The Ethical Turn in Legal Analogy: Imbuing the Ratio Legis with Maṣlaḥa
Al-Ghazālī’s articulation that the purposes of the divine Law (maqāṣid al-sharīʿa) are to attain maṣlaḥa for the five necessary elements of human existence was not only novel but had long-lasting influence on the way Muslim jurists understood the procedure of analogy (qiyās). The correctness of the ratio legis was determinable by its consequences in bringing about maṣlaḥa. This shift was possible only by intellectual shifts in understanding the relationship between ethics and law. This paper traces the development in conceptions of ethics and its impact on the procedure of analogy in three 5th/11th century predecessors of al-Ghazālī, namely al-Baṣrī, al-Dabbūsī, and al-Juwaynī. It shows that al-Ghazālī’s definition of the purposes of the Law was developed based on previous conceptual shifts in the ratio legis from being a sign for the ruling to reflecting the ethical content of the divine injunction
Exploration and analysis of the spelling used in WhatsApp by teaching students: main errors
The aim of this study is to make known which are the most common misspellings or kinds of errors found in conversations held through instant messaging, as well as to observe how the communication is among the youngest. Conversations were collected from WhatsApp groups created by student in the 4th grade of kindergarten and primary education at the University of Extremadura during the 2019/2020 academic year. The results obtained indicate that punctuation marks and letter omissions are the most notable errors.
CLARA Review: K. F. B. Fletcher & Osman Umurhan (eds), 2020: Classical Antiquity in Heavy Metal Music.: London & New York: Bloomsbury Academic. 260 pp.
The concepts ‘classical antiquity’ and ‘heavy metal music’ may appear to be worlds apart. Not only are they separated chronologically but each belongs to an entirely different habitus. While the classical is associated with tradition, good taste and harmony, heavy metal is, at least by some, associated with the very opposite: the breaking of tradition, bad taste and disharmony. And yet, as the present book shows, a very large number of heavy metal bands reference antiquity in various ways, including exponents of Thrash Metal, characterised by speed and aggressiveness; Death Metal, characterised by macabre subject matter and growling vocals; Black Metal with related subject matter but less polished style, and other subgenres. Bands from countries ranging from Greece and Italy to Scandinavia incorporate classical quotations in their lyrics or rewrite ancient texts and myths. Some sing in Greek or Latin, others in Italian or English. The titles of songs, such as Hymn to Apollo, Hymn to Zeus, Medusa and so on, further show the classical inspiration
Scandinavian/Rus’ Captives and Slave Soldiers: an Eastern Perspective
During the Viking Age (c. AD 750–1050), the Rus’, an inclusive group of warrior-merchants of mainly Scandinavian origin – owning and trading slaves – were active in the East (in this case the eastern Baltic region, European Russia, Belarus, the Ukraine, the Black Sea region, Byzantium, the Caucasus, and beyond).
There are several written accounts of Rus’ taken captive in the East during the Viking Age, including information about some of them ending up as slaves. This article will examine different fates of Rus’ captives in these areas, on the basis of contemporary Byzantine, Muslim – and to a limited extent – later Old Slavic and Old Norse written accounts.
The sources reveal that the captured Scandinavian/Rus’ warriors often were victims of a special type of subjugation: ‘slave soldiery’. This status will be contrasted to other types of militarily subordination to illuminate the relative social standings of such warrior groups in the East.of mainly Scandinavian origin – owning and trading slaves – were active in the East (in thiscase is the eastern Baltic region, European Russia, Belarus, the Ukraine, the Black Searegion, Byzantium, the Caucasus, and beyond). There are several written accounts of Rus’ taken captive in the East during the VikingAge, including information about some of them ending up as slaves.
The Gjermundbu find came to light under difficult, wartime circumstances in 1943. With travel and other restrictions in place, a full-scale rescue excavation was not possible, and the find is poorly documented. What is certain, is that we are dealing with a very rich grave from the end of the 10th century, with few if any parallels outside the milieu of the large ship graves. The cremation grave held some very uncommon objects, like a helmet and a chain mail, as well as five or six horses and one or two sledges. While there are many similarities between the Gjermundbu find and the Vendel and Valsgärde burials in Sweden, the closest parallels to the find are the so-called druzhina burials in present-day Russia and Ukraine, and the authors suggest that the buried man was a petty king, who had served in the retinue of Vladimir the Great or one of his predecessors, together with other warriors from Ringerike
Her forklarer Lars Mehlum, leder av NSSF, hvordan
