Pretrial Efforts to Realize Legal Provisions that Are Proportional and Do Not Contract the Perspective Pancasila Law
Pretrial aims to monitor coercive measures carried out by investigators or public prosecutors against suspects, so that these actions are actually carried out in accordance with the provisions of the law, and are truly proportional to the provisions of the law and do not constitute acts that are contrary to the law. The purpose of this research is to describe pretrial legal efforts to achieve justice for underprivileged suspects/families. To analyze pretrials in accordance with the Pancasila legal state perspective. The method used is descriptive, with data sources obtained from journals, books and related articles. The result of this research is Article 22 paragraph (1) of Law No. 18 of 2003 concerning Advocates which states that "Advocates are obliged to provide free legal assistance to justice seekers who cannot afford it." These rules require a lawyer to provide equal access to justice for everyone. This is a form of embodiment of the principle of equality before the law adhered to by Indonesia. In fact, the concept of a legal state for Indonesia is based on the Pancasila ideology, the substance of which includes, among other things, the principle of recognition of God's law, natural law and ethical law. The elements of the Pancasila state are the recognition of guarantees of human and citizen rights; There is a division of power; in carrying out its duties, the government must always be based on applicable laws, both written and unwritten; There is a judiciary that exercises its power independently
Publication-Related Policy and Student Agency in Postgraduate Program of English Language Education: A Case Study
Following Indonesian education policy, universities in Indonesia assign students to publish a scholarly article in at least a nationally accredited journal to accomplish their master’s degree. This study aims to identify and describe student agency in implementing the publication-related policy. The role of agency in learning is so essential and, yet, agency on the part of learners has not been a major concern in studies of agency. So far studies on student agency have mostly focused on assessment and there has been no research, if any, on student agency in responding to a policy related to scholarly publications in higher education. This study filled the gap by examining agentic strategies used by students of a postgraduate English department at a government university in West Nusa Tenggara, Indonesia. This research is a case study involving three (3) postgraduate English department students who were selected purposively. Data collection of the study was conducted by doing in-depth interviews. A semi-structured interview was used in which open and close-ended questions about students' agentiC strategies in responding to the publication-related policy were given. The data form the interviews were analysed using qualitative content analysis. Findings demonstrated the students employed several strategies in responding to the publication policy, which involve utilizing varied online resources, seeking feedback from lecturers and peers, and voluntarily participating in various writing workshops. As students live under varying constraints, further study needs to be conducted to uncover more students’ agentic strategies in responding to publication-related policy
“How to be a W-o-m-e-n? : Women in the Contract of Powerlessness in Oka Rusmini's Poetry”
This study aims to analyze the poem "Pandora" by Oka Rusmini from a feminist perspective, with a focus on depicting women in a condition of powerlessness. This poem explores themes related to women and their experiences in a patriarchal society. The research method used is qualitative analysis with a literary feminism approach. In the poem “Pandora”, Oka Rusmini describes women as beings who are trapped in social roles and expectations that limit their freedom and power. This poem reveals the gender injustice experienced by women, as well as the social and emotional burden they are responsible for. Oka Rusmini uses metaphorical and imaginative language to describe the condition of powerlessness experienced by women. The results of this study provide a deeper understanding of the poem "Pandora" by Oka Rusmini and contribute to the study of feminism in literature. It is hoped that this research can inspire other literary works that raise women's issues and encourage social change that is more inclusive and just
Implementation of Pancasila Student Profile Character Education in the Independent Curriculum
Implementing character education in the context of the Pancasila Student Profil (P5) in the Independent Curriculum in elementary schools is a strategic effort to form a generation with character, competence, and competitiveness. This research examines the implementation of P5 character education in the Independent Curriculum in elementary schools and identifies the challenges and strategies educators use in the implementation process. The research method used is qualitative, using a case study approach at Islamic elementary schools Ashopa and Public Elementary School 5 Praya, which have implemented the Merdeka Curriculum. Data was collected through observation, in-depth interviews, and document analysis. The research results show that implementing P5 character education in elementary schools involves the integration of Pancasila values in teaching and learning activities, developing a positive school culture, and the active role of parents and the community. Good, in terms of the quality of the learning tool, and the activity program strategy uses habituation and strengthens time. Continuous training and mentoring for teachers and cooperation between schools, parents, and the community is needed to overcome this. This research significantly contributes to understanding the implementation of P5 character education. It offers practical recommendations for improving the quality of character education in elementary schools within the Independent Curriculum framework

From the view of how much is affected the companies that participate in controlled transactions, can obtain the impact of cost, when there is not that factor with the case that exists in the analysis of transfer pricing. Improving the Integrative Methodological System for Teaching the Network Technology Course
This research addresses the imperative need for enhancing the integrative methodological system employed in teaching the network technology course. As advancements in technology continue to reshape the landscape of information systems, it becomes crucial to adapt pedagogical approaches to ensure the relevance and effectiveness of educational programs. The study focuses on a comprehensive analysis of the existing integrative methodological system, identifying its strengths and limitations. Through a combination of quantitative and qualitative research methods, including surveys, interviews, and classroom observations, the research seeks to understand the current dynamics of teaching the network technology course. In response to the identified challenges, this research proposes innovative strategies for improvement. These include the incorporation of hands-on practical experiences, real-world case studies, and collaborative projects that mirror industry scenarios. Additionally, the integration of emerging technologies such as virtualization and cloud computing will be explored to enhance the practical applicability of the curriculum. This research aims to contribute to the ongoing discourse on enhancing pedagogical methods in technology education. By refining the integrative methodological system for teaching the network technology course, the study seeks to empower students with the skills and knowledge necessary to thrive in the dynamic and competitive realm of information technology
Sentencing of Jarimah in An Unproven Indictment (Analysis of Judgment No. 15/JN/2022/Ms.Bna
Aceh Qanun Number 6 of 2014 concerning Jinayat Law (hereinafter abbreviated as QHJ) formulates in general ten jarimah. The ten jarimahs consist of Khamar, Maisir, khalwat, Ikhtilath, Zina, Sexual Abuse, Rape, Qadzaf, Liwath, and Musahaqah. Article 191 paragraph (1) of the Indonesian Code of Criminal Procedure (KUHAP) says that if the court is of the opinion that from the results of the examination at the trial, the guilt of the accused for the acts charged against him is not legally and convincingly proven, then the defendant is acquitted. Furthermore, Article 191 paragraph 2 says if the court is of the opinion that the act charged against the defendant is proven, but the act does not constitute a criminal offense, then the defendant is discharged from all lawsuits. The consequences of the provisions of Article 191 paragraph (1) and paragraph (2) above show two things, namely: first, if found guilty according to the procedural law stipulated in the procedural law, then the accused can be found guilty. Second, if it turns out that after examination it turns out that what was done by the defendant was not proven, then the legal consequence is that the defendant must be released. Both provisions do not regulate if the alleged network is not proven, this can be seen in decision Number 15/JN/2022/MS. BNA, which in the verdict was charged with the primary charge and the subsidiary charge. The primary charge of the accused was charged with rape as stipulated in the Qanun of Jinayat Law. Then in the subsidiary indictment where the examination and imposition of 'uqubat on jinayat cases in the Shar'iyah Court must be based on the charges filed by the public prosecutor. Empirical facts show that there was a judge's decision that handed down 'uqubat outside of the charges and demands from the JPU as contained in decision number 15/JN/2022/MS. BNA. The research method used to analyze the problems in this study is the normative legal research method. The primary legal materials used are Qanun Hukum Jinayat, Qanun Hukum procedural Jinayat, Code of Criminal Procedure and judge's decision Number 15/JN/2022/MS. BNA. The approach used is the case approach, the statutory approach and the conceptual approach. Data analysis was carried out prescriptively by assessing whether or not the application of the law in decision Number 15/JN/2022/MS was appropriate. BNA. The results showed that the sentencing of charges that were not proven according to the jinayat procedural law evidentiary mechanism was not appropriate in the context of law enforcement. The legal consequence that arises if the charges are not proven is that the defendant must be acquitted of sentencing. The basis for the judge's extra-indictment was because the defendant at trial had admitted to committing adultery with the victim's child, although the JPU at the trial did not charge him with adultery. In addition, the judge used Jurisprudence No. 675K/Pid/1987 as the basis for sentencing, which allowed the judge to impose a lighter sentence than the charges filed by the JPU. Decision Number 15/JN/2022/MS. BNA from the perspective of legal certainty and justice is not accommodated in it, so it tends to be detrimental to the accused
Harmonizing Religious Diversity: Exploring Effective Intercultural Communication in Dukuh Sampetan Village
Religious tolerance is important to be instilled and carried out in building an interaction relationship in order to avoid divisions that can lead to conflict in society. The existence of a tolerant attitude towards religious differences and is expected to encourage the creation of a peaceful situation so as to create harmony in the interaction of people of different religions. In addition, it is also necessary to foster good harmonious communication so that it can form an understanding that leads to unity. Dukuh Sampetan is one of the dukuhs in Sampetan Village whose people consist of various religions, namely Buddhism, Christianity and Islam. This research uses qualitative research and the theory used is Effective Intercultural Workgroup Communication Theory. This research discusses cultural diversity, which means religious diversity in community groups in Sampetan Village in forming group communication that is able to achieve decisions, satisfaction and effectiveness of group performance in fostering tolerance between religious communities. The conclusion in this study is that communication that occurs in social life in Dukuh Sampetan runs effectively so that religious tolerance exists there is indeed true, seen from the forms of communication seen from general activities, communication that is usually carried out and religious activities
Understanding The Word Toki In Japanese Sentence (Syntax Studies)
Japanese has various characteristics that are used in everyday conversation. This includes Japanese expressions, vocabulary and sentence patterns. This research focuses on understanding the word 'toki' in Japanese through syntax studies. This research aims to facilitate the understanding of Japanese language learners so that they can distinguish the time when a situation or event occurs in various activities that have been carried out, activities that are being carried out or activities that occur continuously. This research method uses a qualitative descriptive method by collecting data from various sources and analyzing them one by one. This research is able to produce an understanding of the word 'toki' which occurs suddenly due to activities carried out by chance, the word 'toki' which occurs continuously when the speaker carries out an activity routinely and the word 'toki' which indicates the occurrence of an activity. in the past when the speaker expresses past events
The Effect of Transformational Leadership and Team Work on Organisational Performance Through the Role of Work Motivation at the NTB Provincial Revenue and Management Agency
This study examines the effect of transformational leadership and team work on organisational performance through the role of work motivation at the Regional Revenue and Management Agency (BAPPENDA) of NTB Province. The method used in this research is quantitative associative. This research focuses on UPTB-UPPD Samsat employees in BAPPENDA NTB. The number of respondents in this study were 161 people. The type of data collection used uses a questionnaire with google form. The analytical tool used is the structural equation model (SEM) method which is processed using the Smart-PLS application. The findings in this study are concluded that transformational leadership has a positive but insignificant effect on organisational performance. While team work and work motivation have a positive and significant effect on organisational performance. In addition, transformational leadership and team work have a positive and significant effect on work motivation. For the role of mediation where motivation is able to mediate the influence of transformational leadership and team work on organisational performance
