Bienes culturales e “interest analysis”: Una victoria para España ante los tribunales de California (Cassirer v Thyssen-Bornemisza Collection Fund)
This article discusses a court decision which may put an end to a long and complex case dealing with the application of the “comparative impairment approach” and with the choice between state and federal conflict of law norms. This case is also very relevant in the ongoing struggle before American courts, to recover works of art expropriated by the Nazis and which may be found outside the United States.Este artículo comenta una sentencia que puede poner fin a un largo y complejo litigio que trata de la aplicación de la teoría de la ponderación de intereses en conflicto – “comparative impairment approach” – en materia de conflicto de leyes. También trata de la elección entre las normas de conflicto federales, o estatales. Este litigio es también muy relevante para la actual batalla que tiene lugar ante los tribunales norteamericanos, para recuperar obras de artes expropiadas por los Nazis y que se encuentran fuera de los Estados Unidos

Divorcio internacional y residencia habitual de los cónyuges. El artículo 3 del Reglamento Bruselas II-ter
This article analyzes one of the most relevant heads of international jurisdiction in the field of matrimonial matters included in art. 3 Brussels II-ter. This legal provision covers seven different grounds of international jurisdiction applicable with regard to legal separation, annulment of marriage and divorce. Specifically, the study focuses on the habitual residence of the spouses at the time the action is brought and its application in Spain. Hence, when both spouses have their habitual residence in Spain at that time, the determination of the international jurisdiction of the Spanish courts in divorce proceedings is always governed by the Brussels II-ter Regulation and never by the Spanish private international law, irrespective of the nationality of the spouses.Este artículo analiza uno de los foros más relevantes en materia matrimonial recogidos en el art. 3 RB II-ter, donde se contemplan siete foros distintos de competencia judicial internacional aplicables a los litigios internacionales de separación, nulidad y divorcio. En concreto, el estudio se centra en el foro de la residencia habitual de los cónyuges y las consecuencias que se derivan de su aplicación en España. De este modo, cuando ambos cónyuges tienen su residencia habitual en España, la determinación de la competencia internacional de los tribunales españoles en procesos de divorcio se rige, siempre, por el Reglamento Bruselas II-ter y nunca por la LOPJ, sea cual sea la nacionalidad de los cónyuges
Derecho a indemnización en materia de datos personales: aspectos internacionales
The recent judgments of the Court of Justice on Article 82 GDPR provide insight into the requirements of this right to compensation. They are also illustrative of the limits of the GDPR as an instrument of harmonization, e.g. as regards the assessment of the amount of compensation. This contribution addresses the specific elements of uncertainty that arise with regard to compensation claims in cross-border situations. The significance of the provisions on jurisdiction of Article 79 GDPR and their interplay with other rules are discussed. In addition, the contribution addresses the complex choice of law issues that arise in connection to the limits of the harmonization brought about by the GDPR in this area.Las recientes sentencias del Tribunal de Justicia sobre el artículo 82 RGPD permiten conocer los requisitos del derecho de indemnización que esa norma establece. Además, resultan ilustrativas de los límites del RGPD como instrumento de unificación, por ejemplo, en lo relativo a la cuantificación de los daños. Esta contribución aborda los elementos específicos de incertidumbre que se manifiestan con respecto al ejercicio de estas acciones de indemnización en situaciones transfronterizas. Se analiza el significado en relación con tales acciones de los fueros especiales de competencia del artículo 79 RGPD y su interacción con otras reglas. Además, se abordan las implicaciones en materia de Derecho aplicable de los límites de la unificación llevada a cabo por el RGPD en este ámbito
Algunas reflexiones sobre la evolución del Derecho internacional de la sostenibilidad
This contribution involves a reflection on the notion of sustainability and its relevance for the international order. As it is an indeterminate notion, it is relevant to approach it in order to see to what extent it is reflected in general and particular legal obligations and whether it is possible to speak of an international law of sustainability. In any case, the current geopolitical and economic context is not very positive, nor is the crisis of multilateralism and international institutions in an international law in transition.Esta contribución supone una reflexión sobre la noción de sostenibilidad y su relevancia para el orden internacional. Al ser una noción indeterminada es relevante acercarse a la misma con la finalidad de ver en que medida se refleja en obligaciones jurídicas generales y particulares y si cabe hablar de un derecho internacional de la sostenibilidad. En todo caso el contexto actual geopolítico y económico no es muy positivo, como tampoco lo es la crisis del multilateralismo y de las instituciones internacionales en un derecho internacional en transición
Reflexiones en torno a una eventual codificación del Derecho internacional privado europeo
The paper analyses a possible codification of European private international law on the basis of its incompleteness. Four types of gaps are identified and it is found that incompleteness is a structural feature and not a transitory situation, which leads to the exploration of a renewed version of a “code” in order to improve access to law by rationalising and systematising the sources.El trabajo analiza las posibilidades de una eventual codificación del Derecho internacional privado europeo partiendo de su carácter incompleto. Se identifican cuatro tipos de lagunas y se constata que el carácter incompleto es una característica estructural y no una situación transitoria lo que conduce a explorar una versión renovada de “código” para mejorar el acceso al Derecho mediante una racionalización y sistematización de las fuentes
Attuazione delle sentenze della Corte EDU e tenuta del giudicato civile in Italia
While the Italian legal system has long provided for the possibility of removing the prejudicial effects of criminal law decisions adopted in violation of human rights, the introduction of a ground for revoking a civil judgment for contravention of the ECHR is more recent. Nonetheless, the new revocation mechanism has a particularly narrow scope of application, so that, in many cases, it is still not possible to reopen national proceedings even though a ruling from the European Court of Human Rights (ECtHR) has finally established the incompatibility of the civil judgment in question with the human rights protected by the ECHR. This study investigates the possible existence of an obligation to reopen domestic civil proceedings as a consequence of the obligation to abide by the judgments of the ECtHR under Article 46 ECHR, considered in light of the rules on State responsibility for international wrongful acts.Se l’ordinamento italiano prevede da tempo la possibilità di rimuovere gli effetti pregiudizievoli delle decisioni penali di condanna adottate in violazione dei diritti umani, più recente è l’introduzione di un motivo di revocazione della sentenza civile per contrasto con la CEDU. Il nuovo meccanismo revocatorio presenta, tuttavia, un ambito di applicazione particolarmente ristretto, cosicché, in molti casi, non è ancora possibile ottenere la riapertura del procedimento nazionale sebbene una sentenza della Corte di Strasburgo abbia accertato l’incompatibilità del giudicato civile con i diritti umani tutelati dalla CEDU. Il presente studio si interroga, allora, sull’esistenza di un obbligo di riapertura dei procedimenti civili nazionali quale conseguenza dell’obbligo di dare esecuzione alle sentenze della Corte EDU, di cui all’art. 46 CEDU, letto alla luce del rapporto di responsabilità internazionale che sorge in conseguenza di un illecito
El modelo del partenariado público-privado en el marco de la reforma de las Naciones Unidas y de la consecución de los objetivos marcados por la agenda 2030
This article examines the public-private partnership model within the framework of the reform of the United Nations system and the achievement of the objectives set by the 2030 Agenda. The first part of the article is dedicated to the identification of the characteristics of the PPP in the legal system and international relations, while the second part analyzes the model issue in the context of the United Nations and its specialized agencies. In the third part, some legal issues relating to both the international legal status of PPPs and the configuration of their responsibilities under international law are examined. Finally, the fourth part highlights how the PPP model could represent a key tool in the future within the framework of the reform of the United Nations and the achievement of the objectives set by the 2030 AgendaEste artículo examina el modelo del partenariado público-privado (en adelante, “PPP”) en el marco de la reforma del sistema de las Naciones Unidas y de la consecución de los objetivos marcados por la Agenda 2030. La primera parte del artículo está dedicada a la identificación de las características del PPP en el ordenamiento jurídico y las relaciones internacionales, mientras la segunda parte analiza el modelo en cuestión en el panorama de las Naciones Unidas y sus Agencias especializadas. En la tercera parte, se examinan algunas cuestiones relativas tanto al estatus jurídico internacional de los PPP como a la configuración de sus responsabilidades según el derecho internacional. Finalmente, en la cuarta parte se destaca cómo el modelo PPP podría representar en el futuro una herramienta clave en el marco de la reforma de las Naciones Unidas y la consecución de los objetivos marcados por la Agenda 2030
