Assessing China’s Environmental NGO Public Interest Litigation Against the U.S. Citizen Suit Model
Get PDFThis dissertation introduces the U.S. and China’s environmental governance evolution, the background of their private enforcement provisions, including each country’s environmental legislative, administrative, and judicial development before establishing private enforcement. After the introduction, the second section examines the U.S. environmental citizen suits’ origin, environmental movements during the 1960s and 1970s, and pioneer ENGOs’ legal experiences. Statutory provisions are reviewed in various aspects in order to fully present this significant U.S. private enforcement measure. The third section analyzes the trajectory of Chinese ENGO EPIL development, including the provisions and typical actions according to several scattered provisions. Section four compares the theoretical and procedural distinctions between the two. Finally, in section five, specific legislation and implementation recommendations to Chinese legislatures and growing Chinese ENGOs are also discussed. One recommendation is to comprehensively legislate an Environmental Public Interest Relief Law in China by integrating statutesto reframe a sound legal system with a rectified understanding of the U.S. environmental citizen-suit system. Another suggestion is to encourage ENGOs to positively and actively reinforce their professionalism through achievable and practical actions based on steady resources and altruistic ethical compliance. As a vital type of private enforcement, ENGO EPIL actions would be oriented to assuring environmental governance compliance to ultimately promote the fundamental and comprehensive environmental governance pattern, environmental administrative enforcement. The recommendations will help systematically realize and regulate environmental EPIL proceedings and continually promote the primary environmental administrative enforcement in an increasingly open and inclusive social context in the coming future

Teaching with Feminist Judgments
Get PDFThis chapter, part of Integrating Doctrine and Diversity: Inclusion and Equity in the Law School Classroom (Carolina Academic Press 2021), provides an overview of the U.S. Feminist Judgments Project, a collaboration of feminist scholars and lawyers who rewrite significant judicial opinions using feminist methods and reasoning. One of the primary goals of the series of Feminist Judgments books is to demonstrate that the law has a vast, but often unrealized, potential for social justice. The feminist judgment methodology requires the authors of rewritten opinions to act as judges in following the rules of precedent and custom—and to be bound by the same facts and law as in the original opinion—while demonstrating that cases can still be decided in ways that address social justice concerns. The academics, activists, and lawyers who collaborate on these volumes provide rewritten opinions accompanied by commentaries that help law students and other readers understand the social and historical context of the original judgment as well as the ways in which feminist theories and approaches influenced the feminist judgment’s reasoning or outcome or both.
This chapter provides concrete suggestions for using feminist judgments as a teaching tool in first-year legal writing courses, doctrinal courses such as in Property, Constitutional Law, and Torts, as well as upper-level courses in Business Associations and Taxation. The rewritten judgments can help students think creatively when researching, show students how to do deep factual research, and help with cultural competence. Analysis of the feminist judgments can also illuminate deeper issues of diversity and inclusion and allow students to become more sensitive to embedded or unconscious bias that they might have otherwise overlook in judicial opinions presented in a typical casebook. By heightening students’ awareness of the importance of perspective, feminist judgments are invaluable and flexible teaching tools
United Nations at 75 and the Challenges Facing International Law
Get PDFOn September 21, 2020, the Member States celebrated the seventy-fifth anniversary of the founding of the United Nations. In the Declaration marking the occasion, world leaders recounted the achievements of the body, including catalyzing decolonization, promoting and protecting human rights, working to eradicate disease, helping mitigate dozens of conflicts, and saving lives through humanitarian action. They also enumerated challenges the world faces, such as “growing inequality, poverty, hunger, armed conflicts, terrorism, insecurity, climate change, and pandemics.” These challenges, the Declaration said, are interconnected and can only be addressed through reinvigorated multilateralism, which, it emphasized, “is not an option but a necessity as we build back better for a more equal, more resilient and more sustainable world.
The Effect of User Interface, User Experience and Design on Mobile E-commerce Applications in the Fashion Industry
Get PDFThis study aims to explore elements of the user experience, and how those with the user interface and design of mobile apps in the e-commerce and fashion industries affect the user experience and customer behavior with online shopping. In this area, other work has been done in evaluating the user experience, and its effects on components of the user interface and design, however, this study offers a more specific look into these features in a niche industry, namely in the frame of e-commerce and the fashion industry. This fits into the context of the field of the user experience as the end-user is central to optimizing the online experience, so gauging it will help optimize features in an application or platform. This also fits into the context of information systems as all applications and businesses, many of which are in the e-commerce and fashion spaces, utilize the technologies and concepts of information systems. To approach this challenge, a survey was conducted using Qualtrics, since conducting a survey is a common method used to answer questions concerning the user experience. Subjects were asked preliminary questions, and questions addressing the five variables of user intention in buying products, usability, ease of use, findability, and desirability. Survey data was collected, and two multiple regression analyses were performed. The statistical significance of the results is determined, and then the relevance is evaluated. It was found that if an application in the mobile e-commerce fashion space is useful to the user, then it is desirable to the user. It was also found that if an app is desirable to the user, users in turn have the intention to buy products using these apps. From this research, next steps include obtaining a larger sample size to get more statistically significant data. Future research includes testing other factors of the user experience, modifying the survey to further test existing variables, and exploring different niche industries in mobile e-commerce applications to explore the user experience in other areas of e-commerce
