    Legal Responses to Sexual Orientation Related Marital Breakdown: A Comparative Analysis of Islamic Family Law and Indonesian State Law

    Marital breakdown due to sexual orientation is becoming an increasingly visible phenomenon in Indonesian courts, but it remains in a gray area in both Islamic family law and national law. This study aims to analyze how both legal systems respond to this issue, both through written norms and jurisprudential practice, while identifying points of convergence and divergence between the two. Using qualitative research methods with a normative comparative approach, this study examines classical and contemporary fiqh literature and legislation. The findings show that although fiqh and Indonesian positive law depart from different epistemological orientations fiqh is based on ethical-normative principles and state law is based on legal-formalist principles both have important intersections in the form of the principle of preventing harm, recognition of factual disharmony, and psycho-social protection of couples. but there are significant differences in the categories of disgrace, standards of evidence, and the scope of judicial discretion, which lead to disparities in rulings. This research contributes to the development of family law discourse by offering a harmonization framework based on maqāṣid al-sharī'ah and a harm-based reasoning approach, as well as recommending interpretive guidelines that can increase legal certainty and protection of couples' rights in marriage cases involving sexual orientation

    Legal Protection of Traditional Cultural Expressions in Aceh: A Comparative Legal Analysis of Islamic Law and Positive Law in Indonesia

    This study aims to analyze the legal protection of traditional cultural expressions (TCEs) in Aceh through a comparative legal analysis of Islamic law and Indonesian copyright law. While TCEs play a crucial role in preserving cultural heritage, their legal protection remains insufficient due to regulatory inconsistencies and enforcement challenges. This research method used is normative juridical research. The primary data sources in this study include Law No. 28 of 2014 on Copyright, Law No. 11 of 2006 on Aceh Governance, and relevant Qanun in Aceh that govern the protection of cultural heritage and intellectual property. The data analysis was conducted through a comparative evaluation of Islamic law perspectives and positive law in Indonesia. The results of this study indicated that Indonesia's legal framework provides formal recognition of TCEs, yet lacks a robust enforcement mechanism. In contrast, Islamic law views TCEs as intellectual property that must be safeguarded under the principles of hifdz al-mal (protection of property) and maslahah mursalah (public welfare). Harmonizing these two legal perspectives is essential to establish a comprehensive and culturally sensitive legal framework. This study contributes to the discourse on intellectual property rights by integrating Islamic and Indonesian legal perspectives, offering a pathway for more effective legal protection of TCEs in Aceh

    From Classical Kafā’ah to Contemporary Economic Justice: A Hadith-Based Legal Reassessment in Islamic Family Law

    This study aims to reassess the concept of economic kafa’ah by re-examining prophetic traditions (ahadith) through a phenomenological and socio-legal lens. Employing qualitative methodology, this research integrates thematic hadith analysis, historical contextualization of classical juristic opinions, and phenomenological interpretation to explore shifts in meaning and application. The findings reveal that economic kafa’ah in prophetic tradition primarily emphasizes ethical reliability, economic responsibility, and shared life capital rather than pre-existing wealth or social pedigree. Contemporary application suggests that kafa’ah is a dynamic construct that may emerge through mutual potential, education, work ethic, and long-term economic cooperation. The legal reassessment demonstrates that classical hierarchy-based criteria are not immutable; instead, they may be contextualized according to maqasid al-shari‘ah to promote economic justice, household stability, and gender balanced financial roles. This study concludes that economic kafa’ah should be reconstructed as a principle of equitable capability and shared socio-economic commitment rather than rigid material equivalence.Penelitian ini bertujuan untuk menganalisis pemahaman tentang Rekonstruksi pemahaman hadis Kafaah perekonomian dalam penentuan pasangan dengan pendekatan Fenomenologis. Kajian ini adalah penelitian kualitatif, dianalisis dengan metode content analysis serta menggunakan pendekatan Fenomenologis. Data bersumber dari Hadis-hadis Nabi yang berbicara tentang Kafaah, litelatur penelitian sosial. Kafaah sering dijadikan keharusan dalam pemilihan pasangan pernikahan, apalagi kafaah secara ekonomi (limaliha) yang selalu dipahami secara materi, oleh karena itu penelitian ini dapat menjadi acuan pemahaman aktualisasi kafaah ekonomi secara kontekstual. Hasil penelitian menunjukkan bahwa hadis yang berbicara tentang Kafaah  terdapat satu hadis dalam Sunan Ibnu majah, 4 hadis terdapat dalam Sunan Imam Darul Qutni, Sedangkan hadis tentang kreteria kafaah terdapat enam hadis dalam kutub al-Tis’ah. Hadis-Hadis tersebut  menunjukkan bahwa kafaah bukanlah syarat syah perkawinan, kafaah merupakan anjuran pertimbangan untuk memilih pasangan dalam berumah tangga. Rekonstruksi Fenomenologi pemahaman kafaah secara ekonomi dalam menentukan pasangan bahwa kafaah tersebut tidak selalu dalam bentuk materi, tetapi dapat secara potensial yaitu persamaan visi, misi, dalam pendidikan, kometmen. Kafaah tersebut akan berimplikasi secara psikologis, ekonomis dan relasi kerja, dalam membina keharmonisan dan keutuhan sebuah rumah tangga

    Implementation of Sharia Marketing Characteristics for Gold Pawn Customers at Bank Mitra Syariah Gresik

    Purpose: Business competition is generally fierce, making it difficult for competitors or similar companies to attract customers. Some competitors may focus more on satisfying rather than optimising profits. The service must be done as well as possible to add value and attract customers. This study aims to see how Sharia marketing characteristics are implemented at Bank Mitra Syariah Gresik. At this point, the researcher collects and organises the needed information, then presents the information according to the topic and summarises the findings, conclusions, and results based on the available evidence and data. Findings: Researchers use source triangulation to validate data. Sharia marketing has four characteristics at Bank Mitra Syariah Gresik: theoretical (rabbaniyah), realistic (al-waqi’yyah), ethical (al-akhlaqiyah), and humanistic (insanity), which have been implemented well. Originality/Values: This study highlights the real implementation of Sharia marketing characteristics at Bank Mitra Syariah Gresik, which positively impacts customer satisfaction. The theistic, ethical, realistic, and humanistic approaches have built a strong image and customer trust in Gold Pawn Services

    Implementing Blockchain Technology in Halal Certification: A Systematic Literature Review of Opportunities and Challenges

    Objectives: This study aims to identify trends, key themes, opportunities, and challenges in the application of blockchain technology in halal certification activities. Design/Method/Approach: This study used the Systematic Literature Review (SLR) method with the PRISMA guidelines. Data were collected from Google Scholar using Publish or Perish (PoP). Findings: the research found that blockchain has significant potential to enhance transparency, efficiency, traceability, and accountability in halal certification through features such as smart contracts and decentralized storage. However, significant challenges remain, including infrastructure readiness, human resource limitations, the absence of global standards, and potential ethical gaps. Publication trends indicate an increase in academic interest in this topic. Originality/Value: This research contributes by mapping the latest literature and filling the research gap related to the application of blockchain specifically in halal certification. The results are expected to serve as a scientific and practical foundation for the development of a more credible and sustainable digitalization strategy for the halal industry

    Integrating Cash Waqf into Indonesia’s Free Meal Program Using the Business Model Canvas (BMC)

    Purpose: This paper explores how Cash Waqf can support Indonesia’s free school meal program by applying the Business Model Canvas (BMC) framework to organize resources, stakeholders, costs, and benefits. Design/Method/Approach: Using a descriptive-qualitative approach, the study draws on secondary data from literature, case studies, and global practices in Islamic social finance. Lessons from the Nordic Pro-Meal initiative and Bangladesh’s BRAC program, both proven to enhance children’s health and learning, are adapted. The BMC is applied to map key partnerships, value propositions, activities, and financial flows for incorporating Cash Waqf into Indonesia’s free meal initiative. Findings: The proposed BMC involves collaboration between government, Islamic finance institutions, NGOs, and private partners. Key activities include fundraising, investment management, program implementation, and community engagement. Value propositions deliver sustainable charity for donors, nutritious meals for students, fiscal relief for government, and stronger social cohesion. Essential resources comprise Cash Waqf funds, human capital, infrastructure, and digital platforms. Costs include operational, technological, and outreach expenses, while revenues stem from Cash Waqf contributions, investment returns, sponsorships, and government support. Findings show Cash Waqf offers a scalable and sustainable funding mechanism to improve nutrition, education, and national development. Originality/Value: This study is the first to examine Cash Waqf’s role in Indonesia’s free school meal program. It contributes an innovative BMC framework demonstrating how Islamic social finance can be leveraged to enhance welfare and educational outcomes sustainably

    Politeness Strategies and Gendered Language Use in Hospitality Discourse: A Case Study from an Urban Hotel in Jakarta

    This research examines the utilization of politeness strategies and gendered language among hospitality professionals at Ibis Styles Jakarta Mangga Dua Square. The main goals are threefold: to find out what kinds of politeness strategies front office staff use, to look at how gender affects the language choices they make when talking to guests, and to look at how important these strategies are for improving customer satisfaction and professional communication. Data were gathered via direct observation of daily service interactions and semi-structured interviews with staff, facilitating a comprehensive understanding of both practice and perception. The analysis shows that people often use both positive and negative politeness strategies. However, the way they use them depends on their gender. Female staff members were more likely to use both positive strategies, like friendly greetings and building solidarity, and negative strategies, like indirect requests and polite apologies. This shows that they were relational and empathetic. In contrast, male staff members mostly used positive politeness strategies that focused on being clear, confident, and efficient, especially when they were busy serving customers. These gendered differences exemplify overarching discourse patterns, including "rapport talk" and "report talk," thereby affirming that communication styles are influenced by both personal preferences and societal expectations, as well as professional standards. The findings underscore that linguistic strategies are not solely a matter of decorum but serve as essential instruments in fostering guest satisfaction and professional credibility. The study contends that neither empathetic nor efficiency-driven approaches should be favored; instead, both fulfill complementary roles in hospitality service delivery. By placing these insights in the context of actual hospitality practices, the research enhances applied linguistics, discourse studies, and hospitality management. It also has real-world effects on professional training and staff development programs that want to improve communication, flexibility, and service excellence in the global hospitality industry

    Peran Program Perpustakaan Keliling sebagai Layanan Publik di Perpustakaan Umum Kota Cimahi: Pendekatan Kualitatif

    This study examines the role of the mobile library program as a form of public service provided by the Cimahi City Public Library in enhancing literacy access for the community, particularly for students in areas with limited access to conventional libraries. The study is motivated by the urgency of equitable access to information as a part of inclusive literacy development. This research employs a descriptive qualitative method, with data collected through in-depth interviews with librarians who are directly involved in the implementation of the program. The findings indicate that the mobile library significantly contributes to increasing students’ reading interest by providing diverse and easily accessible reading materials. The presence of this service allows students to access information without the need to visit a library building directly. However, the implementation of the program faces several challenges, including limited vehicle availability, a shortage of human resources, and the risk of collection damage due to high mobility. Nevertheless, the findings suggest that the mobile library plays a strategic role in expanding the reach of library services and supporting the development of an equitable literacy ecosystem in Cimahi City

    By using the End User Computing Satisfaction (EUCS) paradigm, EUCS is a model or method used to measure the level of user satisfaction with an information system by considering several indicators such as content, accuracy, format, ease and timeliness. This study attempts to assess the level of user satisfaction with Valery , a virtual resource library at the Bandar Lampung University Library that has a unique voice feature that makes it interesting to study. By using quantitative techniques, this study is descriptive. In this study, 88 participants were surveyed. Information was collected using a survey using a Likert scale. This study uses the mean and grand mean formulas for data analysis. Finally, the evaluation findings are presented on an interval scale. By using the End User Computing Satisfaction (EUCS) model, the Bandar Lampung University Library evaluated Valery , a virtual resource library, and found that users were generally satisfied with its system with an average score of 4.51. By using the End User Computing Satisfaction (EUCS) model, Valery  (Virtual Resources Library) of Bandar Lampung University Library received a "Very High" rating in the interval range from 4.20 to 5.0. Suggestions and input for further research are: first, it is expected to conduct research with the same theme but with different perception indicators in order to expand again regarding research and the use of the Valery  application, for example reading access by other users: second, the phenomenon of the number of students is inversely proportional to the number of Valery  digital collections and inversely proportional to the number of users who have installed Valery

    Need Analysis of Teaching Materials for Kitabah Using the Genre-Based Pedagogy

    This study aims to analyze students' needs for Kitabah (Arabic writing) teaching materials through the lens of Genre-Based Pedagogy at IAIN Curup, Indonesia. Although Kitabah is a core component of language acquisition, its instruction remains heavily centered on grammar, with limited emphasis on developing coherent and meaningful texts. Employing a mixed-methods approach, data were gathered from 88 students and lecturers through a 5-point Likert scale survey, in-depth interviews, and classroom observations. The findings reveal that existing teaching materials lack structured guidance to support the progressive development of writing skills. Approximately 85% of students reported difficulties in writing independently, citing insufficient practice and a lack of constructive feedback from instructors. Moreover, the primary textbook used prioritizes grammatical forms over functional writing skills. This study recommends the development of instructional materials grounded in Genre-Based Pedagogy to enhance students’ ability to produce well-organized and purposeful texts. The findings contribute to Arabic language instruction by offering empirical insights for designing more effective Kitabah teaching resources. Theoretically, the study advances understanding of Genre-Based Pedagogy as applied to Kitabah instruction within the Indonesian context
