Records Management of the Cabinet Legislation Bureau: as an example of Houreiansingiroku\n
Get PDFpdf本稿の目的は、内閣法制局において作成される『法令案審議録』（以下、審議録）の管 理や構造を分析し、内閣法制局の記録管理に対する認識を明らかにすることである。 内閣法制局は、各省庁が立案した法律案、政令案および条約案の審査を行う。このよう な職務は審査事務と呼ばれる。『審議録』は、この過程の中で作成される資料で、法制局 が取得した法令案や参考資料、想定問答などが綴られる。先行研究では、1972年に制定さ れた「法令案審議録整理保存要領」によって、『審議録』の作成や管理が定められたと考 えられている。
そこで、本稿では、まず、1969年に作成された複数の『審議録』について、綴られる 資料やその構造を分析した。そして、1975年の『審議録』についても同様の検討を行い、 両者を比較検討した。
その結果、1969年の『審議録』に綴られる資料や編集の方法に規則性が存在することを 明らかにした。さらに、この編集方法は、1975年の『審議録』でもほとんど同様であった。「法 令案審議録整理保存要領」は従来の編綴方法を明文化したものであったといえる。そして、 このような管理が続けられたことは、『審議録』が法制局にとって極めて重要な資料であ ると認識されていることを示している。
The purpose of this paper is to analyze the management and structure of Houreiansingiroku that is records of deliberations on bills and proposed ordinances made in the Cabinet Legislation Bureau, and to clarify recognition for the record management of the Cabinet Legislation Bureau.
The Cabinet Legislation Bureau exams all legislative bills, draft Cabinet orders, and draft treaties that are to be brought before Cabinet meetings. This is called "examination work". Houreiansingiroku was made in this examination work and composed of bills, reference materials, and questions and answers, and so on. In the precedent study, it is thought that the way of making and the management of Houreiansingiroku were established by Houreiansingiroku Seirihozonyouryou established in 1972.
In this paper, I analyzed the spelled document and structure about Houreiansingiroku made in 1969. And I performed a similar examination about records of 1975 and compared 1969 with 1975.
As a result, there are regularities for the editing method and the filed documents in the deliberation record of 1969. And it was revealed that this way of making was almost like the deliberation record of 1975. It is thought that Houreiansingiroku Seirihozonyouryou stipulated a conventional binding method. The fact that this record management has continued indicates that Houreiansingiroku is recognized as an extremely important resource for the Cabinet Legislative Bureau.departmental bulletin pape
