    Analisis Hak Reproduksi Wanita Dalam Perspektif Hukum Positif di Indonesia

    Women's reproductive rights are fundamental human rights recognized both internationally and nationally. This study aims to analyze the protection of women's reproductive rights within the framework of Indonesian positive law, focusing on Law No. 17 of 2023 on Health, along with other related regulations such as the Criminal Code (KUHP) and the Child Protection Law. Using a normative juridical approach, this research examines the regulatory gaps and challenges in the implementation of reproductive rights, especially in rural and remote areas. The findings indicate that despite existing legal frameworks, there are significant inconsistencies in the enforcement and accessibility of reproductive health services, compounded by cultural norms and patriarchal structures. Issues such as child marriage, limited access to quality healthcare, and inadequate legal protection for vulnerable groups, including sexual violence survivors and women with disabilities, highlight the complexity of safeguarding reproductive rights. This study recommends legal harmonization, improved healthcare access, and comprehensive reproductive education to ensure better protection and fulfillment of women's reproductive rights in Indonesia. Strengthening these aspects is crucial to uphold women's health, autonomy, and dignity in accordance with universal human rights standards.Hak reproduksi wanita merupakan hak asasi manusia yang mendasar dan diakui baik secara internasional maupun nasional. Penelitian ini bertujuan untuk menganalisis perlindungan hak reproduksi wanita dalam kerangka hukum positif di Indonesia, dengan fokus pada Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, serta regulasi terkait lainnya seperti Kitab Undang-Undang Hukum Pidana (KUHP) dan Undang-Undang Perlindungan Anak. Dengan menggunakan pendekatan yuridis normatif, penelitian ini mengkaji kesenjangan regulasi dan tantangan dalam implementasi hak reproduksi, terutama di daerah pedesaan dan terpencil. Hasil penelitian menunjukkan bahwa meskipun sudah ada kerangka hukum yang berlaku, masih terdapat ketidakkonsistenan dalam penegakan hukum dan aksesibilitas layanan kesehatan reproduksi, yang diperburuk oleh norma budaya dan struktur patriarki. Permasalahan seperti perkawinan anak, akses terbatas terhadap layanan kesehatan berkualitas, serta perlindungan hukum yang kurang memadai bagi kelompok rentan, termasuk penyintas kekerasan seksual dan perempuan penyandang disabilitas, menggambarkan kompleksitas dalam melindungi hak reproduksi. Penelitian ini merekomendasikan harmonisasi hukum, peningkatan akses layanan kesehatan, dan edukasi reproduksi yang komprehensif untuk memastikan perlindungan dan pemenuhan hak reproduksi wanita di Indonesia. Penguatan aspek-aspek ini penting untuk menjaga kesehatan, otonomi, dan martabat wanita sesuai dengan standar hak asasi manusia universal. Â

    MULTIPLICITY OF CRIMES IN INDONESIAN LAW: REGULATION AND DETERMINATION OF CONCURSUS REALIS

    Concursus realis, or the accumulation of criminal acts, is crucial because it ensures that multiple offenses committed by the same individual are properly addressed within the judicial system. Indonesia, as a state governed by law as stipulated in Article 1 paragraph (3) of the 1945 Constitution, upholds justice and legal certainty as the primary principles of its penal system. This study aims to analyze the regulation of concursus realis in Indonesian criminal law and its application in court rulings. The research employs normative legal methods with a statutory and case analysis approach, utilizing secondary data from regulations, doctrines, and jurisprudence, which are analyzed. The findings reveal that concursus realis is regulated under Articles 65 and 66 of the Indonesian Penal Code (KUHP) and Articles 58 and 59 of Law No. 1 of 2023, stipulating cumulative penalties for independent criminal acts within a series of events, with the maximum sentence of the most severe offense increased by one-third. The application of concursus realis in judicial practice shows significant variation, influenced by judges' interpretations of the 'series of events' concept, yet often inconsistent due to the lack of technical guidelines. Therefore, regulatory revisions and the harmonization of interpretations are essential to ensure that the application of concursus realis supports the realization of justice and legal certainty

    LEGAL CHALLENGES IN COVER SONG DISPUTES: A CIVIL PROCEDURAL PERSPECTIVE ON COPYRIGHT ENFORCEMENT

    Cover song disputes have emerged as a significant concern within civil procedural law in the digital age, driven by the proliferation of online music platforms and frequent disregard of copyright compliance. This study aims to investigate the challenges faced by artists in understanding and adhering to song cover copyright regulations. Employing a qualitative methodology, the research gathered data through in-depth interviews with 50 purposively selected respondents, including musicians, producers, and legal professionals within the music industry. Thematic analysis was used to identify key patterns and themes, revealing that 60% of artists lacked awareness of the legal requirements for obtaining permission to create song covers, leading to increased legal uncertainty and disputes over intellectual property. These findings highlight the critical need for comprehensive educational initiatives and clearer regulatory frameworks to address this knowledge gap and support compliance. Enhancing copyright literacy among artists is essential to fostering a legally secure and balanced environment in the music industry. This study contributes to the existing literature on copyright challenges in the arts sector and underscores the urgent need for regulatory updates and practical measures to ensure fair use and protection of creators' rights in an increasingly digital music ecosystem. Future research should explore the dynamic interaction between evolving technologies and copyright law in shaping the practices of artists and the broader music industry, ensuring the sustainability and fairness of the creative economy.Top of For

    DAMPAK PENCERAIAN ORANG TUA TERHADAP MOTIVASI BELAJAR ANAK DI DESA TADDAN TENGGAH KAB. SAMPANG

    This research is motivated by the impact of parental divorce on children, resulting in the loss of important role models or examples for them. The psychological well-being of children is also disturbed, and they feel disappointed, which in turn affects their motivation to learn. The aim of this study is to investigate the impact of parental divorce on children's motivation to learn in Kampung Kebbun, Taddan Tenggah Village, Camplong District, Sampang Regency. The research method used is qualitative with a descriptive approach, and data collection techniques include observation, interviews, and documentation. Data analysis is conducted interactively. The results of this study, based on observations and interviews, show various impacts of parental divorce on children's motivation to learn. Some children who experience divorce still have high motivation to learn, although sometimes they experience unstable emotions and show independent traits. However, some children experience negative impacts such as decreased motivation to learn, lack of enthusiasm or laziness in learning, lack of concentration, lack of attention from parents leading to cessation of learning, uncontrollable emotions, and feelings of resentment. The conclusion of this study is that in Kampung Kebbun, Taddan Tenggah Village, Camplong District, Sampang Regency, the impact of parental divorce on children's motivation to learn includes decreased enthusiasm for learning, lack of enthusiasm in learning, and a tendency to become lazy in learning. As a recommendation, parents are advised to continue to provide adequate attention to their children, especially when they are studying, and to provide the necessary support and motivation to build their children's motivation to learn

    TRANSAKSI JUAL BELI ITEM VIRTUAL DALAM GAME ONLINE DENGAN SISTEM GACHA PERSPEKTIF FIQH MUAMALAH

    This article examines the legal standing of buying and selling virtual items in online games that use the Gacha system, which often involves loss and uncertainty (Gharar). The Gacha system in online games typically begins when a player, acting as the buyer, performs a top-up to purchase items (in-game currency exchange) from a top-up provider acting as the seller. The virtual goods obtained are then exchanged for Gacha tickets; however, during this process, buyers are not guaranteed to receive the items they desire. Instead, they receive items based on predetermined probability rates outlined in the game's terms. Players require in-game currency to spin or draw from the Gacha in order to use this method. Essentially, a contract must be based on mutual consent of the parties involved, but this method introduces various levels of uncertainty into the transaction. The use of the Gacha system in online games for buying and selling is prohibited in Islamic commercial jurisprudence (fiqh muamalah) because it violates one of the essential pillars and conditions of a valid sale—namely, that the item received does not match what was intended or expected. This means the transaction contains elements of gharar, which is prohibited in Islam and renders the sale invalid under fiqh muamalah

    PENGARUH POLA ASUH ORANG TUA TERHADAP PEMBENTUKAN AKHLAK PRIBADI SISWA SMPN 2 GONDANGREJO KARANGANYAR

    This study aims to analyse the effect of parental parenting on adolescent morals, especially morals towards oneself, in students of SMPN 2 Gondangrejo Karanganyar. Using mixed method sequential explanatory method, this research combines quantitative and qualitative approaches. Data were collected through questionnaires distributed to 35 randomly selected samples. Simple linear regression analysis was used to measure the influence of parenting patterns on student morals. The results showed that parenting patterns had a significant effect on students' morals towards themselves, with a contribution of 40.5%. Democratic parenting tends to produce very good and good morals, while authoritarian parenting tends to produce poor morals. Permissive parenting shows varying results. This study concludes that parenting has an important role in shaping adolescent morals, especially in the context of morals towards oneself

    This study explores the implementation of the ISMUBA curriculum (Al-Islam, Kemuhammadiyahan, and Arabic Language) at Muhammadiyah Boarding School (MBS) Palopo, Indonesia. The research aims to analyze how this curriculum integrates Islamic values and character education within a boarding school system. Employing a qualitative descriptive approach with a phenomenological method, data were collected through in-depth interviews, observation, and documentation. The subjects included curriculum planners, ISMUBA teachers, and school administrators. Data were analyzed using the Miles and Huberman interactive model, including data reduction, display, and conclusion drawing, with validity ensured through source and method triangulation. The findings reveal that the ISMUBA curriculum at MBS Palopo is implemented regularly and contextually through well-planned integration of theological, pedagogical, and contextual dimensions. Formal learning in classrooms is extended into non-formal character development programs such as religious mentoring, tahfidz, halaqah, and Islamic practices embedded in students' daily routines. The collaboration between teachers and dormitory supervisors reinforces the internalization of Islamic values, resulting in increased student discipline, spiritual awareness, and moral conduct. Evaluation mechanisms involve regular teacher coordination, behavioral observation, and student character monitoring, ensuring responsiveness to student needs. The study concludes that the ISMUBA curriculum at MBS Palopo serves as a central framework for character education, blending religious instruction with academic learning in a boarding school context. These findings contribute to the discourse on integrated Islamic education and provide a model for character-based curriculum implementation in Islamic boarding schools.Â

    A NEEDS ANALYSIS OF ESP FOR FASHION DESIGN STUDENTS AT AN INDONESIAN VOCATIONAL SCHOOL

    This research analyzes the ESP learning needs of fashion design students at SMKN 1 Bone, focusing on how English learning can be aligned with the practical and professional demands of the fashion field. This study aims to identify how students perceive their English language needs, their current competencies and difficulties, as well as their preferences for English topics, materials, and learning methods relevant to the fashion field. Using a qualitative descriptive method, data were collected through questionnaires administered to 32 students and interviews with 8 purposively selected participants. The needs analysis framework follows Hutchinson and Waters’ needs analysis, covering necessities, lacks, and wants. The results demonstrate that students view English as important for continuing their education, developing careers, and promoting fashion products internationally. However, many students still struggle with grammar, pronunciation, and speaking, and have limited opportunities to practice English outside the classroom. Vocabulary, writing, and reading are among the most needed language components, particularly for describing products and engaging with global fashion trends. Students also expressed a strong preference for materials that are directly related to fashion and for interactive learning methods such as group work and class discussions. These findings highlight the need to develop more relevant ESP instruction that reflects the realities and expectations of the fashion design field. Teachers are encouraged to adjust lesson plans to better support students’ language development for both academic and professional purposes

    Analysis of Packaging Design by Increasing Sales Turnover in a Sharia Economic Perspective. This research aims to find out whether product packaging design can increase sales turnover and whether product packaging design can increase sales turnover from an Islamic economic perspective at the UTTON Store Jl. Jendral Sudirman District. Bone The type of research used in this research is field research because the researcher conducted research directly at the UTTON Outlet, Bone Regency. The data collection techniques used in this research are interviews, observation and documentation. The instruments in the research carried out in this research were interview sheets and documentation sheets. The data analysis techniques used in this research are data reduction, data presentation, verification and drawing conclusions, and the validity of using member checking. The research results show that packaging design increases sales turnover at UTTON Outlets Jl. Jendral Sudirman District. Bone provides packaging that is futuristic in nature and has a contemporary feel, thus increasing customer or customer attraction in addition to the service and taste of the product itself.     THE EFFECT OF TRUST AND SERVICE QUALITY ON BSI MOBILE BANKING USER SATISFACTION WITH CUSTOMER LOYALTY AS AN INTERVENING VARIABLE (CASE STUDY OF IAIN KUDUS STUDENTS)

    This study aims to analyze the influence of trust and service quality on the loyalty of BSI Mobile Banking users, with customer satisfaction as an intervening variable. The study was conducted on IAIN Kudus students as active users of BSI Mobile. The associative quantitative method was used in this study, with data analysis techniques using Structural Equation Modeling (SEM) based on Partial Least Square (PLS) through SmartPLS software. The results showed that trust had a significant effect on loyalty, while service quality did not have a significant effect. Customer satisfaction as an intervening variable also did not have a significant effect on user loyalty. This study provides new insights for the development of mobile banking applications based on trust and quality service in the context of Islamic banking
