The Belgian Constitution: Modern Constitutionalism’s Greatest Triumph?
Fin dalla sua pubblicazione nel 1831, la Costituzione belga è stata proclamata una delle conquiste principe del costituzionalismo moderno. La sua fama è principalmente dovuta all’effettiva limitazione del potere monarchico a favore della rappresentanza nazionale e al suo elenco di libertà individuali. Data questa reputazione, è sorprendente quanto poco in realtà si sappia della Costituzione belga, del suo processo di stesura e del suo contesto intellettuale e politico. Mentre altre costituzioni del tempo sono sempre più oggetto di studio e ricerca, la Costituzione belga resta seriamentesotto-studiata. Maggiore ricerca è necessaria per stabilire se l’eccezionale reputazione della Costituzione belga del diciannovesimo secolo è meritata oppure no. Questo articolo mira a contribuire alla realizzazione di questo intento formulando un piano di ricerca. Innanzitutto, offre una introduzione alla Costituzione belga e indica un numero di caratteristiche chiave che giustificano una maggiore attenzione da parte degli studiosi. In secondo luogo, fornisce un panorama della ricerca recente sulla Costituzione del 1831 e una valutazione critica di quanto essa ha realizzato.Even since its proclamation in 1831, the Belgian Constitution has been heralded as one of the crowning achievements of modern constitutionalism. Its fame is mostly due to the effective limitation of monarchical power in favour of the national representation, and to its catalogue of individual liberties. Given this reputation, it is surprising how little is actually known about the Belgian Constitution, its drafting process, and its intellectual and political context. While other constitutions of the era are increasingly investigated, the Belgian one remains severely underresearched. More research is necessary in order to establish whether or not the exceptional reputation of the Belgian Constitution in nineteenth-century Europe was deserved. This article aims to contribute to the realization of this goal by formulating a research agenda. First, it offers an introduction to the Belgian Constitution and points out a number of key features which justify greater scholarly attention. Second, it provides an overview of the recent research on the 1831 Constitution and a critical assessment of its realizations.
«Le leggi sono leggi». Legalità, giustizia e politica nell’Italia di Piero Calamandrei
The article is dedicated to the constitutional thought of Piero Calamandrei on the intertwining of legality, justice and politics, within the Italian constitutional history, from the crisis of the liberal state, to fascism, to the birth of democracy, to the Constitution, until 1956, the year of death of the Tuscan jurist. These dramatic historical crossings explain the different points of view of Calamandrei, with a fixed point, the faith in legality as a ‘stainless’ principle of guarantee against arbitrariness. This is the meaning of the ‘metahistorical’ assumed «laws are laws». The different images of legality – formal / substantial, ordinary / constitutional, old / new – made sense in the field of tension between justice and politics, the cornerstone of legal liberalism. In the Fascist regime – for Calamandrei «Authoritarian State» – the formal, liberal legality served as a barrier against Nazi and Soviet totalitarianism; hence the separation between justice and politics, to save Italy the drift of a totalitarian State. In autumn 1943 Calamandrei, refugee at Colcello to escape arrest, developed the concept of «substantial legality», more complex than «formal»; he saw the figure of democracy in the integration between law and politics. In the liberated Florence he taught that fascism had weakened the «authority of the law» and that democracy had to be founded on «true legality, which is not imposed from above, but that desired by the people, which passes through the Constituent». He supported this principle as a publicist, lawyer, politician at the National Council and the Constituent Assembly. In the early Fifties the integration between justice and politics on the one hand seemed appropriate to implement the Constitution, with the hope of launching the Constitutional Court; on the other it seemed to lead to political justice. In the politicization of the judge, in the justice of the «case by case», Calamandrei saw the collapse of the law; he put the difficult ‘way out’ to the «crisis of law» – a topic at the centre of the European debate after the tragedy of war – in the «logical instrument», a constitutive element of «ordinary legality». In 1956 the liberal legality was almost regretted as «peaceful» compared to the constitutional legality, more ‘complicated’ to be a «peaceful instrument of social renewal».L’articolo è dedicato al pensiero costituzionale di Piero Calamandrei sull’intreccio tra legalità, giustizia e politica, entro la storia costituzionale italiana, dalla crisi dello Stato liberale, al fascismo, alla nascita della democrazia, alla Costituzione, fino al 1956, anno della morte del giurista toscano. Questi drammatici attraversamenti d’epoca spiegano i diversi punti di vista di Calamandrei, con un punto fermo, la fede nella legalità come principio ‘inossidabile’ di garanzia contro l’arbitrio. Questo il senso del ‘metastorico’ assunto «le leggi sono leggi». Le diverse immagini della legalità – formale/ sostanziale, ordinaria/costituzionale, vecchia /nuova – ebbero un senso nel campo di tensione tra giustizia e politica, cardine del liberalismo giuridico. Nel regime fascista – per Calamandrei «Stato autoritario» – la legalità formale, liberale, servì da argine contro il totalitarismo nazista e sovietico; da qui la separazione tra giustizia e politica, per risparmiare all’Italia la deriva di «Stato totalitario». Nell’autunno 1943 Calamandrei, rifugiato a Colcello per sfuggire all’arresto, maturò il concetto di «legalità sostanziale», ‘più complessa’ della «formale»; vide nell’integrazione tra diritto e politica la cifra della democrazia. Nella Firenze liberata insegnò che il fascismo aveva fiaccato l’ «autorità della legge» e che la democrazia doveva esser fondata sulla «vera legalità, che non è quella imposta dall’alto, ma quella voluta dal popolo, che passa per la Costituente». Sostenne questo principio da pubblicista, avvocato, politico alla Consulta nazionale e all’Assemblea Costituente. Nei primi anni Cinquanta l’integrazione tra giustizia e politica da un lato sembrò opportuna per ‘attuare’ la Costituzione, con l’auspicio dell’avvio della Corte costituzionale; dall’altro sembrò condurre al cortocircuito, la giustizia politica. Nella ‘politicizzazione’ del giudice, nella giustizia del «caso per caso», Calamandrei vide il collasso della legalità; ripose la difficile ‘via d’uscita’ alla «crisi del diritto» – tema al centro del dibattito europeo dopo la tragedia della guerra – nello «strumento logico», elemento costitutivo della «legalità ordinaria». Nel 1956 la legalità liberale era quasi rimpianta come «pacifica» rispetto alla legalità costituzionale, più ‘complicata’ per essere «strumento pacifico di rinnovamento sociale»
Storie di infamia ai tempi di Schiller
The novel by Schiller Verbrecher aus verlorener Ehre presents a cross-section of the history of German legal culture at the turn of eighteenth and nineteenth centuries through the punishment of infamy, whose application inexorably marks (even with fire branding) the existence of convicted. Usually already deprived of political rights due to their social extraction, they continue on a path of marginalization and exclusion that, by settling in a vicious circle, brings them back to crime by necessity. The criticism put forward by Schiller makes it possible to bring to light some transformations taking place also in a medium-sized Land such as Württemberg. In fact, he writes in a phase of transition in which the Verfassung of the estates is targeted both by the demands of enlightenment and bourgeois reformism, as by the absolutist aims of the sovereigns, intent upon eroding the basis of the privileges of the Stände, but often also wishing to preserve institutions and heritage of the past as a powerful tool of pressure and control.La novella di Schiller Verbrecher aus verlorener Ehre presenta uno spaccato di storia della cultura giuridica tedesca a cavallo tra XVIII e XIX secolo attraverso la pena dell’infamia, la cui applicazione segna in modo inesorabile (anche con la marchiatura a fuoco) l’esistenza dei condannati. Solitamente già privi per estrazione sociale dei diritti politici, essi cominciano un percorso di marginalizzazione e di esclusione che, saldandosi in un circolo vizioso, li fa tornare a delinquere per necessità. La critica avanzata da Schiller consente di riportare alla luce alcune trasformazioni in atto anche in un Land di medie dimensione come il Württemberg. Egli scrive infatti in una fase di trapasso in cui la Verfassung cetuale è bersagliata tanto dalle sollecitazioni del riformismo illuminista e borghese, quanto dalle mire assolutiste dei sovrani, intenti ad erodere la base dei privilegi degli Stände, ma spesso desiderosi di conservare istituti e retaggi del passato come potente strumento di pressione e di controllo

Reading and sharing an anthology of 790 pages, including 365 texts and 140 authors, most ever translated in French, and embracing a historical and intellectual panorama, over two centuries, is a true challenge. The building of a national identity can be summarized in a central question of rare complexity: «The West as a model to imitate, to catch up with, to go beyond it, to regenerate or to reject?» On one hand, the West is «a philosophical issue for Russia»; on the other hand, exists for Western people «a mystery of the Russian otherness». All began with Peter the Great (I) and his female double, Catherine II, the philosopher-empress, with the foundation of the new capital of Russia through the «utmost will» of opening a window on Europe. «The bronze horseman», Peter I’s statue raised by Catherine, is the metaphor of Russia as a European power, haunting western’s imagination and questioning Russians themselves. The chronological thread and the historical canvas, divided into nine chapters (II) start during the Enlightenment period with the poet and national historian Karamzine and lead to the present days «conservative revolution» of Vladimir Poutine, after 70 years of communism. Despite economic changes and ideological ruptures, three type of discourses appear through the time: that of westernizer Europeists, the traditional slavophilia and nationalist trends, all thoughts sealed in orthodox belief. The fall of USSR gave hope or illusion of a «common European dwelling», before provoking pessimistic approaches meaning farewell to Europe for some and welcome to Eurasia for others (III).Lire et partager une anthologie «sans équivalent dans quelque langue que ce soit» de 790 pages, comptant 365 textes et 140 auteurs, la plupart inédite en français et embrassant un panorama his- torique et intellectuel inégalé sur deux siècles, est une vraie gageure. La thématique de construction d’une identité nationale se résume autour de la question centrale d’une complexité inouïe: «L’Occident comme modèle à imiter, rattraper, dépasser, régénérer ou rejeter ?» D’une part l’Occident est «un problème philosophique pour la Russie», d’autre part, il y a pour les Occidentaux «un mystère de l’altérité russe». La genèse de ces débats (I) qui continuent encore de nos jours est à rechercher chez Pierre Le Grand et son double féminin Catherine II, l’impératrice-philosophe, avec la fondation de Saint Pétersbourg, la nouvelle capitale de Russie, née d’une «volonté implacable» de percer «une fenêtre» sur l’Europe. La métaphore de la Russie, puissance européenne, tourne autour de la symbolique du «cavalier d’airain», statue de Pierre Ier érigée par Catherine Seconde, statue qui est aussi une stature, hantant l’imaginaire européen et interrogeant les Russes eux-mêmes. Le fil chronologique et la trame historique en neuf parties (II) nous conduisent du temps des Lumières, commencé par le poète et historien russe Karamzine à la «révolution conservatrice» actuelle imputée à Vladimir Poutine, en passant par 70 ans de communisme. Malgré les transformations économiques et les ruptures idéologiques, trois discours identitaires se perçoivent entre les occidentalistes européistes, les traditionalistes slavophiles et les nationalistes, le tout scellé dans la foi orthodoxe. La chute de l’URSS donna l’espoir ou l’illusion d’une «maison commune européenne», avant de susciter le pessimisme pour d’aucuns d’un adieu à l’Europe et la perspective pour d’autres d’une heureuse Eurasie (III)
Juridification of freedom in Europe: legal history
Studiamo gli stadi principali attraverso i quali si è attribuita una natura giuridica alla libertà in Europa. Come inizio fondamentale del processo che ha portato a una libertà giuridica si è considerato il principio di uguaglianza formale (giuridica). Tracciamo il progresso di percorsi consistenti di legalizzazione della libertà attraverso la consistente implementazione di questo principio. La conclusione consiste nel fatto che è necessario fornire la completa implementazione del principio di uguaglianza formale (legale) per assicurare l’identità della civiltà europea e la libertà legale ad essa immanente nel XXI secolo.We study the main stages of imparting a legal nature to freedom in Europe. As a fundamental beginning of a legal freedom is regarded the principle of formal (legal) equality. We trace the progress of consistent pattern of legalisation of freedom through the consistent implementation of this principle. The conclusion is that it is necessary to provide the fullest realisation of the principle of formal (legal) equality to ensure the identity of European civilization and the legal freedom, which is immanent to it, in the twenty-first century.
Carré de Malberg e l’eredità della Rivoluzione: sovranità nazionale versus sovranità del popolo
Carré de Malberg was a jurist who took seriously the French Revolution constitutional law, in particular the one developed by the constituents from 1789 to 1791. Its principles are considered as the base of the French juridical order, but also of the State in a modern sense. The Alsatian jurist has to keep into account the revolutionary event, because even if he is busy to recognize the superiority of the German juridical doctrine, he tries to find an applicable synthesis of it to the French institutions. The aim of the essay, therefore, is that of to propose the analyses of Carré de Malberg on two principles of the revolutionary tradition, that of national sovereignty and the distinction between constituent power and constituted powers. Putting in evidence, as their use is functional to his idea of juridical positivism.Carré de Malberg è stato un giurista che ha preso sul serio il diritto costituzionale della Rivoluzione francese, in particolare quello sviluppato dai costituenti dal 1789 al 1791. I suoi principi vengono considerati come la base dell’ordine giuridico francese ma anche dello Stato in senso moderno. Il giurista alsaziano, si confronta con l’evento rivoluzionario, perché anche se impegnato a riconoscere una superiorità alla dottrina giuridica tedesca, cerca di trovarne una sintesi applicabile alle istituzioni francesi. L’intento del saggio, quindi, è quello di, riproporre le analisi di Carré de Malberg su due principi della tradizione rivoluzionaria, quello di sovranità nazionale e la distinzione fra potere costituente e poteri costituiti. Mettendo in evidenza, come il loro utilizzo sia funzionale alla sua idea di positivismo giuridico

This study aims at connecting openness with the type of constitutional government ruling in Piedmont-Savoy. The nineteenth-century development of parliamentary systems requires the re- definition of the public participation in the life of the institutions. A representative government bases its legitimacy on the consensus of citizens, keeping the communication between public and representatives alive and constant. Among the regulatory principles of the representative assemblies, the rule of publicity was identified as consisting in public meetings, open discussions and information. The analysis focuses on two central moments of the legislative process: debates and deliberations. Special attention is devoted to the practice of secret meetings of the Parliament and to the alternation between secret and open ballots. Indeed, openness is the atmosphere within which all the powers of the State must work and live and it is the instrument by which the rulers are subjected to the control of national opinion.Questo saggio si propone di mettere in connessione la trasparenza con la forma di governo costituzionale nel Piemonte Subalpino. Lo sviluppo ottocentesco di sistemi parlamentari impone di ridefinire la partecipazione del pubblico alla vita delle istituzioni. Un governo rappresentativo fonda la propria legittimazione sul consenso dei cittadini, mantenendo viva e costante la comunicazione tra il pubblico e gli eletti. Tra i principî regolatori delle assemblee rappresentative è individuato il principio della pubblicità da intendersi come sedute pubbliche, libere discussioni ed informazione. L’analisi si concentra sui due momenti centrali del procedimento legislativo: le discussioni e le deliberazioni. Speciale attenzione è dedicata alla prassi delle sedute segrete del Parlamento e all’alternanza tra voto segreto e palese. In effetti, la pubblicità è l’atmosfera entro cui devono operare e vivere tutti i poteri dello Stato ed è lo strumento per sottoporre i governanti al controllo della coscienza nazionale
