    A Review of the Fairness of Inheritance Distribution for Boys and Girls in Islamic Law: A Gender Analysis

    The division of inheritance in Islamic law provides different shares between sons and daughters, where sons receive twice the share as daughters. However, this division is considered fair from an Islamic perspective, which views that justice does not always mean mathematical equality, but rather the granting of rights in accordance with the responsibilities and social roles of each individual. In Islamic society, men have a responsibility to provide for the family, so a larger share of inheritance is considered part of their economic responsibility. In contrast, women do not have the same obligations, and therefore, they are given a smaller but sufficient inheritance share to meet their personal needs. This article aims to analyze the principles of justice in the distribution of inheritance according to Islamic law, with a focus on differences in inheritance rights between boys and girls using library research research methods. This discussion will also examine the gender perspective in the distribution of inheritance, by criticizing what this system is. is still relevant to the concept of gender equality developing in modern society. The results of the analysis show that even though this distribution is unequal in number, the principles of Islamic justice still apply by providing rights in accordance with the social and economic obligations of each gender. In the modern context, some contemporary thinkers propose a reinterpretation to create a better balance between social justice and gender equality

    This article was written to examine the influence of psychological factors on ethical decision-making in Islamic educational institutions. The research method used in writing this article is a qualitative method with a descriptive approach. Data collection techniques were carried out through: first, in-depth interviews; second, participant observation and third, documentation. Meanwhile, the data collected through the three techniques above were then checked for validity by checking credibility. By increasing awareness of psychological factors and biases, building emotional management skills, and encouraging collaboration, this module helps educational institutions make more ethical, rational, and sustainable decisions. It also plays a role in creating a healthier organizational culture and improving the quality of well-being of all members of the institution

    Analysis of Marriage Without a Guardian for Former Foreign Migrant Workers from Aikmel District, East Lombok, from the Perspective of Maqashid Syariah

    This study examines the phenomenon of marriage without a guardian among former Indonesian migrant workers (TKI) from Aikmel District, East Lombok, in their respective countries. The research method used was qualitative with a sociological approach. Data were collected through in-depth interviews, focus group discussions (FGDs), and documentation studies with 20 respondents. The research results show that the practice of marriage without a guardian has various typologies, ranging from women marrying themselves, using taklik guardians, guardians of local judges (KUA), to guardians with unclear status. The reasons behind these marriages vary, such as seeking protection, avoiding adultery, gaining peace of mind and offspring, and—in some cases—because of a desire to avenge disappointment and freedom of action. Analysis from the perspective of Maqasid Syariah concludes that some reasons for marriage without a guardian, such as protecting the soul, offspring, and honor (hifzh an-nafs, an-nasl, al-'irdl), are in line with the objectives of sharia. However, reasons based on revenge and the desire for absolute freedom without consideration of sharia are considered outside the maqasid of marriage in Islam, even though they may be considered valid from a fiqh perspective by some schools of thought

    This paper aims to explore the concept of istiṭā‘ah in hajj according to Ibn ‘Āshūr ini his Tafsir al-Taḥrīr wa al-Tanwīr and implementation. This study employs a qualitative approach, specifically library research, utilizing written literature as the primary data source. The findings indicate that Ibn ‘Āshūr’s view Istiṭā‘ah encompasses both physical and financial capabilities Physical capability means that the individual must be in good health and able to undertake the journey for Hajj, while financial capability refers to having sufficient funds without neglecting the basic needs of their family. The implementation of this understanding allows for someone to delegate their Hajj to another person if they are suffering from a severe illness or have passed away. Conversely, performing Hajj is prohibited for those relying on loaned funds or still in debt, as these conditions are considered to not meet the Istiṭā‘ah requirement

    Decolonization of Al-Quran studies is a approach that aims to examine, challenge and overcome interpretations and methodologies that are influenced by the hegemony of knowledge, especially by "Western sciences". Decolonization offers an epistemic idea that is inclusive and egalitarian so that it does not give privilege to a particular way of knowing, a framework like this offers an interpretive discourse that is more open, intersectional, dynamic and equal. This qualitative research aims to elaborate on the idea of ​​decolonization in the study of the Qur'an and compare the ideas of thinkers to highlight the common ground of their thinking while maintaining and explaining existing differences, also emphasize the urgency of decolonization in Qur’anic Studies. So, the method used in this research is comparative analysis. This research concludes that decolonization provides several important meanings in the world of interpretation, such as 1). Equality between knowledges and ways of knowing, 2). Cross-cultural or intersectional studies and 3). Restoring ethical values ​​in knowledge and intensifying community involvement in the interpretation of the Koran. Apart from that, this discourse is still faced with various challenges, such as the potential for the emergence of a new style of essentialism that gives birth to neo-colonialism and resistance from some academic circles who still adhere to the traditional paradigm, feel threatened by changes in the structure of "intellectual power" and do not really care about the context and cultural reality of Islamic thought that continues to develop
