The development of data protection regulations is increasing its interactions with the collective action developed by staff representation. In this context, we analyze, on the one hand, its role as guarantor of the integrity of the right to data protection and, on the other hand, and above all, the conflicts that arisein relation to the exercise of its powers. On the latter point, the limitations that may exist on access to personal data by representative organizations and the restrictions on their subsequent use are analyzed.El desarrollo de la normativa sobre protección de datos incrementa sus interacciones con la acción colectiva desarrollada por la representación del personal. En este contexto, se analiza, de un lado, el papel que le corresponde como garante de la integridad del derecho a la protección de datos y, de otro, y sobre

Los aspectos controvertidos de los procesos de estabilización y sus consecuencias indemnizatorias
The collision of labour regulations with the constitutional precepts on access to public employment led to the appearance of the figure of the indefinite non fixed term contract in Public Administration and their instrumental entities; this figure, very widespread in the practice of these organizations, implied the continuity of temporary contracts almost perpetuated over time. After the first attempts to consolidate temporary employment, it was Law 20/2021 that developed selective processes that have been carried out with no less difficulties and with notorious doubts about the legality of its bases, mainly its scales. The consequences for compensation derived from these processes are the following legal controversies that will have to be resolved by the Courts in the near future.La colisión de las normas laborales con los preceptos constitucionales de acceso al empleo público provocó la aparición de la figura del indefinido no fijo en las Administraciones Públicas y sus entidades instrumentales; dicha figura, muy expandida en la práctica de dichos organismos, implicó la continuidad de vínculos temporales de forma casi perpetuada. Tras los primeros intentos de consolidación del empleo temporal, ha sido la Ley 20/2021 la que ha desarrollado unos procesos selectivos que se han desarrollado con no menos dificultades y con notorias dudas sobre la legalidad de sus bases, particularmente de sus baremos. Las eventuales consecuencias indemnizatorias derivadas de éstas son las siguientes controversias jurídicas que deberán resolver los Tribunales del orden social en fechas próximas
Reutilización de productos textiles vs. infracción de un derecho de marca. Estrategias materiales y de litigación transfronteriza
The fashion industry, especially the business based on fast fashion, has been configured around massive production of clothing, footwear and accessories. But not only that, textile production itself generates a significant amount of waste (ad ex., leftover fabrics, pieces of leather, etc.) that are discarded directly. In fact, despite the fact that European standards on waste treatment in Europe are changing (proof of this is Law 7/2022 of April 8, on waste and contaminated soils derivated from the European Directive 2018/851), companies still generate a significant number of waste at time to produ- ce and they also have a lot of leftover stock at the end of each season. Thus, some of the solutions that some experts offer to make the industry increasingly sustainable and circular is for textile companies to manufacture less and reuse more of what is already manufactured. Upcycling is a technique that consists of reusing already used products so that they can have a second life. This reuse, often based on creative techniques, does not pose major legal problems when it is the fashion brand itself that reuses its products or reaches an agreement with another company to collaborate together. The problem arises when a third party uses parts of products protected by a trademark right and, without the owner’s consent, adds them to other products. This legal question that we ask ourselves turns out to be even more interesting when we realize that in most cases these new upcycling creations usually reuse parts of products that feature fashion brands that are well-known worldwide and that belong to the segment of products considered “of luxury brands”. The objective of this paper is threefold, so we are going to analyze: 1) If the up- cycling technique could be contrary to an EU trademark right; 2) Whether upcycling would fit within the concept of European exhaustion of trademark rights and to what extent it could be appropriate to adapt exhaustion to achieve a more sustainable industry; 3) The aspects from a private international perspective should be kept in mind in the event that the trademark owner decides to sue for trademark infringement before European courts.La industria de la moda, tanto el negocio basado en el fast fashion como el de los productos de lujo, se ha configurado en gran medida en torno a una producción masiva. Pero no sólo eso, la producción textil en sí misma genera una importante cantidad de residuos (ad ex., telas sobrantes, trozos de piel, etc.) que se desechan directamente. De hecho, a pesar de que las normas europeas sobre el tratamiento de residuos en Europa están cambiando (prueba de ello es la Ley 7/2022 de 8 abril, de residuos y suelos contaminados, fruto de la Directiva europea 2018/851) todavía las empresas generan un importante número de residuos a la hora de producir y también cuentan con mucho stock sobrante al final de cada temporada. De este modo, algunas de las soluciones que algunos expertos ofrecen para que la industria sea cada vez más sostenible y circular es que las empresas textiles fabriquen menos y se reutilice más lo ya fabricado. El upcycling es una técnica que consiste en reutilizar productos ya usados para que puedan tener una segunda vida. Esta reutilización, en muchas ocasiones basada en técnicas creativas, no plantea mayores problemas legales cuando es la propia marca de moda la que reutiliza sus productos o llega a un acuerdo con otra empresa para colaborar juntas y así aprovechar el stock sobrante. El problema surge cuando, es un tercero el que utiliza partes de productos protegidos por un derecho de marca y sin consentimiento del titular, los añade a otros productos. Esta cuestión jurídica que nos planteamos todavía resulta ser más interesante cuando percibimos que en la mayoría de las ocasiones en esas nuevas creaciones de upcycling se suelen reutilizar partes de productos donde aparecen firmas de moda muy conocidas mundialmente y que pertenecen al segmento de productos considerados “de lujo”. El objetivo de este trabajo es triple, así vamos a analizar: 1) Si la técnica del upcycling podría ser contraria a un derecho de marca de la UE; 2) Si el upcycling encajaría dentro del concepto de agotamiento europeo del derecho de marca y en qué medida podría convenir adaptar el agotamiento para conseguir una industria más sostenible; 3) Los aspectos desde una perspectiva internacional privatista se deberían tener presente en el caso de que el titular de la marca se decidiera a demandar por infracción marcaria ante tribunales europeos
La consecuencias laborales del Brexit para la gente de mar
The exit of the United Kingdom from the European Union has had numerous consequences for seafarers, which have not been addressed by the instrument that governs the relationship between the parties, which is the Trade and Cooperation Agreement. The aim of this paper is to analyse the most significant consequences for this group of workers from an employment point of view, focusing specifically in two aspects: the ending of free movement of workers between the UK and the EU and the emergence of fears of unfair social competition as a result of a possible downgrading of seafarers’social conditions.La salida del Reino Unido de la Unión Europea ha acarreado numerosas consecuencias para la gente de mar, sin que éstas hayan sido abordadas por el instrumento que canaliza las relaciones entre las partes, esto es, por el Acuerdo de Comercio y Cooperación. El objetivo del presente trabajo consiste en analizar las consecuencias más significativas para este colectivo de personas trabajadoras desde el punto de vista laboral, centrándose específicamente en dos aspectos: la finalización de la libre circulación de trabajadores entre el Reino Unido y la UE y la reaparición del temor por una competencia social desleal como consecuencia de una posible rebaja de las condiciones sociales de la gente de mar

With order no. 13504 of 2023, the Italian Court of Cassation ruled on the limits of Italian jurisdiction over actions aimed at ascertaining the invalidity of the Italian portion of an internationally registered design and the non-infringement of the German portion thereof. This contribution analyses some of the issues raised by the present case, such as the identification of the place of registration of an internationally registered design under Article 24(4) of the Brussels I bis Regulation, the relevance of the principle of territoriality for the identification of the place of the harmful event under Art. 7(2) of the Brussels I bis Regulation in relation to the infringement of a national portion of an international design, and the impact that the lack of standing of a defendant which was not part of the dispute may have on the special forum for several defendants under Article 8(1) of the Brussels I bis Regulation.Con ordinanza n. 13504 del 2023, la Corte di Cassazione italiana si è pronunciata sulla

La odisea judicial entre London Steam-Ship Owners-Mutual Insurance Association Limited y el Reino de España: Una aventura legal que está lejos de concluir
The Prestige case has faced a lengthy legal journey. Over the years, English courts issued decisions conflicting with Spain’s Supreme Court ruling. The latest judgment on October 6, 2023, in England adds a new chapter. It asserts that the Spanish Supreme Court’s order for London P&I Club to pay 855 million euros clashes with English arbitration resolutions. This legal contradiction adds an extra layer of complexity, showing ongoing uncertainty about executing judicial decisions and prolonging the mystery of the Prestige case’s final outcome. El caso del Prestige, ha experimentado un extenso recorrido judicial. A lo largo de los años, los tribunales ingleses han emitido decisiones que contrarían con la sentencia del Tribunal Supremo Español. La más reciente sentencia del 6 de octubre del 2023 del Tribunal Superior de Justicia de Inglaterra y Gales agrega un nuevo capítulo a esta saga. El fallo sostiene que la sentencia del Tribunal Supremo Español, que ordenaba a London P&I Club pagar 855 millones de euros, es “incompatible” con las resoluciones arbitrales inglesas. Esta contradicción legal añade una capa adicional de complejidad al proceso, evidenciando la persistente incertidumbre en torno a la ejecución de decisiones judiciales y prolongando la incógnita sobre el desenlace final del caso Prestige
