Contratos licitatórios firmados no município de Canoinhas no exercício 2020 frente ao regramento pandêmico
Get PDFThe study seeks to evidence the application of the legislation in force during the period of pandemic brought about by the coronavirus, in the bidding processes in the Municipality of Canoinhas, promoting the verification of contracts for the acquisition of goods, services and inputs signed in 2020 under the aegis of the regulations pandemics, given that the new coronavirus brought demands for emergency use, which would need to be quickly remedied by the Public Administration. However, the operations carried out by public bodies need to be supported by the legality of the acts, combined with transparency, always striving for efficiency to meet the needs of society. Thus, the research developed was bibliographical and documentary, of doctrinal review, based on the deductive method, the discussion was based on tables prepared from the information provided by the Municipality of Canoinhas on its website and showed that the new regulations were effective in simplifying public procurement processes, notably in facing the needs linked to the pandemic.No estudo procura-se evidenciar a aplicação das legislações vigentes no período de pandemia instaurado pelo coronavírus, nos processos licitatórios no Município de Canoinhas, promovendo a verificação dos contratos de aquisição de bens, serviços e insumos firmados no ano de 2020 sob a égide dos regramentos pandêmicos, haja vista, que o novo coronavírus trouxe demandas de uso emergencial, que precisariam ser rapidamente sanadas pela Administração Pública. Todavia, as operações realizadas pelos órgãos públicos precisam estar amparadas na legalidade dos atos, combinadas com a transparência prezando sempre pela eficácia para atender as necessidades da sociedade. Dessa forma, a pesquisa desenvolvida foi a bibliográfica e documental, de revisão doutrinária, com bases no método dedutivo, a discussão pautou-se em tabelas elaboradas a partir das informações disponibilizadas pelo Município de Canoinhas no seu sítio eletrônico e evidenciou que os novos regramentos foram eficazes na simplificação dos processos de contratações públicas, notadamente no enfrentamento as necessidades vinculadas a pandemia
A inclusão digital nas escolas brasileiras durante a pandemia de COVID-19 em consonância com o objetivo de nº 04 da Agenda 2030 da Organização das Nações Unidas (ONU)
Get PDFIn 2020, Brazil was surprised by the covid-19 pandemic, a time when social isolation was necessary, which reflected on several factors, such as closing the schools and subsequent remote education, as well as the growing digital inclusion in Brazilian schools. The 2030 agenda of the United Nations (UN) sets out objectives and targets for countries to achieve a sustainable future, among them the objective number four sets out to to ensure the inclusion of quality education, in addition to promoting learning opportunities for everyone throughout life. This study is justified because of the importance of analyzing the fundamental right to education and its effectiveness in the pandemic scenario, in relation to the achievement of the objective that deals with education in the 2030 agenda of the UM. For that our question is: to what extent is it possible to guarantee the fulfillment of the objective 4 of Agenda 2030 during the Covid-19 pandemic with digital inclusion in Brazilian schools? The approach method was inductive, due to the use of a specific case, in which a phenomenon that is occurring is observed. The research type is indirect documentary bibliographic-doctrinal. As a conclusion it must be highlighted that for the fulfillment of SDG 04, it is essential that the public authorities at the municipal, state and federal levels create projects and strategies for the integral access of the internet to all individuals, reducing costs and providing quality internet, being also important, the conscious and correct use of these means.No ano de 2020, o Brasil foi surpreendido pela pandemia de covid-19, momento no qual foi necessário o isolamento social que refletiu em diversos fatores, como o fechamento de escolas e posterior ensino remoto, e a crescente inclusão digital nas escolas brasileiras. A agenda 2030 da Organização das Nações Unidas (ONU) estabelece objetivos e metas para que os países alcancem um futuro sustentável, dentre eles, o objetivo número quatro preza por assegurar a inclusão da educação de qualidade, além de promover oportunidades de aprendizagem para todas as pessoas ao longo da vida. O presente estudo justifica-se em razão da importância de analisar o direito fundamental à educação e sua efetividade no cenário pandêmico, em relação ao cumprimento do objetivo que trata da educação na agenda 2030 da ONU, para tanto questiona-se: em que medida é possível garantir o cumprimento do objetivo 4 da Agenda 2030 frente à pandemia Covid-19 com a inclusão digital nas escolas brasileiras? O método de abordagem utilizado foi o indutivo, em razão do emprego de um caso concreto, em que é observado um fenômeno que está ocorrendo. A pesquisa é do tipo documental indireta bibliográfico-doutrinária. Como conclusão destaca-se que para o cumprimento ODS nº 04, é fundamental que os poderes públicos em âmbito municipal, estadual e federal criem projetos e estratégicas para o acesso integral da internet a todos os indivíduos, reduzindo custos e provendo uma internet de qualidade, sendo importante também, o uso consciente e correto dos referidos meios tecnológicos, sobretudo por parte dos alunos
O direito à herança digital e a privacidade do de cujus
Get PDFThis article seeks to verify the existence of a possible conflict between the right of the heirs and the right to privacy of the deceased when the object of sharing is the digital inheritance. As this institute still does not have legislative force through legal norms, it begins in an impasse between the two mentioned rights. Initially, the concept of inheritance will be understood in general, with emphasis on the concept of digital legal assets, to later analyze the digital inheritance and its effect on the Brazilian legal system. Then, part to the right to succession of the digital inheritance of the heirs and the right to privacy of the deceased, focusing on the provisions of the Civil Code and the Federal Constitution of 1988. Finally, the possibility of sharing the inheritance is analyzed. digital heritage and doctrinal opinion on the subject, especially with regard to legislative proposals on this institute. The methodology is deductive and has qualitative analyses, based on bibliographical research carried out by reading scientific doctrines and articles.Este artigo busca verificar a existência de eventual conflito entre o direito dos herdeiros e o direito à privacidade do de cujus quando o objeto de partilha é a herança digital. Como esse instituto ainda não possui força legislativa por meio de normas jurídicas, inicia-se em um impasse entre os dois direitos referidos. Inicialmente, será compreendido o conceito de herança de modo geral, com destaque ao conceito de bens jurídicos digitais, para posteriormente analisar a herança digital e seu efeito no ordenamento jurídico brasileiro. Em seguida, parte-se para o direito à sucessão da herança digital dos herdeiros e o direito à privacidade do de cujus, com foco nas disposições do Código Civil e da Constituição Federal de 1988. Por fim, analisa-se a possibilidade de partilha da herança digital e a opinião doutrinária sobre o tema, principalmente no que tange a propostas legislativas sobre esse instituto. A responsabilidade civil por vício oculto do produto em relação ao direito de indenização ao consumidor
Get PDFAiming, through the deductive method, to clarify the problem of “what and who is the responsibility when it comes to indemnifying the final consumer of a product ejected from addiction?”, The institute of Civil Liability is examined in relation to the obligation to indemnify the consumer for hidden vices coming from the marketed product. For a better understanding of the theme, after a brief introductory analysis of the Consumer Law in relation to its role in the defense of consumers and about their basic rights, it goes through the product concept, its vices, derivations and distinctions, as well as the concepts of supplier, manufacturer and trader, and final consumer and in the types of Civil Liability under the perspective of the Consumer Protection Code. Afterwards, the consumer\u27s rights and guarantees are analyzed and if the responsibility to indemnify the final consumer of a product lies with the manufacturer supplier or the trader supplier, as well as the exclusions of responsibility, under the aegis of the continuous studies of Consumer Protection Code, the Civil Code, the doctrine and jurisprudence. In view of the study, it was verified that the supplier (manufacturer or trader) had an obligation to compensate the final consumer for the defect in the product available for sale, based on the strict civil liability determined by the Consumer Protection Code. However, the characterization of moral damages will depend on the specific case.Objetivando, através do método dedutivo, esclarecer a problemática de “qual e de quem é a responsabilidade na hora de indenizar o consumidor final de um produto eivado de vício?”, examina-se o instituto da Responsabilidade Civil em relação à obrigação de indenizar o consumidor por vícios ocultos oriundos do produto comercializado. Para melhor entendimento do tema, após breve análise introdutória da Lei Consumerista em relação ao seu papel na defesa do consumidor e acerca de seus direitos básicos, adentra-se no conceito de produto, de seus vícios, derivações e distinções, bem como nos conceitos de fornecedor, fabricante e comerciante, e consumidor final e nos tipos de Responsabilidade Civil sob a ótica do Código de Defesa do Consumidor. Após, analisa-se os direitos e as garantias do consumidor e se a responsabilidade para indenizar o consumidor final de um produto é do fornecedor fabricante ou do fornecedor comerciante, bem como as excludentes de responsabilidade, sob a égide dos estudos constantes do Código de Defesa do Consumidor, do Código Civil, da doutrina e da jurisprudência. Diante do estudo, verificou-se que dever do fornecedor (fabricante ou comerciante) a obrigação de indenizar o consumidor final pelo vício que se apresentou no produto disposto à comercialização, com base na responsabilidade civil objetiva determinada pelo Código de Defesa do Consumidor. Todavia, a caracterização dos danos morais dependerá do caso concreto
Gestão de brand equity utilizada pela empresa SAO no mercado de cirurgia bariátrica
Get PDFThe purpose of this article is to analyze how the brand equity management used by the SAO company makes it possible to strengthen the brand in the bariatric surgery market. SAO (Service of Attendance to the Obese and metabolic patient) is a company in the area of the health that has as main service to the bariatric surgery. The methodology used has a descriptive method, quantitative and qualitative approach with data collection with an online questionnaire sent to customers and netnographic observation on the social networks Facebook and Instagram of the company SAO. The results indicate that individualized servisse, a multidisciplinary team, centralized service location, bond with agreements, training of professionals and quality certification add value to the brand, making these references decisive when contracting the services provided.

Brand Positioning.O objetivo deste artigo é analisar como a gestão de brand equity utilizada pela empresa SAO possibilita o fortalecimento da marca no mercado de cirurgia bariátrica. SAO (Serviço de Atendimento ao paciente Obeso e metabólico) é uma empresa na área da saúde que tem como principal serviço à cirurgia bariátrica. A metodologia utilizada possui método descritivo, abordagem quantitativa e qualitativa com coleta de dados com questionário on-line enviado aos clientes e observação netnográfica nas redes sociais Facebook e Instagram da empresa SAO. Os resultados indicam que o atendimento individualizado, uma equipe multidisciplinar, local de atendimento centralizado, vínculo com convênios, capacitação dos profissionais e certificação de qualidade agregam valor à marca, fazendo com que estas referências sejam decisivas na contratação dos serviços prestados.

Panorama dos principais temas, artigos e pesquisadores da área do desenvolvimento regional no Brasil referentes ao ano de 2020
Get PDFThe Regional Development sub-area it´s linked to the area of Urban and Regional Planning and Demography under CAPES. This area comprises 49 Graduate programs, of which 25 are linked to the area of Urban and Regional Planning, 20 are in line with the theme of Regional Development and 04 are linked to Demography. This article aims to analyze the articles published by CNPq Productivity Scholarship researchers from programs in Regional Development. Articles published in journals from the qualis strata A1, A2 and B1 were analyzed, classified themes and main issues addressed. Among the 90 CNPQ Productivity Scholars in the PLURD area, 12 work in Regional Development. The group published 09 articles in journals rated A1 and A2 and 25 articles in journals rated B1. The analysis fostered the identification of the main researchers, themes and issues addressed, allowing for a deeper understanding of the profile of this area of concentration.

Este artículo tiene como objetivo analizar los artículos publicados por investigadores de Becas de Productividad CNPq de programas de Desarrollo Regional. Se analizaron artículos publicados en revistas de los estratos qualis A1, A2 y B1, se clasificaron los temas y se abordaron los principales problemas. De los 90 Becarios de Productividad del CNPQ en el área PLURD, 12 trabajan en Desarrollo Regional. El grupo publicó 09 artículos en revistas calificadas como A1 y A2 y 25 artículos en revistas calificadas como B1. El análisis propició la identificación de los principales investigadores, temáticas y temáticas abordadas, permitiendo una comprensión más profunda del perfil de esta área de concentración.

Megaeventos no Rio de Janeiro: uma reflexão sobre justiça e custo humano
Get PDFFrom the inequalities produced around the mega-events in Rio de Janeiro, this paper proposes a reflection on the invisibility of those who live the “exception as rule” (the tradition of the oppressed, from a Benjaminian perspective, taken up by Agamben). It is important for us to think about the victims of the city\u27s transformation process and how they are affected by the perverse logic of development and progress, as well as the biopolitical strategies of life control that blend into the social fabric responsible for the perpetuation of barbarism. In this article we will talk about the importance of breaking the logic of human cost justification, that is, the injustices done to the excluded in favor of improvements for a privileged part of the population. We will also address the various forms of struggles and resistance put in place that have caused defeats to the state-market consortium for the administration of the exception in Rio de Janeiro.

Invisibility.A partir das desigualdades produzidas em volta dos megaeventos ocorridos no Rio de Janeiro, este artigo propõe uma reflexão sobre a invisibilidade daqueles que vivem a “exceção como regra” (a tradição dos oprimidos, de uma perspectiva benjaminiana, retomada por Agamben). Importa para nós, pensar sobre os vitimados pelo processo de transformação da cidade e de como são afetados pela lógica perversa do desenvolvimento e do progresso, bem como as estratégias biopolíticas de controle da vida que se misturam ao tecido social responsáveis pela perpetuação da barbárie. Neste artigo falaremos sobre a importância de ser rompida a lógica da justificação do custo humano, isto é, das injustiças realizadas aos excluídos em prol de melhorias para uma parcela privilegiada da população. Abordaremos também as diversas formas de lutas e resistências postas em prática que impuseram derrotas ao consórcio Estado-Mercado de administração da exceção no Rio de Janeiro.

Gestão democrática no contexto escolar e político brasileiro
Get PDFIn the current conjuncture of Brazilian society, reflecting the possibilities and challenges of democratic school management becomes necessary, especially when we think that each school is unique and has needs that are related to the context in which it is inserted. For this reason, having the participation of the entire school community is important, both in the constitution of the inclusion process, in the fight against evasion, and in the constitution of appropriate methodological alternatives necessary to deal with the school reality. To this end, a brief history of school management in Brazil is presented, punctuating its implications, possibilities and challenges, in order to reflect on this subject throughout history, so that it is possible to rethink and analyze, in the current context, their practices and concepts. Based on bibliographic research, the aim is to confirm the leadership of the manager and his ability to intervene and share his actions with the school community in order to guarantee quality education to the student. Thus, thinking about democratic management leads to the constitution of an environment that values the community where everyone involved is a partner in the process of preparing the Pedagogical Political Project, that is, they are directly involved with the responsibility of building the school collectively.

Teaching-Learning.Na atual conjuntura da sociedade brasileira, refletir as possibilidades e os desafios de uma gestão escolar democrática torna-se necessário, principalmente, quando pensamos que cada escola é única e possui necessidades que se relacionam com o contexto no qual encontra-se inserida. Por isso, contar com a participação de toda comunidade escolar importa, tanto na constituição do processo de inclusão, do combate a evasão, quanto na constituição de alternativas metodológicas adequadas necessárias para lidar com a realidade escolar. Para tanto, apresenta-se um breve histórico sobre a gestão escolar no Brasil, pontuando suas implicações, possibilidades e desafios, de forma a refletir sobre esse assunto no decorrer da história, de modo que, seja possível repensar e analisar, no atual contexto, suas práticas e conceitos. Com base em pesquisas bibliográficas, visa-se confirmar a liderança do gestor e sua capacidade de intervir e compartilhar suas ações com a comunidade escolar com o intuito de garantir um ensino de qualidade ao educando. Assim, pensar a gestão democrática desemboca na constituição de um ambiente que preza pela coletividade onde todos os envolvidos são parceiros no processo de elaboração do Projeto Político Pedagógico, ou seja, se envolvem diretamente com a responsabilidade de construir coletivamente a escola.

O ensino superior no município de Canoinhas: um estudo do período compreendido entre 1990 a 1999
Get PDFThis article is the result of research whose objective was to investigate the historical trajectory of implementing higher education in the municipality of Canoinhas in the period between 1990 and 1999 and the contributions to regional development. Documentary research was used. The main source of the documentary research was the Jornal Correio do Norte. The study was justified by the celebration of the institution\u27s fiftieth anniversary in the municipality of Canoinhas. The main actions fell on extension and research programs, thus qualifying the teaching of academics and consolidating the true spirit of a University that is structured on the tripod: teaching, research and extension, as a promoter of regional development.

Contestado University.Este artigo resulta de pesquisa cujo objetivo foi investigar o percurso histórico de implantação da educação superior no município de Canoinhas no período compreendido entre 1990 e 1999 e as contribuições para o desenvolvimento regional. Utilizou-se da pesquisa documental. A principal fonte da pesquisa documental foi o Jornal Correio do Norte. Justificou-se o estudo pela comemoração do cinquentenário da Instituição no município de Canoinhas. As principais ações recaíram em programas de extensão e pesquisa, qualificando assim o ensino dos acadêmicos e consolidando o verdadeiro espirito de uma Universidade que se estrutura no tripé: ensino, pesquisa e extensão, como fomentadora do desenvolvimento regional.

Crítica à primazia da economia: uma análise Agambeniana
Get PDFThe purpose of this article is to present a critical view of the neoliberal economy and the process that made the primacy of economic power possible. Based on the critical view of Agamben, it is understood that it is in the face of the economic that the analyzes must be placed in order to understand contemporary times and to think about ways of overcoming naked life. To situate the problem of the article in a historical and philosophical way, it begins with an analysis of the ideological hegemony of the neoliberal project. In the second step, we sought to relate economics to religion, highlighting Benjamin\u27s thesis that "capitalism is really a religion", as it understands that this process has serious ethical and political consequences. In the third moment, following in the footsteps of Agamben, he returns to the first priests of the church to understand the theological process that keeps this relationship between the economy and religion alive. It is concluded that the capitalist economy inherits the conditions given by Judeo-Christian theology. In other words, as soon as there is a separation of kingdom and government, the concept of economics begins to enter the realm of politics, especially because it starts to configure a model for what will form the beginning of a legal order in Western societies.

Fundamentando-se na visão crítica de Agamben, compreende-se que é frente ao econômico que as análises devem se situar para uma compreensão da contemporaneidade e para pensar formas de superação da vida nua. Para situar de maneira histórica e filosófica a problemática do artigo, inicia-se com uma análise da hegemonia ideológica do projeto neoliberal. No segundo momento, buscou-se relacionar economia com religião dando destaque a tese de Benjamin que “o capitalismo é realmente uma religião”, por entender que esse processo tem consequências éticas e políticas graves. No terceiro momento, seguindo os passos de Agamben, retorna-se aos primeiros padres da igreja para entender o processo teológico que mantêm viva essa relação da economia com a religião. Conclui-se que a economia capitalista herda as condições dadas pela teologia judaico-cristã. Ou seja, a partir do momento em que há a separação de reino e governo, a concepção de economia inicia a adentrar no âmbito da política, especialmente porque passa a configurar um modelo para aquilo que formará o início de uma ordem jurídica nas sociedades ocidentais.
