Transformation of Children's Rights After Divorce Outside the Religious Court of Padangsidimpuan City in the Perspective of Maslahah
Divorce is a problem that is quite complicated and very dilemmatic in people's lives. Although Law Number 1 of 1974 was promulgated and enforced 39 years ago, the reality is that the practice of divorce carried out by the husband is not in front of the Religious Court hearing. In Article 39 paragraph (1) of Law N0. 1 of 1974 states that divorce can only be done in front of a competent court after the court concerned has tried and cannot reconcile the two parties. To carry out a divorce, there must be enough reason, that between a man and a woman they will no longer be able to live in harmony as husband and wife. In fact, in the jurisdiction of the Religious Court of Padangsidimpuan City, there are still many who carry out divorces outside the Religious Court. This research method uses a juridical-normative method. The data sources used include primary legal materials, secondary legal materials and tertiary legal materials. After the data is collected, classified and processed, it will be compiled into a scientific paper. The results of this study show that the factors that cause divorce in the Padangsidimpuan City Religious Court are economic factors, community legal knowledge factors, juridical factors, sociological factors, and customary factors (kinship system dalihan na tolu). The mechanism of divorce is carried out by oral talaq, a written statement submitted to the wife, and secretly without anyone knowing it. As a result of the law that arises, the wife has difficulty getting a new marriage through the Religious Affairs Office (KUA), cannot claim living expenses through the Religious Court, it is difficult to get joint property and has a negative impact on the rights of the child who is the victim. Maslahah's view of the transformation of children's rights after divorce is prone to be ignored because the rights to alimony, education, health, and inheritance rights are not fulfilled. The obligation of parents as protectors and guides for children is good. Children do not receive complete affection from their father and mother
The Effectiveness of Implementing the Sorogan Method in Higher Education: A Case Study of the Department of Al-Qur'an and Tafsir Studies
This study explores the dynamics of implementing the sorogan method, a traditional learning approach in pesantren, within the Qur'anic Studies and Tafsir Department at UIN Sunan Kalijaga. The main objective of this implementation is to train and familiarize students with accessing Arabic-language canonical references. Analyzed qualitatively through a case study approach, data were collected through interviews with faculty and students, as well as non-participant direct observations during several lecture sessions. The findings reveal that while this method enhances the personal internalization of understanding, it also faces challenges such as time constraints and difficulty in formulating a format that integrates with the modern curriculum. This study also provides analyses that can serve as considerations and recommendations for optimizing the sorogan method in higher education learning
Tawakkal Concept Theological, Sociological Perspective, and Psychology in the Qur’an
The concept of tawakkal in the Qur’an is often misunderstood as an attitude of surrender without effort, whereas essentially it reflects the integration of human endeavor and dependence on the will of God. Islamic Religious Education (PAI) as an instrument for forming religious character requires an in-depth study of this concept from various perspectives. This study aims to reveal the dimensions of tawakkal in the Qur’an through theological, sociological, and psychological approaches, and to answer the formulation of the problem of how is tawakkal in theological, sociological, and psychological perspectives? The research method used is library research with a qualitative descriptive approach. The main source of this study is the Qur’an, supported by literature on interpretation, Islamic psychology, sociology, and the thoughts of classical and contemporary Islamic figures such as Al-Ghazali, Fazlur Rahman, and Malik Badri. The results of the study show that theologically, tawakkal is a manifestation of monotheism and faith in the power of Allah which brings peace of mind. From a sociological perspective, tawakkal encourages collaboration, social responsibility, and building a resilient society. Meanwhile, from a psychological perspective, tawakkal becomes an effective spiritual coping strategy in improving mental health and emotional stability. The integration of these three perspectives enriches the development of a more holistic and contextual PAI curriculum. Tawakkal is not only a spiritual principle, but also a strategic solution in forming a strong, adaptive, and responsible Muslim personality amidst the challenges of modern life
Gratitude (shukr) and Benevolence (ihsān) to Parents in Tafsir Quraish Shihab: The Relevance of Qur'anic Values for Instant Cultural Generations
This study aims to examine the Qur’anic values of gratitude (shukr) and benevolence (ihsān) toward parents as interpreted by M. Quraish Shihab in his Tafsir al-Misbah, using a thematic exegesis (al-tafsīr al-mawḍū‘ī) approach. The analysis focuses on Surah al-Isrā’ [17]:23–24, which links filial piety (birr al-wālidayn) directly to the principle of monotheism (tawḥīd). By centering the interpretation of Quraish Shihab and contextualizing it within the sociocultural framework of the instant-gratification generation marked by individualism, speed, and emotional detachment. This study is a qualitative study based on library research using the thematic interpretation approach (al-tafsīr al-mawḍū‘ī). The main data were obtained from authoritative interpretation books that were selected purposively because they represent classical and contemporary styles. And applying data triangulation through comparative reading between interpretations and adjustments to empirical findings from sociological and nursing studies on the elderly. This study also adopts the perspective of Jean Watson's Human Caring Theory as an analytical complement to dialogue between Qur'anic values and ethical-spiritual approaches in care. This study explores the contemporary relevance of Qur’anic ethics in strengthening intergenerational ties and elderly care practices. The findings indicate that shukr and ihsān are not merely ethical acts but profound spiritual expressions of faith that must be revitalized in the lived experience of today’s youth. In the context of aging parents, care is viewed as a spiritual devotion that reflects emotional maturity, social responsibility, and personal righteousness. The study also integrates Jean Watson’s Human Caring theory to highlight the compatibility between Islamic spiritual values and holistic caregiving models in modern Muslim families
School Environment Analysis For Effective Learning
An effective learning environment is a context where students can maximize their potential. In this environment, key elements such as interaction between teachers and students, the appropriate use of technology, supportive space design, and relevant curriculum play crucial roles. Skilled teachers who support active learning, motivate students, and build positive relationships can create an environment that fosters both intellectual and emotional growth.The use of technology is a significant component in modern learning environments. Proper integration of technology can enhance students' access to information, provide variation in teaching methods, and facilitate personalized and adaptive learning. Well-designed learning spaces also play a pivotal role. Ergonomic space design, utilization of open areas for collaboration, and provision of adequate resources can create an atmosphere that supports exploration and creativity. Moreover, a relevant curriculum aligned with current needs is also a key factor. A curriculum that blends theory with practical applications, considers the latest developments, and facilitates critical problem-solving can encourage meaningful learning. Overall, an effective learning environment is about creating a stimulating atmosphere that fosters curiosity, supports collaboration, and encourages critical thinking. When all these components are integrated effectively, students can reach their optimal potential in a nurturing and enjoyable learning environment
The Influence of Emotional and Spiritual Intelligence on Students' Honest Behavior
Education is an effort to change an individual's mindset and behavior to mature a person through learning activities aimed at exploring and developing a person's abilities, both intellectually, emotionally, socially, and spiritually. One of the goals of national education is to build character. Honesty is one of the crucial and important aspects of character education. This study aims to determine the influence of emotional and spiritual quotient on students' honest behavior. This research was conducted at MTs Wahid Hasyim 01 Dau in the odd semester of the 2024/2025 academic year. This research uses a quantitative method with a correlational approach. The data collection method in this study uses a questionnaire. The results of this study show: 1). The majority of students' emotional quotient is at the moderate category level, with 71 students or 39.7% having an average score of 75.55. 2). Most of the students' spiritual quotient is at a moderate level, with 69 students or 38.5% having an average score of 75.41. Most of the students' honest behavior falls into the moderate category, with 71 students or 39.7% having an average score of 77.51. 4). There is a simultaneous influence of emotional and spiritual intelligence on honest behavior based on an F-value of 106.213, which is greater than the F-table value of 3.05 with a significance value of 0.000, which is less than 0.05
Mahzab Imams' Views on Breastfeeding Bank Law
In Islamic jurisprudence, there is a difference of opinion among scholars regarding the permissibility of selling breast milk (ASI). The Maliki and Shafi'i schools of thought allow it, while Abu Hanifah forbids it. The scholars who permit the sale argue that breast milk is pure and lawful to consume, so there is no prohibition against selling it. They liken it to the milk of animals, which is generally permissible to sell. On the other hand, Abu Hanifah prohibits the sale of breast milk based on the argument that babies require it, and its sale could lead to exploitation. He reasons that, just as human flesh is forbidden to eat, breast milk should be treated similarly, as it is intrinsically linked to the human body. His stance is based on the analogy (qiyas) that, since human flesh is haram (forbidden) to consume, anything associated with the human body, such as breast milk, should also be considered haram to sell
The story of the Bani Mughirah and Bani Amr as clear evidence of the impact of Riba in socio-economics (Analysis of Asbab al-Nuzul Verses about Riba)
The Qur'an, as the holy scripture, contains teachings for practicing Islam as a religion of rahmatan lil 'alamin (mercy for all worlds). One of these teachings is the prohibition of riba (usury), with the verses concerning riba being among the last legal verses revealed before the passing of the Prophet Muhammad (peace be upon him). These verses are often accompanied by Allah’s warnings. According to the asbab al-nuzul (circumstances of revelation) of Surah Al-Baqarah verses 278 and 279, it is narrated that the Bani Mughirah were significantly affected by riba, leading them to lament, "We are the most miserable people because of riba." On the other hand, Bani Amr felt they could live comfortably by exploiting riba. In Surah Al-Baqarah verse 275, the Qur'an describes those who engage in riba transactions as being akin to a staggering individual. The term "staggering" refers to the condition of those who engage in riba transactions pretending to stand firm when, in reality, they are unstable. The purpose of this study is to explore the concept of riba in the Qur'an and its impact on life by analyzing the asbab al-nuzul of the verses concerning riba. This research employs a descriptive-qualitative method aimed at understanding the concept of riba in the Qur'an and its implications for life. The findings of this study reveal that riba is one of the practices strongly condemned in the Qur'an. This is evident from the frequent association of riba with Allah’s warnings. These warnings are not without reason, as the practice of riba has significant detrimental effects, including moral, psychological, social, and economic harm, as highlighted in one of the narratives related to the asbab al-nuzul of the verses on riba
The Relevance of Ingrid Mattson's Socio-Historical Critical Reasoning to Hadith Contextualization Approaches
The study of Islamic Studies based on the normative laws of the Qur'an and hadith, theoretically its scientific ranks complement each other as the authority of bayan text with a bound level. Contextual interpretation in interpreting the text of the Qur'an and hadith, in addition to the demands of the times for the redaction of the text to be substantive, is also a value of critical reasoning knowledge of the text. Hadith interpretation within the scope of hadith science is part of the conceptual framework of the hermeneutic approach, through contextualization ijtihad. The significance of hermeneutics with contextualization substantially starts from the analysis of the historical context of hadith. Based on the background of the continuing development of hadith studies. This research formulates a main problem formulation, namely how the relevance of Ingrid Mattson's socio-historical criticism reasoning to the Hadith contextualization approach. The purpose of this study is to explore the reasoning of Mattson's socio-historical criticism that is able to interconnect the efforts of contextual ijtihad in hermeneutic theory as enriching the understanding of hadith for modern Muslim communities. The research method used is a qualitative method based on reference sources of books and journals (library research). The focus of the research is Mattson's reasoning of socio-historical criticism in criticizing the text has relevance in the approach of contextualization of hadith. The results of this study found that contextualization is part of the purpose of interpreting the text, so that the ijtihad reasoning of contextualization comes from the analysis of hermeneutic theory
Cleanliness and Comfort Management of As-Sajdah Mosque as an Attraction for the Congregation
This study aims to examine the management of cleanliness and comfort at As-Sajadah Mosque, Baturaja, and its impact on attracting the congregation. Employing a qualitative descriptive approach, this research analyzes the perceptions of mosque-goers regarding cleanliness and comfort, as well as other factors influencing their choice to worship at the mosque. Data collection was conducted through surveys, interviews, observations, and documentation involving both the congregation and mosque administrators. The findings reveal that effective cleanliness and comfort management significantly influence the congregation's willingness to visit and worship at the mosque. Key contributing factors include routine maintenance, the provision of adequate facilities, and efforts to raise awareness among the congregation about maintaining cleanliness. Additionally, the study highlights the strategic location of the mosque, appealing architectural design, well-maintained facilities, and community involvement in mosque activities as pivotal in enhancing its attractiveness. This study concludes that optimal mosque management plays a critical role in improving the quality of worship experiences and fostering a comfortable environment for the congregation. The results are expected to serve as a reference for mosque administrators seeking to implement effective cleanliness and comfort management practices
