The Wife in Family Caregiving : Her Gratuitousness and Inheritance Issues
Get PDFapplication/pdf本稿は、義親の介護を担う「介護嫁」の孕む問題を、以下の二点に焦点をあて論じる。一つは、厚生労働省などの公的データーに依拠し、「誰に介護を希望するか」の期待値と「誰が実際には介護を担っているか」の現実値のギャップが「嫁」についてはいかに大きいかを捉え、それを介護労働の無償性との関連で考察する。いま一つは、相対的に高齢な「介護嫁」は夫に代わって義親を介護する事を自明視する心性を内面化しながらも、親身にまた長きにわたり介護者となっても、法定相続人にはなれないとの法の孕む問題を考える。法律レベルでは、「嫁」の介護労働の無償性に対し、いくつかの救済の道が用意されている。例えば、遺言や生前贈与あるいは養子縁組をし法定相続人になることで、嫁の介護に対する財産的保障を担保したり、また「嫁」に介護を丸投げしてきた義理の兄弟姉妹に遺産相続がなされる場合、彼らに不当利得返還請求を行う事などがあげられる。だが、法律が想定する人間類型は、明確な権利主体として自己決定しうる自立した人間を前提としている。権利を行使しないのは、その人間の自立心のなさゆえであるとの見方を「介護嫁」にあてはめることの過酷さを考えたい。This paper discusses issues involving the wife, who is responsible for caring for her parent-in-law, with a focus on the following two points. One is that, relying on publicly available data from the Ministry of Health, Labour and Welfare and other sources, it can be seen how large of a gap there is in regard to the wife between the expectation value as to who the parent-in-law hopes will be the caregiver and the reality value as to who assumes the caregiver role, which is examined in relation to the gratuitous nature of caregiving labor. The other considers an issue involving the law which is that the caregiving wife is not able to become an heir even if she is warm and loving or has been a long-term caregiver, despite her internalization of a mentality which views as obvious that fact the wife is to care for her parents-in-law in lieu of her husband. At the legal level, several paths for relief are available in relation to the gratuitousness of the wife's caregiving labor. For instance, among some of the legal options available, the wife may become a legal heir through a will, an inter vivos gift, or adoption to secure the guarantee of property for the wife's caregiving, or, if the property is succeeded to the wife's brothers-in-law and sisters-in-law who have left all the caregiving to the wife, the wife may present a claim for unjust enrichment. Nevertheless, the type of human being envisioned by the law is premised on an independent person able to make his or her own decisions as a distinct person sui juris. This paper would like to consider the harshness of applying to the caregiving wife the view that not exercising one' s rights is due to lack of the person's sense of self-reliance.論文(Article)departmental bulletin pape

Get PDFapplication/pdf貧しさの中で育つ－とりわけ社会的、文化的、教育的に刷り込まれた貧しさの中で－ということは、発達リスクを被る可能性を意味する。このリスクは、社会から代償として要求される発達課題を克服する過程で、子どもたちに悪影響を与える。全体として、経済的欠乏状態が文化的・社会的資本の獲得に及ぼす影響により、貧困の固定化が促される。同時に家庭内の社会的・文化的資源が、現在の貧困を克服するためにも、将来の生活における参加機会を分配するためにも、決定的に重要になってくる。本稿は、そうした観点から豊かな国ドイツにおける子どもの貧困について、その長期にわたる影響メカニズムを考察した。Growing up in poverty, especially in socially culturally and educationally imprinted poverty means the possibility to have developmental risks. These risks adversely affect children in the process of overcoming the developmental problems that society imposes them. As a whole, what economical need influences one, when gaining cultural and social capital, accelerates to settle the poverty. At the same time, domestic social and cultural resources are critically important to overcome the current poverty and to distribute the opportunities to participate in the future life. Estimation of Income Distribution Function for Grouped
Get PDFapplication/pdfIn the estimation of income distribution with grouped data, It is difficult for existing meth ods to estimate the density function without values of bounds. In this article, we show a method to estimate income distribution function for grouped data without those bounds. The bounds are explained by some function, and the parameters of that function and income dis tribution function are estimated all together. The frequencies, class means, and distribution function calculated by the method fit well with the values of real data.
