COMMUNICATIVE PHENOMENOLOGICAL THEORY OF LAW
Today the communicative phenomenological law theory is one of the most popular post-non-classical norms of law. Its initial premise is a position: communication is a condition for the existence of law and a form, not just a public one. Texts, actions for their construction and interpretation, the associated thinking, understanding, and interaction of legal subjects form the content of the communication. Considerable interest in the issues of the communicative interaction of legal subjects leads to the assumption that the types of integration understanding are intensively sought in the interpretation of legal phenomena. As noted by one of the most prominent representatives of this theory of law, A.V. Polyakov, legal communication is a legal interaction of legal subjects that arises on the basis of legal interpretation, provides them with correlative powers and legal obligations that are implemented in legal behaviour. At the same time, legal communication is not only a phenomenon of law but also communication as an interactive dialogue of legal subjects, which is implemented using language, as well as other non-verbal means of communication. The theory of legal communication is created on the basis of the need to study the problems of the influence and effectiveness of legislative texts, their impact, which means that legal communication should provide not only the connection of the legislator with the subject of law but also feedback – the connection of the subject of law with the legislator
MOTIVATION OF STUDENTS AND LECTURERS IN THE DISTANCE LEARNING PROCESS
The aim of the scientific article: is to describe and summarize the available literature sources about the advantages and the most significant disadvantages of the distance learning process. The scientific article summarizes how the distance learning process affects students and lecturers, and what are the advantages and most significant disadvantages of such a study process. At the beginning of the pandemic, the distance learning process developed rapidly, which surprised both students and lecturers, as they unexpectedly had to adapt to the new study process and acquire new skills, lecturers to be able to give lectures effectively remotely and students to learn lectures. The distance learning process has both advantages and disadvantages, which are also described in the research. Within the framework of the research, the analysis of literature and materials and the logical constructive method are used to gather the opinions of various authors on the topic of the scientific article
THE RESEARCH OF “UNCONDITIONAL BASIC INCOME” CONCEPT
Over time, the topic of people\u27s financial equality and well-being has always been actual. The topic has been updated by researchers in the past and also today. In the recent past, this idea has been reborn, because with the increasing development of automation and robotics processes, artificial intelligence threatens to take away people’s work. Today, however, this social idea of an unconditional basic income in various societies has acquired a whole new novelty through the circumstances caused by the current emergency on a global scale. The conditions caused by the Covid-19 crisis have overtaken artificial intelligence, leaving millions of people around the world out of work and income. No one can clearly predict the future consequences of the crisis, at the moment we can only sense its approximate scale, which requires a non-standard approach. One of the solutions that would help humanity to survive this turmoil is the unconditional basic income. The idea of unconditional basic income is studied in the work, including the explanation of the concept, advantages and disadvantages, financing possibilities
MOTIVATION TECHNIQUES FOR GAINING AND MAINTAINING THE LOYALTY OF NOWADAY’S WORKFORCE
The problem to be studied: Employee education is not the only criterion. Preparation for a specific job is also important. A lot of resources are spent on training new employees, so it is important to keep existing ones. There is a relatively high unemployment rate in Latvia. At the same time, many employers are looking for employees. The aim of the research: to mark the main causes of staff turnover and to develop proposals for their reduction. To achieve the aim, the following tasks were performed: there were studied the structure and dynamics of salary; job advertisement research; reasons for leaving the job. The authors drew conclusions and made some supplements to employers to attract new employees and retain existing ones
ANXIETY AMONG SCHOOL-AGE CHILDREN IN WAR-AFFECTED AREAS IN UKRAINE AND WAYS TO REDUCE IT: PARENTS’ VIEWS
The Ukrainian-Latvian team of researchers are dedicated to commit their research to finding out parents’ views on whether school-age children experience anxiety in war-affected areas in Ukraine and ways to reduce it. The research also enables to identify the most common signs of anxiety. The data collection instrument includes a web-based questionnaire developed by researchers from Ukraine using Google Forms. All researchers are involved in sharing the developed web-based questionnaire via social media networks. The research sample includes 1346 parents of school-age children from all the parts of Ukraine, namely, Central, Eastern, Western, Northern, Southern Ukraine and Kyiv. Research findings demonstrate the urgent need to implement targeted psychological and pedagogical influences (the use of technologies, methods and techniques aimed at reducing the level of anxiety in school-aged children) in the educational process of general secondary schools, regardless of whether this process is carried out face-to-face, remotely or in a blended learning format. The conducted research makes it possible to substantiate the necessity of creating a web-based support system for educators to reduce anxiety among school-age children. THE EFFECTS OF MYOFASCIAL SELF-RELEASE METHOD AND TOOL APPLICATION ON ATHLETE STRENGTH INDICATORS IN TIBIA EXTENSOR MUSCLES IN FITNESS
The aim of the present study was to analyse the effectiveness of myofascial self-release methods and the use of the tool in the development of strength indicators in the tibia extensor muscles. Instrumental assessment of muscle function was performed on a REV 9000, Technogymᴿ, Italy. The subjects of our study were twenty healthy fitness athletes aged between 20 and 23 years. A set of strength exercises was developed, consisting of 10 exercises focused on increasing the muscle strength of tibia extensor muscles. For the experimental group self-massage with a roller was applied. When applying strength-development exercises with a set of self-release, the dynamics of maximum strength results are as follows: the force balance of the dominant and the non-dominant leg in the control group before (p=0.001) and after (p=0.02) the experiment, and in the experimental group before (p=0.01) and after (p=0.02) the experiment remained unchanged – no significant changes were observed in the results between the groups; - positive dynamics in strength changes were observed for the dominant leg between the control group (p=0.08) and the experimental group (p=0.37) before and after the experiment. The positive increase in the results is in favour of the experimental group, although there are no significant statistical differences in the results of the control group. On the other hand, no differences in the strength dynamics of the non-dominant leg were found.
WEB APPLICATION METHOD "3D EMOTION COMPOSITION IN SUPERVISION" APPROBATION
The global pandemic has accelerated the development of the digital environment, face-to-face work is transferred online, so it is important to create tools adapted to the digital environment. The emergency of Covid-19 has raised the demand for online supervision. In supervision sessions, it is important to talk about experiencing emotions in a professional environment. Latvia lacks digital methods for working with emotions in supervision. The aim of the study was to adapt the 3DEC method, to create it as a web application for use in remote supervision and to approbate the web application "3D emotion composition in supervision" in individual online supervisions. The original method 3DEC is intended for the evaluation of emotional experience in the practice of art therapists (Lejstrauta, 2021; Vanadziņa, 2021). The theoretical basis of the 3DEC method is integrative and includes the following principles: visual representation of emotions in a visible symbolic form; play and play space (Winnicot, 2007); distancing as one of the cognitive emotion regulation strategies (Powers & LaBar, 2019). 3DEC is also based on the Adaptive Coping with Emotions Model (ACE Model) (Berking & Whitley, 2014). The adapted method “3D composition of emotions in supervision” (3DECS) is intended for work in online supervision with the aim to promote awareness of emotions, their understanding and self–reflection. Using distancing and view of other perspectives, the method helps the client to reflect and become aware of emotional experiences, as well as provides an educational function about the meaning of emotions. The 3DECS method develops emotional awareness and adaptive emotion regulation skills. Main results: 1) the web application has been tested and is designed to work with emotions in supervision; 2) the data of the approbation stage show that the web application is sufficiently simple and intuitive; 3) the web application is secure because no information about the customer and the customer\u27s actions in the tool is stored; 4) there are no restrictions on the use of the web application in relation to the duration of the cooperation between the supervisor and the supervision client.
ADAPTATION OF THE ADDICTION TEST ON SOCIAL MEDIA
The issue of addiction to social networks is relevant for our time. The studies carried out in different cultural contexts indicate that addicted people are anxious, less satisfied with life, they may have problems with academic performance and with the achievement of their life and professional goals. Addicted people are more common among younger generation. For the diagnostic and corrective work with people who have addiction problems, require appropriate tools. One of these tools is described in our work. This is a test of dependence by Sheinov in addiction on social networks. The purpose of this study was to translate this test into the Latvian language, to check its reliability and validity. The relevant procedures described in the text of the article indicate to a high degree of reliability and validity of this test. It can also be used for the scientific purposes.
EDUCATORS’ FEEDBACK ON WEBSITE “OVERCOMING STRESS AND ANXIETY TOGETHER: TEACHERS – SCHOOLCHILDREN – PARENTS”
The research aim was to collect feedback from educators on the website “Overcoming Stress and Anxiety Together: Teachers – Schoolchildren – Parents” created within the joint Latvian-Ukrainian project “Web-based Support System for Educators to Reduce Children’s Anxiety in War-affected Areas” (Registration No GPK-07/2022). Immediately after creating a demo version of the website, researchers organised webinars aimed at presenting its content to educators in Ukraine and collected feedback from webinars’ participants. For that very reason the joint Latvian-Ukrainian team of researchers developed a web-based questionnaire using Google Forms. The population of the conducted research comprised 216 educators from different regions of Ukraine including university lecturers, general secondary teachers, researchers and students of pedagogical specialties. The obtained results proved the necessity of developing the web-based support system for educators aimed at reducing anxiety among schoolchildren in war-affected areas in Ukraine.
FORMING OF RESPONSIBILITY IN CHILDREN OF OLDER PRE-SCHOOL AGE BY MEANS OF FICTION LITERATURE
A civilized society sets requirements for the democratic coexistence of persons who possess moral values, benefit society and develop their own abilities. An important characteristic of a person is responsibility, which is formed as a result of the integration of thought processes, social norms, personal attitude in solving dilemmas in life. Responsibility as a child’s conscious behavior in relation to people and nature begins to develop in the period of older preschool age. Independent thinking in judgments acquires logic and a personal attitude to reality. In the pursuit of social activity, children imitate the behavior of significant adults, heroes of their favorite films, cartoons, and works of art. Educators and parents are faced with the task of developing the philosophy of children\u27s worldview through conducting moral and ethical discussions. Our survey of children’ parents with special needs showed a low level of parents’ and educators’ attention to the education of responsibility (4%) compared to other personal qualities (discipline ‑ 18%, ability to adapt to life ‑ 20%, respect to parents ‑ 14%, etc.). This indicates the need to conduct special educational activities that compensate for gaps in value orientations. Emphasis has also been shifted in the education of executive responsibility as opposed to initiative responsibility (75% : 25%), which gives reasons to look for new ways in organizing the interaction of participants in the educational process, to use moral and ethical conversations, to study educational children\u27s literature, in particular, the works of V. Sukhomlynskyi (2018), which became the goal of our scientific exploration. Examples of artistic works and developed problematic questions and tasks for educational work with children of older preschool age in the conditions of a preschool education institution are given
