China's Labor Enforcement Crisis: International Intervention and Corporate Social Responsibility (Note)
No full textInternational concern has been highlighted over China's labor policies in recent years. China's emergence as an international superpower of manufacturing and production by Western-owned and operated companies spotlights China's labor practices as a human rights issue. The reasons for China's lack of enforcement of labor laws likely stems from economic pressure for high output at low cost to producers. Manufacturers in China must choose sacrificing labor conditions to maintain lucrative production contracts. Corporate social responsibility has become a conscious effort by Western companies to ensure labor standards in China are in compliance, however, these efforts may not be enough. This Note focuses on the existing conditions in China's labor industry and the challenges faced by China domestically, international influence, and corporate involvement
Beyond the Plenary Power Doctrine: How Critical Race Theory Can Help Move Us Past the Chinese Exclusion Case (Note)
No full textThis Note argues that the judiciary's implementation of the plenary power doctrine fails to reflect reality. Then, this Note contrasts the racist, historical record with the constitutional freedom that the courts grants the legislative and executive branches. While the legislative and executive branches discriminate, the courts idly stand by, rationalizing ways to give deference. Part II highlights the historical discrimination faced by Asian-Americans and Latinos and, via the interest-convergence principle, explains the increases in immigration and the backlashes that followed those increases. Part II also explains the plenary power doctrine and exhibits some of the doctrine's effects on aliens. Part III argues that the plenary power doctrine lacks substance by highlighting the weakness of the plenary power doctrine's rationale and explaining why any useful analysis of immigration law needs CRT. Part IV concludes by offering a few possible remedies to the current tragedy created by the plenary power doctrine
John Jay, Discrimination, and Tenure (Comment)
No full textOne can see the tension between the tenure system and Title VII. The tenure system was designed to provide autonomy and keep outsiders who lack the necessary credentials out of the decision making process. But if what John Jay says is true: that there is no group of people who can be trusted to do what is right, then even well intentioned tenure boards must refine the process to allow practical checks and balances, and courts must be willing to provide those checks and balances. Section II will provide history, a synopsis of the legal cases that have pitted employment and tenure decisions against Title VII, and examine the historical impact on women in the academy. Section III will examine the distinction courts have made between tenure decisions and regular employment discrimination cases and why the reasoning fails to make a significant distinction. It will also examine the availability of tenure review materials to plaintiffs and why redaction is not ideal for proper adjudication. Finally, it will posit suggestions for a way to move towards fair and transparent tenure decisions in our colleges and universities

This article is the fruit of continuous years of updated study of matrimonial Canon Law, with years of collaboration in ecclesiastical tribunals on the development of the matrimonial processes in causes of matrimonial nullity, as well as giving lectures on Canon Law. This article combines my own reflections with research, especially the works of distinguished canonist. Obviously, the works of the great minds of the Catholic Church have influenced my view on the topic, I alone remain accountable for the material I have written
