    The essence of the rule of law is justice. Justice has many meanings, depending on the perspective. Every country often arise various problems, related to the administration of justice in the realm of law. The concept of justice that have been established in a country is not necessarily better when applied to other countries. However, it is possible to mutual influenced or be integrated between each other thinking about the meaning of justice, particularly those having a universal nature. At the philosophical level, each country has own thoughts of the roots, depending on the basic norms and socio-cultural life of the nation. Thus, about the meaning of justice from the view of philosophy, the proper tools are used is hermeneutic. Search justice in the perspective of hermeneutics in the context of law enforcement should also be framed by the perspective of jurisprudence, in order to obtain the intersection and its implementation easier.     Dalam UUAP (Undang-Undang Administrasi Pemerintahan), penyalahgunaan wewenang merupakan genus yang terdiri dari tiga spesies yang berbeda-beda yakni (1) melampaui wewenang; (2) mencampur-adukan wewenang; (3) bertindak sewenang-wenang. UUAP tidak menjelaskan pengertian penyalahgunaan wewenang, ia hanya mengkualifikasi ke tiga jenis spesies penyalahgunaan wewenang sebagaimana disebut di atas. Dikaitkan dengan kewenangan Peradilan Tata Usaha Negara (Peratun) dalam menguji penyalahgunaan wewenang vide pasal 21 UUAP haruslah dilihat dalam konteks yang terbatas yakni semata dalam aspek pengujian penyalahgunaan wewenang yang menimbulkan kerugian keuangan negara. Pengujian penyalahgunaan wewenang dalam aspek bersifat parsial dan sangat terbatas jika dibandingkan dengan luasnya ruang lingkup dan kompleksitas pengertian penyalahgunaan wewenang dalam hukum administrasi.In the UUAP (Government Administration Law), abuse of authority is a genus consisting of three different species, namely (1) acting beyond authority; (2) mixing up authority; (3) acting arbitrarily. The UUAP does not clarify the definition of abuse of authority; it only classifies it into the three types of abuse of authority as mentioned above. When associated with the authority of the Administrative Court in examining abuse of authority pursuant to Article 21 of the UUAP, it must be seen in a limited context, namely only in the aspect of examination of abuse of authority that results in state financial losses. Examination of abuse of authority in this aspect is partial and very limited compared to the extent of the scope and complexity of the notion of abuse of authority in administrative law

    Lesbian, Gay, Biseksual, dan Transgender sudah menjadi sebuah gerakan berbahaya, akan tetapi belum ada norma hukum yang mengatur tentang perilaku asusila tersebut, Pentingnya sanksi terhadap pelaku zina dan LGBT merupakan bentuk ketegasan negara dalam melindungi moral dan ideologi Nusantara dari faham berbahaya, akan tetapi Mahkamah Konstitusi menolak Permohonan tersebut karena pemidanaan pelaku zina, baik strafsoort maupun strafmaat, dan perilaku asusila lesbian, gay, biseksual, dan transgender memerlukan pembentukan norma baru, sehinggga menjadi Kebijakan hukum pidana (Penal policy). Kewenangan tersebut bukan merupakan kewenangan Mahkamah Konstitusi, akan tetapi menjadi hak Pembentuk Undang-Undang yaitu DPR bersama Presiden. Tulisan ini merupakan Anotasi atas Putusan Mahkamah Konstitusi Nomor 26/PUUXIV/2016 yang memberikan penjelasan kepada masyarakat adanya Quo Vadis Kebijakan hukum pidana (Penal policy) dalam putusan Mahkamah Konstitusi tersebut.Lesbian, Gay, Bisexual, and Transgender are becoming a dangerous movement, yet there is no legal norm governing this immoral behavior. The sanctions importance towards adultery and LGBT perpetrators is a form of state assertiveness in the conservation of the moral and ideology from dangerous movement. Meanwhile, the Constitutional Court rejected the request by the argumentation which is that punishment of adultery, both strafsoort and strafmaat, and Lesbian, Gay, Bisexual, and Transgender needs a new norm to a penal policy. The authority is not the authority of the Constitutional Court, but it is the right of the Acting Legislator, namely the House of Representatives together with the President.     Pemerintah berupaya gencar memberantas penyalahgunaan dan peredaran narkotika di Indonesia yang kerap terjadi dan telah menerobos berbagai lapisan masyarakat. Di institusi TNI, tidak jarang ditemui oknum prajurit TNI terlibat dalam penyalahgunaan narkotika, terlihat dari banyaknya perkara pidana narkotika yang disidangkan di pengadilan militer di beberapa wilayah Indonesia. Sampai saat ini belum ada regulasi khusus dari internal TNI yang mengatur Oditur Militer dalam mengeksekusi terdakwa sesuai perintah putusan untuk melaksanakan rehabilitasi medis dan sosial di rumah sakit yang ditunjuk. Lebih lanjut, belum ditemukan peraturan yang menunjuk rumah sakit milik pemerintah ataupun rumah sakit milik kedinasan di institusi TNI sebagai tempat rehabilitasi medis dan sosial yang dikhususkan bagi Prajurit TNI aktif. Tujuan penelitian ini untuk mengidentifikasi upaya yang bisa dilakukan agar perintah putusan pengadilan untuk melakukan rehabilitasi medis dan sosial dapat terlaksana di lingkungan institusi TNI dan sesuai dengan amanat undang-undang. Penelitian ini menggunakan metode hukum normatif dengan didasarkan pada pengkajian hukum positif. Penelitian ini menggunakan bahan hukum primer berupa undang-undang dan putusan pengadilan, bahan hukum sekunder berupa buku-buku, jurnal, tesis dan lain sebagainya. Pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach) digunakan dalam penelitian ini. Beberapa putusan tingkat kasasi dalam amar putusannya memerintahkan terdakwa (prajurit TNI yang didakwa) untuk melaksanakan rehabilitasi medis dan sosial, hal ini merupakan langkah progresif atau terobosan baru di ranah peradilan militer. Namun demikian, ditemui kendala dalam pelaksanaan eksekusinya. Oleh sebab itu, perlu dibuat regulasi khusus di internal institusi TNI untuk menetapkan rehabilitasi medis dan sosial terhadap prajurit yang terlibat penyalahgunaan/pecandu narkotika. Inisiasi kerja sama institusi TNI dengan beberapa rumah sakit pemerintah dan/atau seluruh rumah sakit milik TNI yang dilengkapi dengan unit rehabilitasi medis dan sosial juga perlu dilakukan.The government has aggressively combat drug abuse and trafficking in Indonesia, which often happens that even had penetrated various layers of the society. This makes narcotics related crime was categorized as an extra ordinary crime, requiring special and ongoing handling. In TNI institutions there were many TNI soldiers involved in narcotics abuse as there are still many narcotic criminal cases being tried in military court in some parts of Indonesia. There is no special regulation within the TNI institution that regulates the Military Oditur to execute the defendant in accordance with the order of the decision to carry out medical and social rehabilitation at the designated hospitals. Furthermore, no regulations have been formulated that assigns state-owned hospitals or government-owned hospitals in TNI institutios as a special medical and social rehabilitation center for TNI soldiers. This study aims to identify measures that can be done in order to command the court\u27s decision can be implemented in the environment and in accordance with the military institution mandated by law. The method used in this study is normative law research based on positive law study. This study uses the primary legal materials in the form of law and court decisions, secondary legal materials in the form of books, journals, theses and so forth. A statute approach and case approach were used in this study. Several judgments of appeal as yudex juris mention in the ruling ordered the defendant (TNI soldiers indicted) to carry out medical and social rehabilitation is a progressive step or a new breakthrough in the realm of military court, although encountered obstacles in the execution. Need to be made in the internal regulation of the military institutions to establish medical and social rehabilitation of the soldiers involved in the abuse / drug addicts. Initiation TNI cooperation with several goverment hospitals or owned hospitals in TNI institutions equipped with medical and social rehabilitation unit also needs to be done

    Munculnya fallacy argumentum ad verecundiam dalam suatu putusan pengadilan merupakan suatu penalaran hukum yang tidak tepat, oleh karena penggunaan otoritas yang tidak dapat dibenarkan berdasarkan Ilmu Hukum, akan berakibat kepada validitas dari amar putusan—yang merupakan konklusi, yang dapat dibatalkan.     Since the verdict of the Constitutional Court (MK) Number 93/PUU-X/2012 pronounced on Thursday, August 29, 2013, concerning the judicial review of Law No. 21 of 2008 on Islamic Banking, it is no longer dualism dispute resolution. The verdict as well as strengthen the jurisdiction of Religious Court to resolve Islamic banking disputes. In consideration of the judges, judges agreed stating that Article 55 paragraph (2) and (3) of Law No. 21 of 2008 which is an ideal norm, contains no constitutional problems. The problem is the explanation of the constitutional article 55 paragraph (2) of the Act. The emergence of the Constitutional Court verdict No. 93/PUU-X/2012 which substantially states that the explanation of Article 55 paragraph (2) of Law No. 21 of 2008 does not have binding force, basically does not violate the principle of freedom of contract which is common in contract law. The parties are allowed to make a dispute resolution agreement out of religious court based on provisions as Act No. 30 of 1999 on Arbitration and Alternative Dispute Resolution.     Penghindaran pajak yang dilakukan dengan skema tertentu oleh wajib pajak badan, dalam hal ini korporasi telah menjadi permasalahan yang sulit diatasi dengan instrumen perundang-undangan yang ada saat ini khususnya melalui ketentuan pidana. Penelitian ini bertujuan menganalisis efektivitas Undang Undang Ketentuan Umum Perpajakan Nomor 6 Tahun 1983 sebagaimana telah diubah berdasarkan Undang Undang Nomor 16 Tahun 2009 (selanjutnya disebut UU KUP), spesifik ketentuan pidananya dalam mengatasi penghindaran pajak oleh wajib pajak badan. Penelitian ini merupakan penelitian hukum normatif, dengan pendekatan kualitatif. Data disajikan secara deskriptif untuk mendapatkan kesimpulan yang terkait setiap pokok penelitian. Hasil penelitian ini menunjukkan masih kurang memadainya perangkat pidana dalam UU KUP, diindikasikan dengan masih tingginya nilai penghindaran pajak oleh wajib pajak badan. Pembinaan wajib pajak sebagai tujuan pidana pajak tidaklah berjalan semestinya, terlihat dari kultur pajak wajib pajak badan yang masih menganggap pajak sebagai beban untuk diefisienkan, mulai dari pelaku usaha, hingga akademisi. Dalam penerapannya, pidana pajakpun diterapkan sesuai unsur subjektif dan objektif ketentuan pidana Pasal 38-39 UU KUP. Namun UU KUP ternyata masih menganut pemidanaan terhadap orang pribadi sebagaimana dianut KUHP/KUHAP tanpa ada penjelasan lebih lanjut, sehingga menjadi masalah dalam penerapannya terhadap korporasi. Namun dengan adanya Perma Nomor 13 Tahun 2016 maka hal itu dapat dilakukan, meskipun bersifat formil. Disisi lain, pidana UU perpajakan meskipun dikatakan menganut asas ultimum remedium namun kenyataannya, ketentuan pidananya masih banyak yang menganut pidana sebagai premium remedium.Tax evasion by the corporate taxpayer has become difficult to overcome with existing legislation instrument especially by criminal law. This research analyzes the effectiveness of Law Number 6 of 1983 on General Provisions of Taxation as amended by Law Number 16 of 2009 (hereinafter UU KUP), Specifically through its criminal provision, against the corporate taxpayer. This research was a normative legal research with qualitative analysis method. The research was presented descriptively in order to draw the conclusion about each subject of the research. The research result showed the inadequate enforcement of UU KUP showing the high indication of the tax evasion by the corporate taxpayer. The control system of the taxpayer through criminal sanction had not run effectively, it was seen by the culture of the corporate taxpayer who still regards taxes as burdens to be addressed, ranging from business actors to academics. Furthermore, the tax crime was applied according to the subjective and objective elements of the criminal regulation Article 38-39 of UU KUP. However, UU KUP holds punishment system against only individuals as a law subject without any further explanation, as adopted by KUHP / KUHAP. Thus becoming a problem in its application to corporations. Nevertheless, with the presence of Supreme Court Regulation Number 13 of 2016, this case could be done, although it is still a formal regulation. On the other hand, the taxation law, though it was said that it held the principle of ultimum remedium, in reality, its criminal provision was still much embraced the crime as the premium remedium
