The legal protection for the acquired employment rights of the public officer in Iraq

    No full text
Public officers are guaranteed several acquired employment rights, like annual salary increases, promotion, leave, and overtime pay. However, in Iraq, there is frequent issuance of revocation and cancellation decisions for previously acquired employment rights. These decisions are often conducted without due consideration of the potential violations of the previously granted acquired rights. The root of this issue may be traced back to deficiencies within the legal framework governing the revocation and cancellation in Iraq and the apparent shortfall in the expertise of the personnel responsible for issuing these revocation and cancellation decisions. By adopting doctrinal and non-doctrinal legal research methodology, this thesis examines the legal protection for the acquired employment rights of the public officer in Iraq. It examines the laws and regulations governing the acquired employment rights of the public officer in Iraq; determines judicial legal guarantees approved by the Iraqi Judiciary to protect acquired employment rights of the public officer in revocation and cancellation cases; analyses the extent to which the Iraqi judiciary applies these legal guarantees to protect the acquired employment rights of public officer in Iraq; recommends what strengthens the protection and stability of acquired employment rights of the public officer in Iraq in revocation and cancellation cases. The data was collected through the library-based approach and semi-structured interviews with judges, lawyers, public officers, jurists, and academics. Several methods of data analysis, such as critical, analytical, and content analysis, were employed in analysing the data. The findings reveal that the laws, such as Civil Service Act No. (24) and State Employees Discipline Law No. (41), governing acquired employment rights in Iraq are not sufficient, and there is legal uncertainty in the revocation and cancellation decisions issued by the administrative judiciary. This is due to the legal ambiguity in the applicable laws. Legal reforms are recommended to enhance clarity and specificity in the regulations governing study leave and promotions in the Iraqi public service. By amending Article 7 of Instruction No. (165) for study leave to detail cancellation reasons and revising Article 7 of Civil Service Act No. (24) to require Promotions Committee members to be experts in administrative and legal affairs, these changes aim to safeguard public officers' acquired employment rights, thereby improving legal certainty and fostering a creative work environment

    Get PDF
In recent decades, Malaysia has witnessed significant economic growth and development. However, this progress has been accompanied by rising living costs, particularly in urban centres, placing increasing pressure on household budgets. This thesis investigates the impact of rising household expenses on the financial distress experienced by individuals and families residing in urban areas of Malaysia. Using in-depth interviews, the research explores the challenges and coping strategies of both urban and rural residents dealing with financial strain. It highlights the different ways individuals and families manage these challenges, and the potential consequences of their strategies. The study finds that rising household expenses greatly impact financial distress, with low-income urban families being the most affected. Middle-income households use budgeting strategies to cope, while upper-income groups face fewer disruptions. Financial distress extends beyond just material hardship, contributing to psychological stress and strained social relationships. Common coping mechanisms include growing food, cutting discretionary spending, and relying on community support. The findings stress the need for targeted policies like subsidies and financial education to help vulnerable groups manage financial distress and build resilience

The development of the takaful industry in Malaysia was inspired by the prevailing needs of the Muslim society for a Shariah-compliant product. The market penetration rate for conventional life insurance and family takaful products for 2022 was 54 and 20.1 percent, respectively. It indicates that much of the Malaysian population is still uninsured/protected. Thus, this study incorporates the Theory of Planned Behaviour with other supporting behavioural-based theories, such as the Brand Association, Unified Theory of Acceptance and Use of Technology and Initial Trust Formation Model, in assessing the customers’ intention to participate in the products. These theories highlighted crucial predictors for behavioural studies, including the influence of attitude, subjective norms, perceived behavioural control, halal brand association, facilitating condition and moderating effect of institutional trust on the behavioural intention. A questionnaire was conducted on academicians in seven Malaysian private Islamic universities. The data were analyzed using Covariance-Based Structural Equation Modelling (CB-SEM) and Statistical Package for the Social Sciences (AMOS). The result unveiled that attitude, subjective norms, and perceived behavioural control are positive and significantly influence the customers’ intention to participate in the family takaful products. Meanwhile, the two variables, halal brand association and facilitating conditions, indicated unsupported insignificant evidence. Moreover, institutional trust has significantly moderated the relationship between attitude, subjective norms, and perceived behavioural control on behavioural intention, but not halal brand association and facilitating conditions. This study highlights the crucial importance of these factors, adding to the existing knowledge and literature. Takaful operators must utilize these findings to enhance their operations and effectively re-strategize their marketing of the products to the public
