Get PDFThe death of an heir has created rights for their heirs to control and/or obtain the inheritance of the deceased. According to the Western Law of Inheritance, there are two ways to inherit a portion of the deceased\u27s estate: according to the provisions of the law and as designated in a testament. In the formation of a testament, the role of a notary is important and crucial. This is because a notary can oversee, provide advice so that the content of the heir\u27s testament does not contradict the law. One of the rules that must not be violated in the creation of a testament is regarding the absolute rights of the heirs or legitimate portion as regulated in Article 913 of the Civil. However, in reality, there are still testaments that violate the provisions of the legitimate portion from one or all of the heirs even though the testament has been made by or before a notary. This has undoubtedly caused injustice to the heirs, and more severely, the validity of a testament is then questioned as to whether it complies with the existing laws or contravenes statutory regulations. In writing this journal, the author uses a normative juridical method, which is an approach based on primary legal materials by examining various theories, concepts, legal principles, and regulations related to this research
Pengaruh Media Sosial Pada Persepsi Publik Terhadap Sistem Peradilan: Analisis Sentimen di Twitter
Get PDFSocial media has become a major platform for the public to express their views on various issues, including the judicial system. This study aims to analyze the influence of social media, particularly Twitter, on public perception of the judicial system in Indonesia. The method used in this research is sentiment analysis applied to thousands of tweets related to judicial issues. Data were collected using data mining techniques and analyzed to identify positive, negative, and neutral sentiments towards the judicial system. The results show that the majority of sentiments expressed by the public on Twitter tend to be negative, reflecting widespread dissatisfaction with the judicial system. Positive sentiments emerged in the context of policy reforms and legal transparency, while negative sentiments were often linked to issues of corruption and injustice. In conclusion, social media, especially Twitter, significantly influences public perception and can serve as an important source for understanding public opinion on the judicial system

Pembahasan dalam artikel ini mengenai pembatalan perkawinan yang tidak dicatatkan, upaya yang dapat dilakukan setelah pembatalan perkawinan seperti dilakukannya itsbat nikah bagi yang beragama Islam dan mendapatkan surat keterangan menikah setelah dilakukannya pemberkatan pernikahan bagi yang beragama Kristen dan Buddha, dan akibat hukum, kedudukan, serta status waris anak pasca pembatalan perkawinan yang ditentukan oleh pengakuan anak yang dilakukan oleh ayah biologisnya. Apabila anak tersebut tidak diakui sah, maka anak statusnya menjadi anak luar kawin yang hanya mempunyai hubungan keperdataan dengan ibunya saja dan tidak mendapatkan hak mewaris dari ayah biologisnya

This research highlights the lack of understanding among the general public regarding Papua\u27s tribes, revealing the uniqueness of the Ngalum Tribe and identifying obstacles in preserving their educational and traditional knowledge heritage. Employing qualitative research methods, the study focuses on the role of the Ngalum Tribe\u27s Council of Customs in transferring cultural knowledge and sustaining traditional values in the Oksibil District, Pegunungan Bintang Regency. Data collection involved observation, interviews, document studies, and analysis through data triangulation. The results indicate that the development of the Ngalum Tribe\u27s traditional teaching system is less effective, with a lack of creativity among the millennial generation and various challenges such as difficulties in developing cultural tools, high maintenance costs, and insufficient understanding of traditional dances. Improvements entail an innovative approach to the teaching system, active support for millennial creativity, and the exploration of financial solutions. Despite the challenges, the preservation efforts are progressing well

Get PDFThe presence of waqf land certainly provides many benefits for the community\u27s survival. However, in practice, most waqf land is still used individually or privately by the community. One of them happens to the waqf land located at the Amal Muslimin Mosque in Southeast Medan Village, Medan Denai District, Medan City, where this land is eventually used by local residents for personal interests, they build houses for their residences, until now, which in its utilization, it violates the basic substance of the waqf practice in accordance with Islamic teachings. Land that is waqfed can only be utilized for collective welfare, not personal. So this research aims (1) to find out the law of utilizing waqf land belonging to the Muslim Amal Mosque according to the views of Islamic Law; and (2) The law of utilizing waqf property for individual private interests. To achieve the above objectives, this research uses a normative-empirical method, using references from various books, journals, legislation, observation and interview results, as well as other supporting literacy. The results of this study reveal that using the waqf land of the Amal Muslimin Mosque for personal gain by building houses for local residents to live in is prohibited in the positive law study law and prohibited in Islamic sharia

This is because reclaimed land is directly controlled by the state. The purpose of this research is to examine the Validity of Reclaimed Land Ownership from the Perspective of Indonesian Land Law. The research method employed is a juridical-normative approach with a descriptive research specification. The data types include secondary data, and the data sources consist of primary legal materials, secondary legal materials, and tertiary legal materials. The data collection technique utilized is literature review, and the data analysis technique is qualitative. Essentially, ownership and control rights over reclaimed land are rights held by the state. For individuals or communities seeking to control reclaimed land, obtaining prior permission from the government is required, typically by submitting a land rights application to the Land Office with jurisdiction over the location of the land in question

Efforts made to harmonize this were by holding an international convention by The International Institute for the Unification of Private Law (UNIDROIT) which gave birth to The UNIDROIT Principles of International Commercial Contracts (UPICCs). UPICCs are actually used as a legal basis for implementing international trade contracts. The formulation of the research problem is how is the principle of freedom of contract, the principle of good faith and fair dealing regulated in international law and national law?, and what are the challenges of implementing the UNIDROIT principle in international trade contracts in Indonesia? ? This research is normative legal research and is analytical descriptive. The results of the research are that international law regulations regarding the principle of freedom of contract, the principle of good faith and fair dealing are regulated by UPICCs. Meanwhile, regulations in national law can be seen in the Civil Code and the ITE Law. S Because the UPICCs regulate many matters that are not detailed in Book III of the Civil Code, the challenge is the unification and codification of contract law to provide legal certainty, with uniform provisions that can be universally accepted by countries involved in international trade
