    A Phenomenological Study of Theft Recidivism and Law Enforcement Strategies in Tulungagung, Indonesia

    Theft recidivism remains a persistent global concern that reflects the complex interaction of socio-economic, psychological, and environmental factors shaping criminal behavior across diverse societies. Similar to global trends observed in the United States, Europe, and Japan, recidivism in Indonesia demonstrates how structural inequality, limited rehabilitation, and weak reintegration frameworks perpetuate repeated offending. Despite these parallels, Indonesian studies have primarily focused on normative legal analyses, offering limited insight into offenders' lived experiences and socio-structural dynamics. Addressing this gap, the present study explores the phenomenology of theft recidivism within the jurisdiction of the Tulungagung Police Department through a qualitative approach using deductive analysis. The findings reveal that economic strain, social disconnection, and institutional shortcomings jointly sustain reoffending behavior. Bronfenbrenner's Ecological Systems Theory shows these factors interact across individual, interpersonal, institutional, community, and policy levels, forming an interdependent framework of recidivism. The Tulungagung Police have localized global best practices by integrating Social Control and Community Policing strategies—combining pre-emptive, preventive, restorative, and rehabilitative measures. Programs such as legal education, neighborhood patrols, restorative justice, and post-release empowerment reflect a shift from punitive deterrence to participatory crime prevention. Theoretically, this study contributes to global criminological discourse by contextualizing ecological and phenomenological insights; practically, it offers a localized, evidence-based model for sustainable desistance in Indonesia

    Reconstructing Legal Accountability through Body-Worn Cameras: A Normative Study of Criminal Justice Reform in Indonesia

    Efforts to modernize Indonesia's criminal justice system demand legal mechanisms that ensure accountability, fairness, and human rights protection at every procedural stage. While global studies on Body-Worn Cameras (BWCs) have focused on operational and policing impacts, few have examined their normative legitimacy and evidentiary validity within Indonesia's legal context. Anchored in the principles of the rule of law, due process, and evidentiary integrity, this study analyzes the legal status of BWCs, explores comparative practices in other jurisdictions, and formulates an ideal regulatory model for Indonesia. This research employs a normative legal method using conceptual and comparative approaches, analyzing statutory materials, public policies, and international practices from the United States, the United Kingdom, Germany, and Australia. The findings reveal that Indonesia lacks a comprehensive legal framework governing operational standards, data management, and the evidentiary use of BWC recordings, resulting in uncertainty and fragmented practices. Comparative experiences show that BWCs become effective when legal systems ensure chain-of-custody integrity, privacy protection, and independent oversight. This study formulates a conceptual legal model integrating accountability, evidentiary reliability, and data protection through explicit activation rules, retention schedules, and dual accountability mechanisms involving internal and external oversight. Accordingly, BWCs are positioned not merely as technological devices but as instruments of legal reform that align Indonesia's criminal justice system with global standards of transparency, proportionality, and rights-based governance

    Digital Patriarchy: How Indonesian Islamic Preachers Construct Gender Asymmetry through YouTube Fatwas

    Social media has emerged as a new platform for religious figures to disseminate fatwas (Islamic legal opinions). These platforms undoubtedly facilitate public access to pragmatic answers regarding Islamic legal issues. However, the credibility of fatwas issued on social media is frequently contested, particularly concerning gender bias. This study examines religious figures’ fatwas on YouTube about spousal relations through the lens of feminist theory. Employing a qualitative empirical approach, the research utilizes netnography as its data collection method. The findings reveal that most religious figures’ fatwas on position the wife in a state of economic dependence on her husband, while relegating her to domestic roles with obligations centered on fulfilling spousal domestic needs, particularly sexual demands. Such narratives starkly contradict principles of gender equality and perpetuate bias by potentially disregarding wives’ sexual agency. These fatwas stem from conservative interpretations of Q.S 4:34 by religious figures. [Media sosial muncul sebagai platform baru bagi tokoh agama untuk menyebarkan fatwa (pendapat hukum Islam). Platform ini memudahkan akses publik terhadap jawaban-jawaban praktis terkait persoalan hukum Islam. Namun, kredibilitas fatwa yang dikeluarkan di media sosial sering kali diperdebatkan, terutama terkait dengan bias gender. Penelitian ini mengkaji fatwa para tokoh agama di YouTube mengenai relasi suami-istri melalui perspektif teori feminis. Dengan menggunakan pendekatan kualitatif, dalam beberapa hal penelitian ini menerapkan bagian dari kerja netnography sebagai teknik pengumpulan data. Hasil penelitian menunjukkan bahwa sebagian besar fatwa yang disampaikan oleh para tokoh agama menempatkan istri dalam posisi ketergantungan ekonomi terhadap suaminya, sekaligus membatasi perannya pada ranah domestik dengan kewajiban yang berfokus pada pemenuhan kebutuhan rumah tangga suami, khususnya kebutuhan seksual. Narasi semacam ini secara jelas bertentangan dengan prinsip kesetaraan gender dan memperkuat bias dengan berpotensi mengabaikan agensi seksual istri. Fatwa-fatwa tersebut berakar pada tafsir konservatif terhadap Q.S. 4:34 oleh para tokoh agama.

    The Transformation of Judicial Ijtihad in the Indonesian Judiciary in Response to the Escalation of Law: A Maqasid ash-Sharia Perspective

    The advancement of human civilization has revealed one of the inherent weaknesses of positive law in fulfilling its function as a framework for social life. Consequently, transformation within the legal system is imperative as a means of enhancing legal certainty within judicial institutions. Judges required to engage in ijtihad (independent reasoning) to facilitate legal transformation and to ensure that the legal order remains responsive and relevant. This study is a literature research study using a qualitative approach. The data used in this study include statutory regulations, books, prior research, and other relevant literatures. The primary objective of this research is to examine how judicial discovery, regarded as a representation of truth in court proceedings, must be interconnected with various supporting instruments to achieve substantive justice in accordance with the framework of Maqasid ash-Sharia. The findings indicate that the incorporation of Maqasid ash-Sharia within judicial ijtihad plays a pivotal role in legal reform aimed at responding to the evolving needs of society. Despite its theoretical significance, the application of this concept in judicial decisions must also be accompanied by the judge’s moral conscience, as both elements collectively guide the judge toward rulings that could realize the public welfare (maslahah). However, this study acknowledges its limitations regarding the practical implementation of its findings. Therefore, future research employing empirical methods within judicial institutions is recommended. Kemajuan peradaban manusia menunjukkan salah satu kelemahan hukum positif dalam memenuhi fungsinya sebagai kerangka kerja bagi kehidupan sosial. Oleh karena itu, transformasi dalam sistem hukum menjadi sangat penting sebagai sarana untuk meningkatkan kepastian hukum dalam lembaga peradilan. Hakim dituntut untuk terlibat dalam ijtihad (penalaran independen) untuk memfasilitasi transformasi hukum dan memastikan bahwa tatanan hukum tetap responsif dan terkini. Penelitian ini merupakan penelitian kepustakaan dengan menggunakan pendekatan kualitatif. Data yang digunakan dalam penelitian ini meliputi peraturan perundang-undangan, buku-buku, penelitian terdahulu, dan literatur lain yang relevan. Tujuan utama dari penelitian ini adalah untuk melihat bagaimana penemuan hukum yang dianggap sebagai representasi kebenaran dalam proses peradilan, harus saling berhubungan dengan berbagai instrumen pendukung untuk mencapai keadilan substantif sesuai dengan kerangka Maqasid al-Syariah. Temuan-temuan ini menunjukkan bahwa penggabungan Maqasid al-Syariah dalam ijtihad yudisial memainkan peran penting dalam reformasi hukum yang bertujuan untuk merespons kebutuhan masyarakat yang terus berkembang. Terlepas dari signifikansi teoretisnya, penerapan konsep ini dalam putusan pengadilan juga harus disertai dengan hati nurani moral hakim, karena kedua elemen tersebut secara kolektif memandu hakim untuk menghasilkan putusan yang mampu mewujudkan kesejahteraan masyarakat (maslahah). Penelitian ini mengakui adanya keterbatasan dalam hal implementasi praktis dari temuan-temuannya.     Towards the Reconstruction and Reinterpretation of al-Kulliyyāt al-Khams: A Study of Maqāṣid in the Interdisciplinary Islamic Studies Master's Program at UIN Sunan Kalijaga

    This article aims to examine the research trends on Maqāṣid Sharī'ah topics within the Interdisciplinary Islamic Studies Master's Program at UIN Sunan Kalijaga Yogyakarta. This study is significant for developing Maqāsid Shariah studies in state Islamic universities. The research method employed is a literature study, utilizing data from student theses on the topic of Maqāsid Shariah to reveal trends in studies over a six-year period from 2018 to 2023. The results indicate that student theses tend to focus on the following topics: (1) studies of the thoughts of Maqāsid figures, (2) thematic fiqh studies from a Maqāsid perspective, (3) legal studies from a Maqāsid Shariah perspective, (4) public policy studies related to Maqāsid, and (5) Maqāsid approaches to interpreting Quranic verses. Their studies successfully initiated a new discourse in Maqāsid research within the Indonesian context through the development of: The hifz al-mithāq discourse regarding the disbandment of Hizbut Tahrir Indonesia; The hifz al-khuṣūṣiyah discourse concerning the issue of personal data protection in the Draft Law on Personal Data Protection; and The hifz al-mujtama' discourse within the discussion of Islamic legal dialogue in a pluralistic society in Kaloran. In conclusion, the Interdisciplinary Islamic Studies Master's Program develops Maqasid al-Shari'ah studies by reconstructing and reinterpreting al-Kulliyāt al-Khams, while actively incorporating the dynamic Islamic and Indonesian discourses. Artikel ini bertujuan untuk mengkaji tren penelitian bertopik Maqāsid Syariah pada Program Magister Interdiscipliner Islamic Studies UIN Sunan Kalijaga Yogyakarta. Kajian ini penting untuk mengembangkan kajian Maqāsid Syariah di Perguruan Tinggi Islam Negeri. Metode penelitian ini adalah penelitian literatur dengan data berupa tesis mahasiswa bertema maqasid syariah untuk mengungkap tren studi selama enam tahun 2018-2023. Hasil penelitian menunjukkan bahwa pertama, kecenderungan penelitian tesis mahasiswa terfokus pada topik penelitian berikut: (1) kajian pemikiran tokoh maqasid; (2) kajian fikih tematik dengan perspektif maqāsid; (3) kajian yuridis hukum dengan perspektif maqāsid syariah (4) kajian kebijakan publik terkait maqāsid dan (5) kajian maqāsid sebagai pendekatan penafsiran ayat-ayat al-Quran. Studi mereka berhasil melahirkan wacana baru dalam kajian maqāsid dalam konteks Indonesia melalui pengembangan wacana hifz al-mitsāq dalam konteks pembubaran Hitbut Tahrir di Indonesia, wacana hifz al-khusūsiyah pada isu perlindungan data pribadi dalam Rancangan Undang-Undang Perlindungan Data Pribadi dan wacana hifz al-mujtama' pada diskursus dialog hukum Islam dalam masyarakat majemuk di Kaloran. Dalam konteks ini, dapat disimpulkan bahwa studi maqasid syariah di Program Magister Interdiscipliner Islamic Studies mengembangkan studi maqasid melalui rekonstruksi dan reinterpretasi kulliyat al-khams dengan mempertimbangkan wacana keislaman dan keindonesiaan yang dinamis

    The Concept of Mubadalah as the Basis for the Protection of Human Rights in Islamic Family Law

    Islamic family law regulations in Indonesia are still influenced by traditional understandings that tend to be textual-normative, especially in issues of child marriage, polygamy, financial responsibility, child custody, and inheritance distribution. This condition poses challenges in realizing gender justice and the protection of human rights. This study aims to analyze the concept of mubadalah as a humanistic and equitable approach to interpretation, as well as its potential as a basis for the protection of human rights in Islamic family law. This study is a literature study with a normative juridical approach. Data was obtained through a review of legislation, the Compilation of Islamic Law (KHI), the Qur’an, hadith, classical books, journal articles, and other relevant literature. The analysis was conducted descriptively and qualitatively by interpreting religious texts contextually. The results of the study show that the concept of mubadalah emphasizes reciprocity, justice, and shared responsibility between men and women. In the context of Islamic family law, this approach emphasizes the protection of children in child marriages, makes justice the benchmark in polygamy, interprets alimony as a shared responsibility, emphasizes joint custody and the best interests of the child, and opens up room for ijtihad in the distribution of inheritance. Thus, the concept of mubadalah can be used as a conceptual basis for reforming Islamic family law to bring it into line with the principles of gender justice and human rights protection. Regulasi Hukum keluarga Islam di Indonesia masih dipengaruhi oleh pemahaman tradisional yang cenderung tekstual-normatif, terutama dalam isu perkawinan anak, poligami, tanggung jawab nafkah, hak asuh anak, dan pembagian harta warisan. Kondisi ini menimbulkan tantangan dalam mewujudkan keadilan gender dan perlindungan hak asasi manusia (HAM). Penelitian ini bertujuan menganalisis konsep mubadalah sebagai pendekatan tafsir yang humanis dan berkeadilan, serta potensinya sebagai landasan perlindungan HAM dalam hukum keluarga Islam. Penelitian ini merupakan penelitian kepustakaan dengan pendekatan yuridis normatif. Data diperoleh melalui kajian terhadap peraturan perundang-undangan, Kompilasi Hukum Islam (KHI), al-Qur’an, hadis, kitab klasik, artikel jurnal, dan literatur relevan lainnya. Analisis dilakukan secara deskriptif-kualitatif dengan menafsirkan teks-teks keagamaan secara kontekstual. Hasil penelitian menunjukkan bahwa konsep mubadalah menekankan adanya kesalingan, keadilan, dan tanggung jawab bersama antara laki-laki dan perempuan. Dalam konteks hukum keluarga Islam, pendekatan ini menegaskan pada perlindungan anak dalam perkawinan anak, menjadikan keadilan sebagai tolak ukur dalam poligami, memaknai nafkah sebagai tanggung jawab bersama, menitikberatkan hak asuh secara bersamaan dan kepentingan terbaik untuk anak, serta membuka ruang ijtihad dalam pembagian warisan. Dengan demikian, konsep mubadalah dapat dijadikan landasan konseptual dalam pembaruan hukum keluarga Islam agar selaras dengan prinsip keadilan gender dan perlindungan HAM

    Amnesti Dan Abolisi Dalam Sistem Hukum Tata Negara Indonesia: Kajian Kritis Atas Kasus Hasto Kristiyanto Dan Tom Lembong

      Amnesti dan abolisi merupakan hak prerogatif Presiden sebagaimana diatur dalam Pasal 14 ayat (2) UUD NRI Tahun 1945. Kewenangan ini menjadi instrumen politik hukum yang dapat menghapus sifat pidana (amnesti) maupun menghentikan penuntutan (abolisi) dengan pertimbangan Dewan Perwakilan Rakyat (DPR). Namun, dasar hukum yang berlaku hingga kini masih bersandar pada Undang-Undang Darurat Nomor 11 Tahun 1954, yang secara historis lahir dari konteks politik darurat dan sudah tidak relevan dengan sistem hukum modern. Penelitian ini menggunakan pendekatan yuridis-normatif dengan menelaah ketentuan konstitusi, peraturan perundang-undangan, serta praktik pemberian amnesti dan abolisi dalam kasus Hasto Kristiyanto dan Tom Lembong. Hasil kajian menunjukkan bahwa meskipun pemberian amnesti dan abolisi sah secara konstitusional, penerapannya pada kasus tindak pidana korupsi berpotensi melanggar prinsip equality before the law sebagaimana dijamin dalam Pasal 27 ayat (1) UUD 1945, serta melemahkan integritas sistem peradilan. Oleh karena itu, diperlukan rekonstruksi pengaturan melalui pembatasan agar amnesti dan abolisi tidak berlaku bagi tindak pidana luar biasa, kewajiban menunggu putusan inkracht, serta penguatan mekanisme checks and balances melalui DPR, Mahkamah Agung, dan partisipasi publik. Dengan demikian, hak prerogatif Presiden tetap berada dalam koridor hukum, mencegah kesewenang-wenangan, dan menjaga komitmen pemberantasan korupsi.

    Tinjauan Negara Hukum terhadap Perlakuan Diskriminatif Dalam Penempatan Dan Perlakuan Kerja: Kajian Putusan No. 41/Pdt.Sus-Phi/2023/Pn Bdg

    This study examines discriminatory treatment against workers within employment relations by analyzing Decision No. 41/Pdt.Sus-PHI/2023/PN Bdg as a case study. Employment relations in Indonesia’s legal framework are inherently subordinative, placing workers in a structurally weaker position compared to employers. Such imbalance creates space for both direct and indirect discriminatory practices, often disguised within internal company policies. A normative assessment of the 1945 Constitution, the Manpower Law, and its implementing regulations underscores the State’s obligation to provide legal protection through the principles of non-discrimination, legal certainty, and substantive justice. The analyzed decision demonstrates that the worker was subjected to job reassignment, consecutive warning letters, and termination of employment without adequate objective justification. These actions constitute indirect discrimination, as they appear formally legitimate yet substantively disadvantage the worker and reflect the employer’s misuse of authority. The panel of judges found that the employer’s actions lacked objective grounds and failed to uphold fairness within industrial relations. The court restored balance by granting the worker her entitlements, including compensation and process wages. This study emphasizes that legal protection for workers must not remain merely normative but must be effectively realized through judicial mechanisms. The analysis of the decision illustrates that labor law functions as a corrective instrument to rebalance power relations and prevent discriminatory practices detrimental to workers within employment settings

    Peran Wanita Karier Dalam Rumah Tangga Militer Berbasis  Mubādalah

    The dynamics of multiple roles are a common phenomenon in household relations, including in military families. The main issue addressed in this study concerns the challenges faced by women who are married to military personnel while also pursuing careers. These women face three concurrent roles: as wives, professionals in the public sector, and members of the Persit organization. Based on this context, two main research questions are formulated: first, how do career wives perform domestic, public, and social roles simultaneously? Second, how is the principle of Mubādalah reflected in husband-wife relations within the context of military households?. This study employs a field research method with a gender-based approach. Primary data were obtained through in-depth interviews with five military couples, conducted within the Group 2 PCBS Kopassus environment. The data were analyzed using the Miles and Huberman model, with analytical references to Caroline Moser’s Women’s Triple Role theory and the five pillars of Mubādalah. The findings show that career wives are able to carry out multiple roles proportionally with the support of their husbands. Husband-wife relationships are built on mutual reciprocity, as reflected in role-sharing, open communication, and emotional as well as spiritual support. The Mubādalah framework has proven to be a relevant approach in strengthening family resilience within military settings, leading to the formation of households that are harmonious, just, and equitable. This research contributes to the discourse on gender roles and family resilience in the context of modern military households. Dinamika peran ganda merupakan fenomena yang kerap muncul dalam relasi rumah tangga, termasuk dalam keluarga militer. Permasalahan utama yang diangkat dalam penelitian ini berkaitan dengan tantangan yang dihadapi oleh perempuan yang telah menikah dengan prajurit militer dan sekaligus menjalani peran sebagai wanita karier. Mereka dihadapkan pada tiga peran sekaligus, yaitu sebagai istri, profesional di sektor publik, dan anggota organisasi Persit. Berdasarkan kondisi tersebut, dirumuskan dua permasalahan utama, pertama bagaimana istri karier menjalankan peran domestik, publik, dan sosial secara simultan, kedua  bagaimana prinsip Mubādalah dalam relasi suami istri diwujudkan dalam konteks rumah tangga militer. Jenis penelitian ini adalah penelitian lapangan dengan pendekatan gender. Data primer diperoleh dengan melakukan wawancara mendalam kepada lima pasangan dari rumah tangga militer. Dengan penelitian dilakukan di lingkup Grup 2 PCBS Kopassus. Data dianalisis dengan menggunakan metode Miles dan Huberman dengan merujuk pada teori Women’s Triple Role dari Caroline Moser serta konsep lima pilar Mubādalah. Hasil penelitian menunjukkan bahwa istri karier mampu menjalankan peran ganda secara proporsional dengan dukungan suami. Relasi suami istri dibangun dalam semangat kesalingan, ditunjukkan melalui pembagian peran, komunikasi terbuka, serta dukungan emosional dan spiritual. Konsep Mubādalah terbukti menjadi pendekatan yang relevan dalam memperkuat ketahanan keluarga militer, sehingga tercipta rumah tangga yang harmonis, adil, dan berkeadilan. Penelitian ini memberikan kontribusi bagi wacana gender dan ketahanan keluarga dalam konteks rumah tangga militer modern.  

    Converging Religious Doctrine: Sunni-Shi’i Marriages in Indonesia

    Taking the floor in Bondowoso, this article sheds light on the cross marriage practices between Sunni-Shi’i communities. The main question addresses how the marriages converge religious norms and socio-cultural dynamics, considering the significant theological differences between the two. This study positions itself within the context of Islamic jurisprudence, highlighting the normative differences in marriage practices between Sunni-Shi’i traditions. Through in-depth interviews and participant observation, the findings reveal that love, economic considerations, and strong social support play crucial roles in overriding the different doctrines. Sunni-Shi’i couples in Bondowoso successfully take care of their relationships through mutual respect and open communication, contributing to broader social cohesion. The marriages between Sunni and Shi’i individuals in Bondowoso adhered to a combination of religious and state legal frameworks to ensure legitimacy and social acceptance. Some couples followed the Sunni Shafi’i school of thought ensuring that the marriage contract (akad nikah) included the presence of two witnesses and the guardian(wali) for the bride. In cases where Shi’i traditions were incorporated, the ceremony sometimes included additional blessings or teachings from Shi’i scholars, while the concept of temporary marriage (mut’ah) was explicitly avoided due to broader Sunni opposition. Additionally, all marriages were officially registered under Indonesia’s state law through the Office of Religious Affairs (KUA), aligning with national legal requirements for marriage recognition. [Berlatar di Bondowoso, artikel ini menyoroti praktik pernikahan antara anggota komunitas Sunni dan Syiah. Pertanyaan utama yang dibahas adalah bagaimana pernikahan tersebut mengharmoniskan norma-norma agama dan dinamika sosial budaya, mengingat adanya perbedaan teologis yang signifikan di antara keduanya. Studi ini berada dalam konteks yurisprudensi Islam, dengan menyoroti perbedaan normatif dalam praktik pernikahan antara tradisi Sunni dan Syiah. Melalui wawancara mendalam dan observasi partisipatif, temuan penelitian ini mengungkap bahwa cinta, pertimbangan ekonomi, dan dukungan sosial yang kuat memainkan peran penting dalam mengatasi perbedaan doktrin. Pasangan Sunni-Syiah di Bondowoso berhasil menjaga hubungan mereka melalui saling menghormati dan komunikasi yang terbuka, yang pada akhirnya berkontribusi terhadap kohesi sosial yang lebih luas. Pernikahan antara anggota Sunni dan Syiah di Bondowoso mengikuti kombinasi kerangka hukum agama dan negara untuk memastikan legitimasi serta penerimaan sosial. Beberapa pasangan sengaja mengikuti mazhab Syafi’i dengan memastikan bahwa akad nikah dilaksanakan dengan kehadiran dua saksi serta wali bagi mempelai wanita. Dalam kasus di mana tradisi Syiah turut dimasukkan, upacara pernikahan terkadang mencakup doa tambahan atau pengajaran dari ulama Syiah, sementara konsep pernikahan temporer (mut’ah) secara eksplisit dihindari karena adanya penolakan yang luas dari kalangan Sunni. Selain itu, semua pernikahan secara resmi didaftarkan sesuai dengan hukum negara melalui KUA, sejalan dengan persyaratan hukum nasional untuk pengakuan pernikahan.
