Wa Lā Taġlū Fī Dīnikum" in Q.S. An-Nisā' (4):171: A Hermeneutic Analysis of Fazlur Rahman's Double Movement in the Context of Religious Moderation in the Post-Truth Era

The phenomenon of rising religious populism, digital radicalism, and theological disinformation in the post-truth era has shifted religious authority from clerics and academics to a digital space full of emotions and ideological biases. This condition gave rise to a new form  of ghuluw (extremism) that was not only theological, but also epistemological. This research aims to answer the main question: what is the meaning of "wa lā taghlū fī dīnikum" in Q.S. An-Nisā' (4):171 can be interpreted through  Fazlur Rahman's double movement hermeneutics  to strengthen the paradigm of religious moderation in the post-truth era? Using a qualitative approach based on literature studies, this study utilizes Fazlur Rahman's major work Themes of the Qur'an and Islam and Modernity as a theoretical foundation, and is supported by classical and contemporary interpretations for textual analysis. The data analysis technique is carried out through two stages of double movement: understanding the historical context of the revelation (the first movement) and relevanting it to modern socio-religious conditions (the second movement). The results of the study show that the prohibition of ghuluw in the verse has universal moral relevance as a warning against the absolutism of interpretation and the claim of the single truth in the age of disinformation. Through the double movement approach, it is found that religious moderation is not an ideological compromise, but a rational expression of Qur'anic ethics that integrates faith, reason, and humanity. This research offers an epistemological synthesis in the form of "contextual-moderate interpretation", which is an integrative interpretive model between texts, contexts, and social morals. This study recommends the development of further research on the integration of Rahman's hermeneutics with maqāṣid al-sharī'ah and religious digital literacy theory to strengthen the epistemic resilience of the ummah in the midst of a global crisis of trut

Effectiveness of Islamic Law in Protecting The Rights of The Child

    Get PDF
The article critically evaluates the success of Islamic Family Law in meeting its core goals of child protection and welfare, comparing its influence and execution to the CRC's worldwide standards. Islamic Family Law provides a comprehensive framework based on religious and cultural norms to protect children's rights. Despite its strong basic principles, Islamic Family Law's practical application and efficacy in safeguarding children's rights varies greatly among sociopolitical circumstances, echoing the issues experienced by the Convention on the Rights of the Child (CRC). A mixed-method approach was used, combining quantitative analyses of child welfare statistics from mostly Islamic nations with qualitative evaluations based on case studies, interviews with legal experts, and reviews of secondary literature. Key indices of child welfare and rights were monitored throughout time, with comparison studies showing the disparities in results across different national contexts. The statistics show that Islamic Family Law has resulted in major advances in child welfare in a number of nations, while the extent of application and success varies. The efficacy of these legislation is heavily determined by unique sociopolitical and economic circumstances. The incorporation of Islamic values has facilitated worldwide discourse and action, raised awareness and established a precedent for child safety. Islamic Family Law has made significant contributions to defining the agenda for children's rights in Islamic contexts, but its practical impact varies greatly. A personalized, context-specific strategy, together with ongoing monitoring and modification, is required to guarantee that its ideas are universally recognized and effectively applied

Marriage Law Reform in Indonesia A Maqasid al-Usrah Perspective on Legal Adaptation

    Get PDF
This study explores the reform of Indonesian marriage law through the lens of maqasid al-usrah, the family-centered objectives within Islamic legal theory. It critically assesses whether key legal reforms such as marriage registration, minimum age requirements, regulation of divorce, and prenuptial asset arrangements align with the ethical aims of Islamic family law, including the protection of lineage, dignity, justice, and family welfare. Employing a qualitative library research method, the paper draws on classical Islamic jurisprudence, statutory legal documents, court practices, and the analytical framework of Jamaluddin al-Athiyya. It finds that while Indonesian legislation increasingly incorporates maslahah (public benefit) and maqasid reasoning to justify reforms, the implementation often falls short due to bureaucratic barriers, legal pluralism, and social inequality. For instance, minimum age laws are undermined by widespread judicial dispensations, and formal protections for women are diluted by enduring patriarchal norms and unequal access to justice. The study argues that maqasid al-usrah has been invoked more as a justificatory narrative than as a fully operational legal method. It concludes that meaningful application of maqasid requires not only legal reform but also structural, procedural, and cultural transformation to ensure that laws genuinely promote justice, protect the vulnerable, and reflect the dynamic needs of Indonesian Muslim society. This research contributes to the growing discourse on maqasid-based legal reform and offers a practical framework for evaluating future policy developments in Islamic family law

Integrasi Moderasi Beragama dan Industri Halal: Tantangan dan Solusi

    No full text
The rapid expansion of Indonesia’s halal industry requires alignment between economic growth and the principles of religious moderation, including wasaṭiyyah (balance) and maṣlaḥah (public welfare). This study analyzes how these principles are integrated into halal governance, certification, and policy frameworks while identifying structural and socio-cultural barriers that hinder their implementation. Employing a descriptive qualitative design grounded in interpretivism, the research uses document and content analysis of legal instruments (Law No. 33/2014 on Halal Product Assurance), institutional reports (BPJPH and KNEKS), and peer-reviewed literature. Triangulation was applied through cross-validation of academic, governmental, and media sources. The findings reveal that religious moderation is conceptually acknowledged yet structurally fragmented due to bureaucratic inefficiencies, inconsistent policy coordination, and limited accessibility for micro and small enterprises (MSMEs). Cultural resistance and theological diversity further constrain its application. The study contributes to the interdisciplinary discourse on Islamic governance and ethical regulation by operationalizing wasaṭiyyah and maṣlaḥah as analytical tools for inclusive halal policymaking. It recommends strengthening regulatory coordination, digitizing halal certification, and embedding moderation training within institutional programs to enhance transparency and inclusivity. Religious moderation thus emerges not merely as a moral principle but as a structural framework for sustainable halal industry development and global competitivenessIndustri halal di Indonesia mengalami pertumbuhan pesat, namun implementasi prinsip moderasi beragama—yang mencakup keseimbangan, toleransi, inklusivitas, dan keadilan—masih menghadapi berbagai tantangan.

Analysis of Takhrij Hadith in the DSN-MUI Fatwa on Halal Tourism: A Critical Study of the Sanad and Matan

    Get PDF
DSN-MUI Fatwa No. 106/DSN-MUI/X/2016 regarding halal tourism is a significant reference in Indonesia. This research analyzes the authenticity of the hadiths within this fatwa using a qualitative method with a takhrij al-hadith approach, focusing on the quality of the sanad (chain of narrators) and matan (text). The primary data sources are the DSN-MUI fatwa, hadith collections, and narrator biographies (rijal al-hadith) such as Tahzib al-Tahzib and Tahzib al-Kamal. Findings indicate that two hadiths narrated by Imam Ahmad and Imam al-Baihaqi are classified as dhaif (weak) but may be used for fadha'il al-a'mal (virtues of deeds) if their weaknesses are not severe. Conversely, a hadith narrated by Abd al-Razzaq is deemed sahih (authentic). This study contributes by performing takhrij from Mashadir al-Asliyah (primary sources) on the hadiths of the halal tourism fatwa, an underexplored area

Unveiling the Concept of Taklīf in the Qur’an: A Tahlīlī Study in the Context of Generation Beta

    Get PDF
The principle of taklīf (religious obligation) within the limits of human capacity represents one of God’s blessings upon His creation. Allāh (SWT) has removed hardship in its implementation, ensuring that all individuals can fulfil His commands and avoid His prohibitions. The Qur’an explicitly emphasises that Allāh does not impose a burden beyond the ability of His creatures. The issue addressed in this study concerns the meaning of taklīf in the Qur’an. This inquiry corrects the common misconception among laypeople that paradise can only be attained by those who possess extensive religious knowledge and perform intensive acts of worship—such as highly concentrated prayers, lengthy recitations, abundant deeds, or eloquent Qur’anic recitation. In reality, attaining paradise is not as difficult as often imagined. This research aims to explore and clarify the meaning of taklīf in the Qur’an. The study employs a descriptive-analytical method, which involves presenting all relevant data concerning the subject matter and analysing it by examining the various aspects embedded in the interpreted verses. This research adopts a qualitative, library-based approach. The novelty of this study lies in uncovering the semantic dimensions of taklīf in the Qur’an through key terms such as kataba, faraḍa, lāzim, amara, and wajaba. The findings suggest that taklīf should not be understood merely as a burden, but rather as an obligation intended to facilitate human practice of religion. When individuals immerse themselves excessively in spiritual practices without considering divine ease, they may fail to perform religious duties properly. Islam provides rukhṣah (dispensations) to maintain balance, and neglecting them by insisting on ʿazīmah (the original strict ruling) when concessions are permitted may impose unnecessary hardship. This research concludes that the meaning of taklīf encompasses five key semantic expressions—kataba, faraḍa, lāzim, amara, and wajaba—which collectively convey the sense of obligation and responsibility that does not impose undue difficulty.

    Get PDF
Purpose: This study tests the influence of knowledge, level of education, religiosity, socialisation, and income on the interest in waqf money in the Muslim community in Palembang. Design/Method/Approach: This study uses the SmartPLS 3.3.9 application and the Structural Equation Modelling (SEM) model approach as a quantitative research methodology. It uses questionnaire data with the criteria of Muslim respondents in Palembang who have an income and have never received money from a waqf. The sample size was determined based on Roscoe’s theory, which is at least 10 times the number of variables studied, so the minimum number of respondents is 60. Findings: Based on the results of this study, it was found that the variables of knowledge and religiosity did not have a significant effect, with a p-value greater than the significance level of 0.05. However, the variables of education, socialisation, and income significantly affect the interest of the Palembang city Muslim community in making money waqf in BWI South Sumatra Province. This proves that the money waqf in Palembang is greatly influenced by several factors, with a p-value of less than the significance level of 0.05. Originality/Values: The main contribution of this study is to provide a survey that is needed periodically through education to the Muslim community of the city of Palembang, so that it becomes a comprehensive study that can increase the public’s interest in doing money waqf

Islamic Banks as Agents of Economic Growth: An Econometric Analysis of Islamic Economy

    Get PDF
This study scrutinizes the role of Islamic banks as dynamic agents fostering economic growth underpinned by Shariah-compliant principles, notably risk-sharing, prohibition of interest (riba), and avoidance of excessive uncertainty (gharar). Utilizing advanced econometric methodologies including stationary tests (ADF, KPSS), Johansen co-integration error correction mechanisms, Granger causality, fully modified ordinary least squares (FMOLS), and quantile regressions on a broad panel dataset from 1990– 2023 covering Muslim-majority economies and GCC , the analysis confirms a statistically positive nexus between Islamic banking development and macroeconomic growth indicators such as GDP and capital formation. Incorporating mathematical models of profit-and-loss sharing (PLS) and asset-backed finance within stochastic optimization frameworks, elucidates the mechanisms by which Islamic finance bolsters financial stability, deepens financial inclusion, and promotes sustained development. The findings underscore the critical moderating impact of inflation and economic policy uncertainty, highlighting the necessity of macroeconomic stability to optimally leverage Islamic finance’s potentials. Policy recommendations include enhancing Shariah governance, expanding inclusive finance infrastructure, and reinforcing regulatory environments. This paper advances the literature by integrating Islamic economic theory with econometric modeling to delivering an interdisciplinary framework for future research, policy making and proposes a new understanding from an econometric perspective about impact of islamics economics in economic development
