    A study on the children's rights advocacy function in children's homes

    application/pdf論文(Article)This paper investigated the children's rights advocacy function in children's homes in the Japanese system. First, I reviewed previous research and redefined the rights advocacy function. Based on the redefinition, I examined the Child Welfare Law, Child Guidance Center Management Guideline and Children's Home Management Guideline. In addition, I examined whether the right to be heard is exercised effectively in children's homes and in external organizations of children's homes. The results revealed that there was insufficient understanding of the rights advocacy function in the law and management guidelines. There were no external organizations acting exclusively on the children's behalf. On the basis of the results, I provided the following suggestions for developing the children's rights advocacy function in Japan. Ombudsmen of citizens, such as those in the Shonan welfare network Ombudsman, should visit where the children live. Third-party committees without being appointed by the children's home managers, trained to understand advocacy roles, should work as children's advocates.departmental bulletin pape

    application/pdf論文(Article)The hedge fund industry is one of the fastest growing sectors in finance market, due to limited regulatory oversight, flexible investment strategies, and performance-based fee structures. The rapidly growth of this industry has captured the attention of both academics and practitioners. Hedge funds held about 47 per cent of the $3 trillion worth of CDOs on the eve of the financial crisis. Hedge funds and other financial institutions suffered huge losses in the global financial crisis, because the price of securitized products such as CDOs plummeted to the ground when the crisis happened.     On the ethics in the Bhagavad-Gītā : focusing on the examples of "saṃnyāsa" and "tyāga"

    application/pdf論文(Article)Three ethical principles are found in the Mahābhārata, an epic Sanskrit poem from India. The first is the act of affirmation and the second is the act of denial. The third principle retains the characteristics of the preceding two in that the act of denial is kept in mind when executing an act. The third principle is found in the Bhagavad-Gītā, the 6th volume of the Mahābhārata. In this paper, examples of the usage of the words "saṃnyāsa" (renunciation) and "tyāga" (abandonment) which represent the spirit of the act of denial were investigated by using an index and collecting them from the text. In conducting this study, those examples were classified by cross-referencing the main viewpoints which distinguish those ethical principles to the contents of the act, how to act, and the state reached by the act. Renunciation and abandonment are related to how one acts. Concerning how to act, the objective and the way of renunciation and abandonment are important. The objects of renunciation are "karman" (act) and "saṃkalpa" (will) and the objects of abandonment are "saṅga" (adherence), "karma-phala" (result of the act), "kāma" (desire), "krodha" (anger), "lobha" (covetousness), and others. These objects are the effects resulting from the three guṇas (sattva, tamas, and in particular, rajas) that constitute the prakṛti, the origin of all material things in the universe. The act also results from the guṇas of prakṛti. Therefore, the way of renunciation and abandonment of the effects from these guṇas is called the way of Yoga. It is reasoned that the state attained by taking action can be explained as, "The act is not done even if one does the act. " This kind of mental detachment enables one to avoid karma even while continuing to physically act. This is because the state is separate from the effect of guṇas.departmental bulletin pape
