    URGENSI HUKUM PADA PENDERITA KELAINAN SEKSUAL (BDSM DAN HOMOSEKSUAL)

    Sufferers of BDSM and homosexual mental disorders are at great risk of being involved in criminal acts, but there is no law that specifically regulates criminal acts committed from BDSM and homosexual activities. The aim of this research is to determine the extent of legal urgency required for perpetrators of criminal acts who have sexual disorders which are included in mental disorders because Article 44 of the Criminal Code only regulates reasons for forgiveness for ODGJ. This research uses qualitative research methods and a descriptive approach and uses normative data collection techniques. The results of the research obtained are that there are no monetary crime laws regulating sexual disorders, especially BDSM, however, the crime of sodomy can be charged under the obscenity article of the Criminal Code and the Child Protection Law. Perpetrators of criminal acts who have sexual disorders are also subject to law because they do not fulfill the elements stated in Article 44 of the Criminal Code

    Criminal Liability for Perpetrators of Human Trafficking against Children as Victims

    Human trafficking is one of the major crimes involving human rights violations. The main problem today is the crime of human trafficking, which is why almost every country is trying to reduce it because the number continues to increase from year to year. As in the example discussed in this paper, 28% of TIP victims are children, according to data collected from the journal. This study examines the sentencing of the court panel against TIP perpetrators who use children as unpaid sex workers. Literature review is an important legal material for Normative Juridical legal research in this study. The results of the study indicate that the perpetrator has legally committed TPPO against the child victim so that she can work as a prostitute without a warrant, and the perpetrator has also fulfilled the provisions of the Law on the Crime of Human Trafficking. Therefore, the panel of judges sentenced her to 5 years in prison and a fine of 120,000,000 Million Rupiah which will be replaced with 2 months in prison if the fine is not paid

    The Urgency of Establishing Legal Instruments Against Potential Artificial Intelligence (AI) Crimes

    The development of artificial intelligence (AI) has brought significant progress in various sectors, but on the other hand, it also presents the potential for crimes that have not been fully accommodated in the existing legal system. Crimes involving AI such as deepfakes, data manipulation, autonomous cyber attacks, and misuse of algorithms raise serious issues in terms of legal accountability, perpetrator identification, and victim protection. The criminal law system in Indonesia, which generally still relies on the principles of legality and the subjectivity of human error, does not yet have adequate legal instruments to address AI-based crimes that are autonomous and adaptive. This study aims to examine the legal vacuum that occurs, evaluate regulations in several other countries as a comparison, and offer the urgency and direction of the formation of new legal instruments in Indonesia. The method used is juridical-normative with a comparative and conceptual approach. The results of the study indicate the need to establish a special legal framework regarding AI, both in the form of new laws and reformulation of criminal norms that can accommodate the unique nature of artificial intelligence. Without adaptive legal reform, Indonesia will face serious legal loopholes that can be exploited by digital criminals

    This study aims to examine the urgency of legal protection for Songket Batu Bara cloth within the framework of intellectual property law, with an emphasis on its recognition as a Traditional Cultural Expression (EBT) that receives legal protection based on the provisions of Law Number 28 of 2014 concerning Copyright. Songket Batu Bara cloth is a cultural product of the Malay community that is full of historical, artistic, and philosophical values, and is passed down from generation to generation. Typical motifs such as bamboo shoots, cananga flowers, and pandan shoots contain deep symbolic meanings and socio-cultural functions. This study uses a normative juridical method with a statutory regulatory approach and a conceptual approach, to analyze the positive legal norms that form the basis for the protection of this traditional cultural work. The results of the study indicate that legal protection for Songket Batu Bara is not optimal due to obstacles in the aspects of legal substance, institutional structure, and legal culture of the community. The absence of specific technical regulations, the weak role of related institutions such as the DJKI and regional offices, and low legal awareness among craftsmen are the main inhibiting factors. Therefore, it is necessary to formulate affirmative policies by local governments through regional regulations, strengthening the institutions of artisan communities, and synergy between academics, the private sector, and the community to realize an effective, adaptive, and sustainable intellectual property rights protection system

    Regulations related to termination of employment for reasons of efficiency are not explained explicitly, this will have an impact on the emergence of industrial relations disputes, thus affecting the balance between the interests of employers and the protection of workers/laborers. This study aims to examine the regulations regarding termination of employment for reasons of efficiency based on laws and judges' decisions and efforts to resolve them to ensure justice for the parties. In this study, a normative juridical method is used with a statutory and case approach, where this study analyzes Law Number 13 of 2003, Law Number 6 of 2023, Government Regulation Number 35 of 2021, and decisions such as the Constitutional Court Number 19/PUU-IX/2011. With the findings of ambiguity in the definition of efficiency, the phrase loss, and prevention of potential losses, which are seen in the cases of PT. S against Mrs. E and PT. Jtrust Olympindo Multi Finance against Sudadi Hari Widianto, causing misuse of efficiency reasons in termination of employment. Thus, in its implications, it is necessary to update regulations with a more explicit definition of efficiency, strengthening the role of judges in analyzing company financial audit reports, and transparent steps by companies such as analyzing the company's macro and micro conditions in advance and mapping workers/laborers to ensure the achievement of justice, benefits, and legal certainty, so as to support a harmonious balance in industrial relations

    Deposit-refund systemcan influence the behavior of companies and consumers. Many governments have enacted laws to promote recycling as part of a larger effort to reduce waste management and preserve the environment. The purpose of this study was to determine the implementation of the deposit refundable system in Indonesia. The research method used was descriptive qualitative. The results of the study indicate that in Indonesia, laws and regulations governing waste management, from the national to the regional level, already exist in Indonesia. The main legal basis for waste management in Indonesia is Law of the Republic of Indonesia Number 18 of 2008 concerning Waste Management (UU 18/2008, or the Waste Management Law). In principle, Indonesia applies an economic instrument in the application of the deposit refundable system, which is a manifestation of the polluter pays principle, which is an economic policy to internalize the costs of pollution or environmental damage

            This study aims to analyze the effect of auditor competence and independence on audit quality at public accounting firms in Medan. Competence and independence are two important factors that influence the quality of audits produced by auditors. The research method used was a quantitative approach with a sample of 32 auditors obtained from 7 public accounting firms in Medan. Data testing was conducted using validity tests, reliability tests, classical assumption tests, and multiple linear regression.       The results of the test show that the data analysis using partial tests (t-test) shows that: (1) Auditor competence does not have a significant effect on audit quality. (2) Auditor independence does not have a significant effect on audit quality. The results of data testing using the (F-test) indicate that: (3) Auditor competence and independence do not have a significant effect simultaneously on audit quality. &nbsp

    The use of gadgets among children is increasingly causing concern and can have a negative impact on their development. In 2022, around 33.44% of early childhood in Indonesia have used gadgets, the majority of children over 5 years old have accessed the internet with a percentage of 88.99%.In the initial survey, it was found that students' knowledge was still lacking regarding the importance of maintaining a balance in time when using gadgets.To determine the effect of health promotion through educational game media on knowledge about the impact of gadget use on students of SDN 010056 Sei Renggas. Using One Group Pretest Posttest design. The sample was all 5th and 6th grade students totaling 37 students. Data analysis using univariate, normality test with Shapiro Wilk Test and difference test using Wilcoxon Rank Test. The mean increase in respondents' knowledge was 5.57, withPositive Ranksof 37, Mean Rank of 19.00, while Sum of Ranks of 703.00. In addition, a significance value of 0.000 <0.05 was obtained, which indicates that there is a significant difference between the pretest and posttest results. There is an influence of health promotion through educational games of snakes and ladders in increasing knowledge about the impact of gadgets on students of UPTD SDN 010056 Sei Renggas. It is hoped that the school can provide counseling on the impact of gadget use using educational game media, which can attract students' attention so that the message or information to be conveyed can be easily received and can be applied in everyday life.

    Hospital management information systems Implementation is believed to provide various benefits for health service providers. Therefore, human resources need to be empowered and supported in terms of developing services in the health sector based on technology. To determine the effect of HR competence in the utilization of hospital management information systems at Bandung General Hospital, Medan City. The research is an analytical survey with cross sectional. The population used was all human resources at Bandung Hospital, Medan City, totaling 141 people and sampling using simple random sampling so that 59 people were found. Data analysis using univariate and bivariate tests (chi square test0. There is an influence of HR work skills (p=0.002), HR knowledge (p=0.005), HR work experience (p=0.005) and HR work behavior (p=0.007) on the use of hospital management information systems. There is an influence of HR work skills, HR knowledge, HR work experience and HR work behavior on the utilization of hospital management information systems at Bandung General Hospital, Medan City. It is expected that hospitals can conduct training or socialization regularly to improve knowledge and quality of health services.

    Improving the Knowledge and Attitudes of Premenopausal Women in Facing Physical Changes during Menopause through Audiovisual Media Health Education

    Lack of understanding about premenopause can affect women's attitude and readiness to face it. Education through audiovisual media increases knowledge and forms positive attitudes more effectively. This study assessed the effect of audiovisual education on the knowledge and attitudes of premenopausal women in dealing with physical changes during menopause. The research design used was pre-experimental with a one-group pretest-posttest design. The research was conducted at Kauman Husada Clinic in Malang. The research was conducted in November - December 2024. The study population was all premenopausal women aged 40-50, with 50 people obtained by a total sampling technique. The dependent variables of this study are knowledge and attitude. The independent variable is health education with audiovisual media. This study's intervention was providing health education through audiovisual media. Data was collected directly by giving knowledge and attitude questionnaires before and after the intervention. The stages of data analysis began with calculating the frequency distribution of knowledge and attitudes before and after the intervention, using the t-Wilcoxon test. The results showed differences in respondents' knowledge before and after audiovisual media education (p = <0.001). There is a difference in the attitude of respondents before and after being given audiovisual media education (p = <0.001). The conclusion is that providing education using audiovisual media significantly affects the increase in knowledge and attitudes of respondents
