Garis Ideologi Agraria Di Era Presiden Joko Widodo
The inauguration of President Jokowi for a second term has made the public hope that there will be a significant breakthrough in the agrarian sector. However, this hope has been disappointed—again by Jokowi—because of the passage of the UU Cipta Kerja which has a significant impact on agrarian issues. Civil groups noted that the law will further add to the blurry future of agrarian reform as enshrined in the fifth precepts of Pancasila and Article 33 of the UUD 1945. Taking this background, the author is interested in analyzing the lines of agrarian ideology in the era of President Joko Widodo, using qualitative methods that based on literature studies, and using the analysis knife of the Fifth Precepts of Pancasila and Article 33 of the UUD 1945 to provide a deeper perspective on agrarian policy in the era of President Jokowi's leadership
Perlindungan Hukum Terhadap Pekerja Dengan PKWTT Akibat Pemutusan Hubungan Kerja Pada Masa Pandemi Covid-19
Sebagian manusia memilih menjadi pekerja di badan usaha orang lain baik yang berbadan hukum maupun badan usaha yang tidak berbadan hukum untuk dapat memenuhi kebutuhan hidup yang layak. Namun, seringkali terjadi pemutusan hubungan kerja atau sering disebut pecat khususnya pada masa pandemi Covid-19 ini yang dilakukan oleh pengusaha menyebabkan pekerja tidak lagi mendapatkan upah untuk memenuhi kebutuhan hidup yang layak. Sehingga Negara mengeluarkan peraturan yang memberikan perlindungan hukum terhadap pekerja agar pekerja masih dapat memenuhi kebutuhan hidup yang layak tersebut setelah dilakukannya pemutusan hubungan kerja. Permasalahan yang dikaji dalam penelitian ini perlindungan hukum terhadap pekerja dengan PKWTT akibat pemutusan hubungan kerja pada masa pandemi Covid-19. Metode penelitian ini menggunakan metode hukum normatif yang menggunakan pendekatan Perundang-Undangan dan pendekatan analitis. Kesimpulan yang didapat penulis dari penelitian ini adalah bahwa pekerja dengan PKWTT yang di-PHK pada masa pandemi Covid-19 mendapatkan perlindungan berupa hak-hak yang wajib diberikan pengusaha kepada pekerja berupa Uang Pesangon, Uang penggantian Masa Kerja dan Uang Penggantian Hak. Pekerja juga mendapatkan bantuan jaminan kehilangan pekerjaan dari BPJS berupa uang tunai, akses informasi pasar kerja dan pelatihan berbasis kompetensi. Selain itu pekerja juga mendapatkan bantuan dari Pemerintah berupa bantuan gaji/upah sebesar Rp.500.000,00 (lima ratus ribu) perbulan selama 2 (dua) bulan khusus selama masa pandemi Covid-19 i
Politik Hukum Lingkungan Dalam Kebijakan Pembangunan Berkelanjutan Berwawasan Lingkungan Di Indonesia
Pembentukan hukum bidang lingkungan hidup dalam perkembangannya mengalami berbagai tantangan, khususnya ketika kepentingan lingkungan dibenturkan dengan kepentingan ekonomi dan pembangunan nasional. Beberapa perubahan substansial dalam Undang Undang Cipta Kerja melahirkan diskursus khususnya jika dikaitkan dengan konsep pembangunan berkelanjutan berwawasan lingkungan yang merupakan poros kebijakan negara dalam pembangunan nasional. Hal ini dikarenakan perubahan tersebut diarahkan pada paradigma developmentalism yang dibuktikan dengan perubahan kebijakan berupa penyederhanaan proses perizinan dan beberapa permasalahan serius berkaitan dengan terdistorsinya kepentingan lingkungan. Maka dari itu, politik hukum menjadi kajian penting guna memastikan aktualisasi dari pembangunan hukum lingkungan, telah sesuai dengan arah kebijakan yang digariskan dalam Undang Undang Dasar Negara Republik Indonesia Tahun 1945. Penelitian ini menyimpulkan bahwa kebijakan hukum lingkungan terus mengalami progresivitas, hingga akhirnya Undang Undang Cipta Kerja memberikan regresi sehingga tidak lagi sesuai dengan arah kebijakan negara yang digariskan dalam konstitusi
Legal Protection of Work Safety Crimes Victims In Indonesia
Between 2014 and 2018, the Indonesian Ministry of Manpower recorded 89,625 cases of work accidents, and 1,193 of them resulted in death. During this period, 34,075 companies were reported for alleged work safety crimes. From the 2,074 cases, only four have been sentenced to prison. The most interesting issue is that the victims of work safety crimes do not get any kind of restitution or even compensation. This article aims to investigate the legal protection for victims of work safety crimes from the criminal law perspective. The method used is normative qualitative research on primary data, such as work safety legislation, the Criminal Code, and criminal court decisions. As a result, the work safety law stipulates that the purpose of law enforcement on work safety is recovery for victims, repairs and prevention. They are carried out to protect the public interest. Work safety regulations also regulate the qualifications of actions categorized as work safety crimes. Unfortunately, the regulation does not provide a mechanism for resolving work safety crimes. So that the settlement of work safety crimes relies on the general criminal justice system that adheres to retributive objectives in law enforcement. The purpose of law enforcement on work safety cannot be applied because victims do not get restitution or compensation. Thus, to obtain legal protection in accordance with the objectives of law enforcement on work safety, the alternative solution is a criminal policy to establish a special criminal mechanism for the settlement of work safety crimes
Indonesia's Mineral Export Prohibition and Legality of Export Duties Under the GATT Rules
The development of electric vehicles has been becoming a global trend to tackle worsening air pollution. The rich mineral country desires to reduce greenhouse gas (GHG) through transportation transformation by building a domestic-based battery vehicle industry. The policy resulted in importing export restrictions on nickel ore and bauxite by the Indonesian government. However, the measures are inconsistent with Article XI.1 of the GATT rules, which forbid imposing restrictions on the global market. There are cases in WTO DSB deciding that export restrictions infringe the provision, such as in China – Raw Materials (DS394) and China – Rare Earth (DS431) cases. In such cases, adjudicators also do not justify the imposition of export duties for the members. Meanwhile, Article XI.1 does not prohibit the imposition of export duties as another option to impose export restraints. The Indonesian authority could apply the measures. This Article analyses Indonesia's justification for imposing export control through the GATT rules. The research is conducted based on a normative juridical approach in which the sources come from the rules of GATT and its DSB decision to analyse the extent to which the measures are allowed to take into force for the member regarding the GATT provisions. The Article finds that Indonesia may be justified in the imposition of export duties to control the export of both raw materials. Article XI.1 of GATT justifies the original and accepted members to impose the duties measures as there are unclear provisions on export prohibition, which means Indonesia could enforce the charge of duties implicitly
PERLAWANAN PIHAK KETIGA (DERDEN VERZET) TERHADAP SITA EKSEKUSI TANAH ATAS PENETAPAN KETUA PENGADILAN NEGERI (ANALISIS PUTUSAN PENGADILAN NEGERI NO. 213/Pdt.Bth/2017/PN PLG)
Abstract:Basically, court proceedings can be carried out directly by parties who feel disadvantaged. A person or civil legal entity that feels that his interests have been impaired by a decision of the Chair of the District Court may file a written claim with the competent court. The injured party is not involved in a case, which is referred to as a third party. Which in this study the third party filed a derden verzet resistance to the district court in order to defend their rights in the case of seizure of the execution of the land that was the object of the dispute in the case. With which is the main problem in this study regarding the application of the principle or principle of prudence of judges in giving a fairest consideration to the parties, especially third parties, then the judge's consideration of Pekara No.213 / Pdt.Bth / 2017 / PN. PLG which is the subject of analysis in this study, also relates to the derden verzet resistance proposed by third parties in order to obtain justice, as well as the concept of the regulation of confiscation of execution in the future so as not to harm third parties. This study uses a research method that is normative legal research, which is based on the results of research applications submitted by third parties can not be accepted by the judge on the basis that the third party should submit an ordinary resistance is not derden verzet on the seizure imposed by the judge. Of course it does not provide justice for third parties, because judges are less careful and less careful in considering the main points which are argued on the basis of resistance proposed by third parties in the Palembang District Court.Keywords: Resistance, Derden Verzet, Third Party, District Court, Confiscation of Execution
SINKRONISASI PENGATURAN KEWENANGAN PEMERINTAH DAN PEMERINTAH DAERAH DALAM PENYELENGGARAAN KEHUTANAN DI DAERAH (Studi Penerapan Pasal 14 Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah Juncto Pasal 66 Undang-Undang Nomor 41 Tahun 1999 tentang Kehutanan)
Penelitian tesis ini membahas tentang sinkronisasi kewenangan Pmerintah dan Pemerintah Daerah dalam penyelenggaraan kehutanan di daerah (Studi Penerapan Pasal 14 Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah (UU Pemerintahan Daerah) Juncto Pasal 66 Undang-Undang Nomor 41 Tahun 1999 tentang Kehutanan (UU Kehutanan)).Hasil penelitian menunjukkan bahwa dalam pengaturan kewenangan Pemerintah Daerah dalam penyelenggaraan kehutanan di daerah terjadi dualisme norma dikarenakan ketentuan Pasal 66 ayat (1) UU Kehutanan menyatakan Pemerintah menyerahkan sebagian kewenangan kepada Pemerintah Daerah terhadap penyelenggaraan kehutanan dalam rangka pengembangan otonomi daerah, sedangkan ketentuan Pasal 14 ayat (1) dan ayat (2) UU Pemerintahan Daerah merumuskan bahwa kewenangan penyelenggaraan hutan menjadi kewenangan Pemerintah Pusat dan Pemerintah Daerah Provinsi, sedangkan Pemerintah Kabupaten/Kota hanya berwenang mengelola Taman Hutan Raya. Dampak terhadap perbedaan tersebut adalah : terhadap struktur kelembagaan, Gubernur, Bupati/Walikota harus berkoordinasi dengan DPRD dan kementerian/lembaga terkait yang membidangi urusan pemerintahan konkuren meliputi bidang kehutanan, dan melaporkan pelaksanaannya kepada Menteri Dalam Negeri; terhadap hubungan antara Pemerintah Kabupaten dengan Pemerintah Provinsi, apabila tidak cermat dan tidak memperhatikan asas keadilan dan pemerataan dalampengelolaan dan pemanfaatan sumber daya kehutanan yang secara kewilayahan pada umumnya berada pada wilayah kabupaten/kota, bukan provinsi, maka berpotensi timbulnya sentimen kedaerahan yang berlebihan dan terjadi konflik kepentingan; dan terhadap peraturan perundang-undangan, adalah terdapat dilema dasar peraturan perundang-undangan yang menjadi acuan pemerintah mana yang berwenang dalam penyelenggaraan kehutanan di daerah, mana yang specialis mana yang generalis. Sinkronisasi dilakukan dengan dua cara, pertama, sinkronisasi vertikal melalui permohonan judicial review Pasal 14 UU Pemerintahan Daerah terhadap Pasal 18 ayat (2) UUD 1945. Kedua, sinkronisasi horizontal antara ketentuan Pasal 14 ayat (1) dan Pasal 15 ayat (2) UU Pemerintahan Daerah, melalui pembentukan peraturan pelaksana misalnya dalam bentuk Peraturan Pemerintah yang mengatur mengenai pendelegasian Pemerintah Pusat (Presiden) kepada Pemerintah Daerah Kabupaten/Kota (Bupati/Walikota) terkait distribusi urusan kehutanan otoritet dan operasional dengan asas dekonsentrasi dan tugas pembantuan
Can Judges Ignore Justifying and Forgiveness Reasons for Justice and Human Rights?
In the criminal law system in Indonesia, there are two reasons why an individual suspected of having committed a crime must be released. These two reasons are justifying and forgiveness reasons. In practice, these two reasons are linked to the elimination of criminal acts based on legal justice and human rights. This article discusses the legal consequences when the judge rejects the justifying and forgiveness reasons that can eliminate the sentence. The method used in this research is normative juridical by analysing norms, principles and rules of law with a case approach. As a result, this research shows that judges in practice have the authority given by law to determine whether an action can be categorised as justifying and forgiveness reasons that eliminate punishment by referring to the principles and legal regulations for justice and human rights. However, when the judge ignores these two reasons due to considerations of lack of justice and respect for human rights, this practice can be carried out by the judge with the consequence that this decision will cause harm, suffering and misery for the accused. This article argues that to protect the public interest from wrong decisions is necessary to reform the Criminal Procedure Code (KUHAP) to provide objectivity, honesty, and justice that rely on legal principles and rules
Society 5.0: A New Challenge to Legal Norms
Society 5.0 is a new term used to indicate the future world. This society is based on ubiquity, learning machines, the internet of things, big data, cloud computing, cryptography, and biometrics. All these technologies will be merged to create a new mode of life. The new way of life will inevitably influence human beings’ values, concepts, and conduct. The result of these changes will consequently bring challenges to many legal areas. This paper addresses the challenges that brought society 5.0 to legal norms. It utilises the analytical approach to examine the capability of pre-existing legal norms to cope with new realities created by society 5.0. The paper analyses the legal implications of society 5.0 in their sociological context. It presents a jurisprudential vision to establish legal norms compatible with the new society. Three fundamental principles should be considered to establish new legal. First, social facts that trigger legal regulation can simultaneously occur in multiple places. Secondly, what the study called duality of legal rules will not survive in society 5.0 era. Third, the paper turns the spotlight on new intelligent systems which may introduce new law addressees
Non-Adherence to Human Rights and Humanitarian Laws in the Conduct of Armed Conflict in Yemen
To protect the properties, lives, and dignity of human persons worldwide, the International Humanitarian Law seeks to uphold and promote Human Rights Law and other international frameworks regulating the rights of civilians and parties to armed conflict. The conduct of parties to the armed conflict who have grossly violated the combined provisions of International Human Rights Law and the International Humanitarian Law resulted in the persistence of armed conflict and warfare in Yemen, thereby crossing every access road to humanitarian rights and privileges. The researchers adopt the doctrinal methodology to investigate the status of warfare in Yemen, the provisions of the law on International Human Rights and Humanitarian Law, and the extent to which the parties to the armed conflict in Yemen break such laws. The International Humanitarian Law and the International Human Rights Law regulate the conduct of actors and parties in the armed conflict both in Yemen and the world at large. The finding of this studydemonstrates that all the participants in the conflict in Yemen violate the International Humanitarian Law. Therefore, they are accountable for such violations.The research recommends strict adherence and compliance to both the International Human Rights Law and the Humanitarian Law throughout the armed conflict in Yemen to have lasting peace. Furthermore, accountability for violations committed should be identified, and all actors in the armed conflict should be punished accordingly
