society. KAJIAN HUKUM EKONOMI ISLAM TERHADAP PASAL 91 UNDANG-UNDANG CIPTA KERJA TENTANG PENGUPAHAN
Tulisan yang berjudul Kajian Hukum Ekonomi Islam terhadap Pasal 91 Undang-unsdang Cipta Kerja tentang pengupahan ini dilatar belakangi oleh dihapuskannya peraturan mengenai wajib membayar upah kepada pekerja dalam undang-undang cipta kerja, sementara sebelumnya dalam undang-undang cipta kerja tertera hal demikian. Begitu juga dalam hukum ekonomi islam hal demikian telah diatur, bahwa wajib bagi pengusaha atau pemberi pekerjaan membayar upah kepada pekerjanya. Tujuan dari penelitian ini adalah untuk mengetahui dan mengalisis tentang kajian hukum ekonomi Islam terhadap Pasal 91 Undang-undang Cipta Kerja tentang pengupahan. Dengan demikian hasil penelitian ini adalah bahwa dalam hukum ekonomi Islam wajib membayar upah bagi pekerja. Berdasarkan analisis penulis bahwa dalam hal pembuatan undang-undang, pemerintah telah mempertimbangkan banyak hal. PENGARUH PENGETAHUAN DAN MOTIVASI INVESTASI TERHADAP MINAT INVESTASI MAHASISWA FAKULTAS EKONOMI DAN BISNIS ISLAM IAI NUSANTARA BATANG HARI DI PASAR MODAL SYARIAH INDONESIA
Mahasiswa, khususnya yang terdaftar dalam program Perbankan Islam dan Ekonomi Islam di Fakultas Ekonomi dan Bisnis, Institut Agama Islam Nusantara Batanghari, mendapatkan pendidikan dalam keahlian investasi pasar modal. Penelitian ini bertujuan untuk menguji dampak pengetahuan dan motivasi investasi terhadap minat di pasar modal Islam. Pengetahuan investasi mengacu pada pemahaman tentang penggunaan sumber daya untuk menghasilkan keuntungan, sementara motivasi investasi menunjukkan dorongan untuk terlibat dalam kegiatan investasi. Penelitian ini menggunakan metodologi kuantitatif dengan menggunakan teknik survei, termasuk 87 peserta investor mahasiswa dari Galeri Investasi Islam di Institut Agama Islam Nusantara Batanghari. Temuan analisis statistik menunjukkan bahwa pengetahuan investasi dan motivasi investasi memiliki pengaruh parsial, positif, dan substansial terhadap minat investasi. Pengetahuan investasi memiliki dampak sebesar 34,6%, sementara motivasi investasi memberikan pengaruh sebesar 54,7%. Pengetahuan investasi dan motivasi investasi bersama-sama meningkatkan minat investasi sebesar 64,3%. Temuan-temuan ini secara signifikan meningkatkan pemahaman tentang faktor-faktor penentu yang mempengaruhi minat investasi di pasar modal Islam dan memberikan dasar bagi inisiatif yang bertujuan untuk menambah minat investasi masa depan
STRATEGI BERTAHAN HIDUP JANDA USIA MUDA DI KOTA PALOPO
The status of being a widow, especially for young women, often brings negative impacts on their daily lives. Therefore, this research aims to understand the obstacles faced by young widows and the strategies they employ to cope with these challenges. The study was conducted in Pontap Subdistrict, Palopo City, focusing on informants who have experienced divorce or the loss of their husbands within the age range of 19-40 years. The research employed a qualitative approach with the goal of providing an in-depth description of the cases under investigation. The findings of the research reveal that young widows in Pontap Subdistrict face primary challenges in the form of negative social stigma from the surrounding community and economic constraints. This stigma manifests as negative labels attached to the widow status, creating additional barriers in their daily lives. Meanwhile, economic constraints emerge as a crucial factor affecting their ability to meet the basic needs of their households. To address these challenges, young widows employ various strategies that can be categorized into active, passive, and networking strategies. Active strategies involve additional efforts, such as increasing working hours during leisure time. Passive strategies include measures like cutting down on expenses. Networking strategies involve more intensive involvement in community life, building close relationships with family members, neighbors, and relatives as a form of social support and fostering a sense of communal cooperation
RECONSTRUCTION OF THE SCOPE SECURITY MANAGEMENT SYSTEM GOVERNMENT IN BONE REGENCY
The urgency of reconstructing the security management system within the scope of government in Bone Regency stems from the increasing complexity of governance and the evolving security challenges that threaten institutional stability and public trust. This study examines the legal foundation of the government security management system in Bone Regency, the concretization or practical implementation of the security management system, and the law enforcement of the government security management system in the region. Employing a normative-empirical legal study, this research utilizes a legislative approach, a case approach, and a conceptual approach. The legal materials analyzed include primary legal materials, secondary legal materials, and tertiary legal materials, with data collection methods consisting of observation, interviews, and documentation. Data processing and analysis are conducted through qualitative analysis to assess legal aspects and descriptive analysis to synthesize findings. The study reveals that while the security management system adheres to the principle of legality through standardized procedures based on existing laws and regulations, its practical implementation faces considerable obstacles. Limited infrastructure, technological constraints, and social disparities within institutions hinder comprehensive enforcement. Consequently, an urgent update to the security management system is necessary to foster preventive, responsive, and collaborative measures between leaders and security personnel, ensuring a more effective and resilient governance framework
LEGAL CONSEQUENCES OF EMPLOYER NON-COMPLIANCE IN FULFILLING SOCIAL SECURITY OBLIGATIONS FOR WORKERS SUBJECTED TO UNILATERAL TERMINATION
Labor social security is a fundamental right guaranteed by the state to protect workers from social and economic risks, including unilateral termination of employment. However, in practice, many employers fail to comply with their obligations to provide social security benefits to workers who have been unilaterally dismissed. This non-compliance has severe consequences for workers' well-being and legal implications for employers. This study aims to analyze the legal implications of employers' non-compliance in providing social security benefits to workers affected by unilateral termination and examine the government's role in enforcing the law and protecting affected workers. The research employs a normative juridical method with a statutory and case approach. The findings reveal that employers' failure to pay labor social security contributions can result in administrative, civil, and criminal sanctions under Law Number 24 of 2011 on BPJS and Law Number 13 of 2003 on Manpower. Additionally, workers whose rights are violated can seek legal recourse through the Industrial Relations Court (PHI). The government plays a crucial role in ensuring employer compliance through supervision, law enforcement, and providing dispute resolution mechanisms and legal assistance for workers. This study concludes that enhancing regulatory effectiveness and monitoring employer compliance is essential to safeguarding workers' rights, maintaining economic stability, and promoting social welfare in Indonesia
LEGISLASI PRODUK HUKUM ISLAM: PROSES, TANTANGAN, DAN IMPLEMENTASI DI INDONESIA
This article examines the products of Islamic legal thought, which have a broad impact on Muslim communities and can serve as a strong foundation for legal principles. The aim of this study is to explore the existence, issues, and application of Islamic legal instruments within the legal system. The research employs a qualitative method, utilizing bibliometric and textual approaches, along with descriptive analysis.The findings reveal that Islamic law has developed in Indonesia through the products of four schools of legal thought: fiqh (Islamic jurisprudence), fatwas by religious scholars, court decisions (ijtihad), statutory regulations, and sociological legal theories. The challenges in legislating Islamic legal thought in Indonesia include low legal awareness, discrimination, the pluralistic legal system, internal debates among Muslims, lack of education, and political dynamics. Addressing these challenges requires an integrative approach involving all elements of society to foster better understanding and support for the implementation of Islamic law within the national framework
