Civilian Border Patrols: The Right to Safely Cross the Border vs. the Right to Protect Private Property (Comment)
No full textThis Comment calls for comprehensive immigration reform by outlining results of a failed federal immigration policy that does not address society's pressing concerns pertaining to immigration. The discussion will begin with the source of federal power to control immigration issues and then shift to the civilian response to a lack of federal immigration reform. It will outline the source of a civilian border patrol group's right to monitor the border and make arrests; the ensuing litigation; immigrant's rights at the border; the racial tensions that result from the lack of federal immigration reform; and conclude with a proposed resolution to calm civilian tensions on the U.S.-Mexico border. The legislative and civilian backlash against immigrants has lead to an upswing in civilian border patrol groups who are often driven by racial prejudices and who advocate and influence the enactment of racially-biased legislation which leads to the creation of a new, second-class immigrant American citizen
Moving beyond the Immutability Debate in the Fight for Equality after Proposition 8
No full textThis Article will proceed in four parts. It provides a background discussion of the landmark United States Supreme Court cases dealing with sexual orientation. Then it examines state court decisions in the marriage context, including a focus on the California Supreme Court's 2008 Marriage Cases decision, which declared sexual orientation a suspect classification, eschewed the "immutability" debate, and mandated marriage equality for all Californians. Part IV discusses Proposition 8 and the peculiar vulnerability of LGBTs illustrated by that voter initiative. Part V provides an analysis of how greater rights may ultimately be achieved in the courts by building upon the California Supreme Court's analysis of the "integral nature" of sexual orientation
