LEGAL PROTECTION FOR EMPLOYEES DUE TO NON-PAYMENT OF HEALTH SOCIAL SECURITY CONTRIBUTIONS BY THE COMPANY
National Social Security will be administered by the BPJS, which consists of the Health BPJS and the Employment BPJS. The obligations of companies are to register as BPJS participants and pay BPJS membership dues. This research aims to understand and analyze the legal provisions if the company does not pay BPJS Health contributions even though it has deducted employee salaries. Apart from that, this research also aims to understand and analyze legal protection for employees who are not paid BPJS Health by the company. The type of method applied in this research is normative legal research. Companies are required to register themselves and their workers as Participants in BPJS. The sanction for those who do not register are administrative sanctions and criminal sanctions are imposed if the company is proven to have committed a crime of embezzlement by not paying salary deductions. Challenges in Safeguarding Rights for Child Indigenous Faiths
A child of a indigenous faiths community is someone who has grown up in a community that holds certain traditional beliefs or faiths, which are often local and not tied to a major religion or official doctrine. They may follow or practice traditions such as the worship of nature, ancestral spirits, or rituals passed down through generations. In general, protection for minority groups. This research will examine the problematic fulfillment of children's rights of indigenous faiths in Indonesia. The approach method used in the research is normative juridical through legal principles, legal systematics, legal synchronization, and legal comparison. The data analysis method is qualitative juridical obtained through primary, secondary and tertiary data related to case studies of the fulfillment of children's rights of indigenous peoples in the region. The results of the research obtained from the problematic fulfillment of children's rights of indigenous faiths, first, the lack of legal recognition and identity/rejection of childbirth certificate registration for indigenous faiths couples. Second, the right of children to receive education in accordance with the curriculum and teachings of their beliefs. Third, protection from discrimination: Children from indigenous faith communities may be vulnerable to discrimination, and fourth, freedom of religion. ANALISIS YURIDIS TERHADAP KUALIFIKASI PEMBUKTIAN SEDERHANA DALAM KASUS PAILIT DEVELOPER RUMAH SUSUN DITINJAU DARI SEMA NOMOR 3 TAHUN 2023 DAN UNDANG-UNDANG TENTANG KEPAILITAN DAN PKPU
Pertumbuhan bisnis properti rumah susun oleh developer seringkali memiliki persoalan terkait pemenuhan utang kepada para kreditor yang dapat diselesaikan melalui lembaga kepailitan di Pengadilan Niaga. Kepailitan yang diatur dalam Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan PKPU mengharuskan pemeriksaan perkara dilakukan lebih cepat melalui pembuktian sederhana yang hingga saat ini belum memiliki pembatasan secara jelas dalam UU KPKPU. Dengan metode yuridis-normatif, artikel ini akan menganalisis kedudukan dan kekuatan pemberlakuan SEMA Nomor 3 Tahun 2023 terhadap UU KPKPU serta kepastian hukum atas developer rumah susun berkenaan dengan pembuktian sederhana dalam proses kepailitan. Hasil menunjukkan bahwa pada praktiknya masih terdapat inkonsistensi hakim dalam memutus perkara permohonan pernyataan pailit dan PKPU terhadap developer rumah susun pada kasus yang serupa berkenaan dengan pemenuhan syarat pembuktian secara sederhana. SEMA Nomor 3 Tahun 2023 ditujukan untuk mengisi kekosongan hukum terkait syarat pembuktian sederhana yang diatur dalam Pasal 8 ayat (4) UU KPKPU khususnya pada permohonan pernyataan kepailitan terhadap developer rumah susun yang selama ini memiliki disparitas interpretasi oleh hakim. Namun demikian, sebagai suatu pedoman, SEMA tidak bersifat wajib dipatuhi oleh hakim sehingga hakim tetap memiliki freedom of judge dalam memeriksa dan memutus perkara tanpa dikenai sanksi apabila SEMA dikesampingkan dalam pertimbangan hukumnya. Permohonan pernyataan pailit dan/atau PKPU tetap dapat diajukan terhadap developer rumah susun untuk kemudian hakim akan mempertimbangkan berdasarkan fakta-fakta dalam persidangan dengan turut mempertimbangkan SEMA Nomor 3 Tahun 2023 untuk kemudian menjatuhkan putusan
ASAS KESALAHAN TERKAIT PERTANGGUNGJAWABAN PIDANA ATAS TINDAK PIDANA DALAM PELAKSANAAN JABATAN NOTARIS
Untuk dapat di pertanggungjawabkan secara pidana, seseorang harus memiliki kesalahan dalam melakukan tindak pidana. Notaris dalam melaksanakan jabatannya hanya mengkonstatir kehendak para pihak ke dalam akta autentik. Apakah asas kesalahan juga berlaku terhadap pengenaan pidana bagi notaris dan bagaimana bentuk kesalahan sehingga seorang notaris dapat dipertanggungjawabkan secara pidana. Penelitian ini adalah penelitian hukum normatif, menggunakan pendekatan perundang-undangan dan kasus. Hasil penelitian: Pertama, pengenaan pidana terhadap notaris mulai dari perumusan pasal-pasalnya sampai dengan putusan-putusan pengadilan telah dibuktikan adanya “kesalahan” dimiliki pelaku notaris sebelum penjatuhan pidana. Kedua, bentuk kesalahan berupa “kesengajaan” notaris yang terbukti di persidangan sedangkan bentuk kesalahan berupa “kealpaan” tidak ditemukan baik dalam rumusan pasal perundang-undangan maupun di dalam putusan-putusan pengadilan. Saran penelitian bahwa ketentuan pidana terhadap notaris perlu diatur eksplisit dalam Undang-Undang Jabatan Notaris sebagai lex specialis, sehingga aparat penegak hukum maupun notaris memiliki kepastian hukum mengenai batasan suatu tindak pidana dapat dipertanggungjawabkan terhadap seorang notaris. Selanjutnya, perlu diatur tegas bahwa hanya bentuk kesalahan berupa “kesengajaan” seorang notaris dalam melaksanakan jabatannya yang dapat dikenakan pidana, sedangkan notaris yang karena “kealpaan” hanya dapat dikenakan sanksi secara administratif dan/atau perdata
Tinjauan Viktimologis terhadap Korban Revenge Porn Menurut Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual berdasarkan Tipologi Korban
Kemajuan teknologi informasi yang cepat telah membawa dampak signifikan bagi masyarakat, terutama jika tidak disertai dengan literasi digital yang memadai. Hal ini memunculkan penyalahgunaan internet, seperti kasus revenge porn, yang merupakan kejahatan siber yang merugikan korban secara fisik dan daring. Penelitian ini bertujuan memahami bagaimana hukum dan viktimologi dapat melindungi korban dan mencegah kejahatan revenge porn dengan menggunakan metode penelitian normatif yuridis melalui pendekatan peraturan perundang-undangan yang bersifat kualitatif. Sebelum diberlakukannya UU TPKS, perlindungan hukum bagi korban kekerasan seksual di Indonesia sangat tidak memadai. Dengan adanya UU TPKS, kini terdapat kerangka hukum yang lebih komprehensif untuk menangani kasus kekerasan seksual, memberikan perlindungan, dan memastikan keadilan bagi korban. Dari perspektif viktimologi, korban revenge porn dapat dikategorikan sebagai korban yang tidak bersalah atau tidak berpartisipasi, meskipun mereka terlibat dalam pembuatan konten. Faktor utama terjadinya victim blaming dalam kasus revenge porn adalah ketidakadilan gender dan mitos pemerkosaan. UU TPKS memberikan perlindungan hukum yang lebih baik bagi korban revenge porn. Namun, perubahan sikap dan persepsi masyarakat serta peningkatan kesadaran akan ketidakadilan gender tetap diperlukan
Praktik Beneficial Ownership dengan Nominee Structure pada Daftar Negatif Investasi (DNI) dalam Penanaman Modal Asing terhadap Iklim Bisnis dan Legalitas Operasi Perusahaan ditinjau dari Hukum Positif di Indonesia
Penelitian ini menganalisis kedudukan beneficial ownership dalam Penanaman Modal Asing yang terdaftar dalam Daftar Negatif Investasi (DNI) di Indonesia dan pengaruhnya terhadap iklim bisnis serta legalitas operasi perusahaan dengan struktur nominee. Metodologi yang digunakan adalah yuridis empiris dengan pendekatan deduktif, berlandaskan pada peraturan perundang-undangan sebagai data primer dan dipadukan dengan studi pustaka yang relevan. Hasil penelitian menyoroti bahwa investor asing yang ingin menanamkan modal di Indonesia cenderung melanggar DNI yang berdampak besar pada sektor strategis ekonomi lokal, umumnya pelanggaran ini terjadi menggunakan nominee structure. Pelanggaran ketentuan kepemilikan asing dalam DNI terhadap kegiatan operasi perusahaan dapat berujung pada pembubaran perusahaan atau pencabutan izin usaha, hal ini menegaskan pentingnya kepatuhan terhadap aturan yang berlaku
REVIEW OF REVERSIONARY RIGHTS IN THE SOLD-FLAT AGREEMENT OF SONG CREATION ASSOCIATED WITH LAW NUMBER 28 OF 2014 ON COPYRIGHT
The copyright reversion provision or known as reversionary right contained in Article 18, 30, and 122 Law of the Republic Indonesia Number 28 of 2014 on Copyright is a legal substance that has been regulated by various countries in the world. This provision is intended to provide justice for creators whose rights are often violated in the implementation of copyright transfer agreements with a sold-flat mechanism. Indonesia Copyright Law is not specifically determined an implementing rules or guidelines to exercise this rights of reversions provisions. In its application, there have been rejections from record producer company such as in the case of Constitutional Court Decision Number 63/PUU-XIX/2021. This article is placed to review the implementation of reversionary rights provisions in Indonesia by analyzing national dan international provisions and court decisions with normative juridical methods and comparative law, as well as analytical and exploratory descriptive approaches. The implementation of reversionary rights provisions in Indonesia will raise challenges of weak legal understanding and disruption of rejection by record producers, which will weaken aspects of the implementation process. The provisions of the stages of the submission notifications process and documentation of reversionary rights in writing applied by the United States and the Netherlands can be something that Indonesia develops in strengthening the implementation process of reversionary rights provisions. To exercise and enforce their reversion rights, songwriters can renegotiate the agreement with the record producer, file for compensation with the commercial court, or also join the Collective Management Organization
LOCAL CONTENT REGULATIONS IN INFRASTRUCTURE DEVELOPMENT AND THE NATIONAL TREATMENT PRINCIPLE
The local content requirement is a policy aimed at promoting domestic industries and reducing dependence on imported products. However, its application, particularly in the procurement of goods for solar power plants, raises concerns about potential violations of the national treatment principle found in international agreements such as GATT 1994 and the Agreement on TRIMs. This study seeks to explore the implementation of local content requirements in infrastructure project procurement in relation to the national treatment principle and the government's efforts to enforce these regulations. The research employs a normative juridical approach, drawing on literature sources and analyzing the issue based on legal principles. The study is descriptive-analytical in nature, utilizing secondary data gathered from primary, secondary, and tertiary legal materials through literature review and analyzed using qualitative juridical methods. The findings indicate that the application of local content requirements in the procurement of infrastructure projects for solar power plants in Indonesia is not fully aligned with the national treatment principle. The government has made efforts to enforce local content requirements without breaching international law by implementing incentives and providing exceptions for imported goods under certain conditions
IMPLEMENTATION OF THE PRINCIPLE OF SECURITY IN THE PROCESS OF ELECTRONIC FIRST TIME LAND REGISTRATION TO REALIZE LEGAL CERTAINTY FOR THE COMMUNITY
In the current industrial era 4.0, the development of information technology has influenced all aspects of people's lives, including implementing government duties. One area that is also affected by advances in information technology is the land sector. The enactment of ATR/BPN Ministerial Regulation No.1 of 2021 and PP No. 18 of 2021 is a concrete manifestation of the use of developments in information technology in the land sector. Implementing land registration through an electronic system is expected to benefit the community, especially in terms of guaranteeing legal certainty. However, in its implementation, it turns out that various problems are still found, one of which is the neglect of the principles in land registration, namely the principle of security. The principle of security requires that land registration be carried out carefully and meticulously to guarantee legal certainty for holders of land rights. In this research, we will examine the application of the principle of security in electronic land registration to ensure legal certainty for the community. Using the normative juridical approach and analytical descriptive method, it can be said that the implementation of the principle of security in land registration via an electronic system that has been carried out by the Land Office has not been optimal. This can be seen from the many disputes and cases in the land sector that are still occurring and of course they are detrimental to society
Age Verification Regulation in Social Media Platform Usage: Preventive Measures Against Online Child Sexual Violence
The escalation of internet use in various age groups has resulted in an increase in the number of social media users from year to year, until at the beginning of 2023 there were 212.9 million internet users and 167 million social media users, equivalent to 60.4% of the total population, it is also known that around 87% of children in Indonesia have been introduced to social media before turning 13 years old. With easy access to the internet, perpetrators of sexual violence are increasingly adapting to exploit children's vulnerability, thus changing the dimensions of sexual violence that are increasingly directed at children. This phenomenon has made several developed countries adapt by implementing various approaches to prevent children from becoming victims of sexual violence in cyberspace. This research aims to obtain a complete picture of sexual violence against children facilitated by social media platforms, and find alternative policies to limit access to protect children from a series of vulnerabilities that can result in sexual violence in cyberspace. The research method used in this research is normative juridical. The results of the study found that if today's easy access to social media has made children more vulnerable to becoming victims of sexual violence in cyberspace, prevention with a criminal law and telematics approach should be carried out to prevent children from perpetrators of sexual violence. Indonesia has actually taken a proactive policy with the enactment of the Personal Data Protection Law, but it has not regulated provisions related to age limits and rules that require strict application of age verification for children accessing social media
