Similarities and Differences in the Conditions of an Ideal Ruler from the Perspective of the Imamiyyah and Sunni Schools

This comparative study examines the “conditions of an ideal ruler” in two Islamic legal traditions: The Imamiyyah and the Sunni schools. It aims to provide an integrated view of the similarities and divergences in the requirements for leadership as found in linguistic, jurisprudential, and theological texts. The research employs a descriptive-analytical approach based on library studies. First, the meaning of “ruler” is clarified in its dual usage (judge or governor), and then the conditions are categorized and compared as “general” and “specific.” The findings indicate that both traditions emphasize common traits such as Islam, reason, maturity, manhood, sound senses and faculties, courage, trustworthiness, and insight or political competence. In contrast, meaningful differences emerge regarding justice, ijtihad, Quraysh lineage, faith in the more specific sense (Imamiyyah affiliation), and purity of lineage: justice is a prerequisite for the validity and continuity of authority in the Imamiyyah, while in some Sunni sources it is considered a condition of perfection or non-essential; ijtihad is obligatory in the Imamiyyah, whereas among some Sunnis, knowledge combined with the possibility of consultation suffices; Quraysh lineage is important in many Sunni sources but not considered relevant in the Imamiyyah during the Occultation; and faith in the specific sense and purity of lineage are prominent conditions in Imamiyyah literature. The study ultimately presents a matrix of “minimum common requirements” and “maximum doctrinal criteria,” which may serve as a guide for designing constitutional frameworks and contemporary policy-making in the Islamic world, clarifying the relationship between legitimacy, acceptance, and effectiveness in leadership models

Criminal Liability Termination of Vegetative State from Perspective of Islamic Jurisprudence

The termination of Vegetative state is among the emerging crimes whose criminal liability in this writing has been explained in a descriptive-analytical manner and has been compiled by the library method. Vegetative state is a medical term and means a life in which the patient, due to the death of the cerebral cortex and the living of its stem, only possesses involuntary activities such as growth, development, evolution, heartbeat, respiration, digestion, and similar ones, but does not benefit from actions such as speech, cognition, sensation, and voluntary movement. Research in recognizing the ruling and inferring the jurisprudential ruling regarding the cessation of Vegetative state showed that the Termination of any stage (Vegetative state, animal life and human life) from the stages of human life has a different and separate criminal liability relative to the other stages. By relying on valid jurisprudential evidence, it was concluded that the criminal liability for the Termination of Vegetative state is the same as the criminal liability for the Termination of the life of a fetus (before the blowing of the soul). For a better understanding of the subject, it is suggested that the criminal liability of the Termination of Vegetative state from the perspective of Islamic jurisprudence be investigated comparatively with common law

Why Disrespectful Acts against Prophet Muhammad and Quran Must be Outlawed Worldwide: An Analysis of Legislations and Case Laws (Part 2)

In this article, the discussion centers on the laws based on which the cartoons of the Prophet Muhammad, mocking, and insulting him, as well as any disrespectful acts against him or the Quran, should be banned globally. The discussion is based on previous rulings of the courts around the world trying similar cases. It has been shown that regarding similar cases, based on the courts’ own judgments, defamation, mocking, and insulting Prophet Muhammad is definitely hate speech. During the analysis of the case law, it can be seen that some criminal codes have been applied in an uneven way, particularly in the cases related to Prophet Muhammad, where the inconsistency in enforcement has been evident. Since the publication of the Danish Mohammed cartoons, a clear instance of double morality has emerged in how society applies the right to freedom of expression. For example, while cartoons depicting sensitive topics to Muslims, such as the prophet Mohammed, are commonly seen as justified exercises of this right, there is a striking contradiction in how cartoons on subjects sacred to Western secular society, notably the Holocaust, are often met with denunciation. Relevant domestic and international laws have been referenced in the accompanying supplementary file. Also, the relevant case law has been briefly summarized in the supplementary file. Each discussion of case law has been categorized according to the three-condition test established by the European Court of Human Rights (ECHR). This classification has facilitated the examination of each of these conditions in cases involving disrespectful acts towards Prophet Muhammad, the Quran, as well as Jesus and Saint Mary

The Impact of Contextual Teaching and Learning on Mathematical Literacy and Its Five Aspects Across Educational Levels: A Systematic Literature Review

This study aims to describe the influence of implementing the Contextual Teaching and Learning (CTL) approach on improving students’ mathematical literacy skills across various educational levels. The study employs a Systematic Literature Review method involving 30 selected articles that discuss the application of CTL in mathematical literacy and its five components. The findings indicate that the implementation of CTL consistently enhances all aspects of mathematical literacy significantly compared to conventional methods. In addition, supporting factors were identified, including the relevance of learning materials to real-world contexts, the active role of teachers, and the use of technology. Conversely, inhibiting factors include limited teacher competence, restricted instructional time, and inadequate ICT facilities. Previous studies also exhibit limitations such as small sample sizes, short intervention durations, and incomplete research designs. Overall, CTL has been proven to positively contribute to improving mathematical literacy within real-world-based learning contexts

Inside information is information that has not been disclosed to the public, which is directly or indirectly related to the securities being traded or their issuers and, if published, would affect the price or decision-making of investors to trade. The Securities Market Law has criminalized the use of inside information. Its criminalization has been based on principles such as protecting the public interest of the market, administering justice, establishing economic security, eliminating and preventing market disruption, and the principle of no harm or resentment. Although the scope and inclusion of these principles encompass all crimes, more attention has been paid to economic crimes, especially crimes of the stock exchange and securities markets; the crime of inside information, according to the Securities Market Law, is committed by legal entities such as brokers, broker-dealers, market operators, and companies registered in this market, and like other ordinary crimes, it has material, moral, and legal elements. The securities market, which is a specialized market; Therefore, the crimes formed in it have more problems than ordinary crimes; considering such problems, it is obvious that criminalization, its foundations, pillars, and conditions need to be discussed in terms of criminal law; so that the market is protected from the anomalies and disorders that have been created in it, so that losses and damages do not occur to marketers, and justice prevails in the capital market

The Scope of Spouses' Privacy from the Perspective of Verses and Narrations

The family, as a small society, has laws and boundaries from an Islamic perspective, and its members must adhere to these laws and respect each other's privacy. Privacy is a fundamental principle in society and one of the most basic human rights, which is also raised within the family as the most fundamental social institution. Islam, as a complete religion, has established laws for the family and spousal privacy, the observance of which will lead to the exaltation of the family foundation. However, privacy in marital relationships remains unknown and is not well-explained for many. From the perspective of Islamic jurisprudence, spouses also enjoy privacy and independent interests relative to each other, and neither party has the right to intrude upon the other's privacy. This research, which is a library study written using a descriptive-analytical method, attempts to define the scope of spousal privacy and explain ways to strengthen the family foundation and improve relationships between spouses through this approach. The results obtained in this discussion include respecting the privacy of each spouse at home, physical privacy, sexual privacy, ideological privacy, etc., to achieve peace, strengthen the family foundation, and improve marital relations
