The Role of Law in Handling Demonstrations and Destruction of Public Facilities: A Review of Provisions in The KUHP and Enforcement Practices

    No full text
The phenomenon of demonstrations that culminate in anarchic acts and the destruction of public facilities creates a dilemma between upholding order and protecting freedom of expression as a constitutional right of citizens. This article seeks to examine in depth the legal provisions regarding demonstrations and the destruction of public facilities as stipulated in the Criminal Code (KUHP) and analyzes the practice of law enforcement from the perspective of justice and legal certainty. The research method used is normative juridical, with a conceptual and legislative approach through a review of positive legal norms, legal principles, and expert doctrines. This approach is used to find the integration between norms and practices in law enforcement against demonstrations that culminate in anarchy. The results of the study indicate that although normatively the Criminal Code has adequately regulated through articles regarding violence against people or property, the practice of law enforcement still faces problems in applying the principles of proportionality and protection of human rights. Substantively, the law has not fully functioned as a means of social reform because it is often applied rigidly without considering the social and political context behind the demonstrations. Therefore, a progressive legal approach is needed as proposed by Satjipto Rahardjo, which positions law not only as an instrument of order, but also as a tool of justice that is oriented towards benefit and humanity

The Position of Children from Unsecured Marriages in The Distribution of Inheritance: A Study of National Civil Law and Islamic Law

    No full text
Unregistered marriages that are religiously valid but not registered by the state often raise issues regarding the status of children in inheritance. This phenomenon is increasing in society, but has not been balanced by an adequate understanding of the legal consequences for the status of children. This study uses a normative juridical method with a statutory regulatory approach and a comparison between National Civil Law and Islamic Law. The results show that in National Civil Law (Marriage Law and Civil Code), children from unregistered marriages are categorized as illegitimate children and only have a civil relationship with the mother, unless there is evidence and a court ruling. Constitutional Court Decision No. 46/PUU-VIII/2010 expands the civil relationship with the biological father, but its application still relies on formal evidence so that children's access to inheritance rights is still indirect. In contrast, in Islamic Law and the Compilation of Islamic Law, the validity of a marriage is determined by the fulfillment of the pillars and requirements of religion; children from unregistered marriages are considered legitimate children and automatically have a lineage relationship and inheritance rights to the father based on the principle of al-walad lil-firāsy. Thus, there appears to be a disharmony: Civil Law prioritizes administrative certainty, while Islamic Law prioritizes substantive justice and the protection of children's rights

Online Sales and Purchase Agreement as A Private Deed: Analysis of Legal Certainty, Contract, and Formal Authority

    No full text
Digitalization has driven a shift in buying and selling transaction patterns from conventional forms to online transactions through marketplaces and social media. This change raises questions regarding the status of online buying and selling agreements as private deeds in the civil evidence system. This study uses a normative juridical method through a statute approach, a conceptual approach, and a case approach. The purpose of the study is to analyze whether digital agreements such as checkout, chat, electronic invoices, and the use of electronic signatures meet the requirements for a valid agreement in Article 1320 of the Civil Code and can be qualified as private deeds. The results of the study indicate that electronic documents have legal force as evidence under the ITE Law and substantially fulfill the elements of an agreement according to the Civil Code. However, there are still conflicting norms and inconsistent application by judges regarding the authentication of electronic documents in civil disputes. This study also emphasizes that further regulations regarding the legalization mechanism or formal validation of electronic documents are needed so that digital deeds obtain evidentiary force equivalent to private deeds in judicial practice

The use of polybags in plant nurseries has negative environmental impacts due to their non-biodegradable nature and potential contribution to plastic pollution. This study aims to develop organic pots as an alternative to polybags, which also function as soil amendments for peatlands. The organic pots were formulated using a combination of organic and inorganic materials, including egg trays, maggot compost, cocopeat, and dolomite. Three formulations were tested with the following compositions: (1) 50% egg trays, 40% maggot compost, 5% cocopeat, and 5% dolomite; (2) 50% egg trays, 35% maggot compost, 10% cocopeat, and 5% dolomite; and (3) 50% egg trays, 30% maggot compost, 15% cocopeat, and 5% dolomite. The pots were molded using a manual tool and sun-dried. Maggot compost was used due to its high content of macro and micronutrients, as well as its alkaline pH, which helps neutralize the acidity of peat soils. The results showed that the organic pots had good physical structure, were biodegradable, and had the potential to improve seedling growth in peatland environments. This innovation offers an environmentally friendly solution for nursery management and reducing plastic waste in the forestry sector
