A legal analysis of judicial rules and procedures relating to public order concept in Palestinian civil and commercial procedure law no. (2) of 2001 and the impact of nullity on it
In Palestine, matters regarding civil and commercial disputes brought before civil courts are subject to the litigation procedures stipulated by the Palestinian Civil and Commercial Procedures Law No. 2 of 2001. According to this law, litigation rules are of two types: peremptory or supplementary rules, depending on their relevance to the public order concept. While the supplementary rules are subject to the will of the parties where they may agree to confer jurisdiction on a specific court located within the country of their choice, for peremptory rule that is related to public order, the jurisdiction belongs to the court. As specified in Law No. 2, the court and litigants must apply the peremptory rule, or judicial ruling will be nullified. Despite this, the Law does not clarify “public order”, making it impossible to distinguish peremptory rules and supplementary rules. Other than bringing about the nullity of the judgment, there were also inconsistencies and contradictions in the judicial decisions. Therefore, this study aims to examine public order concept in addition to distinguishing the peremptory rules from the supplementary rules. This is a doctrinal legal study that adopted a qualitative approach. The study considered both primary and secondary sources namely the law, scholarly articles, books, and online databases. Moreover, interviews were held with 12 respondents for their expert opinion on the subject matter where the data obtained were further transcribed. Other data sources gathered were critically and analytically analysed through the content analysis approach. The finding indicates uncertainty to the meaning and definition of public order concept that has caused difficulty in distinguishing peremptory and supplementary rules. This has not just resulted in contradictions and nullity of judicial rulings but also delaying the issuance of the judgments. Therefore, to avoid this ambiguity, the study recommends amending Law No. 2 by supplementing provisions that explain and clarify public order. This will subsequently enhance the concept of public order and make clear discrepancy between peremptory and supplementary rules, thus circumventing or lessening contradictions of judicial rulings and nullity of judgments

Integrated competency-based leadership development programme in a non-governmental organisation: An action research
This research aims to adopt best practices in Leadership Development Programmes (LDPs) utilized by the business sectors and apply them in the context of nongovernmental organisations (NGOs) in improving and transforming their leadership development and succession planning. Previous research mostly focused on LDP practices in businesses, and little attention given to the Non-Governmental Organisations (NGOs). Notably, few studies focused on the practical applications of the LDP practices and how to integrate the types of learning to ensure consistency and coherence of its implementation. This study addressed the gap by implementing a competency-based LDP in NGOs and integrating formal, informal and social learning. The study employed a collaborative action research approach with four cyclical motions: planning, acting, observing, and reflecting, in a planned and systematic manner. The study found that best practices in LDPs by business organizations can be implemented in an NGO setting. Another important finding of the study is that by providing a practical framework, formal, informal, and social learnings can be integrated in the NGO setting. The study main finding is a LDP framework that serves as a practical guide for integrating formal, informal, and social learning when implementing a competency-based LDP in the context of NGOs' culture and operating environment. Overall, the study extends the LDP framework, thus aid as guide in integrating formal, informal, and social learning when implementing a competency based LDP in the context of NGOs' culture and operating environment

The effect of MCCG compliance level on the likelihood of Malaysian firm financial distress
This study aims to examine the effect of the Malaysia Code of Corporate Governance (MCCG) compliance on the likelihood of financial distress among Malaysian industrial firms. Secondary data from Datastream and manually collected data from annual report disclosed in Bursa Malaysia for 78 listed firms under the industrial sector from 2017 to 2021 with a sample of 390 firm-year observations, are used to self-construct corporate governance index. Binary coding score is constructed to measure MCCG compliance in the Malaysia Corporate Governance Index (MCGI). Descriptive analysis, correlation analysis, regression model analysis on three models comprised of corporate governance element, mechanism, and self-constructed MCGI is used to examine the effectiveness of MCCG 2021 in mitigating financial distress on Malaysian PLCs. Using Binary Logistic Regression analysis, this study provides evidence that good corporate governance can also be achieved by adhering to the best practices proposed in MCCG 2021 as it positively reduces the likelihood of financial distress. MCCG 2021 provision is adequate for Malaysian firms to sustain their financial stability. This study enriches the literature on corporate governance by supporting that CG best practices reduce the level of financial distress in a listed firm. Interestingly, the appointment of senior independent directors, gender diversity, two-tier voting process elements, and risk management committees mechanism have negative significant relationship with the financial distress likelihood. These findings encourage listed companies in Malaysia to adhere to and implement good corporate governance practices guided by MCCG 2021, which has been proven to reduce the likelihood of financial difficulties and increase investor, regulatory, and stakeholder confidence. This research study is subject to several limitations. The observation period of the company year needs to be extended as this study involved only 35% of listed firms in the industrial sector in Malaysia
Investment propensity among Malaysian youth in the stock market
This study is to investigate the association between six independent variables which separated by significant association namely psychological behaviour, financial literacy, risk tolerance and insignificant association including attitude, perceivable behavioural control, and subjective norms. To achieve the study objective, the primary data has been collected by means of questionnaires. The questionnaires have been distributed to Malaysian youth which 100 surveys have been successful collected. This paper's findings came from a survey of 100 Malaysian youth respondents. To analyse the data, this study has utilised Partial Least Squares Structural Equation Modelling (PLS-SEM). The findings indicated that the dependent variable and independent factors had both a significant and an insignificant association. Psychological behaviour significantly positively influence stock market investment intention. This study in line with the Phan and Zhou (2013) study's conclusions. However, it was discovered that financial literacy, risk tolerance, attitude, subjective norms and perceived behaviour control had insignificant impact on Malaysian youths' intentions to invest in the stock market. This study's conclusions contradict those of earlier research, which are not consistent with one other (Ibrahim & Arshad, 2018; Lai, 2019; Ryu & Ko, 2019). Finally, by better understanding the variables that influenced Malaysian youth’s investment intention, this study will be useful to future researcher, the government, and investment firms
