La legge degli Astynomoi e la tutela urbanistica a Pergamo nel II secolo a. C.
EnThis paper analyses anew two passages of the well-known Astynomoi Law in the attempt to stress the unitary character of this Hellenistic prostagma and to reconsider several procedural aspects that are central to the understanding of this document. Moreover, in these few pages the author tries to assess the current status of another important question pertaining to this text, namely the interpretation of its function in the 2nd century A.D. when it was re-inscribed and displayed in the lower Agora of Pergamon.DeDer vorliegende Aufsatz widmet sich der Analyse von zwei Abschnitten des Astynomengesetzes aus Pergamon unter einer neuen Perspektive. Dabei geht es vor allem darum, die einzigartige Bedeutung dieses hellenistischen Prostagmas hervorzuheben und einige Aspekte aufzuzeigen, die von besonderer Wichtigkeit sind, um das Dokument in seiner gesamten Aussagekraft zu verstehen. Darüber hinaus soll in einem weiteren Schritt Antworten auf die Fragen nach der Funktion dieser Inschrift im 2 Jhd. n. Chr., der Zeit also als die heute erhaltene Abschrift auf der Unteren Agora von Pergamon aufgestellt wurde, vorgestellt werden

Most of the exegeses conducted on the antinomy Iul. 13 dig., D. 41.1.36 - Ulp. 7 disp., D. 12.1.18 pr. are obviously led by the aim to confirm the respective theory of iusta causa traditionis held by the author. For instance, the prevailing opinion imputes to Iulian the justification of the transfer of ownership by a loan agreement, applying the principle in maiore minus inest. In different ways, but with the same intention, Cannata, Flume, Schanbacher, and Harke, amongst others, recently attempted to declare Iulian to be an exponent of a causal traditio. These theories seem to have in common the negligence of the fragment's wording: Iulian emphasizes the existence of a dissensus in causa twice, whilst mentioning exclusively the consensus in corpore as reason for the transfer of ownership. Thus, the pattern of a homogeneous opinion in classical Roman law, in terms of the causal principle like it is preferred today, cannot be convincingly founded in the antinomy
Patronum cooptare, patrocinium deferre: Lex Irnitana, cap. 61
EnThe patronatus admits different approaches, from the public law and also from the private law. In this paper I deal with public patronatus as it's cited in the spanish municipal laws examining their requisites trough a comparison between the Lex Ursonensis and the Leges Malacitana and Irnitana, and the significances of 'patronum cooptare' and 'patrocinium deferre'.ItIl patronato presenta diversi profili, di carattere pubblicistico come anche privatistico. In questo saggio l'A. indaga il patronato pubblico, così come è documentato nelle leggi municipali della Betica, esaminandone i requisiti attraverso una comparazione fra Lex Ursonensis e Leges Malacitana e Irnitana, con riguardo ai significati delle espressioni 'patronum cooptare' e 'patrocinium deferre'
