Prohibition of Discrimination in Employment and Occupation in International Labor Documents
The necessity of equality of opportunity and elimination of discrimination in recruitment and employment is one of the important international labor standards. discrimination in work means any priority, preference, and exclusion based on unreasonable and logical grounds that harm or destroy equal opportunity and equal treatment in employment and occupation. The index of discrimination is social dynamics in two types, i.e. inter-generational and international. Eliminating discrimination in employment and occupation is one of the important standards of international labor law, which in its various forms should be gradually eliminated by countries. On the other hand, it is clear from international labor documents that different behaviors are not included in the scope of discrimination, and on the other hand, discrimination has effects and consequences that should not be neglected. The international standards of work in the mentioned fields have been analyzed and evaluated in this article with a descriptive-analytical method
Community Participation in Village Tourism Development
Community participation in tourism development is the participation and equality of community members in a particular activity. Raharjana (2012) believes that the community plays an important role in supporting tourism development, especially in controlling the direction of tourism development so that it can minimize the negative impact of tourism activities. One of the well-known tourist villages in West Lombok Regency is Senggigi Village. This location became a research location with the title "Community Participation in Tourism Village Development (Senggigi Village Study, Batu Layar District, West Lombok Regency). This research examines community participation in the development of tourist villages using a qualitative approach. Apart from that, in this research data collection used interview, observation and documentation methods. The collected data will be analyzed descriptively qualitatively. Meanwhile, the theories used are Max Weber's theory of participation and social action. It was found that the participation of community members, especially those around the beach, was very good. The impact of community participation on development greatly helps the local economy
Constitutionalism of Presidential and Vice-Presidential Terms in a Presidential System
The existence of a three-year presidential discourse through the 5th Amendment Bill to the 1945 Constitution does have advantages and losses, considering the considerable implications of a president who serves three terms. This study has two objectives, namely first to find out how the presidential system reacts to proposed changes, and second, how the debate around the 5th Constitution of 1945 affects changes in presidential mandates in 3 terms. This study is a standard legal research that uses three approaches, namely the legal approach, the historical constitutional approach, and the conceptual approach. Handep Hapakat Culture, a Social Phenomenon in Malan/Farming in Katimpun Village, Mantangai District, Kapuas Regency, Central Kalimantan
Hapakat is a motto of Ngaju Dayak people that has been rooted down from generation to generation, which was originally used to open land for farming (Malan/Ngaju). This culture is a culture of deliberation of tribesmen led by the Customary Chief (demang) in 1. Determining the start time of farming; 2. determining the boundaries of field land 3. Determining the borrowing of field land. This deliberation is full of kinship because Dayak people in the past lived in Betang houses and it was easy to deliberate. Nowadays they live in each house, and the deliberations are held in the Demang's house or in Balai Basarah (a place of worship for Dayak Kaharingan residents). Batana (Farming) Tana, (mit ciner Zahl: katana,) Feld, Keissfold. - Manana, auf dem Felde arl)eitcn; (gcbriiuchli- cher: raalun;) irgeodwo cin Fold machen. or Malan (maimbul parei/planting rice) is one of the livelihoods of the Ngaju Dayak community. Farming in the concept of Ngaju Dayak thought and culture and Dayak in general is not a matter of forest logging or shifting cultivation as it is stigmatised. In the perspective of the Ngaju Dayak people, farming is a process to breed rice as a manifestation of Dewi Sri or the Goddess of Rice. Rice was originally the food of the Sangiang who were stolen by Princess Jampa from Mahatala because the princess was sorry to see human life on earth. Therefore, it is not allowed to waste paddy, rice, or rice because it has a spirit called gana. Katimpun village is one of the villages in Mantangai sub-district on the Kapuas River. The population of Katimpun village is 442 males and 420 females, totalling 862, with an area of 70 square kilometres and wet and dry moorland. The majority of Katimpun villagers are farmers and planters, and on average own at least 1 hectare of agricultural and plantation land, some even own up to 5 hectares
Gender Discrimination and the Principle of Equality in International Human Rights Documents and Afghanistan's Legal System
Gender equality and the prohibition of discrimination against women are fundamental topics in the human rights discourse in the modern era. Since these inequalities are applied to half of the people of human society, it is still a controversial and unresolved global issue. Gender discrimination and inequality against women is rooted in various factors including culture, traditions, patriarchal culture, and unfair laws of countries. Today, gender discrimination is considered against human dignity and values and the principle of human equality. For this reason, any inequality and discrimination in important international human rights documents and covenants, the basic laws of most countries have been negated and prohibited. However, gender inequality is a pervasive phenomenon seen not only in underdeveloped countries but also in the hidden social layers of developed societies. Afghanistan is one of the countries that suffers from the problem of gender inequality. Mechanisms to guarantee gender equality were included in the constitution of the Republic of Afghanistan and the civil laws of the same period. However, gender inequality is still considered a fundamental problem in the way of human development in Afghanistan.
Improving Student Learning Outcomes and Critical Thinking Skills Using the Inquiry Learning Model
This study aims to implement the Inquiry Learning model to enhance learning outcomes and critical thinking skills among students in Phase D of Class VIII at Assisi Medan Catholic Private Junior High School. The research process utilized the classroom action research (CAR) method involving 26 eighth-grade students in Phase D during the academic year 2023/2023. The analysis results indicate a significant improvement in applying the Inquiry Learning model across various cycles. For instance, during the orientation phase, the percentage increased from 62.5% in Cycl 58.33% in the subsequent cycle, representing a 10% increase. Similarly, there was a notable enhancement in students' critical thinking abilities, particularly in providing explanations, building basic skills, making inferences, offering further explanations, and devising strategies and tactics. For example, in the stage of providing further explanations, the percentage rose from an initial 38.46% of successful students to 60.25% in the following cycle, marking a 56.65% increase. However, there was a significant decrease in students' eloquence skills and criteria for eligibility. For instance, in eloquence skills, the percentage of students dropped drastically from 65% in the first cycle to 15.38% in the subsequent cycle, experiencing a decline of -49.62%. Research recommendations include facilitating teachers in implementing effective Inquiry Learning models and expanding project-based and interactive learning approaches
Political Mentality and Its Transformation (In the Case of Post–Communist Uzbekistan)
The article analyzes the transformational processes under the influence of universal democratic values (human rights and freedoms, pluralism, justice, democracy, democratic political governance) in the political mentality of ethnic Uzbeks, who make up the majority of the population, on the example of Uzbekistan, one of the post–communist young independent states of Central Asia. Adoption of democratic laws is not enough for the political transformation of society. The democratic political transformation in the spiritual life of the society cannot be achieved without changing the communist values that have been forcefully instilled in the human mind by the communist political regime for 70 years, without completely removing them from the life of the person and the society. Today, the post–Soviet Uzbek society is undergoing a complex and difficult process of spiritual transformation.
State Law Dynamics in the Context of Indonesia's 2024 Simultaneous Regional Elections
The article considers the dynamics of state law in the 2024 simultaneous elections of regional heads in Indonesia. The methods used include literature analysis and empirical studies to evaluate various aspects of the law and its implementation in the 2024 pillage. The purpose of this study is to identify possible legal problems during the implementation of elections and offer appropriate solutions to improve the quality of democracy in Indonesia. The principal issues discussed include law regulation, the appointment of deputies, and the potential legal issues between the various levels of government in the context of the 2024 simultaneous selection of capitals. The article gives a brief description of the role of legal regulation in ensuring the execution of democratic and just regional leadership and the legal challenges faced in the process. Regulatory dynamics in 2024 simulating regional head discipline are necessary to understand in order to avoid conflict and ensure political stability during the transition of government. Based on literature analysis from credible sources, the article concludes that there needs to be a revision of the law and an increased capacity for elections as well as an improved mechanism for settling disputes to address the issues at hand.
Defect of Will as the Basis for Rescission Rights in the Legal Systems of Iran and Afghanistan
One of the key legal foundations for certain rescission rights (khiyarat) in civil law is the concept of a "defect of will." This theory posits that rescission rights are a mechanism to remedy deficiencies in the consent (rida) of contracting parties. Specifically, it argues that in cases such as khiyar al-‘ayb (rescission due to latent defects) and khiyar al-ghabn (rescission due to gross inequity in the price), the aggrieved party's consent is vitiated by an underlying defect. Proponents of the defect of will theory highlight principles such as the qawaid al-iqdam (principle of voluntary risk assumption), the rational foundation of rescission rights, the waiver of rights through conduct, waiver clauses within contracts, and the concept of mitigating harm as supporting evidence. They assert that this theory provides a more comprehensive and coherent explanation of the rules governing rescission rights compared to the la darar (no harm) rule, and it aligns more closely with established civil law and Islamic jurisprudence. In Afghanistan, the Civil Code explicitly recognizes the defect of will as the basis for rescission rights. Concepts like ghabn (unfair advantage) and tadlis (fraudulent misrepresentation) are considered defects in consent under Afghan law. In Iranian civil law, some scholars also refer to the defect of will as a basis for certain rescission rights. While several of these rescission rights clearly stem from a defect in consent, the drafters of Iran's Civil Code, following Islamic legal traditions, have categorized these rights as grounds for contract termination (rescission) rather than treating them as cases of contract invalidity arising from defective consent (as stipulated in Article 199). This approach does not negate the la darar principle but acknowledges its limitations in fully explaining the legal scope of rescission rights. The defect of will theory, on the other hand, offers a more precise and well-grounded framework for interpreting the rules of rescission and exhibits greater congruence with both civil law doctrine and Islamic jurisprudence. Consequently, it provides a more comprehensive foundation for justifying rescission rights in both jurisdictions
Wordwall Media Improves Narrative Text Writing Skills in Children with Autism
The purpose of this study was to improve the ability of autistic students in class III SDLB Autism in SLB Negeri 1 Bantul to write narratives using wordwall media. This research used a two-cycle Classroom Action Approach. The research was conducted from February to April 2023, and the subjects were three autistic students: YPS, STY, and RMD. Tests, field observations, and documentation were the data collection methods used. Qualitative and quantitative descriptions were used to analyze the data. Writing Indonesian narrative text using the material of daily activities before going to school is an improved ability. Planning, implementation, observation, and reflection were conducted at each meeting.Writing narrative text in Indonesian subject with daily activities material before going to school improves the ability. Planning, implementation, observation, and reflection were carried out at each meeting. The results showed that the three subjects became better at writing narrative texts with certain characteristics. These three subjects can fulfill five aspects of narrative text writing activities, namely the suitability of writing content, word choice, spelling and punctuation, grammar, and writing time. The method used by the three subjects to improve their ability to write narrative text by using wordwall media proved to improve their ability to write better. The data collected showed that the average score of 56.67 was obtained in the pre-cycle and then increased to 67.33 in cycle I and rose to 78.67 in cycle II. The results of cycle II have reached the indicator of the success of the action, which is 75 of the KKTP set by the school. Based on the data collected, it can be concluded that wordwall media can make learners more involved and make them better at writing narrative texts
