Classification Of Mediators In The Practice Of Penal Mediation With A Restorative Justice Approach After A Traffic Accident
Traffic accidents are a disturbing problem for road users, can cause material and immaterial losses, and are one of the criminal cases that can be resolved through mediation. Penal mediation is a way of handling criminal case disputes involving victims and perpetrators, as well as third parties, namely mediators, without eliminating the principles of restorative justice. The research objective in this article is to examine how mediators are classified based on their role in post-accident criminal mediation mechanisms and examine the juridical basis for implementing criminal mediation in handling traffic disputes. This article uses a juridical-normative research method with a statutory and conceptual approach. The results of this study are, first, that the principle of restorative justice contained in penal mediation has been carried out by the police using the right of discretion contained in the Letter of the Chief of Police Number Pol: B/3022/XII/2009/SDEOPS dated 12/14/2009 concerning handling cases through alternative dispute resolution (ADR). Second, there is no explicit regulation governing penal mediation, but implicitly it has been regulated in Article 1, Number 7, of Law No. 11 of 2012 concerning Juvenile Justice, which is better known as diversion
Cyber Notary Dalam Pembuatan Akta
This study aims to analyze the implementation of cyber notary services in Makassar City and to analyze the inhibiting factors for implementing cyber notary services in making deed in Makassar City. This research is an empirical research type, the location of this research was conducted in Makassar City, South Sulawesi Province. The results of the study show that the application of cyber notary services to date has not had a notary in Makassar City who has made a notary deed using the cyber notary system because a notary does not have the authority granted by law to make it. The authority granted by UUJN is limited to the authority to certify transaction activities between notaries and appearers, including data collection. But not for the Notary's authority as a whole, namely the preparation of authentic deeds or the making of authentic deeds. The existence of legal implications for the delay in implementing cyber notary services is due to the ambiguity of norms (inconsistency) regarding Article 16 paragraph (1) letter m UUJNP 2014 with Article 15 paragraph (3) UUJNP 2014 which has implications for the implementation of a notary's authority such as the application of cyber notary in making deed authentic. Including the existence of several existing laws, namely: Article 1 paragraph (7) UUJN; Article 16 paragraph (1) letter m UUJN; Article 1868 Civil Code; and Article 5 paragraph (4) of the ITE Law which has legal implications for delays in the implementation of cyber notary services. So that if a notary insists on making an authentic deed in a cyber notary way, it will result in the degradation of the authentic deed into an underhanded deed

Peraturan di Tingkat Desa Legal?
Villages are stated to be the smallest government structure in Indonesia. A village is an area that has certain boundaries, as a legal community unit that has the right to regulate and manage the affairs of local communities based on their origins. Apart from that, the village government also has the authority to determine legislative products mentioned in village regulations. However, this form of legal regulation is not included in the hierarchy of legal regulations in Indonesia, and in practice it is rarely known by the public. Therefore, this research will focus on identifying the legality of the position of regulations in villages as part of the national legal and regulatory framework. The research method used is a normative legal research method which discusses the position and legality of regulations in the village based on applicable laws and regulations as primary legal material. Apart from that, the discussion is also complemented by secondary legal materials in the form of books and articles published in journals based on theories, concepts, as well as legal principles and adages. The research results show that the village government is the smallest unit in the government system in Indonesia. The village government, like other governments in the region, has the authority to regulate and manage its government affairs autonomously based on the division of affairs and rights according to the origins of the village. Regarding this authority, the village government has the authority to form village regulations and village head regulations. The status and legitimacy of village regulations and village head regulations are recognized as statutory regulations and have binding legal force as long as they are formed based on higher statutory regulations or based on their authority over the village's original rights
Indonesia Sebagai Anggota International Centre For Settlement Of Investment Disputes
International Centre For Settlement Of Investment Disputes (ICSID) is an effort to settle investment disputes by means of arbitration. This institution aim to create a just, effective, and fair treatment towards both contracting parties which are (a) investor from another state and (b) host state. As dispute might rise within an investment contract, Indonesia believes that by joining ICSID, the investors will be given the ultimate protection of unfair treatment from Indonesia. This is due to the fact that investors are allowed to bring such dispute into the arbitration of ICSID, should a violation is being conducted. Even if the intention of Indonesia to join ICSID was made in good faith, many violations of the investor’s responsibility result in many cases of ICSID. Moreover, ICSID’s claim to solve a dispute with effective, and fair treatment towards both contracting parties are at stake, considering there are a lot of cases that require more than 10 (ten) years to be settled. Therefore, many people are expressing their concern of Indonesia’s status as one of the ICSID member. The method of  this research is based on a Case Based Approach and considered as a normative legal research as it’s type in order to answer the research question regarding Indonesia’s status as an ICSID member.Â
