THE ROLE OF TECHNOLOGY IN ENHANCING A RECOVERER-ORIENTED APPROACH TO THE ENFORCEMENT PROCESS

Recognizing the evolving nature of the enforcement process and the need to prioritize the rights of recoverers, this study explores how technological advancements can be leveraged to facilitate a more efficient and effective enforcement process. By adopting a recoverer-oriented approach, where the focus is on restoring the rights of recoverers rather than solely on the debtor, the enforcement process can align more closely with principles of justice and fairness. The research employs a multidimensional methodology, combining legal analysis, case studies, and comparative assessments of enforcement processes across different jurisdictions. Additionally, technological advancements such as automation, data analytics, and digital platforms are examined for their potential to streamline and optimize the enforcement process. Imigração, Refúgio e Terrorismo na Mídia: Associações, Responsabilizações e Medidas Restritivas
Get PDFNas últimas décadas, as migrações, refúgio e terrorismo ganharam destaque no cenário internacional. Esses termos muitas vezes são entrelaçados e erroneamente atribuídos. Nesse sentido, o objetivo do artigo é analisar através de categorias pré-estabelecidas as possíveis associações negativas, bem como a atribuições de culpa que podem ter sido derivadas em relação aos imigrantes. Para isso, foi utilizado como método de pesquisa a análise de conteúdo de notícias eletrônicas presentes nas versões online de jornais britânicos e norte-americanos no período de 2015 e 2016, além de fontes bibliográficas. O artigo indica a presença de associações negativas em relação aos imigrantes, a atribuição de culpa a imigrantes e governantes e uma possível influência desses aspectos nas medidas restritivas à imigração adotada na Europa e nos Estados Unidos nesse período
Cross-Border cooperation through universities: are educational preferences of students in Belarus similar to those in Lithuania?
Get PDFObjective: The article provides a comparison on educational preferences of student in Belarus and Lithuania. If the educational preferences of students from Belarus and Lithuania are similar, then this contributes to cross-border cooperation between the universities of these two countries. Methods: The reliable research methods that the author used in the study were: literature review, questioning and statistical processing of questionnaires, verification of statistical hypotheses. Results: It was statistically proved that educational preferences in Belarus and Lithuania are similar. This means that student educational preferences in Belarus and Lithuania are in cognitive proximity. The difference must not be taken into account in planning Cross-Border cooperation Belarusian and Lithuanian universities. The results are highly statistically significant (99,0%). In this case, you have a decision-making process with accurate, controlled probability. Conclusion: The difference of the educational preferences of Belarusian and Lithuanian students is not a barrier to the construction of Cross-Border cooperation in the field of higher education. This scientific fact is in a good practical significance for Cross-Border cooperation in higher education. For example, for creation of knowledge networks
O DIREITO AO LIVRE PLANEJAMENTO FAMILIAR E AS INOVAÇÕES LEGISLATIVAS FACE À LEI Nº 9263/1996
Get PDFObjetivo: O artigo representa uma reflexão sobre a evolução do direito ao livre planejamento familiar e da esterilização voluntária no Brasil, destacando os resquícios da ingerência do Estado na esfera individual e o papel do gênero no âmbito reprodutivo. Para mais, tem por objetivo analisar as postulações da Lei nº 9.263/1996 antecedentes à Lei nº 14.443/2022, bem como as inovações impetradas. A pesquisa considera fundamental delimitar o atual cenário dos direitos reprodutivos para, assim, adequá-lo ao patamar constitucional.Metodologia: Adere ao método hipotético-dedutivo, com a aplicação de técnicas de pesquisa bibliográfica e documental, mediante a utilização de livros e de artigos científicos pertinentes à temática, bem como da jurisprudência e da legislação específica sobre o tema.Resultados: O trabalho reconhece a elevada valia das alterações postuladas pela Lei nº 14.443/2022, mas aponta a necessidade da apreciação crítica dos seus verdadeiros efeitos, especialmente no que tange à implementação das balizas legais do direito ao livre planejamento familiar à prática.Contribuição: O texto poderá servir de ponto inicial para estudos relativos aos atualizados requisitos concernentes à Lei de Planejamento Familiar, além de sinalizar a importância da contínua análise acerca de sua efetivação prática.Palavras-chave: Planejamento Familiar; Esterilização Voluntária; Direitos Reprodutivos; Lei nº 9.263/1996; Lei nº 14.443/2022. ABSTRACTObjective: The article represents a reflection on the evolution of the right to free planned parenthood and voluntary sterilization in Brazil, highlighting the remnants of the interference of the State in the individual sphere and the role of gender in the reproductive sphere. Furthermore, it aims to analyze the postulations of Law No. 9.263/96 prior to Law No. 14.443/22, as well as the innovations filed. The research considers it essential to delimit the current scenario of reproductive rights in order to adapt it to the constitutional level.Methodology: It adheres to the hypothetical-deductive method, with the application of bibliographic and documentary research techniques, through the use of books and scientific articles relevant to the theme, as well as jurisprudence and specific legislation on the subject.Results: The paper recognizes the high value of the amendments proposed by Law No. 14,443/2022, but points out the need for critical appreciation of its true effects, especially with regard to the implementation of the legal beacons of the right to free planned parenthood to practice.Contribution: The paper may serve as a starting point for studies related to the updated requirements concerning the Planned Parenthood Law, in addition to signaling the importance of continuous analysis of its practical implementation.Keywords: Planned Parenthood; Voluntary Sterilization; Reproductive Rights; Gender; Law No. 9.263/96; Law No. 14.443/22
DEMOCRACIA DIGITAL: O USO DA INTERNET NO FORTALECIMENTO DA DEMOCRACIA PARTICIPATIVA NO BRASIL
Get PDFO presente artigo tem por finalidade analisar em que medida os espaços tecnológico-virtuais, proporcionados pelo uso da internet, favorecem ampliação dos espaços públicos de debate e o fortalecimento do exercício da democracia participativa no cenário brasileiro. Para tanto, utilizando-se da pesquisa qualitativa exploratória e do método dedutivo, serão inicialmente abordados os reflexos da revolução tecnológica, na formação da sociedade da informação, e o surgimento de uma nova concepção de democracia: a democracia digital. Na sequência, pretende-se demonstrar a instrumentalidade da incorporação da internet no jogo democrático e, em adição, examinar experiências e estratégias de participação popular democrática nos espaços virtuais, por meio do uso hashtags e plataformas colaborativas. Ao final, verificou-se o efetivo potencial da internet no desenvolvimento e consolidação da democracia participativa brasileira, através de uma nova camada de expressão da democracia tradicional, que utiliza a internet como ferramenta de remoção de obstáculos à ampliação da participação popular na condução do interesse público e coletivo, criando, portanto, um novo palco de participação política aberto, plural e acessível, onde os espaços virtuais são considerados a nova ágora do século XXI
AGENT-BASED MODELING IN MULTI-LEVEL INDUSTRIAL ECOSYSTEMS DEVELOPMENT
Get PDFIn industrial ecosystems development, there are currently trends towards deepening vertical and horizontal integration within the innovation processes framework. They entail approaches complication to management functions implementation. Management and development problems solutions in multi-level industrial ecosystems becomes particularly relevant. The study’s purpose is to formulate possible approach to such problems solving that can increase management decision-making efficiency. The work proposes simultaneous agent-based modeling and multi-level digital twins use in order to simulate economic processes. The study proposes multi-level industrial systems conceptual scheme for an agent-based modeling, taking into account its’ vertically hierarchical structure. The proposed model identifies four levels (with their own agents), differing in the nature of the tasks being solved, the responsibility area, organizational and economic mechanisms used. It is proposed to base the model on economic and mathematical tools, in particular computer modeling methods, creating digital twins specifically. Digital twins are used to analyze production chains, assess internal and external factors effect, develop alternatives and select most preferable solutions to emerge management problems. At the same time, it was determined that digital twins structure should be multi-layered, where each subsequent level incorporates digital twins developed on the previous one, endowed with implemented functions certain set. It is substantiated that one of the important tasks is to determine industrial ecosystem digital twin managerial layer optimal configuration. This layer is responsible for modeling the organizational and managerial component and is built on needs to achieve financial and economic activity target indicators. MODELING OF SUSTAINABLE DEVELOPMENT PROCESSES OF ENTREPRENEURIAL ECOSYSTEM IN THE CONTEXT OF BIOLOGICAL THREATS BASED ON THE EXAMPLE OF YUGRA
Get PDFObjective: This article presents a comprehensive model for assessing the resilience of regional business ecosystems with a specific focus on the Khanty-Mansiysk Autonomous Region (Yugra), Russia. Methods: The study incorporates various parameters to evaluate the resilience and development potential of the entrepreneurial environment in the face of biological threats, such as the COVID-19 pandemic. Methodologically, the authors use a multi-stage calculation process normalizing regional indicators and assessing them relative to the maximum values for the Russian Federation. Results: The outcomes indicate that the entrepreneurial ecosystem of Yugra is currently at a satisfactory level of sustainability. However, critical areas for further improvement include developing networks, talent and knowledge acquisition, developing leadership skills, and adopting Industry 4.0 technologies. Conclusion: The present research provides valuable insights into the specific challenges and opportunities facing regional business ecosystems in the context of biological crises and emphasizes the importance of addressing these challenges to enhance economic resilience and growth. The implications of this study underscore the need for targeted interventions to bolster Yugra's entrepreneurial ecosystem. Strategies should focus on enhancing networking, nurturing local talents, promoting innovation, and facilitating the adoption of advanced technologies. By addressing these critical areas, regional authorities and stakeholders can better position Yugra to thrive in the face of future biological threats and foster sustainable economic development
GUARANTEES TO ENSURE THE RIGHTS, FREEDOMS AND LEGITIMATE INTERESTS OF PERSONS IN PLACES OF DETENTION
Get PDFObjective: The object of the article is theoretical and practical aspects of ensuring the rights, freedoms and legitimate interests of persons held in places of detention, taking into account current legislation and regulatory requirements of the European Union.Methods: The research was conducted using the methodology of systematic comprehensive analysis of legal phenomena, and the factor and evolutionary approaches were applied.Results: The study examines the guarantees of the rights, freedoms and legitimate interests of persons in places of detention, as well as the methods of exercising the rights, freedoms and legitimate interests of detainees and administratively arrested persons. The article also highlights the content of legal regulation, including internal regulations, provision of medical and legal assistance, and ensuring sanitary and hygienic standards in places of detention in the institutions of the Ministry of Internal Affairs of Ukraine. The author emphasises the importance of supervision and control to ensure the exercise of the rights of detained and arrested persons.Conclusion: The relevance of this topic is explained by the need to improve legislation in order to ensure more effective exercise of the rights and legitimate interests of persons in places of detention. The rights, freedoms and legitimate interests of detainees and administratively arrested persons are determined by the Constitution of Ukraine, laws, orders of the Cabinet of Ministers of Ukraine and internal regulations. One of the aspects of the activities of the administration of places of detention is to ensure the exercise of the rights of this category of citizens and stateless persons. The author also examines the peculiarities of legal implementation of the rights and legitimate interests of persons held in places of forced detention by public administration bodies. The methods of exercising the rights, freedoms and legitimate interests of persons in places of forced detention are investigated. The author also highlights the content of legal regulation, including internal regulations, provision of medical and legal assistance, and ensuring sanitary and hygienic standards in places of detention in the institutions of the Ministry of Internal Affairs of Ukraine. DIREITO ÀS ATIVIDADES FÍSICAS E ESPORTIVAS DE PESSOAS TRANS E OS NÚCLEOS DE ESPORTE E LAZER DOS CENTROS EDUCACIONAIS UNIFICADOS (CEUS) DE SÃO PAULO
Get PDFPessoas transexuais, aquelas que não se identificam e não se sentem pertencentes ao seu sexo anatômico ou biológico de origem, sofrem preconceito, discriminação e diversas formas de violência, além da violação de direitos fundamentais e constitucionais. O direito ao esporte abrange não apenas o acesso equitativo às atividades físicas, mas também a inclusão de todas as identidades de gênero em condições que respeitem suas especificidades. Este artigo propõe reflexões sobre o direito de pessoas trans às atividades físicas e esportivas dos Núcleos de Esporte e Lazer (NELs), dos Centros Educacionais Unificados (CEUs) de São Paulo, a partir da análise de políticas públicas, decretos e demais documentos históricos que regem as atividades desenvolvidas por esse equipamento público, assim como, com base em resultados de pesquisa realizada com profissionais de educação física que atuam em CEUs do Município, em relação à transexualidade e à sua atuação junto a essas pessoas. Trata-se de um estudo de caso, desenvolvido por meio de análise documental e aplicação de questionários online, enviados por email aos Analistas de Informação, Cultura e Desporto e aos Coordenadores de Esportes, todos profissionais da Educação Física dos NELs, dos 46 CEUs da Rede Direta de Ensino da cidade de São Paulo. A análise dos documentos e dos questionários evidenciou que, apesar das pessoas transexuais terem o direito de frequentar com segurança as atividades destes NELs, e de serem respeitadas, há ainda situações de desconhecimento, preconceito, falta de orientação, inadequações de infraestrutura e tabus a serem rompidos quanto aos aspectos biológicos e fisiológicos relacionados às pessoas trans. Portanto, dificuldades por parte de profissionais de educação física que atuam nos CEUs precisam ser enfrentadas, especialmente com processos de formação continuada, assim como há necessidade de melhorias na infraestrutura local, por exemplo, adequações em banheiros, para atender com maior dignidade pessoas transexuais e toda população.
CHARACTERISTICS OF INFORMATION SUPPORT FOR STATE POLICY IN THE FIELD OF HIGHER EDUCATION IN THE RUSSIAN FEDERATION ON SOCIAL MEDIA
Get PDFObjective: The article presents an investigation into the implementation of information support for state policy in the field of higher education in the Russian Federation. The relevance of the problem is determined by the specificity of the powers imposed on state bodies, which have recently undergone a series of changes. The study aims to test the congruence between the responsibilities assigned to the Ministry of Science and Higher Education of the Russian Federation (as a key player in this policy) and the information policy it carries out. Method: The research method includes a content analysis of materials posted on the main media resources of the Ministry. Results and Conclusion: The conducted content analysis shows that the information support of state policy in the field of higher education in the Russian Federation on social media carried out by the Ministry as the key subject partially corresponds to the assigned responsibilities. However, the content posted can only indicate formal management of social networks without recognition of their social significance. Therefore, while the Ministry's presence in the social media landscape aligns with its responsibilities, the content it shares could be seen as lacking in substantial social impact
