Get PDF自動車損害賠償保障法（自賠法） 16条1項に基づき、被害者が保険会社に対し損害賠償額の支払を求める訴訟において、裁判所は、最判平成18年3月30日民集60巻3号1242頁を依拠して、自賠責支払基準の「重過失減額規定」に拘束されずに、被害者の過失割合をそのまま過失相殺率として適用し損害賠償額の算定を行っている。訴外において、たとえば自動車相互間事故の死亡被害者のケースでは、通常、相手加入の自賠責からか自身が被保険者となる自損事故保険（人身傷害保険の付帯以外）のいずれかから1500万円の支払いを受けられる。しかし、訴訟になると、裁判所が上述の算定を行うことから、自賠責では、1500万円を大きく下回る賠償額の支払が行われる可能性が高い。人身傷害保険の普及に伴い、自損事故保険の付帯率が縮小しており、現状、自損事故保険を巡る問題について、注目度が低くなっている。しかし、本稿では、改めて、裁判所の支払基準非拘束性判断の結果生じている「被害者保護」に倖る問題を指摘し、その解決策の一つとして、自賠責制度を補完する目的で創設された自損事故保険の支払要件の緩和の提言を行うものである。論文(Article)departmental bulletin pape
