    香港影視業勞工狀況終期研究報告2024

    推動影視業發展是港府近年的文創政策重心。影視業較為人注目的是黃金年代後票房積弱和創作自由的議題;而銀幕背後,從業員的處境則容易被忽略。本研究報告兼用定量和定質的調查,深入淺出地分析本地投身電影、電視、廣告、網片等影像製作的從業員的勞動條件,探討不合理待遇的成因,並按研究結果提出政策及行業倡議。 本研究以問卷調查了212為從業員的工作狀況,與44名從業員進行深度訪談,得出以下主要發現: 1)影視業以自由工作者為主,他們的僱傭型態零散,普遍沒有明文及完整合約便要開工,並容易面臨拖糧和其他形式的剝削(詳見第5部分): 影視從業員以自由工作者為主,缺乏保障,面對多種危脆性(見p.26) 多數從業員開工前不會簽署正規協議(見p.35) 業內實際工作協議的完整度,比從業員理想的完整度有很大落差(見p.38) 行業零散度高,導致拖糧問題普遍(見p.47) 從業員容易面臨壓價和被資方轉移商業風險(見p.53) 2)影視業的生態和文化令從業員面對不公的操作和「行規」亦難以改變。這些因素包括:行業以人脈為重、行內層級文化較強、從業員願意為創作犧牲待遇、行內較缺乏團結及行動意識(詳見第6部分): 從業員極度依賴人脈接觸工作機會。遇到不合理待遇時,顧慮到自己形象和開罪前輩的可能性,很多人都會忍氣吞聲,避免被行家覺得麻煩、小器,導致不獲重用。這無疑是製造了灰色地帶,讓掌握工作機會的人士和單位可以刻薄對待和剝削勞工,而毋須被問責(見p.58) 行內論資排輩的文化仍然存在,底層從業員要對前輩服從,表現出「肯捱」、願意「跟師傅學嘢」、甚至「任砌」等特質,難以反駁不合理要求,勞動尊嚴受損(見p.62) 從業員對藝術創作抱有熱誠,在商業製作中亦未必完全以金錢衡量自己的付出,因此容易陷入甘願「自我犧牲」的心態,導致被剝削(見p.64) 從業員若遇到不公平待遇,普遍不傾向團結行家一起尋求改變。主流的做法是在個人網絡傳播、私下聯絡對方追討、或放棄追究。多名受訪者歡迎行內發展出爭取權益導向的工會,惟他們認為現時並未有足夠條件推動(見p.65) 3)影視製作市道不佳,令製作預算壓縮,令長工時、職安意識不足問題亦更難有資源應對(詳見第7部分): 拍攝現場有不少職安隱患,頗多從業員曾經歷或目睹工傷發生。從業員工時長、經常在疲勞狀態下工作;拍攝節奏趕急;現場未必有專業人員把關安全,僅靠經驗判斷安危等,都是造成職安隱患的原因(見p.77) 從業員連續多日超時工作的情況非常嚴重。受訪從業員認為行內有必要對作息時間有合理的規範,不應犧牲從業員健康(見p.74) 從業員認同需要專人負責監察片場安全,但對於如何實行並無共識(見p.81) 從業員普遍認為政府對行業的支援資源不足、不到位,應邁向更開放、不以商業效益為主要考量的方向改善(見p.84) 基於研究結果,我們對香港影視行業及政府提出以下倡議(詳見第8部分): 保障自由工作者基本待遇(見p.87) 業界引入標準合約,推廣開工前先簽訂完整協議的文化 政府透過資助影像製作項目,推廣勞工友善措施 業界規範工時,減低超時、高強度工作的情況 改善工作條件及職業安全(見p.89) 業界和政府合作,設定適用於影視製作的職安課程、認證系統、作業指引 政府改善職安執法 從業員自我組織,維護及推動權益 支援業界發展(見p.92) 政府改善資助制度,支援各規模、多元創作 增加畢業生支援,輔助院校新晉人才與業界接軌https://commons.ln.edu.hk/ccrd_report/1005/thumbnail.jp

    茹國烈先生於2024年4月22日蒞臨嶺南大學圖書館分享他的新作《文化城市之路》。 曾任香港藝術學院院長,西九文化區管理局表演藝術行政總監、香港藝術發展局行政總裁和香港藝術中心總幹事,茹先生在他的新書中以他的個人見證紀錄香港是怎樣從「文化沙漠」走到「文化城市」。茹先生多年來活躍於香港的文化生態圈,對當中的發展具備深切全面的了解,參加者可以從茹先生的見解中認識到香港的文化藝術及創意產業,而有意投身藝術工作的參加者更可從中加深了解香港未來的文化政策和發展。 We are glad to have Mr. Louis YU, the author of a newly published book “Towards a Cultural City”, giving a booktalk at Lingnan Library on 22 April 2024. In this book, Mr. YU documents how Hong Kong transforms from “cultural desert” to the cultural city we see now from his own observations working as Director of the Hong Kong Art School, Executive Director of Performing Arts of the West Kowloon Cultural District Authority, Chief Executive of the Hong Kong Arts Development Council, and Executive Director of the Hong Kong Arts Centre.Mr. YU has in-depth and comprehensive participation in Hong Kong’s cultural ecosystem.     時代與女性:張愛玲《金鎖記》與弗吉尼亞‧伍爾夫《奧蘭多》對比探析

    作為20世紀初重要的女性主義作家,張愛玲與弗吉尼亞·伍爾夫(Virginia Woolf)的作品均有助於成為探究早期女性主義發展之線索。透過比較《金鎖記》與《奧蘭多》(Orlando: A Biography)的女性意識,可以得出中西兩地女性在困境上、自主權上與未來議題上之異同,從而探尋兩部作品對時代的重要性,幫助研究20世紀女性主義之雛形。 本論文正文部分分為三個章節,第二章旨在透過研究外部因素與女性困境之關係,發掘中西兩地父權架構之異同。第三章主要研究女性自身的心理世界,窺探中西兩地女性內囿困境之狀況與回應,初步探討自主權之差異。第四章透過比較兩個文本的結局,分析作者對女性未來議題與出路之反思,思考其時代開拓意義。最後,透過三種角度的比較,確立兩本文學對研究20世紀女性主義思想之重要性

    A qualitative study on transnational caregiving for older parents in China

    The increasing number of international migrations in China poses challenges for the care of older parents who are left behind, considering China’s emphasis on family support. This study aims to investigate transnational care arrangements for older parents whose children are overseas. It mainly addresses three research questions:1) What are the contents of filial piety in the context of international migration? 2) How do Chinese transnational family members negotiate and distribute elder care responsibilities? 3) To what extent can the transnational caregiving model explain elder care in Chinese transnational families? The transnational caregiving model proposed by Baldassar, Baldock, and Wilding, in 2007 is used to understand the care of older parents in Chinese transnational families, combining the perspectives of care circulation, situated transnationalism, and Confucian filial piety. The study conducts 48 in-depth interviews with older parents and adult migrant children residing in the US, Canada, Australia, and the UK. The sample comprises 20 participants from rural areas and 28 from urban areas. The study has several findings. Firstly, filial piety has changed in the transnational context, with older parents prioritizing their adult migrant children’s life and personal development over expecting much care from them. Despite feeling obligated and guilty, adult migrant children have shifted their views on filial piety to prioritize personal and nuclear families. Some adult migrant children believe that caring for parents should not solely be the responsibility of children. Adult migrant children emphasise providing spiritual and emotional support to older parents. And they pay attention to their older parents’ health. There are differences in filial piety between urban and rural transnational families. Secondly, it examines the negotiation and distribution mechanism of elder care responsibilities of transnational families and finds that it is affected by migration history, kinship relationships, and life course. Migration history shapes perceptions and practices regarding caregiving responsibilities. Kinship relationships mainly include the relationship between older parents and adult migrant children, adult migrant children and siblings, adult migrant children and spouses, and older parents and their siblings. Care responsibilities must be reassessed and reallocated at different life stages. Finally, this study enriches and expands the transnational caregiving model and proposes the Chinese transnational family care model. Chinese transnational elder care practices can be divided into five categories: financial support, gift-giving, transnational communication, remote assistance, and visits. The transnational care arrangement for older parents is the result of the interaction of care capacity, culture (Confucian filial piety) informed care expectations and responsibilities, negotiated care commitment under multiple family relationships, and older parents’ ageing views. The proposed model enriches the contents of the original model’s three dimensions of factors and expands a new dimension, that is, the older parents’ ageing views. The factors influencing older parents’ ageing views include attitude towards moving abroad, care needs, and acceptance of formal old-age care. This study suggests that policies and services should be developed for both adult migrant children and older parents to facilitate transnational elder care, with a focus on labour policies, immigration policies, visa policies, and social security provisions. Services should be designed to promote the mental health of transnational family members and the harmony of family relationships. Additionally, services should fully utilize the Internet and sometimes may require cross-border cooperation to help transnational family members obtain useful information and customize special care services to enhance their care capacity

    Does violent crime matter in tax aggressiveness?

    Research in psychology documents that repeated exposure to violence increases behavioral aggressiveness. This mechanism is likely to apply to organizations through interactions and connections among individuals within local social networks. In this study, violent crimes are used as a social context to examine local corporate aggressive behaviors. The focus is on management, which is mainly responsible for making corporate decisions. The study investigates whether firms\u27 tax aggressiveness is positively associated with the violent crime rate surrounding their headquarters. The results of the study show a positive correlation between corporate tax aggressiveness and the violent crimes surrounding corporate headquarters. It further proves that firms with younger CEOs are more susceptible to violence. Robustness tests, including alternative tax aggressiveness proxies and violent crime proxies, also support the research findings. Furthermore, this study includes non-compliant firms and concludes similar results as the OLS regressions, mitigating the concerns of omitted variables. Taken together, this research offers robust empirical evidence to support the conclusions that corporations headquartered in high-violent-crime areas are more prone to engaging in corporate tax aggressiveness. This research responds to the prior tax research’s call to study tax aggressiveness and combine social and environmental constructs with it. It also contributes to the growing tax literature by suggesting one important factor that is closely related to corporate tax aggressiveness. It provides financial reporting information users with one more clue to detect potential tax-aggressive corporations and benefit their decision-making. Finally, this study indicates that anti-violence public expenditures have spillover effects on public revenue, benefiting the growth of aggregate tax revenues

    “Feels a lot like love” : love-in(g) China in the reform era

    This research examines the changing landscape of love in China during the economic reform since 1978. This landscape includes the drastic social transformations, the decentralisation of state control, and the intense processes of marketisation and privatisation of the economy. The thesis investigates the changing values, moral codes and forms of intimacy inscribed in love , thus exploring the privatisation of the heart during China\u27s economic reform. Although focusing on contemporary times, this research also examines the genealogy of love since the early moment of China\u27s modernity, and explores the historical residuals that exist in today\u27s emotional landscape. My research argues that the discourse of love and the emotional life it regulates are central to the formation of the modern, reflexive subject and, thus, decisive for examining Chinese modernity. The ideals of and the yearnings for love are like itchy and painful wounds that allow us to go deep into the tissues of Chinese society and to explore the perplexing coexistence of socialist rule, neoliberal logic and self-governing practices (Sun and Yang, 2021) in the contemporary time. From the changing notions of familial intimacy and interpersonal relationships to the rising consumption of romance and nationalist sentiments, as well as the formation of Chinese cosmopolitanism and the new middle class, the thesis examines these essential aspects of Chinese society through an analysis of the discourse of love . The research combines textual analysis and curatorial practice to understand the making of love in the Chinese context and the ways in which people love and are touched and mobilised by love . Through the exploration of popular cultural products, the spatial and artistic re-enactment of the aesthetics, memories, and bodily sensations that vibrate with the feelings of love , the thesis hopes to add to the analysis of the discourse of Chinese modernity by investigating the process of subject formation in post-reform China through the lens of love

    A revision of Hong Kong harvestmen : biodiversity, ecological preferences and geographical distribution

    Opiliones, or harvestmen, is a common animal found throughout the world, there are currently over 6,650 species worldwide but the actual number is estimated to exceed 10,000, making it the third largest order in the class Arachnida. Despite its diversity, it is a rather understudied group. In Hong Kong, there are four described species, but the most recent relevant literature dates back to the at least the early 20th century. This thesis focuses on two common species found in Hong Kong: one previously described species (Heterobiantes geniculatus) and one new species (Pseudoleiobunum lutulentum sp. nov.). I employ an innovative integrative taxonomy approach, which involves a mix of modern techniques such as electron microscopy and phylogenetic analysis, which not only provides a better understanding into harvestman biology, but also provides a more robust analysis which leads to more precision in species delimitation. The work accomplished in this study will undoubtedly be useful to future harvestman-related studies in Hong Kong and Asia. Taxonomic protocols established in this research can be referenced and used to study other taxa, such as spiders and scorpions. This thesis ultimately showcases the importance of taxonomy, as it lays groundwork for further biological studies

    Animal adoption experiences in Hong Kong

    This study explores how the different aspects and variables will affect the experiences of animal adoption. Animal adoption is the process of adopting strays or abandoned animals, which is also an alternative to obtaining pets. The research provides a theoretical framework to further understand the dynamics of animal adoption in various dimensions, such as the drivers of animal adoption, the role of animal adoption organizations, and the normative expectations of animal adopters. This research attempts to empirically fill this topic\u27s research gap to explain the relationship between the variables and adoption experiences. In this study, the adoption experiences will be examined with the concepts of human-human and human-animal relations, as well as the motivation for the animal adoption. These reflections will be highly related to the future support and programs for animal adoption in increasing the adoption rate. Qualitative methodology will be the research method in this study. A total of 8 interviewees who have adopted animals from formal and informal organizations will be interviewed to collect data in this study

    古典詩學情景説的理論構成及其演化特徵

    作爲中國古典詩學重要範疇之一,情景歷來爲衆家所論議,被視爲詩歌創作的本質基礎和審美構成。追溯起來,情景説在劉勰、鍾嶸等人的著述中已顯理論離形,觸及“情”“景”二者之關係,但其理論導向,重在解釋“感物”成詩的發生原理,闡述自然之“景”觸動詩人之“情”的引發作用。宋明以來,情景成爲重要的詩學話題,對其理論探討趨於加强,尤其是明人謝榛,園繞情景關係的闡説相對集中和詳明,更明確了其對詩歌本質構成和藝術經營所具有的特定意義,謝氏的相關論述,體現了某種劃時代的標誌性意義。在有清一代詩學領域,有關詩歌情景問題的探討漸趨增多,其中王夫之、吴喬、朱庭珍等人堪稱代表,特别是對於情景關係的辨析,成爲諸家闡發的一個核心問題,其討論的角度或層次呈現多樣化特徵,豐富了情景這一範疇的理論建設。 As one of the important categories in Chinese classical poetics, the theory of feeling and scene has always been discussed by scholars and regarded as the essential foundation and aesthetic composition of poetry creation. Retroactively, the theory of feeling and scene can be found in the writings of Liu Xie and Zhong Rong, involve the relationship between “feeling” and “scene”. However, the theoretical focus was mainly on explaining the occurrence principle of poetry inspired by external objects, elaborating on the triggering effect of natural “scenarios” on poets’ “feelings”. Since the Song and Ming dynasties, the theory of feeling and scene has become an important poetic topic, and theoretical discussions tends to be strengthened. Especially for Xie Zhen, a scholar of the Ming dynasty, his elaboration on the relationship between feeling and scene is relatively concentrated and detailed, further clarifying its specific significance to the essential composition and artistic management of poetry. Xie’s relevant discussions reflected a certain landmark significance. In the field of poetics in the Qing dynasty, discussions on the issue of poetic scenarios gradually increased, with Wang Fuzhi, Wu Qiao, and Zhu Tingzhen being representative figures. Especially the analysis of the relationship between feeling and scene became a core issue explored by many scholars. The diverse perspectives or levels of discussion have enriched the theoretical construction of this category
