    Get PDF
This article discusses the comparison between the mortgage rights mechanism in the Indonesian legal system (Hak Tanggungan) and the mortgage system in common law. The main focus lies on the legal characteristics of each system, such as the nature of the right, publicity principle, executory power, debtor protection, and the separation of ownership. Through a normative juridical and comparative law approach, it is found that the Indonesian system emphasizes legal certainty and execution efficiency, while the common law system tends to offer greater protection to debtors through the principle of equity of redemption and the separation of legal and equitable ownership. These differences reflect contrasting orientations between procedural efficiency and substantive justice in protecting the rights of parties in secured transactions

    Get PDF
The learning revolution that shifts to numeracy learning affects the availability of the need for teaching materials that include numeracy learning linked to technology in the current digitalization era to encourage students' learning outcomes that are still relatively low, due to students' critical thinking skills and mathematical disposition that still need to be improved. This can be resolved by providing media through the aims in this research, namely to develop numeracy e-modules on statistics content oriented to critical thinking skills and mathematical disposition of grade VIII junior high school students that are appropriate for practical use. This research is a development research with ADDIE model. Data were gathered based on questionnaires and mathematical critical thinking skills tests. The research results show that the numeracye-module meets the validity criteria in terms of media (medium) and material (high). Practicality level assessment by teachers by 95% (very practical) and students by 90.2% (very practical). Pretestand Postest results from the criticalt hinking skills test and students 'mathematical disposition increased in N-Gain in the interval g ≥ 0.7 with a high category. It is concluded that the developed e-module is feasible touse in terms of validity, practicality and effectiveness

    Get PDF
Prayer is the pillar of religion and the foremost among acts of worship. Performing prayer is considered one of the most significant religious practices, a defining characteristic of prophets, and a crucial foundation for fulfilling their mission. Like any other form of worship, prayer holds value only when its intended purpose is realized, meaning it must be impactful and effective. According to the Quran, the essential elements of an impactful and effective prayer include humility before the Almighty God, consistency and vigilance in performing prayers, remembrance of God during prayer, and the establishment (iqama) of prayer rather than merely reciting it. Functionally, effective prayer creates a foundation for the growth of individual and social values, fosters psychological tranquility in the worshiper, reduces crime at both individual and societal levels, aids in resolving various issues, and eliminates the effects of inappropriate behavior from the human psyche. This study employs a qualitative research method of a descriptive-analytical nature and aims to examine the effectiveness and impact of prayer on individual and social well-being. The findings indicate that impactful prayer elevates individual and social values, guides the worshiper toward inner peace, and significantly reduces the likelihood of sin and disobedience within personal and social contexts

Reduction of Penalties for Legal Entities in the Criminal Law of Iran and Afghanistan in Light of Judicial Determination of Punishment

    Get PDF
Legal entities, as one of the fundamental players in the realm of criminal justice, do not have a long history and have only attracted the attention of legislators in recent centuries. Given that these entities may, in the course of their activities, engage in a series of criminal behaviors, legislators consider these cases in criminalization and sentencing, taking into account the unique characteristics and other features of legal entities, and allow judges some discretion in sentencing. Thus, in certain cases, legal entities benefit from certain attributes or eligibility that allow for leniency, including mechanisms such as penalty reduction. Determining the circumstances under which these entities are eligible for reduced penalties, identifying the types of reductions, and assessing the resulting implications are topics worth exploring. This study addresses these questions through a descriptive-analytical method and library-based data, defining penalty reduction as a judgment for the minimum prescribed penalty, which can be categorized into degree reduction and specific reduction. When penalty reduction is applied to those committing criminal behavior, various effects can be expected, such as considering the offender's conditions, creating an environment for rehabilitation, and more

    Get PDF
The purpose of this research is to discover and present the model of belief education in the aspect of monotheism in the Holy Quran, which was done with the analytical-exploratory-inferential method. The meaning of the model in this thesis is "a theoretical model, framework and process in which human belief education is formed". By referring to the Holy Quran and examining and analyzing the verses, the findings of the research indicate that the Holy Quran has used a three-component model for religious training of people. The constituent components of this model are vision-tendency, action and behavior, respectively. In the component of insight, he has presented knowledge and knowledge about God Almighty through the expression of attributes, mention of blessings, expression of natural phenomena and creating questions from the trainee (student). In the tendency component, by expressing the attributes of God, the weakness and incapacity of false gods, it creates love and affection towards God in the trainee and hatred and disgust towards false gods, and finally, this insight and tendency leads to the trainee's action, which in practice He goes to God alone, worships Him alone, and avoids false gods. Each of the above three components have a close and close relationship with each other and are associated with each other, and in belief education, all components must be considered together in order to form a complete and desirable model of belief education. The lack of any of them will cause disruption and inefficiency of the desired model. In the priority and delay of the above components, the insight component has a logical priority and is more important

Why Disrespectful Acts against Prophet Muhammad and Quran Must be Outlawed Worldwide: An Analysis of Legislations and Case Laws (Part 1)

    Get PDF
Controversies arose much more than before after the deliberate republication of the Prophet’s Muhammad cartoons by a French weekly magazine, Charlie Hebdo in 2020. But, this article will prove that ridiculing and insulting are not instances of the right for the freedom of speech and expression. It has been discussed that publishing the insulting cartoons do not count as a defense of the right for freedom of expression. Europeans have never permitted the prosecution of Prophet Muhammad cartoons or Quran burning issues to reach the courts because they understand that if these cases were brought before the court, the judicial system would be required to restrict such actions based on their criminal laws. Even if the court ruled it as free speech, the civil parties could appeal to the European Convention on Human Rights (ECHR), and it would have to restrict those actions according to para. 2 of Article 10 of the convention, as it has previously ruled in several similar cases. If the ECHR supports such actions, the decision would be conflicting. It is evident from both a rational and moral standpoint that such actions are unjustifiable, and there is no requirement to consult the regulations of the courts in Europe or America. The approach of this article, however, aims to demonstrate that the disrespectful acts against Prophet Muhammad and the Quran should be globally outlawed. This is substantiated by examining previous worldwide courts, to illustrate that failure to prosecute such acts contradicts their principles, values, and prior judgments. This article demonstrates that if cases involving Prophet Muhammad cartoons, Quran burning, or any other form of disrespect towards them were to be brought to court, they would not be considered as free speech and would not be protected as such
