    Validation of Instrument Test Diagnostic Four Tier Digital to Identify Misconception and Conceptual Understanding of Newton’s Law Matter in High School Physics

    This research aims to produce a digital four-tier diagnostic test instrument product that is qualified to identify misconceptions and conceptual understanding of students reviewed from the validity of the content of the test instrument and the analysis of the digital four tier diagnostic test media. This research is a development research using the 4D method which includes 4 stages namely define, design, development, and disseminate. The research instruments include digital four tier diagnostic test instruments that have been validated logically based on the opinions of experts and empirically based on field trials and declared valid and reliable. The results showed that the digital four tier diagnostic test instrument developed falls into the valid category and can be used based on expert judgment

    Termination of Contract Due to Force Majeure Is Reviewed from Presidential Decree Number 12 of 2020 Concerning the Determination of Non-Natural Disasters of the Spread of Corona Disease 2019 (COVID-19) as a National Disaster

    The COVID-19 pandemic that began to spread in Indonesia in early 2020 has had a significant impact on various aspects of life, including the economic and business sectors. In response to this situation, the Indonesian government designated the COVID-19 pandemic as a national disaster through Presidential Decree Number 12 of 2020. This determination provides a legal basis for various actions and policies needed to deal with the impact of the pandemic, including in the context of civil law relationships such as contracts. In practice, many contracts cannot be executed as they should due to restrictions imposed by the government, a decline in economic activity, and other factors related to the pandemic. This raises legal questions related to the application of the concept  of force majeure in contractual relationships. Force majeure is a crucial issue because the COVID-19 pandemic situation, which many parties consider to qualify as a force majeure condition, forces the parties to the contract to terminate or suspend their obligations. However, the application of force majeure in the context of Indonesian law is not always simple. Each contract has  a different force majeure clause  , and its application requires careful legal interpretation. Presidential Decree Number 12 of 2020, although it establishes COVID-19 as a national disaster, does not explicitly provide guidelines on how the concept  of force majeure should be applied in contracts affected by the pandemic. Therefore, an in-depth juridical review is needed to understand the legal implications of termination of a contract based on force majeure in this context. This study aims to analyze whether the determination of the COVID-19 pandemic as a national disaster can be used as a basis for force majeure for contract termination, examine how Indonesian civil law regulates the concept  of force majeure in the context of national disasters, Provide recommendations related to legal steps that can be taken by parties whose contracts are affected by the COVID-19 pandemic

    The Local Wisdom Values of the Nagari Tuo Pariangan Tourism Village

    Nagari Koto Tuo Pariangan is a village in Minangkabau that has very valuable customs that have been there in culture and heritage for his ancestors. This research function is for looking for knowledge elements of culture and getting to know local wisdom in Nagari Tuo Pariangan. The data collection method used in the study is qualitative, using observation, in-depth interviews, and documentation. The results show that the people of Nagari Tuo Pariangan are still capable of becoming accustomed to a maintained style of life that has been there. Preservation culture is seen from local values in Minangkabau, such as religious values, honest values, tolerance values, discipline and responsibility values, equality and justice values, care social values, polite and friendly values, and communicative values

    Formulation of Social Sanctions for Corruption Convicts as a Form of Finding New Legal Rules in Indonesia

    Corruption is an extraordinary crime that has a very complex modus operando with the involvement of more than one party. Corruption has become a culture in government life in Indonesia. Therefore, effective law enforcement is needed to be able to eradicate this crime. So far in Indonesia, criminal sanctions have been implemented as a form of legal accountability, but in fact this is not enough to deter corruptors. The aim of this research is to formulate new legal findings in the form of implementing social sanctions as a form of law enforcement in corruption cases. The research method used is normative research. The results of the research show that social sanctions are felt to be effective because the focus is on causing psychological burdens, namely in the form of shame because they are required to become social workers for a certain period of time. It is hoped that this feeling of shame will trigger a sense of deterrence so that corruptors do not repeat the same actions. However, unfortunately until now there are no laws and regulations that stipulate social sanctions as an alternative sanction for criminal acts of corruption. Therefore, from this research, it is hoped that the government can immediately formulate social sanctions as additional sanctions to assess their effectiveness in eradicating criminal acts of corruption

    Growth Mindset in English Language Teaching and Learning

    Several studies have revealed that inadequate English proficiency, instructor inventiveness, and student learning motivation are major issues in Indonesia. These restrictions must be overcome. The current study stresses the concept of growth mindset, first proposed by psychologist Carol Dweck, as a critical response to previous setbacks. Several sources were located utilizing the library research method to answer the study's questions. It is thought that students with a growth mindset are more likely to persevere in the face of adversity, viewing failure as a learning opportunity rather than a setback. Students with a growth mentality are more inclined to accept challenges during their English learning journey. They see failures as chances for progress rather than impassable hurdles. Students who believe they can grow and improve have higher levels of self-efficacy. Growth mindset enhanced some students' socioemotional abilities and study habits, notably among low-income students. Furthermore, teachers with a growth mentality are more willing to receive feedback and improve their teaching approaches. Teachers with a growth perspective are more inclined to seek professional development opportunities. Teachers with a growth mindset are more likely to experiment with new instructional methods and innovative techniques. Effective professional development programs are critical for providing teachers with the skills and knowledge needed to effectively promote growth mindset principles. The success of implementing a growth mindset into the curriculum is primarily determined by teacher attitudes and training

    Dividend Policy and Firm Value: The Impact of Earning Management and Financial Performance

    Through this research, we aim to explain the impact of earnings management on firm value and dividend payment, and the impact of financial performance on firm value and dividend payment. Additionally, this research seeks to determine whether dividend policy contributes to firm value. The research uses an explanatory approach. The sample consists of mining companies listed on the Indonesia Stock Exchange that have published financial statements and distributed dividends from 2019 to 2023. Data analysis is conducted using Partial Least Squares (PLS). The findings reject two hypotheses: earnings management does not significantly contribute to firm value and has a negative impact on dividend payment. Another result shows that financial performance contributes to both firm value and dividend payment. Furthermore, firm value is influenced by dividend payment

    Cultural Habitus of Tiban Traditional Performance as a Part of Rain-Invoking Ritual in Wajak Kidul Tulungagung

    This study discusses a phenomenon of how the concept of habitus manifests in the Tiban traditional performances which creates the practices, the symbols, the reproduction, and the transmission of culture. Habitus is a habit and way of thinking which originated from a social structure. Tiban is a traditional performing art from Wajak Kidul Tulungagung which is a form of transcendental communication as a part of rain-invoking ritual for the community to ask for rain in the middle of the dry season. Various kinds of art forms in Tiban cultural performances make a great appeal to be explored further, particularly about the cultural practices contained therein. This study also looks into what causes the adaptation of the transformation and the changes. When the social setting changes, habitus can play a role in choosing, modifying, or preserving traditional elements that are considered relevant. Overall, this paper highlights that habitus is an important mechanism in the realization of values and symbols in the Tiban tradition, shaping the way society understands, interprets, and practices the tradition, ensuring its continuity, and enabling adaptation to social change

    Application of Prison Penalty to Children in Conflict with the Law in the Criminal Act of Predictive Murder

    The case of premeditated murder committed by a child in Kalimantan which became the public spotlight because the perpetrator's child committed a very sadistic premeditated murder, where in this case the victim was a family consisting of a father, mother, and their three children. Then the level of cruelty in this case surprised many parties, considering that not only one but five lives were lost in a very brutal way. The formulation of the problem in this study is (1)How is the application of prison sentences to children in conflict with the law for the crime of premeditated murder?(2)Has the imposition of imprisonment for children in conflict with the law in the crime of premeditated murder fulfilled justice? The method used is normative law, using a statutory, case and conceptual approach. Law Number 11 of 2012 concerning the Juvenile Criminal Justice System explains that if it is proven that a child (underage) has committed a crime of premeditated murder, the trial process is in accordance with applicable provisions while the penalty is ½ (one half) of the adult penalty and children cannot be subject to the death penalty and life imprisonment. The imposition of imprisonment for children in conflict with the law in the crime of premeditated murder is considered not to fulfill the sense of justice for the general public, especially for the victim.The provision has caused controversy and debate among the public and legal experts. Many argue that the 10-year prison sentence is disproportionate to the seriousness of the crime committed, especially considering the extraordinary impact of losing five lives at once

    Bloom’s Revised Taxonomy: An Approach to the Content Analysis of the ESP Medical and Paramedical Textbooks

    Objective: This research aimed to conduct a content analysis of medical and paramedical textbooks at Shiraz University of Medical Sciences, focusing on Bloom's Revised Taxonomy (2001). The study sought to determine which taxonomy levels are more prominent in both types of textbooks and whether there are any differences between the two disciplines regarding thinking skills and knowledge levels. Method: The textbooks were coded using a coding scheme for which the reliability was assessed through intra-coder reliability. After data analysis, we calculated the frequencies and percentages of different thinking levels and knowledge. Results: The findings revealed that medical textbooks emphasize lower levels of thinking and knowledge although there is some variation in the learning objectives of the taxonomy. On the other hand, paramedical textbooks prioritize higher knowledge and thinking, albeit with less diversity. The Chi-Square test confirmed a statistically significant difference between the types of exercises in the two groups of textbooks. Discussion: Medical textbooks exhibited a broader coverage but less depth in terms of thinking skills and knowledge, while paramedical textbooks demonstrated the opposite pattern. Finally: the study provides implications for teachers and material developers to consider

    Improving Students' Conceptual Understanding and Mathematical Connections Using the CORE (Connecting, Organizing, Reflecting, Extending) Learning Model

    This research aims to examine and describe: (1) the effect of CORE learning model on students' conceptual understanding and mathematical connection skills; (2) the superiority of CORE learning model in terms of students' conceptual understanding skills; and (3) the superiority of CORE learning model in terms of students' mathematical connection skills. The type of research used that conducted at SMA Negeri 1 Langke Rembong is a quasi-experimental study. The population of this study consisted of all grade XI students and the samples included classes X-B and X-D, each comprising 30 students. Data collection methods included mathematical concept understanding and mathematical connection abilities test consisting of five essay questions. The research instruments were validated by experts and proven reliable. A comparison test of two mean vectors using  test statistic and a significance level of  was used to determine the effect of the learning model. The superiority test between the CORE learning model and the Direct Instruction (DI) model used an independent sample t-test statistic. The results of this test also showed the superior learning model for each ability. The results showed that at a significance level of : (1) the CORE learning model had a simultaneous effect on conceptual understanding and mathematical connection; (2) the CORE model was superior to the DI learning model in terms of students' conceptual understanding; and (3) the CORE model was superior to the DI learning model in terms of students' mathematical connection
