    Angela Nikoletti, Sabine Gruber, Lili Gruber and Francesca Melandri analyse the context of violence, deceit and neglect in the annexation of South Tyrol. We analyse their denunciations of the greed of the Italian, Austrian and German governments and reflect on the structures of resilience in relation to hope. We look at the topicality of these colonially nuanced events in geopolitical power games.     Leading Changes in School Culture : Insights from a Three-Year School Improvement Program

    In decentralized educational systems, schools are expected to meet high standards, with school principals granted wide-ranging autonomy in decision making. This creates significant challenges for school leadership. Previous studies have suggested that partnerships with universities can be an effective way to drive change in the school culture by creating artifacts to initiate discussions about espoused beliefs and values, and even about basic underlying assumptions. This article presents a longitudinal study of five schools participating in a three-year program. The program aimed to create a collaborative culture by enhancing teaching and learning practices through distributed leadership, co-creation, and evidencedriven decision making. The study identified changes in school culture based on interviews with school teams and mentors and on teacher surveys conducted during the program. The findings highlight the challenges that the school leadership encountered when creating practices for effective professional learning, such as learning communities and peer observations. Effective leadership is crucial in evidence-driven decision making, as goaloriented leaders are necessary for sustaining collaborative organizational routines for data use.     The Fulfilment of a Statute Barred Debt Based on a Subsequently Annulled Effective Judgment

    Podle judikatury Nejvyššího soudu platí, že plní-li dlužník promlčený dluh na základě pravomocného rozsudku, který je následně zrušen kasačním rozhodnutím Nejvyššího soudu z důvodu nesprávného právního posouzení otázky promlčení, vzniká tím dlužníku právo na vydání toho, co plnil, jako bezdůvodného obohacení. Při bližší analýze této judikatorní linie Nejvyššího soudu však vyjde najevo, že ve skutečnosti postrádá jakoukoli oporu v hmotném právu. Zároveň nesprávně předpokládá přímý dopad procesněprávních institutů do hmotněprávních poměrů, kdy otázku, zda došlo ke splnění dluhu, ve skutečnosti spojuje s existencí pravomocného soudního rozhodnutí. Uvedená judikatura je potom pouze důsledkem nevhodné koncepce dovolání jako mimořádného opravného prostředku směřujícího proti již pravomocným rozhodnutím odvolacích soudů v českém právu. Namístě by proto byla změna pojetí dovolání na řádný opravný prostředek, neboť v takovémto procesněprávním rámci by k situacím, kdy dlužník plní na základě posléze zrušeného pravomocného rozsudku, prakticky nemohlo docházet.According to the case law of the Supreme Court, if a debtor pays a statute barred debt to the creditor based on an effective judgment which is subsequently annulled by the Supreme Court due to incorrect legal assessment of limitation, the debtor can claim from the creditor what he had previously paid as unjust enrichment. However, upon closer analysis of this case law it is evident that it lacks any foundation in substantive law. It also wrongly presupposes the direct effects of the institutes of procedural law on substantive legal relations as it links the question of whether a debt had been fulfilled with the existence of an effective court decision. This case law actually results from the unsuitable conception of the appeal to the Supreme Court (dovolání) as an extraordinary legal remedy against already effective decisions of appellate courts under Czech law. A change of the conception of the appeal to the Supreme Court (dovolání) to an ordinary appeal would therefore be suitable as in such procedural framework, situations in which the debtor pays based upon a later annulled effective judgment practically could not occur

    Online experience sharing without explicit social interaction does not foster social bonding

    Humans have a unique capacity to bond with others through shared experiences, even in the absence of explicit communication. Yet it is unknown whether this capacity is flexible enough to accommodate the different kinds of virtual environments on which we increasingly rely. In the current pre-registered study, we examined whether this capacity still operates effectively on shared screens during non-communicative video mediated interactions, in dyads and in groups. Participants (N = 144 US participants, 71 female, 72 male, 1 non-binary) either watched a video on a shared screen together with (pre-recorded) partners or watched individually while these partners attended to something else. Equivalence tests showed that self-reported social bonding scores were practically equivalent between conditions. Thus, in contrast to several in-person studies, there was no difference in social bonding between conditions. These results show that, in the absence of explicit communication, some of humans’ most fundamental social bonding mechanisms might not operate as effectively in video mediated social interactions. As such, without sufficient active social or emotional engagement, the social costs of increasingly relying on video mediated social interactions might be greater than previously thought

    “Data cultures in human resources management in SMBs in North-Rhine Westphalia” is the title of the author's current project, which is researching the opportunities and challenges of digital transformation in small and medium-sized companies. For this purpose, interviews were conducted with human resources managers. In light of findings from work and organizational sociology, the following basic thesis of this article emerges: Human resources management and employees in SMBs alike will produce completely new data cultures during digital transformation, which they will have to “manage”. Univerzita Karlova má pravidlo, že diplomovou práci, jež byla hodnocena jako výborná, lze za splnění dalších podmínek uznat jako práci rigorózní. Jednou z těchto podmínek je, že stěžejní závěry práce byly publikovány buď ve formě odborné knihy, nebo odborného článku v časopise zařazeném do databáze Web of Science nebo Scopus

    Cesty brněnských profesorů – ty měřené na kilometry i ty seskládané z životních peripetií – byly někdy dlouhé a komplikované. Nejeden z nich skončil v doživotní emigraci v cizině, další se v posledních letech svého života uchýlili do emigrace vnitřní. Některé z nich směřovaly k ministerským křeslům, jednou dokonce do čela vlády, jiné (ale někdy i tytéž) je srazily do vězení či koncentráku a k profesím, v nichž nemohli uplatnit své excelentní vzdělání. Krátká životní cesta Michaila Arturoviče Zimmermanna byla specifická v tom, že směřovala opačným směrem než cesty většiny ostatních emigrantů: začala v dálné cizině a po mnoha peripetiích skončila v Československu, byla poměrně krátká a ve své rozhodující fázi jej dovedla od beznaděje válečného zajatce až k pozici respektovaného profesora v demokratickém Československu, který ovšem i přesto zemřel, aniž by se stal československým občanem. Na brněnské fakultě působil jen krátce, přesto se rychle zařadil k jejím oporám
