Legal Dynamics of Child Determination in Marriage That Are Not Recorded From the Perspective of Islamic Law

    No full text
This study discusses legal issues related to the status of children born from marriage that are not recorded at the Office of Religious Affairs (KUA) as described in case Number 15/Pdt.P/2024/PA. Sdn in the Religious Court. This problem can be seen in the gap between the legality of religious marriage and the administrative legality of the state, which has an impact on the ambiguity of the nasab and the protection of children's civil rights. The rights of children that should be guaranteed by the state such as the right to name and identity, the right to obtain a birth certificate, the right to support from the father, the right to inherit, and the right to guardianship are not optimally protected.  This study aims to find out the legal considerations of the panel of judges in determining the origin of children in the case and analyze the views of Islamic law regarding the status of children due to unrecorded marriages. This study uses a qualitative method with a normative juridical approach and field research, with primary data sources in the form of copies of court documents and interviews with judges, as well as secondary data from Islamic legal literature and laws and regulations. The results of the study showed that the judge considered evidence such as DNA test results, identity documents, and witness statements as the basis for determining the child to be a legitimate child, based on Article 43 paragraph (1) of Law No. 1 of 1974 and Constitutional Court Decision No. 46/PUU-VIII/2010. In the perspective of Islamic law, the child still has a nasab to his father because the marriage is religiously valid, and in his consideration, the judge is in line with the values  of sharia maqashid, especially hifz al-nasl (protection of offspring), hifz al-nafs (protection of life), hifz al-'ird (protection of honor), hifz al-mal (protection of property) and hifz al-din (protection of religion). This research recommendation emphasizes the importance of marriage registration in KUA as a form of legal protection for children's rights and efforts to realize legal certainty for families

Legal and Social Challenges of Marriages Involving Individuals with Mental Disorders in Rural Indonesia: A Case Study

    No full text
This study explores the legal and social issues surrounding marriages involving individuals with mental disorders in rural Indonesia, focusing on a case in Dusun Jambu Tenang, Bilah Hulu District. The problem reflects broader global concerns about marital legality, mental competence, and the protection of vulnerable individuals within family law frameworks. Using a qualitative case study approach, the research analyzes how the Office of Religious Affairs (KUA) determines the validity of such marriages by examining institutional interpretations, administrative practices, and local community norms. Data were gathered through interviews with KUA officials, religious leaders, family members, field observations, and document analysis. The findings show that KUA Bilah Hulu places legal and mental capacity as core determinants of marital validity. Consistent with Indonesian Marriage Law and the Compilation of Islamic Law, the KUA maintains that a marriage is invalid when mental incapacity prevents a prospective spouse from providing conscious and voluntary consent. Therefore, medical or psychiatric assessment becomes essential whenever indications of mental disorders arise. However, the absence of detailed technical guidelines, limited mental-health services in rural settings, and strong sociocultural pressures often hinder proper verification. This case contributes to global discussions on the rights of persons with psychosocial disabilities, particularly regarding free and informed consent as emphasized in the Convention on the Rights of Persons with Disabilities (CRPD). The study highlights the need for clearer regulatory mechanisms and stronger cross-sector collaboration to ensure legal protection and prevent forced or invalid marriages

Contemporary Ijtihād in Islamic Law: A Comparative Fiqh Analysis of the Indonesian Ulama Council (MUI) Fatwa on the Stoning of the Jamārāt during the Days of Tashrīq

    No full text
High crowd density during the Hajj pilgrimage, particularly during the ritual of stoning the jamarāt (ramy al-jamarāt) in Mina, poses serious safety risks for pilgrims, especially Indonesian pilgrims who are predominantly categorized as high-risk due to advanced age and health conditions. Responding to this challenge, this study examines the implementation of ramy al-jamarāt during the Days of Tashrīq from the perspective of contemporary Islamic legal ijtihād, focusing on the 2024 Fatwa issued by the Indonesian Council of Ulama (Majelis Ulama Indonesia, MUI) at the 8th Ijtimā‘ Ulama, which permits the ritual to be performed before dawn under certain conditions. This research adopts a qualitative library-based method using a comparative fiqh approach. Primary data consist of the official 2024 MUI Fatwa document, supported by classical fiqh literature from the four Sunni schools of law and contemporary scholarly works. Data are analyzed through content analysis to assess the legal reasoning underlying the fatwa. The findings indicate that Islamic jurisprudence provides legal flexibility through the principle of rukhsah (legal concession), allowing ramy al-jamarāt to be performed before zawāl when necessary, although the most virtuous time remains after zawāl. The permissibility is supported by the Ḥanafī school, early scholars, and contemporary jurists emphasizing the protection of life (ḥifẓ al-nafs) and the prevention of harm (darar). Accordingly, the MUI fatwa reflects a contextually responsive form of contemporary ijtihād for modern Hajj management

Islamic Expressive Writing for Psychological Healing

    No full text
Expressive writing, a therapeutic technique shown to alleviate emotional distress, has not been widely adopted in Islamic education despite its proven benefits. This study aims to integrate expressive writing with Islamic principles to support anxiety relief among adolescents in educational settings. Specifically, it compares the outcomes of this intervention in state schools versus Islamic schools, examines gender differences, and assesses the impact of participants’ personalities and social support on the effectiveness of the intervention. The study employed a pretest-posttest control experimental design involving 124 adolescents aged 13 to 15 years from a state school and an Islamic junior high school. Participants were selected based on self-reported anxiety symptoms measured by the Generalized Anxiety Disorder 7 (GAD-7) questionnaire, which has demonstrated strong psychometric properties, with a Cronbach’s alpha of 0.89, indicating high reliability and construct validity supported by correlations with other established anxiety measures. The intervention included expressive writing exercises integrated with Islamic teachings, and anxiety levels were measured pre and post-intervention. The results show that in the state school, the intervention significantly reduced anxiety levels, with an average decrease of 2 points in anxiety scores (p = 0.04). In the Islamic school, the intervention resulted in an average increase of 2.4 points in scores. Integrating expressive writing with Islamic principles can effectively address anxiety among students, creating a more supportive and holistic educational environment. The culturally and spiritually relevant framework enhances the therapeutic impact, indicating significant potential for this approach in both state and Islamic schools

    No full text
Student life satisfaction is a determining variable in academic success influenced by student engagement and academic engagement. However, these two seem overlap, yet are actually distinct.  This Study aimed to examine how each type of engagement contributes to students life satisfaction. To do so, 524 students of Madrasah Aliyah or Islamic Senior High Schools in Indonesia, aged 15 to 18 years were observed. Their data were collected using three validated instruments, including the Student’s Life Satisfaction Scale, the Student Engagement Scale and the Utrecht Work Engagement Scale (UWES-9S). In the analysis, hierarchical regression and Sobel's test were used. Based on the analysis, it was found that the contribution of emotional engagement dimension and the absorption dimension resulted a significant positive correlation with student’s life satisfaction (p < .01), emotional engagement (β = .440, p  < .01) and absorption (β = .966, p < .01). Those directly predicted life satisfaction. In addition, parallel mediation of absorption academic engagement fully mediated the relationship between behavioral engagement and student’s life satisfaction (β = .096, z = 3.38, p < .05) and cognitive engagement and student’s life satisfaction (β = .156, z = 4.05, p < .01). In addition, absorption partially mediated the relationship between emotional engagement and student’s life satisfaction (β = .210, z = 6.90, p < .01). In conclusion, student engagement and academic engagement are not overlapping, but are distinct construct

Numeracy and Growth Mindset Profiles as a Basis for Differentiated Guidance Service in Islamic Schools

    No full text
Up to present, guidance and counseling (GC) services in Islamic schools tend to be homogeneous, often overlooking the diversity of students’ characteristics. This practice overlooks the effectiveness of differentiated guidance. Key factors worth considering for differentiating guidance services are numeracy skills and growth mindset (GM). In this regard, this study aims to: (1) cluster students based on their numeracy skills and GM with K-means techniques; (2) interpret the clusters’ characteristics; and (3) recommend data-driven GC service strategies. Quantitative method K-means clustering was applied to 321 grade VIII students from Islamic junior secondary schools in two provinces in Indonesia. Data from numeracy test and GM questionnaire were analyzed using the Elbow, Silhouette, Kruskal-Wallis, and Dunn post-hoc methods. The result of the study revealed three student clusters: (1) low numeracy and low GM (Double Susceptible); (2) high numeracy and moderate-to-high GM (Empowered); and (3) low numeracy but high GM (Affective Potential). Findings confirm that numeracy skills and GM do not always align, underscoring the need for integrated cognitive and affective interventions. Significant differences in numeracy skills and GM distribution were found between clusters. The different characteristics between clusters lead to diverse service strategies offered for each cluster. These strategies include a cognitive distortion journaling and belief disputes for double susceptible students; career visualization and leadership simulation for empowered students; and mathematical mindfulness and emotion regulation for affective potential students. Data-driven GC services are crucial in supporting students' academic and psychological development

Women's Rights in Islam: A Thematic Interpretive Review

    No full text
Using thematic interpretation, this article examines women's rights from an Islamic perspective. By analyzing relevant verses from the Quran, the aim of this study is to gain a better understanding of the often-contested position and rights of women in Islam. This study examines both interpretation and gender studies. The aim is to gain an understanding of how the principle of gender justice is applied in Islam and how thematic interpretation can provide a broader explanation of women's rights. This research is important because of the misperception of women's position in Islam, which is often influenced by limited interpretations. This study uses thematic interpretation with a qualitative analysis of verses related to women. The hypothesis proposed is that with a more comprehensive understanding of interpretation, women's rights in Islam can be seen as part of universal social justice. The results show that the Quran explicitly provides equal rights for women, both in family, social, and economic aspects. The contribution of this study is to provide a more holistic understanding of women's rights in Islam and to enrich the discourse on the application of the principle of gender equality in a religious context. Thus, this research is expected to contribute to correcting misunderstandings and introducing a fairer and more contextual interpretation of women's rights in Islam
