Juridical Analysis of the Rechterlijk Pardon Concept Implementation in Ordinary Criminal Act Associated with the Non-Retroactive Principle in Indonesian Criminal Law
At first, the regulation of the concept of rechterlijk pardon in the provisions of Indonesian criminal law was inspired by a similar arrangement in the provisions of criminal law in the Netherlands. Where the purpose of the inclusion of the concept is to avoid the rigidity that has long occurred in the practice of administering criminal law there. Such reasons are also the reasons behind the inclusion of the concept of rechterlijk pardon in the provisions of Indonesian criminal law. Although it has been more than thirty years since the concept was first discussed, until now the concept of rechterlijk pardon has only been regulated in the provisions of article 54 paragraph (2) of the Draft Criminal Code and article 70 of the Juvenile Criminal Justice System Law. However, in the practice of examining ordinary criminal cases, it turns out that there have been several district court decisions that apply the concept of rechterlijk pardon in the consideration of their decisions, including the verdict of criminal case number 1038/Pid.B/LH/ 2019/PN Pbr, criminal case verdict number 52/Pid.B/2020/PN LBB, criminal case record number 1/Pid.C/2021/PN Ttn, and criminal case verdict number 8/Pid.B/2022/PN Rtg. Even though it is known that the criminal law Indonesia adheres to a non-retroactive principle that prohibits the enactment of a statutory provision before the provision is passed. Therefore, in this article, we will discuss further about the implementation of the concept of rechterlijk pardon in each criminal case decision, which is connected with the non-retroactive principle that applies in the provisions of Indonesian criminal law
Status of N, P, K, C-Organic and pH Nutrient in Paddy Fields in South Bolaang Mongondow Regency, Indonesia
Rice is the main food crop in Indonesia because rice is a staple food. Therefore, rice production must be increased significantly to meet the needs of the growing population. To increase rice production, in addition to superior varieties, irrigation, pest, and disease control, the nutrient fertility status of rice fields is also very important. Nutrient content in the soil that is below the critical limit is a limiting factor for plant growth and yield. Therefore, the nutrient status of rice fields at the farmer level needs to be identified to improve soil fertility. Bolaang Mongondow Regency is the largest rice-producing district in North Sulawesi Province. In Lolak District, Sangtombolang District, and Dumoga District, many large rice fields are the largest rice producers in North Sulawesi Province, which supply rice to Manado. The status of pH, C-organic, N, P, and K is important to know because it affects the growth and yield of rice. This study aims to study the nutrient status of rice fields in Bolaang Mongondow Regency. This study used a survey method and soil sampling was analyzed for pH, C-organic, N, P, and K at the Palm Plant Standard Instrument Testing Laboratory of Manado. Soil samples were taken from rice fields owned by farmers in Lolak District, Sangtombolang District, and Dumoga District. The results showed that the nutrient status of rice fields in South Bolaang Mongondow Regency varied in each village. Nitrogen nutrient status ranged from 0.01–0.19%, Phosphorus between 87–307 ppm, and Potassium between 0.2–0.5%. In addition, the soil pH was classified as acidic, and the C-organic content was classified as low. Increasing the use of organic fertilizers, agricultural lime to increase pH, application of N, P, and K fertilizers based on soil conditions, and implementing crop rotation to increase soil fertility and productivity
Environmental Care Character Profile of Elementary School Students in the Era of Independent Curriculum
An attitude to environmental care means paying attention to everything in the environment, both biotic and abiotic and being responsible for always maintaining its sustainability and balance by trying to avoid damage. In daily life, humans can act towards their environment in good or bad ways. To help people become more concerned about the environment, education should be provided by inserting materials about caring for the environment. Having a strong understanding of the environment is expected to encourage people to act better for the environment. This research is a type of quantitative descriptive research. Descriptive research aims to describe or describe existing phenomena, both natural and human-made phenomena. The subjects used in this study were elementary school students in 6th class. As many as 30 students took 10 samples and 3 teachers. The data collection instruments used were interviews, test questions and questionnaires. The data analysis technique used is a qualitative descriptive approach. The results showed that the attitude of environmental care in elementary schools is included in the low criteria with a percentage of achievement of 58, 82%. Suggestions that can be proposed in this study are to increase parental participation in the application of environmental care character.
Strengthening Character Education through the Strengthening the Profile of Pancasila Students Project at SMAN 1 Pajo
Character education is one of the problems faced by society because there are so many inequalities and social violations committed by the younger generation, where students are also included. This study aims to explore the role of schools in instilling character education strengthening in the school through the Student Profile of Pancasila strengthening project, especially in SMAN 1 Pajo. This research influences qualitative methods with a literature study and case study approach. Qualitative methods are used to explain the problems raised in the research. Meanwhile, the literature study approach is used to take theories that will be used as analysis material, while the case study approach is used to photograph the situation that occurred at SMAN 1 Pajo. Data collection was conducted by interviews conducted with the coordinator of the project program at SMAN 1 Pajo. The results of the study, it was found that the project activities to strengthen the profile of Pancasila students at SMAN 1 Pajo were carried out through the stages of preparation, implementation, and evaluation. It can be concluded that strengthening character education can be done by schools through these activities
Protection of the Rights of Traditional Communities in the Ownership of Traditional Land Rights for Public Interests (Study of the Drafting of Traditional Legal Community Legislation)
Indigenous Peoples played an important role in the founding of the Republic of Indonesia. However, until now there are still many conflicts between Indigenous Peoples with the government and private companies. So, they are negatively impacted. The conflict occurred due to the State's low level of recognition of customary rights and the neglect of the rights of Indigenous Peoples in the process of determining land functions. Indonesia does not yet have special regulations that regulate and recognize the existence of indigenous peoples. Until now, the state has not been able to fulfill the rights of indigenous peoples as part of Indonesian citizens. The existence of customary law communities needs special attention from the state. It cannot be denied that the existence of indigenous communities spread across all Indonesian provinces is not a fiction. It is time for the state to give true recognition to the existence of indigenous peoples. There is a need for a special law that deals with the problems of customary law communities, namely through the Customary Law Community Bill. The DPR RI as a people's representative institution plays a role in forming and ratifying the Bill on Customary Law Communities so that legal issues regarding violations of the rights of indigenous peoples can be resolved. This ratification also aims to provide legal certainty regarding the fulfillment of the rights of indigenous peoples
Analysis of Students' Problem Solving Skills on the Material of Two-Variable Linear Equation System
This research aims to describe students' problem solving skills. This type of research is descriptive research with a qualitative approach. The subjects in this study were VIII grade students totaling 33 students. The process of taking subjects through purposive sampling technique. The data collection techniques used were tests, interviews, and documentation. Data analysis techniques using Miles and Huberman, namely data reduction, data display, and verification. Data validation with triangulation. The result of this study is the problem solving ability of students in grade VIII of one of the State Junior High Schools in Yogyakarta on the material of the system of linear equations of two variables is included in the low category. This can be seen from the number of students who have problem solving skills in the low category of more than 50%. Students who have problem solving skills in high qualifications are only 27%. Students who have moderate problem solving ability amounted to 9%. The remaining 64% have low problem solving skills
Implementation of the Independent Learning Curriculum in the Indonesian Language Learning Process at Vocational High Schools (SMK)
The effectiveness of the educational process is shaped by both internal (individual) and external factors, with the curriculum being a key external element that significantly influences learning outcomes. This research focuses on the implementation of the Merdeka Belajar curriculum in Indonesian language instruction at vocational high schools. To evaluate its success, a descriptive quantitative approach was applied, with data collected through questionnaires distributed via Google Forms. The study targeted a population consisting of three vocational high school principals, their administrative staff, and three Indonesian language teachers. A purposive sampling method was used to select participants who were directly involved in implementing the curriculum. Microsoft Excel was utilized to analyze the data, assessing the extent of the curriculum's application and highlighting any obstacles faced during its execution. The findings of this study aim to offer meaningful insights that can assist both educators and policymakers in improving the educational process, particularly in vocational high schools. This research is crucial in understanding how the Merdeka Belajar curriculum affects the teaching of the Indonesian language and will contribute to the refinement of teaching practices and curriculum development. Writing and Indonesian Islamic Boarding School (Students, Teachers, and Alumni): A Mini-Pilot Study Perspective
Studies on writing are categorized into monodisciplinary and interdisciplinary. Related with matter the study, this aim explores unesa-trend writing, and program writing from Unesa for students, teachers, and alumni boarding schools that are found in the East Java region. So far, research on writing is still in the partial category, resulting in partial outcomes. This research method uses qualitative Which puts forward narration data and data interpretation. The respondents for this research were students, teachers, and alumni of East Java Islamic boarding schools. This research used 150 respondents. Technique analysis data was carried out using the stages of identification, classification, verification, and final presentation of the main data, in the final stage the researcher carried out triangulation. From the various questions asked, the results showed that (1) there were more female respondents, (2) most of them came from Islamic boarding school students/children, (3) most of the respondents' writings had never been published in the mass media (4) most of the respondents' motivation in writing is for fun (5) respondents answered that deadlock/stagnation was the complaint of most respondents when writing
Study the Commercial Trading Strategy of Iran and Afghanistan in the Development of Islamic External Trading Principles
Both Iran and Afghanistan need to develop their external trade as one of the main factors behind of economic and social growth and development. In the present, both states are getting involved with sanctions and restrictions of The United States of America, the main question is that how can they increase bilateral trade and what is the appropriate strategy for this? The research method of accomplishing of this paper is descriptive-analytical method by using library’s data. The results of this paper show that the political and economic conditions of the two states, and also being neighbor, cultural common aspects and long border need to make an interactive trade because this is the most suitable strategy for both sides. This interaction leads both states to development of the trading through the principles of external trade in Islamic values, and it creates a win-win result for Afghanistan and Iran. In such interactive trading, Iran can neutralize side of the sanctions with helping of Afghanistan, and Afghanistan, whose external trade is in a defensive position against external threats, can take advantages from trade with a reliable trade partner and experience fair trade.
Business Judgment Rules Regulations by Directors in Indonesia
This writing aims to analyze further implementation the Business Judgment Rule (BJR) principles in Indonesia and apply the BJR principles to the decisions made by directors that result in losses for a Limited Liability Company. This research employs a normative legal research method with a statutory approach. The research findings indicate that the BJR has been regulated in Article 97 paragraph (5) of the Indonesian Company Law. Article 104 paragraph (4) of the Limited Liability Company Law. This principle provides an exception to the liability of directors whose decisions result in losses for the Limited Liability Company, provided that the decision is made in good faith and full responsibility, as it constitutes an inherent fiduciary duty of the directors. An example of applying the Business Judgment Rule (BJR) is in a case decided by the Supreme Court of the Republic of Indonesia No. 121 K/Pid.Sus/2020, where the defendant in that decision was acquitted of all legal charges. However, in the judgments of the lower court and the appellate court, the defendant was found to have been proven guilty of committing corruption offenses. The Supreme Court argued that the defendant's actions to develop the company did not fall outside the scope of the BJR, as there were no elements of fraud, conflicts of interest, and intentional unlawful acts
