A study of the educational significance of modeling expression in the new kindergarten teaching procedures area "Expression"
Get PDFapplication/pdf新幼稚園教育要領が平成29年に告示され、平成30年に施行された。領域「表現」の造形表現においても保育の質的改善が求められている。本稿では、幼稚園教員の免許を修得する学生への指導を目的として、今回の改訂の趣旨やこれまでの実践例を踏まえ、幼稚園と連携してきた小学校教員としての経験を生かし、また本学での授業を振り返りながら、新幼稚園教育要領に則した領域「表現」における造形表現はどうあればよいか考察することとした。最終的に本学の授業科目｢保育指導法(表現Ⅱ)」の授業構想を提示したいと考える。考察に当たっては、領域「表現」の変更点､幼稚園教育要領及び幼児造形の変遷、小学校における「造形遊び」との関連などの視点からアプローチを行った。The new kindergarten teaching procedures was announced in 2017 and came into effect in 2018. There is also a need to improve the quality of childcare in the modeling expression of the area "expression". In this paper, first, for the purpose of instructing students who have acquired a license for kindergarten teachers, based on the purpose of this revision and practical examples so far, we will make use of our experience as an elementary school teacher who has collaborated with kindergarten, and also teach at our university. While looking back on, I decided to consider what the modeling expression should be in the area "expression" in accordance with the new kindergarten teaching procedures. Finally, I would like to present the lesson concept of the lesson subject "Childcare Teaching Method (Expression Ⅱ) of our university. In considering this, I approached from the viewpoints of changes in the area "expression", changes in kindergarten teaching procedures and infant modeling, and I also approached from the relationship with "modeling play" in elementary schools.論文(Article)departmental bulletin pape
An Investigation into Shintaro Okuno's Literary Criticism of Chinese Traditional Opera
Get PDFapplication/pdfChinese Xiqu (traditional opera) was first analyzed by Chinese scholar Guowei Wang in the 1913 monograph "A History of Song and Yuan Drama. " Having aroused great interest in this academic field,Japanese scholar Masaru Aoki also achieved academic renown and both their seminal works have been highly cited. Based on results proposed by Wang and Aoki, Shintaro Okuno's analysis was also highly evaluated for raising unique points. This current study compared and analyzed "From Reading Opera to Theater Going Experience", "From Research Period Opera to Found Opera's Generation and its Extension Process", "Opera structure and Character Anaiysis", and other works. Estimation of arson involving the insured person in fire insurance
Get PDF最判平成13年4月20日判時1751号171頁は、自殺か事故かについて争われた傷害保険死亡保険金の請求事案に対し、「各約款に基づき、保険者に対して死亡保険金の支払を請求する者は、発生した事故が偶然な事故であることについて主張、立証すべき責任を負うものと解するのが相当である」と判示した。
これに対し、最判平成16年12月13日民集58巻9号2419頁は、店舗総合保険契約に基づいて、火災を原因とする保険金の支払請求事案について、商法や約款規定より上記最判平成13年が射程しないとの判断のもと、「保険金の請求者（被保険者）が火災の発生によって損害を被ったことさえ立証すれば、火災発生が偶然のものであることを立証しなくても保険金の支払を受けられることとする趣旨のものと解される」と判示した。
上記最判平成13年において、保険金請求者に傷害保険事故の偶然性の主張立証責任を負わせた理由として、モラルリスク排除の観点が強調されたが、上記最判平成16年は、その点についての判断が見られない。しかし、火災事故においても手口が巧妙な偽装放火も数多くあり、保険者が被保険者関与の放火を立証することは困難性を伴うものである。
そこで、火災保険においては、モラルリスクを排除するためには、保険者は正攻法としての被保険者の故意招致の立証を行う必要があるが、本稿では、保険契約におけるモラルリスクの持つ相互的な意味を踏まえたうえで、火災保険における被保険者関与の放火の推認について考察することを課題としたい。論文(Article)departmental bulletin pape

Get PDFapplication/pdf東京高判平成19年2月28日金融・商事判例1322号45頁は、弁護士賠償責任保険の被保険者である弁護士が受任して遂行した業務に起因して顧客から損害賠償請求訴訟を提起され、自ら訴訟活動を行い勝訴した後、同保険の保険者に対し、弁護士報酬相当の保険金の支払いを求めた保険金請求訴訟事案である。
原審は本件請求を棄却し、控訴審においても、同保険が填補する損害の範囲としての弁護士報酬とは、被保険者である弁護士が他の弁護士に実際に弁護士報酬を支払うことになった場合を指し、被保険者が自己に対して提起された損害賠償訴訟において自ら代理人として訴訟を追行した場合はこれに該当しないと判示された。
本稿では、弁護士賠償責任保険の争訟費用について争われた最近の裁判例を確認したうえで、上記東京高判平成19年において、被保険者である弁護士が自ら訴訟遂行した場合の弁護士費用の請求の可否について考察を加えることを課題としたい。論文(Article)departmental bulletin pape
