Cyber resilience in combating ransomware attacks: A psychological case study perspective on the hospitality industry

    No full text
This paper studies the drivers that have a significant impact on organizational resilience in terms of ransomware attacks in the hospitality industry of Indonesia, with a particular focus on hotels operating in Bali. The interviews with IT managers in two of the most important hotels were conducted using in-depth interviews. They showed that the ransomware attacks caused severe operational disturbances and a loss of consumer confidence. Despite these, several proactive measures have been put in place by the hotels, and this has emanated through the strong leadership from the senior management to upgrade cybersecurity infrastructure and to instigate staff awareness programs. The findings pinpoint budget limitations and inadequate training, which align with the existing literature, as some of the important obstacles. The work underlines the desperate need for adaptive strategies in cybersecurity and develops an understanding that a collective organizational commitment is required toward sensitive data protection and good reputation building. Indeed, the research points out that creating security awareness among all employees would genuinely enhance the culture of cybersecurity and resilience. Collaboration between industry players and governmental bodies may provide the required wherewithal and frameworks for building up strength with which the ransomware threat could be tackled effectively. Given the practical recommendations, it might be useful to consider how to make the hospitality industry resilient in the case of ransomware attack

    No full text
Biological, cognitive, and socioemotional changes occur in adolescents. Teenagers pay more attention to physical appearance and body shape based solely on personal judgment or society's views, without looking at other aspects, such as religion. Therefore, the purpose of this study was to describe and analyze the significance of religion in teenagers' body image from the perspective of the psychology of religion. The method used was qualitative with a phenomenological study design. Data collection techniques included observation, interviews, and documentation. The research participants totaled four people, three of whom had a positive body image and one other had a negative one. The results showed that religion was related to body image. Participants with a positive body image consider that they have been created by God perfectly, and they are grateful for everything about themselves and their appearance. Participants with a negative body image recognized that God had indeed created all humans good, but participants always felt dissatisfied with themselves, so participants continued to think about and improve things that they felt were not good. Most importantly, all participants acknowledged that religion guided them in finding meaning and purpose in life. Religion provides a strong basis for building a positive and healthy body image by thinking, responding to every event, and reflecting on or self-evaluating. This study implies that each individual is aware of the importance of self-acceptance, seeing, and thinking that the self is valuable and special

The Legitimacy of Marrying a Pregnant Woman from the Perspectives of Islamic Scholars and Legislation in Indonesia

Shotgun marriage is a serious issue that has recently become increasingly common in society. Some men who impregnate women take responsibility and are willing to marry them, while others run away and shirk their responsibility. While some men are willing to marry women who are already pregnant, the perception still exists in some parts of society that those couples must remarry after the children are born and that the children cannot be traced back to the fathers who acknowledge it. This present study aims to answer the following question: what is the legitimacy of marrying a pregnant woman according to Islamic scholars and Indonesian law in the maslahah method? The results of the study reveal that according to Abu Hanifah and his student Muhammad, it is permissible to marry a pregnant woman if the one who marries her is the man who impregnated her. However, the marriage of a pregnant woman to a man who did not impregnate her is still a matter of debate. According to Abu Hanifah and Muhammad, it is permissible, but the man should not have intercourse with her until the child is born. According to Abu Yusuf and Zafar, it is not permissible to marry a woman who is pregnant as a result of zina (fornication) with another man because it is likened to pregnancy without zina. Imam Malik does not allow the marriage of a pregnant woman because of zina and considers such a marriage to be invalid, and the woman must undergo the iddah (waiting) period. Imam Shafi'i, on the other hand, considers shotgun marriage to be valid, regardless of whether the man who marries her is the one who impregnated her or not, and it is permissible for him to have intercourse with her even though she is pregnant because the presence of the fetus does not invalidate the marriage contract. According to the Hanbali scholars, marrying a pregnant woman is not valid unless two things have been done: she has repented and she has waited out the iddah period. Article 53 of the KHI (Kompilasi Hukum Islam/The Compilation of Islamic Law) states that a woman who is pregnant outside of marriage can be married to the man who impregnated her, and the marriage can be solemnized without waiting for the child to be born. However, the KHI should also add a phrase about a man who marries a pregnant woman who is not the one who impregnated her. This permissibility does not mean condoning zina but rather accommodating the interests of Indonesian society, which is in line with the opinion of Imam Shafi'i

The research aims to analyze changes to articles in Law Number 16 of 2019 concerning Marriage which are the result of revisions to previous provisions, namely Law Number 1 of 1974 concerning Marriage. This research is a juridical research by analyzing legal politics regarding changes in marriage law using a statutory approach, case approach, conceptual approach, and legal comparative approach. The results of this research are: First, the revision carried out by the government still leaves legal problems, this is based on the decision of the Constitutional Court in several judicial reviews of Law no. 1 of 1974 concerning Marriage. Second, the age limit regulated in Law no. 16 of 2019 concerning Marriage is not yet ideal and synergistic with other statutory provisions. Third, the purpose of the amendment to Law no. 1 of 1974 concerning Marriage is to reduce legal problems in society. On the other hand, the same problems still occurred when the previous provisions were implemented, such as the death rate for girls who married at a young age, the increasing number of requests for marriage dispensations, and the failure to achieve the marriages desired by law. However, changes to the marriage age limit provisions at least attempt to minimize cases of early child marriage in Indonesia

Islamic Family Law Reform in Indonesia: A Review of the Supreme Court's Decision on the Postponement of the Distribution of Joint Property

    Get PDF
The settlement of joint property between husband and wife after divorce often ends up in the Religious Court, even reaching the level of cassation and judicial review (PK), such as in the Supreme Court Decision Number Register 159/K/AG/2018. In this case, especially related to disputes over joint property in marriages with minor children, the Supreme Court not only refers to the normative law contained in the law, but also considers a sense of justice and benefit. This research uses a qualitative descriptive method with an empirical juridical approach. This approach is referred to as empirical legal research because it focuses on analyzing the implementation of normative legal provisions directly (in action) in certain legal events in society. Primary data was obtained from Supreme Court decision No 159 K/Ag/2018, No 618/Pdt.G/2012/PA.Bkt, No 38/Pdt.G/2013/PTA.Pdg, No 88K/Ag/2015, No 159/K/AG/2018, No 99/Pdt.G/2023/MS, as well as laws related to the research being discussed. Secondary data is obtained from books, scientific articles and previous research results related to joint property and those that have the same discussion. Data collection techniques using literature study and qualitative data analysis are used to explore certain phenomena and find out the causes. The results showed that the Supreme Court judge in deciding this case used the method of legal discovery through legal interpretation, especially systematic interpretation and sociological interpretation. In the case, the judge postponed the division of joint property until the children of the disputing parties reached the age of mumayyiz, thus showing attention to aspects of substantive justice. Systematic and sociological legal interpretations by judges show that in resolving post-divorce joint property disputes, especially those involving minors, judges must consider the social realities that live in society to actualize justice. This emphasizes the role of judges not only as law enforcers, but also as guardians of the public good. This research concludes that legal discovery by judges through interpretation based on systematic and sociological approaches can realize concrete justice in society, especially in divorce cases involving children

Transformation of Islamic Law into Positive Law within Pornography Legislation

    Get PDF
As the country with the largest Muslim majority in the world, it is only natural to frame Islamic law as the legal framework for pornography legislation. The reality is that Indonesia is a unitary state, so the establishment of an Islamic state is not feasible. This article falls underthe category of literature research with a qualitative approach. The methodology used is normative legal studies with a content analysis approach. The research concludes that the transformation of Islamic legal values can be manifested in positive law by implementing Islamic law in Indonesia without establishing an Islamic state. The transformation of Islamic law into positive law in national politics regarding the Pornography Law has had a significant impact on the process of accommodating Islamic law within Indonesia's legal system. The pattern of transformation in Islamic law is substantive (essential). Although not exactly the same as what exists in the concept of Islamic law, the substance or essence is in line with Islam or not contradictory to Islamic teachings, as seen in Law No. 44 of 2008 concerning pornography

Shafi'i madhhab followers constitute a majority among Muslims in North Sumatra. This article aims to explore the fatwa methodology and the impact of madhhab influences on decisions issued by the North Sumatra MUI. The research seeks to identify which Sunni schools of thought guide the MUI's fatwa decisions. This paper addresses two main issues: the methodology employed by the North Sumatra MUI in issuing fatwas, and the influence of madhhab thinking on fatwas, particularly those related to prayers issued between 2000 and 2010. To analyze the fatwa methodology of the North Sumatra MUI, this article employs three theories of legal interpretation: bayÄni, ta'lÄ«lÄ« and istislÄhÄ«. The approach taken in this paper invoããlves content analysis, specifically examining fatwa texts to address the research focus. This study centers on referencing Madhhab perspectives found in the official fatwa decisions of the North Sumatra MUI. This study is crucial to assess the extent of Madhhab influence on issued fatwas, particularly within the regional context at the provincial level. Methodologically, the study found that the North Sumatra MUI employs three approaches in its fatwa process: bayÄni, ta'lÄ«lÄ« and istislÄhÄ«. Regarding the influence of Madhhab thinking, the study discovered that the North Sumatra MUI referenced the viewpoints of the four Madhhabs' imams in the three fatwas analyzed. Based on this research, it is evident that the fatwas draw from not only the Shafi'i school but also from the other three schools. Among the fatwas analyzed, the Hanafi school predominates, appearing in all three cases, with the Shafi'i school appearing twice, and the Maliki and Hanbali schools each appearing once
