Evidence of Authentic Deeds in Civil Disputes Related to Nominee Agreements on Ownership of Land Title Certificates
Ideally, in civil disputes related to nominee agreements regarding ownership of property certificates, the authentic deed can serve as a strong tool to ensure the validity of legal transactions. However, in reality, the implementation of authentic deeds is often hindered by doubts regarding their validity and compliance with applicable legal regulations, especially when involving foreign nationals (WNA) in land transactions. The aim of this research is to analyze the evidentiary power of authentic deeds in civil disputes involving nominee agreements on property ownership certificates and assess their effectiveness in the legal process. This article falls under normative juridical legal research with a statutory approach and case approach. The methodology used involves library research and qualitative analysis of regulations and relevant court decisions. The research concludes that authentic deeds have valid evidentiary power if they meet the formal, material, and external requirements, but can be canceled if they do not fulfill these conditions, and the notary who issues them may face sanctions. Notaries are responsible for ensuring the validity of the deeds they create, and if they cause harm to other parties, they can be held accountable according to applicable laws
The Responsibility of Higher Education Institutions in Human Trafficking Cases Disguised as Internships: An Analysis of Islamic Criminal Law
Ideally, higher education institutions should act as entities that protect students' rights and provide quality education without abusing their position for harmful purposes. However, in reality, some universities are involved in practices that can harm students, including the misuse of internship programs that lead to human trafficking crimes. This study aims to analyze the legal responsibilities of higher education institutions in cases of human trafficking that occur within internship programs, using an Islamic criminal law approach. This article is categorized as a qualitative-based literature study. The methodology used is a normative juridical approach. The research results show that human trafficking cases in Jambi demonstrate complexity, involving both individuals and corporations, with different legal sanctions under Law No. 21 of 2007 and Islamic criminal law. Higher education institutions, such as Universitas Jambi, play an important role in providing assistance to victims, supporting legal processes, and collaborating with relevant parties to combat human trafficking, reflecting their moral and social responsibility
Eigendom: A Dutch Colonial Legacy in Indonesia's Land Ownership System in Case Number 109 PK/Pdt/2022
Ideally, Indonesia's land ownership system should have fully adopted the provisions of the 1960 Basic Agrarian Law (Undang-Undang Pokok Agraria or UUPA), which abolished eigendom as a form of property ownership. However, in reality, legal disputes persist regarding former eigendom verponding land, as seen in Case Number 109 PK/Pdt/2022. This case reflects legal issues concerning land rights originating from the colonial system and their implications for legal certainty in land ownership in Indonesia. This study aims to analyze the legal status transformation of eigendom verponding after the enactment of the 1960 UUPA and to examine the legal impact of the Judicial Review (Peninjauan Kembali or PK) decision in Case Number 109 PK/Pdt/2022. This article falls under qualitative library research using a normative legal study methodology. The findings indicate that the legal status of eigendom verponding has been converted according to national agrarian regulations. However, in practice, differences in legal interpretation continue to arise, leading to land ownership disputes. Case 109 PK/Pdt/2022 reaffirms that land title certificates issued under agrarian law provisions hold greater legal recognition than ownership claims based on colonial-era eigendom verponding
Gift Prize Program in the Easy Mudharabah Savings at BSI KCP Surabaya Rungkut 1: A Review of the DSN-MUI Fatwa
Ideally, Islamic banking should operate within the boundaries of Sharia, free from elements of riba (usury), maysir (gambling), and gharar (uncertainty). However, the reality at BSI KCP Surabaya Rungkut 1 reveals the implementation of a promotional program called Pesta Hadiah Raih Berkah, which potentially involves competitive elements, fund blocking requirements, and reward distribution based on deposit amounts—raising concerns about possible deviation from Sharia principles. This study aims to analyze the program's compliance with DSN-MUI Fatwa No. 86/DSN-MUI/XII/2012. Employing a qualitative approach with empirical legal and case study methods, the research gathers data through interviews with BSI representatives, supported by documentation and recent literature. The findings indicate that the program generally aligns with the fatwa, particularly regarding the source of funds and the form of rewards. However, aspects such as transparency and potential speculation still require careful oversight to ensure that promotional strategies do not violate Sharia values
Problematika Pengawasan Kesyariahan Peer-to-Peer Fintech Syariah: Analisis POJK Nomor 10/POJK.05/2022 dan Peran DSN MUI
This study aims to analyze the regulatory issues in the supervision of Sharia compliance within the Peer-to-Peer (P2P) Sharia Fintech system, particularly in the implementation of Financial Services Authority Regulation (POJK) Number 10/POJK.05/2022. The contribution of this research includes strengthening Sharia fintech regulations through more specific and collaborative supervisory recommendations between the Financial Services Authority (OJK) and the National Sharia Council of the Indonesian Ulema Council (DSN-MUI). This article falls under qualitative library research using a normative legal study method. It examines legal rules, regulations, and fatwas while evaluating the effectiveness of Sharia compliance supervision in practice. The findings indicate that the supervision mechanism of Sharia fintech remains weak due to the lack of direct monitoring by OJK and DSN-MUI, the absence of binding supervisory standards, and the reliance on internal reports from fintech platforms. Strengthening OJK's role in establishing stricter Sharia supervision guidelines and implementing a periodic audit system is necessary to ensure compliance with Sharia principles
Relasi Adat dan Hukum Islam: Menelisik Akulturasi dan Kearifan Lokal dalam Masyarakat Gorontalo
The acculturation between customary traditions and Islamic law in Gorontalo is so strong that the general public often finds it difficult to distinguish between original Islamic teachings and customs that have been Islamized. Some customs have been fully adopted into Islamic law, while others have undergone modifications and adjustments. This study aims to analyze how Islamic law and local customs interact within Gorontalo society and to identify the various forms of acculturation that have taken place. The focus of this research is to examine how customs influence the practice of Islamic law, both in aspects that remain stable and those that have undergone changes. The research employs a library research method by reviewing various sources, including classical Islamic texts, previous studies, and references on both Islamic law and Gorontalo's customary traditions. This sociological approach enables an in-depth analysis of how Islamic legal concepts have transformed through their interaction with local customs. The findings reveal that in the realm of ibadah mahdhah—such as ablution (wudu), dry ablution (tayammum), ritual bathing (mandi wajib), prayer (shalat), almsgiving (zakat), fasting (puasa), pilgrimage (hajj), minor pilgrimage (umrah), and animal sacrifice (qurban)—Islamic law has remained stable despite interactions with local traditions. However, in other aspects, such as marriage, inheritance, and certain religious practices—including remembrance of God (zikir), recitation of the Qur'an, the call to prayer (azan), funeral rites, and Friday prayers—changes in their implementation have occurred due to customary influences. This acculturation process has shaped a distinctive pattern in the application of Islamic law, giving rise to two forms of local wisdom: value-based wisdom and the adaptation of Islamic legal practices through customary processes. The contribution of this study lies in its deeper understanding of how Islamic law adapts within a local cultural context. The findings are expected to serve as a foundation for the development of more contextual studies on Islamic law and as a reference for formulating legal policies that remain faithful to Islamic principles while accommodating local wisdo
INTEGRATING QUR'ANIC ETHICS WITH SDGS: A THEMATIC STUDY OF SURAH AL-BAQARAH VERSES 30 AND 275-279
The Qur'an as a guide to life for Muslims offers universal guidance that covers various aspects of life, including economic development and social sustainability. Surah Al-Baqarah verse 30 and verses 275-279 are ethical theological foundations in building governance that is fair, sustainable, and free from economic injustice. The Qur'anic approach to human development is not only normative but also provides practical solutions. The prohibition of usury, the recommendation of zakat, infaq, sadaqah, and human responsibility as khalifah are integral mechanisms to create inclusive and sustainable development. Therefore, this study aims to examine the relationship between the values contained in Surah Al-Baqarah verses 30 and 275-279 with the goals of SDGs by using a thematic interpretation approach. The results show that achieving the SDGs requires the integration of spiritual values, as taught in the Qur'an, to complement technical and economic approaches. Therefore, the Qur'an can be the main reference in addressing various global issues through a holistic approach that incorporates ethics
Systematic Literature Review : Pengaruh Teknologi terhadap Gaya Belajar Matematika Peserta Didik
This study aims to determine the impact of technology use on students’ learning styles in mathematics. The research method employed is a Systematic Literature Review (SLR), collecting data and searching for information using the Publish or Perish 8 application with Google Scholar and Crossref databases within the 2020–2024 timeframe. The Google Scholar database was limited to 100 articles annually, resulting in 467 articles, while the Crossref database yielded 1000. A total of 1467 articles were obtained, then a filter was carried out by adjusting the objectives of the research, and the final result was 18 relevant articles obtained from the filter results using the PRISMA method to see the influence of technology on students who have various learning styles, especially when studying mathematics. The results show that technology enhances the effectiveness of learning for visual, auditory, and kinesthetic learning styles. Applications such as PowerPoint and Quizizz were found to improve learning outcomes for visual learners. Meanwhile, audio-based media like song lyrics and interactive videos are more suitable for auditory learners. GeoGebra and Augmented Reality (AR)-based applications are better suited for kinesthetic learners. Overall, technology that is tailored to students’ needs can significantly increase their motivation and engagement in the learning process
Pengembangan Media Pembelajaran Berbasis Kontekstual Berbantuan Articulate Storyline pada Materi Barisan dan Deret Geometri
This research is based on the low interest and understanding of students in the material on sequences and series, as well as the limited use of interactive learning media that can present real contexts in the learning process. The purpose of this study was to observe the process and results of developing contextual learning media based on Articulate Storyline on the material of geometric sequences and series. This research is a development research with an approach to Thiagarajan's 4D development model which consists of four stages, namely Define, Design, Develop, and Disseminate. The subjects of this research trial were teachers and students of class X of SMA Negeri 5 Banda Aceh. Data was collected through validation sheets, teacher and student practicality sheets. The results of the validation analysis from experts show that the media obtained a validation score of 82.86% which is included in the very valid category, and the validation results by material experts were 75.76% which is included in the valid category. Based on the teacher's practicality sheet, the results obtained were 80.36% (Very Practical) and the results of the validation of the student's practicality sheet that was tested were 81.20% (Very Practical). Based on the overall results of the process of developing contextual learning media on the material of sequences and series assisted by Articulate Storyline, it is stated that it is valid and practical for use in learning activities
Implementasi Pembelajaran Variatif dalam Pendidikan Islam: Solusi Terhadap Tantangan Pemahaman Mahasiswa
Islamic Religious Education is an important component in the formation of character and morals of students in higher education. However, students' understanding of the concept of Islamic religious education still faces various obstacles influenced by the learning methods applied. This study aims to evaluate the implementation of learning methods and their impact on students' understanding of the concept of Islamic Religious Education. The research method uses a qualitative approach with data collection techniques in the form of in-depth interviews with a number of students taking the Islamic Religious Education course. Data analysis was carried out thematically to identify obstacles and the effectiveness of the learning methods used. The results of the study showed variations in students' understanding influenced by the type of learning method, where interactive methods such as group discussions and project-based learning were more effective in increasing understanding than traditional lecture methods. The obstacles encountered included social environmental pressure, lack of practical understanding, limited time management, and the influence of a modern lifestyle that did not support the practice of religious values. The role of lecturers as facilitators and role models is very influential in increasing students' motivation to learn and practice religious values. Therefore, the implementation of varied and contextual learning methods is very important in helping students understand and internalize the concept of Islamic Religious Education. This study emphasizes the need for the development of innovative learning methods and the provision of conducive learning environment support to improve the effectiveness of religious education in higher education
