Protection of Children's Rights in Post-Divorce Custody Disputes Comprehensive Study on the Best Interests of Children
In the framework of Indonesian positive law, it is only the KHI that assigns child custody to the mother. Other legal provisions merely indicate that both parents are responsible for their children's care without clarifying which parent is awarded custody following a divorce. Various rulings exist that have granted custody to mothers, yet there are also instances where custody has been awarded to fathers. This creates ambiguity regarding the determination of child custody post-divorce. The objective of this study is to assess the most effective indicators for judges to consider in making child custody decisions, grounded in the principle of prioritizing the child's best interests. The methodology employed for this research is prescriptive normative legal analysis with a conceptual focus. Findings indicate that several factors can be utilized when deliberating on custody matters, including the child's wellbeing, the behavior of the parents, cooperation between them, and the allocation of parenting time. Should there be a need for additional factors, judges are permitted to incorporate these, provided they align with the principle of the child's best interests
Mining Permits and Environmental Justice in Indonesia: Imam Al-Mawardi's Perspective on the Decision of the Semarang Administrative Court No. 68/G/Pu/2021/PTUN.SMG
This study aims to analyze the dynamics of mining permits in Indonesia through a case study of the Semarang Administrative Court Decision No. 68/G/Pu/2021/PTUN.SMG, with a particular focus on environmental justice for the residents of Wadas Village from the perspective of Imam Al-Mawardi's thought. The research employs a normative juridical method with a qualitative approach, examining legal documents, court rulings, mining regulations, and Islamic literature related to the concept of justice. The findings reveal that the court's consideration primarily emphasizes administrative and procedural legality, while neglecting the principle of substantive justice, which, according to Al-Mawardi, centers on the protection of community rights, public welfare (maslahah), and the prevention of environmental damage. These findings highlight a disparity between national development interests and the rights of local communities. Accordingly, the study recommends a reform of mining permit policies to ensure greater participation and fairness, as well as the integration of the principle of al-‘adalah (justice) into legal decision-making and public policy processes in Indonesia
Legal Protection of the Fulfillment of Workers' Rights in Industrial Relations Disputes (Case Study of Pt New Era Rubberindo Gresik)
Industrial relations disputes remain one of the most persistent problems in Indonesia’s labor governance, particularly regarding the fulfillment of workers’ fundamental rights. This study examines the issue of weak legal protection experienced by workers in industrial relations disputes, as reflected in the case of PT New Era Rubberindo Gresik, where workers’ rights to wages, severance pay, and social security were not fulfilled despite a court decision. The main objective of this research is to analyze the forms of legal protection guaranteed under Law Number 13 of 2003 on Manpower, Law Number 6 of 2023 on Job Creation, and Industrial Relations Court Decision Number 706 K/Pdt.Sus-PHI/2022, as well as to evaluate the effectiveness of dispute resolution mechanisms in ensuring compliance with these provisions. This research employs a normative juridical method with statutory and case approaches. Primary data consist of labor regulations and the PHI decision, while secondary data consist of academic literature on labor law. Data were analyzed descriptively and qualitatively to assess the consistency between legal norms and their implementation in practice. The findings indicate that legal protection for workers includes both substantive and procedural guarantees, but their implementation remains weak due to low corporate compliance and inadequate government oversight. In the case of PT New Era Rubberindo Gresik, the company failed to execute the PHI ruling despite having permanent legal force, demonstrating structural deficiencies in enforcement mechanisms. The study concludes that strengthening supervisory functions, applying firm administrative sanctions, and enhancing the role of labor unions are essential to ensure effective protection of workers’ rights in industrial relations disputes
Criminal Aspects of Drug Abuse in Indonesia (Normative Juridical Analysis)
Drug abuse is an extraordinary crime with multidimensional impacts on society, encompassing legal, social, and public health aspects. The increasing number of drug users each year indicates that existing criminal law policies are not yet fully effective in comprehensively preventing and addressing drug crimes. This research aims to analyze the criminal aspects of drug abuse using normative legal research methods based on legislative and conceptual approaches. The study examined Law Number 35 of 2009 concerning Narcotics, as well as various legal literature and previous research findings. The results of this study confirm that criminal law in drug abuse must be implemented in a balanced manner, combining repressive and rehabilitative aspects. The state needs to firmly enforce the law against drug dealers and producers, but is also obligated to provide protection and rehabilitation for users who become dependent. A proportional approach between criminal sanctions and rehabilitation will achieve substantive justice, reduce prison overcrowding, and create a more humane legal system oriented toward social recovery
Pengaruh Pembelajaran Matematika Realistik dengan Pendekatan ESD Terhadap Kemampuan Pemahaman Konsep Matematis Siswa SMA
Penelitian ini bertujuan untuk mengetahui pengaruh Pembelajaran Matematika Realistik (PMR) dengan pendekatan Education for Sustainable Development (ESD) terhadap kemampuan pemahaman konsep matematis siswa pada materi Statistika. Metode yang digunakan dalam penelitian ini adalah kuasi eksperimen dengan posttest only with non-equivalent group design, melibatkan dua kelas X dari salah satu SMA Negeri di Jakarta. Kedua kelompok sama-sama memperoleh pembelajaran melalui model Problem-Based Learning (PBL), namun pada kelas eksperimen diberikan perlakuan tambahan berupa PMR berbasis ESD. Pengumpulan data dilakukan melalui tes pemahaman konsep yang telah melalui proses validasi. Hasil analisis menunjukkan bahwa nilai rata-rata kelas eksperimen sebesar 83,03 secara signifikan lebih tinggi dibandingkan kelas kontrol yang memperoleh nilai rata-rata 74,24. Penelitian ini menggunakan analisis data dengan menerapkan uji-t independen guna mengidentifikasi perbedaan rata-rata nilai posttest antara kelompok eksperimen dan kelompok kontrol. Sebelum pelaksanaan uji-t, dilakukan terlebih dahulu pengujian asumsi melalui uji normalitas dan uji homogenitas untuk memastikan bahwa data telah memenuhi syarat penggunaan analisis statistik parametrik. Temuan ini menunjukkan bahwa integrasi pendekatan ESD dalam pembelajaran matematika memberikan dampak positif terhadap pemahaman konsep siswa. Selain meningkatkan kemampuan kognitif, pembelajaran berbasis ESD juga mendukung pembentukan kesadaran siswa terhadap persoalan sosial dan lingkungan. Oleh karena itu, PMR dengan pendekatan ESD dapat dipertimbangkan sebagai alternatif strategi pembelajaran yang inovatif, kontekstual dan relevan untuk diterapkan dalam pengajaran matematika di jenjang sekolah
Kemampuan Literasi Matematis Siswa dalam Menyelesaikan Soal Sistem Persamaan Linear Satu Variabel Konteks Parkir Kendaraan
Several previous studies have widely discussed students’ mathematical literacy; however, research that specifically analyzes junior high school students’ mathematical literacy in the topic of Linear Equations in One Variable through contextual problems remains limited. Therefore, this study aims to describe the mathematical literacy abilities of junior high school students in solving contextual problems related to the System of Linear Equations in One Variable. This study employed a qualitative research method involving 33 eighth-grade students of class VIII-I at SMP Negeri 6 Kota Jambi with diverse ability levels. The research instruments consisted of contextual essay tests, interviews, and documentation of students’ written responses. The test items were validated by experts and designed to reflect real-life situations. The results indicate that students’ mathematical literacy skills are generally low, with the majority of students classified in the low category. Students experienced difficulties in understanding information presented in the problems, formulating mathematical models, and interpreting as well as concluding the solutions. Analysis based on mathematical literacy indicators shows that only a small proportion of students were able to fulfill all three indicators comprehensively. These findings suggest that students have not yet met the demands of solving contextual problems mathematically. The results of this study may serve as a basis for developing more contextual and applicative mathematics literacy–based learning to improve the quality of mathematics education at the junior high school level
Towards a Deeper Understanding of Family Influence in the Guidance of Moroccan Muslim Students: Development and Validation of Specific Scales for Successful Guidance
In Moroccan Muslim societies, where collectivist and Islamic values shape familial roles, parental practices and family social-financial capital play a pivotal role in students’ career trajectories. However, existing measures rarely capture these intertwined dimensions within this specific socio-cultural framework. This study addresses this gap by conducting two independent studies to develop and validate two scales: the Scale of Parental Practices in Educational and Vocational Guidance (PPEVG) and the Family Social Financial Capital Scope (FSFC). The first study involved 324 Muslim high school students (55% girls) aged 17–18, enrolled in the final year of baccalaureate programs across various academic tracks, from six Moroccan regions, to validate the PPEVG. The second study included 340 Muslim students (62% girls) with the same characteristics to validate the FSFC. Both studies employed multistage cluster sampling. Exploratory (KMO=0.776 and 0.722) and confirmatory factor analyses confirmed the robustness of both scales, with McDonald’s omega coefficients ranging from 0.729 to 0.785. Findings from the PPEVG showed that supportive parental practices (M=16.4) were more prevalent than interfering ones (M=12.9), with a moderate correlation (r=0.36) suggesting that parents may exhibit both behaviors. Parental education significantly influenced practices: higher paternal education correlated with stronger support, while lower maternal education increased interference. FSFC scores highlighted the critical role of socio-financial resources in enabling students' mobility beyond their home region. These findings offer culturally tailored tools for counsellors and actionable insights for policymakers to design inclusive guidance frameworks and address socio-economic disparities in collectivist contexts
Effectiveness of Behavioristic Counseling Modeling Techniques and Role-Playing Techniques to Reduce Cyberbullying
Cyberbullying is an aggressive behavior that aims to hurt others in social networks through digital devices connected to the internet. Cyberbullying has negative impacts on its victims such as trauma, anxiety, depression, stress, and emotional disorders. The purpose of this study is to confirm the effectiveness of behavioristic counseling modeling and role-playing techniques to reduce cyberbullying in male and female students. This study used a factorial experimental design. The subjects in this study were 20 students who attended SMA Negeri 3 Mataram and SMK Negeri 2 Mataram, Indonesia. Data were collected using a cyberbullying scale. Data analysis used repeated measure Anava statistics. The results of this study reveal that behavioristic counseling with modeling and role-playing techniques is effective for reducing cyberbullying. In addition, it is obtained that the role-playing technique is superior to the modeling technique in reducing cyberbullying. Furthermore, the data obtained in this study showed that there was no significant difference between female students and male students in terms of the ability to reduce cyberbullying. Behavioral counseling can effectively reduce cyberbullying. In addition, behavioral counseling assisted by role-playing techniques is more effective in helping to reduce students' cyberbullying behavior than modeling techniques using videos
The Influence of the Learning Environment on the Learning Interest in Islamic Religious Education Subjects of Junior High School Students in Central Lampung Regency
This study aims to determine the influence of the learning environment on the learning interest of junior high school students in Central Lampung Regency. This study uses a quantitative method with a correlational approach. The population of this study is junior high school students in Central Lampung Regency. While the sample used in this study was 101. The sampling technique used propability sampling. This research instrument used a questionnaire while documentation study was used to obtain supplementary data. Based on the results of the t-test statistical test that the t-value = 6.745 and t-table = 1.96, with a significance value of 0.000 obtained, which means H0 is rejected. The results of the study indicate that there is a significant influence between the learning environment on students' learning interest. The coefficient of determination shows a score of 0.315, which means the influence of the learning environment on students' learning interest is 31.5% while the remaining 68.5% is influenced by other factors not examined. Thus, to increase students' learning interest, a conducive environment is needed, both physical and non-physical environments. Based on the results of the study, it is recommended that school principals and parents can take steps to create a safe and comfortable learning environment and improve the learning environment by adding facilities and infrastructure so that students' interest in learning can increase
Planting the Values of Islamic Religious Education in Elementary School Aged Children at the Baitul Makmur Islamic Boarding School, Metro Lampung
This study aims to examine the process of instilling Islamic religious education values in elementary school-aged children (6–12 years) at the Baitul Makmur Islamic Boarding School, Metro, Lampung. The research method used is a descriptive qualitative approach through observation, interviews, and documentation. The results show that the Islamic boarding school plays an important role in instilling religious values in students, emphasizing aspects of faith education such as the introduction of the pillars of faith, worship education through the practice of congregational prayers, and moral education including politeness, tolerance, and respect for teachers and parents. The learning methods applied include role modeling, habituation, targhib-tarhib, and Qur’anic and prophetic stories. Although positive impacts on children’s character formation are evident, several challenges remain, such as inconsistency in understanding ethics and responsibility. Overall, the cultivation of Islamic religious education values in this boarding school has proven effective in shaping children’s spirituality and personality from an early age
