La Constitution belge de 1831 et les Constitutions prussiennes de 1848 et 1850. Emprunts et usages d’un modèle constitutionnel
Although many of its provisions are only a mirror of the French Charter of 1830, the Belgian Constitution of 7 February 1831 could be considered across the Rhine as a «constitutional ideal». The reception of this model in Prussia in the 1840s did not take place by textual reproduction, but in favor of more or less perceptible «traces». The effects of political will (in the form of a violation or revi- sion of a constitutional text) can, if not erase, at least greatly diminish these footprints. Moreover, the Belgian model evoked during the Prussian constituent processes only serves to justify a fragile liberal façade behind which the principle of authority remains. Thus, the links forged between the Belgian Constitution of 1831 and those of the Kingdom of Prussia of 1848 and 1850 testify, through the inter- play of uses they reveal, to the ambiguity of the circulation of constitutional models.Bien que nombre de ses dispositions ne soient qu’un miroir de la Charte française de 1830, la Constitution belge du 7 février 1831 a pu être considérée outre-Rhin comme un « idéal constitutionnel ». La réception de ce modèle dans la Prusse des années 1840 ne s’opère pas par une repro- duction textuelle, mais à la faveur de « traces » plus ou moins perceptibles. Les effets qu’emporte la volonté politique (sous la forme d’une violation ou d’une révision d’un texte constitutionnel) peuvent, si ce n’est effacer, du moins largement minorer ces empreintes. Obtaining and Assessing Information about Rule-of-Law Compliance in Mem- ber State Courts. Using the European Ar- rest Warrant as an Illustration
A seguito dei passi indietro compiuti dalla Polonia negli ultimi anni per quanto concerne lo Stato di diritto, diversi altri Stati membri dell’UE si sono chiesti se gli individui per i quali è richiesta l’estradizione in Polonia tramite un mandato d’arresto europeo (MAE) emesso in virtù della Decisione quadro relativa al MAE debbano effettivamente essere estradate o se l’estradizione comporti una violazione dei diritti fondamentali di cui all’art. 47 della Carta dei diritti fondamentali dell’Unione europea e all’art. 6 della Convenzione europea dei diritti dell’uomo. La Corte di giustizia dell’Unione europea (CGUE) ha riscontrato tale riluttanza, come si evince dalla sua giurisprudenza, ed ha pertanto sviluppato un orientamento, c.d. delle circostanze eccezionali, che pone in essere un’eccezione alla regola derivante dal principio della fiducia e del riconoscimento reciproco tra gli Stati membri secondo cui un individuo soggetto ad un MAE debba essere estradato nello Stato membro richiedente. Secondo tale orientamento, l’estradizione può essere rifiutata ove l’individuo corra un rischio attuale di violazione del suo diritto fondamentale ad un giusto processo dinanzi ad un giudice indipendente ed imparziale precostituito per legge. Per valutare l’esistenza di un simile rischio, la CGUE ha autorizzato le autorità giudiziarie incaricate dell’esecuzione del mandato – nella prassi, spesso tribunali nazionali di primo grado – a effettuare una “valutazione dello stato di diritto” nei confronti dell’autorità giudiziaria ordinante tramite una valutazione bifasica, c.d. test di LM. Il presente contributo passa in rassegna le condizioni in presenza delle quali un’autorità giudiziaria può rifiutare di eseguire un MAE, con riferimento al rischio che il diritto ad un giusto processo possa essere violato ove l’individuo sia estradato nello Stato membro richiedente. L’analisi si sofferma innanzitutto sulla giurisprudenza della CGUE che ha sviluppato il test di LM. Segue un’analisi più dettagliata del test di LM per stabilire come le autorità giudiziarie incaricate dell’esecuzione di un MAE debbano concretamente farne applicazione caso per caso. Tale analisi di dettaglio ricomprende: (i) i criteri essenziali per la valutazione del rischio da parte dell’autorità giudiziaria investita dell’esecuzione; (ii) la necessità per l’autorità giudiziaria investita dell’esecuzione di avere accesso ad informazioni adeguate e affidabili sullo Stato di diritto nello Stato membro richiedente; e (iii) il metodo di valutazione di tali informazioni, in generale e caso per caso.As a result of the backsliding of the rule of law in Poland in recent years, several other EU Member States have questioned whether persons whose surrender to Poland is requested by means of a European Arrest Warrant (EAW) issued by virtue of the EAW Framework Decision should actually be surrendered to that Member State, considering that it violates the fundamental rights arising from Article 47 of the Charter of Fundamental Rights of the European Union and Article 6 of the European Convention on Human Rights. In its case-law concerning such reluctance to execute EAWs, the Court of Justice of the European Union (CJEU) has developed the exceptional-circumstances doctrine, which constitutes an exception from the main rule – following from the principle of mutual trust and recognition between the Member States – that a person subject to an EAW must be surrendered to the issuing Member State. Under this doctrine, the surrender of a requested person may be refused if that person, were he or she to be surrendered, would run a real risk of breach of his or her fundamental right to a fair trial before an independent tribunal previously established by law. For the purpose of determining whether such a risk exists, the CJEU has empowered the executing judicial authorities – which are often national courts of first instance – to perform a “rule-of- law check” of the issuing judicial authority using a two-step test often referred to as the LM test. This article discusses the conditions under which an executing judicial authority may refuse to execute an EAW with reference to the risk of fair-trial breaches that might occur if the requested person were to be surrendered to the issuing Member State. It first presents the CJEU’s case-law developing the LM test. This is followed by a more detailed analysis of the LM test to establish how executing judicial authorities should concretely apply that test in individual cases when assessing whether a requested person should be surrendered to an issuing Member State. The issues discussed include (i) what criteria are essential for the executing judicial authority’s assessment, (ii) how the executing judicial authority can obtain access to adequate and reliable information about conditions in the issuing Member State and (iii) how that information should be assessed, both at a general level and in relation to a requested person in a specific case.
Judges Assessing the Independence of Judges. Historical Foundations and Practical Procedures in Facing the Threats against the Rule of Law in Europe
La terzietà ed indipendenza delle corti rappresentano elementi essenziali per assicurare il buon esito del progetto comunitario. La recente riviviscenza degli “stati illiberali” mette a repentaglio lo stato di diritto a tal punto da rischiare l’erosione delle stesse fondamenta del sistema giuridico dell’Unione Europea. Nel 2018, la Corte di giustizia dell’Unione Europea (CGUE) ha dato il via a due distinte prospettive giurisprudenziali. La prima ha visto la Corte dichiararsi competente su questioni riguardanti l’indipendenza della magistratura, una competenza in precedenza riservata esclusiva- mente agli stati membri. La seconda ha visto la Corte riconoscere ai giudici nazionali una sorta di “potere di vigilanza” sullo stato di diritto con riguardo ai giudici di altri stati membri nel valutare l’indipendenza e terzietà delle autorità giudiziarie competenti a rilasciare mandati di arresto europei (MAE) – un’assoluta novità per i giudici di merito. La terzietà ed indipendenza dei giudici sono alla base dello stato di diritto (o Rechtsstaat), nonché del diritto ad un equo processo ai sensi dell’articolo 6 CEDU e dell’articolo 47 CDFUE. Il presente contributo si propone di delineare una base teorica per interpretare i principi dello stato di diritto (o Rechtsstaat) secondo la teoria di Kaarlo Tuori sulla stratificazione giuridica. Inoltre, il presente con- tributo riassume brevemente i recenti sviluppi che hanno caratterizzato lo stato di diritto di matrice comunitaria – nello specifico i due nuovi orientamenti giurisprudenziali della CGUE – nonché gli articoli ricompresi nel presente numero del Journal of Constitutional History che fanno riferimento al progetto intitolato “Judges Assessing the Independence of Judges. Historical Foundations and Practical Procedures in Facing the Threats against the Rule of Law in Europe”.The existence of impartial and independent courts is a cornerstone of the success of the European project. The recent renaissance of “illiberal States” jeopardises the application of the rule of law and risks destroying the foundations of the EU legal order. In 2018, the Court of Justice of the European Union (CJEU) began developing two new lines of case-law. Firstly, the CJEU found itself to be competent to rule on matters regarding the independence of the judiciary, which used to be part of the purely internal competence of the Member States. Secondly, the CJEU empowered national courts to perform a “rule-of-law check” of courts in other Member States by assessing the independence and impartiality of judicial authorities having issued a European Arrest Warrant (EAW). This represents a new task for what are often courts of first instance. The impartiality and independence of judges is a cornerstone of the rule of law and the “Rechtsstaat” and of the right to a fair trial according to Article 6 ECHR and Article 47 of the Charter of Fundamental Rights of the European Union (CFR). This article provides a theoretical basis for the understanding of the principles of the rule of law and the Rechtsstaat, in the form of Kaarlo Tuori’s theory about the layers of the law. Further, it provides a summary of developments as regards the rule of law in Europe in recent years – especially as regards the two new lines of case-law of the CJEU – as well as summaries of the articles included in this issue of the «Journal of Constitutional History» that form part of the project «Judges Assessing the Independence of Judges. Historical Foundations and Practical Procedures in Facing the Threats against the Rule of Law in Europe».
Drafting Dignity
L’umanesimo rinascimentale italiano ha dato vita a una dinamica europea della dignità. Comunemente, la storia della dignità umana viene letta in chiave ontologica, basandosi su un’essenza «intrinseca» e «inviolabile» dell’esistenza umana. Ciò è dovuto al rilievo giuridico della Dichiarazione universale dei diritti dell’uomo del 1948 e della Legge fondamentale tedesca del 1949, entrambe desiderose di vietare qualsiasi atrocità disumana e discriminatoria. La lettura dei maestri italiani del Quattrocento, e in particolare dei contemporanei di Pico della Mirandola, Ficino, Manetti, Salutati e Valla, rivela una svolta argomentativa che si allontana dalle deduzioni scolastiche di essenze ontologiche dalla natura metafisica dell’uomo, e mette in evidenza la relazione tra la «competenza redazionale» dell’uomo e ciò che egli vuole essere. Il delfico «Conosci te stesso» (gnṓthi seautón) non si riferisce mai a una cognizione solipsistica di individui isolati. Piuttosto, è solo attraverso la reciprocità delle relazioni che l’uomo si riconosce, «forma e formatta» la sua personalità, il suo linguaggio, il suo pensiero, le sue azioni, il suo ambiente e quindi, naturalmente, la sua volontà. Questi termini di reciprocità sono al centro del breve contributo che segue.Italian Renaissance humanism released a European dynamic of dignity. Commonly, the history of human dignity is read in an ontological way, relying on an ‘inherent’ and ‘inviolable’ essence of human existence. This is due to legal prominence of the Universal Declaration of Human Rights of 1948 and the German Basic Law 1949, both eager to ban any inhumane atrocities and discrimination. Reading the Italian masterminds of the quattrocento, and esp. Pico della Mirandola’s contemporaries Ficino, Manetti, Salutati, and Valla, reveals an argumentative turn away from scholastic deductions of ontological essences from the metaphysical nature of man, and highlights the relatedness of the human ‘drafting competence’ of what he wants himself to be. The Delphic ‘Know thyself’ (gnṓthi seautón) never referred to a solipsistic cognition of isolated individuals. Rather, it is only by the reciprocity of relations that man recognizes himself, ‘shapes and formats’ his personality, his language, his thinking, his actions, his environment, and thus, of course, his will. These terms of reciprocity lie at the heart of the following short contribution.
Camillo Montalcini e l’amministrazione della Camera dei deputati tra età giolittiana e fascismo. Note per una biografia
The essay aims to re-read and deepen the figure of Camillo Montalcini and his role within the administration of the Chamber of Deputies, starting from archive documents. He entered by com- petitive examination as a clerk in November 1885 and climbed through all the various internal grades of the parliamentary administration. He was the first Secretary-General, appointed on 1st July 1907, and had the task of regulating the activities of the parliamentary bureaucracy under a single direction, transforming its image into a more modern one. He was an indispensable key man, influential interpreter of presidential strategies, a resolver of doubts, an interpreter of norms, a prompter of resolutions, a connoisseur and preserver of parliamentary practice. He professed the autonomy of parliamentary administration and the separation of technical and political functions within Parliament. For this reason, he was probably disliked by fascism.Il saggio si propone di ri-leggere e approfondire la figura di Camillo Montalcini e il suo ruolo dentro l’amministrazione della Camera dei deputati, ripartendo dai documenti di archivio. Entrato per concorso come impiegato nel novembre 1885, risalì tutti i vari gradi interni dell’amministrazione parlamentare. Fu il primo Segretario Generale, nomina avvenuta il 1° luglio 1907, ed ebbe il compito di regolare sotto un’unica spinta direttiva l’attività della burocrazia parlamentare trasformandone l’immagine in una più moderna. Fu indispensabile uomo chiave, influente interprete delle strategie presidenziali, risolutore di dubbi, interprete delle norme, suggeritore di delibere, conoscitore e conservatore della prassi parlamentare. Professò l’autonomia dell’amministrazione parlamentare e la separazione tra funzione tecnica e funzione politica dentro il Parlamento. Per questa ragione, probabilmente, non fu amato dal fascismo
Rappresentanza politica e rappresentanza degli interessi
This paper aims to identify the notion of representation of interests in fascist Italy’s juridical debate, in order to explore its role in shaping the new fascist State and the new legislation on this subject (from 1928’s electoral reform to 1939’s institution of Camera dei Fasci e delle corporazioni). The features of mass society, particularly the role played by multifarious groups of interest, together with the new forms of intervention adopted by public power, will help us understand the different ways of seeing the representation itself: is it considered a relevant tool in connecting State and society (even in a bottom-up approach)? Is it also a way to protect the different social, political, and economic interests within the State? Finally, the paper argues that the regime’s public discourse intended to avoid any reference to the notion of representation of interests as a feature of the new fascist order, inspired to the diverse idea of ‘preventive sterilization’ of conflict and pluralism, irrespective of its actual success.L’articolo intende analizzare se e come la nozione di rappresentanza degli interessi venga utilizzata dalla riflessione giuridica dell’Italia fascista, il ruolo che a essa viene riconosciuto (o meno) nel mettere a fuoco i contorni del nuovo Stato e nel restituire le caratteristiche dei principali interventi normativi in materia (la riforma elettorale del 1928 e l’istituzione della Camera dei Fasci e delle Corporazioni nel 1939). Muovendo dalle caratteristiche della società di massa, scandita intorno a gruppi portatori di determinati interessi, e dalle nuove modalità di azione e intervento del potere pubblico, si tenta di verificare come tali aspetti incidano nel modo di considerare la rappresentanza: se in essa si veda uno strumento di connessione (anche ascendente) tra Stato e società; e se venga concepita come strumento per garantire una proiezione istituzionale a differenti interessi sociali, politici ed economici. Si ritiene, in conclusione, che la pubblicistica di regime (e non solo) abbia escluso la possibilità di riferirsi alla nozione di rappresentanza degli interessi per descrivere la novità fascista, ispirata alla diversa idea di una sterilizzazione preventiva – non importa quanto davvero riuscita – del conflitto e del pluralismo
Moderating Power in the 19th century Brazilian Constitutional Doctrine
Questo studio affronta i dibattiti Giuridici della seconda metà del diciannovesimo secolo sulla responsabilità legale del potere moderatore. Attraverso un’analisi archeologica della struttura e del contenuto degli argomenti utilizzati, questo lavoro si propone di comprendere le regole che hanno costruito l’ordine discorsivo all’interno del quale si è sviluppato il dibattito e che hanno ispirato il complesso processo di modernizzazione del discorso giuridico brasiliano dopo l’indipendenza del Paese. La conclusione è che le differenze tra i giuristi del periodo non sono solo politiche o ermeneutiche, ma riflettono anche il contrasto tra due diverse concezioni del diritto. La prima è una nozione razionale-realista, che comprende il diritto come un insieme di relazioni necessarie tratte dallo spirito dell’ordine costituzionale mentre la seconda nozione è una nozione giuridico-formalista, che comprende il diritto come un insieme di norme positive formalizzate nel testo della costituzione.This study addresses legal debates from the second half of the nineteenth century about the legal responsibility of the moderating power. Through an archaeological analysis of the structure and content of the arguments used, this paper aims to understand the rules that constructed the discursive order within which the debate was developed and which have inspired the complex process of modernization of the Brazilian legal discourse after the independence of the country. We conclude that differences between jurists of the period are not only political or hermeneutical, but also reflect the contrast between two different conceptions of law. The first is a rational-realist notion, which understands law as a set of necessary relationships drawn from the spirit of the constitutional order while the second notion is a legal-formalist one, which understands law as a set of positive norms formalized on the text of the constitution.
History of Constitutional Review in Brazil (From Foundation to Nowadays)
Questo saggio consiste in una indagine storica sulla formazione del sistema brasiliano di controllo di legittimità costituzionale partendo dalla Costituzione dell’Impero del 1824 fino all’attuale Costituzione del 1988. Più specificamente, cerca di offrire una critica rivolta alla narrazione del discorso giuridico brasiliano che concepisce l’attuale modello di controllo di legittimità costituzionale come il prodotto di una graduale evoluzione legislativa, il cui punto di partenza è stato concepito invece soltanto dalla Costituzione del 1891. Per raggiungere il suo obiettivo, questo saggio parte dalla premessa che il sistema di controllo di costituzionalità è definito da una decisione politica durante il processo costituente, il che significa riconoscere che non si tratta di una funzione intrinseca all’attività del giudice oppure al potere giudiziario. Grazie all’approccio storico-contestuale, questa ricerca cerca di studiare le fonti storiche di ognuno dei periodi costituenti per concludere che la definizione su quale autorità sia quella legittima a dire “l’ultima parola” in materia costituzionale deriva da una costellazione di fattori culturali, politici e giuridici.The article performs a historical investigation on the formation of Brazilian constitutional review system since the Imperial Constitution of 1824 until the current Constitution of 1988. More specifically, it aims to offer a critique of the narrative of Brazilian legal discourse, which conceives the current model of judicial review as a product of a gradual evolution of legislation, whose starting point was to be found in the Constitution of 1891. In order to achieve its goal, this essay assumes the premise according to which the system of constitutional review is defined by a political decision during the constituent process, which means to recognize that it is not an inherent function of the judge or of the Judiciary Power. From the historical contextualism approach, this research relies on the examination of historical sources of each of the constituent periods and concludes that the definition of the legitimized authority to say the “last word” in constitutional matters stems from a constellation of cultural, political and legal factors.
La civilizzazione statuale nell’opera di Gaetano Filangieri. Teoria politica, edu- cazione giuridica, rivoluzione costituzionale
This essay aims to show that the concepts developed by the great Neapolitan jurist and philosopher Gaetano Filangieri (1753-1788) were aimed at finding the means – especially legislative, but not only – to start the civilization process in Italy, i.e. the social and individual feeling that in the main European countries had made possible a mature socialitas, that in turn made citizens able to cooperate and to self-regulate through the general identification of the associates in a common political and institutional project. In The Science of Legislation Filangieri seems persuaded that withouth this social foundation no law can be enforced. At the same time, he identifies in a new legal education the decisive element to make that crucial step to transform a community into a society. The forma mentis of the Ancien Regime lawyers’ was still imbued with the ancient structures of the jus commune, and any reform had to be preceded by a new legal education to overcome that obsolete and static mentality and make it evolve into a vision in which law was no longer considered an ontic order but a dynamic order. This is the most important meaning that was already inherent in the title of the Filangierian work: it was necessary to pass from the medieval Scientia Juris, centered on the patriarchal mediation of the magistrates who held themselves inspired by the divine munus, to an empirical legal science that knew how to make legislation able to descend into the karstic rivulets of the social body. For this reason, the contribution of Filangieri was among the most important and decisive in the struggle for the affirmation of modern legal democracy.Questo saggio si propone di dimostrare che l’elaborazione concettuale del grande giurista e filosofo napoletano Gaetano Filangieri (1753-1788) è proiettata a individuare i mezzi – soprattutto legislativi, ma non solo – per avviare in Italia il processo di civilizzazione statuale, ossia quel sentire sociale e individuale che nei principali Paesi europei aveva reso possibile una socialitas matura e capace di forme avanzate di cooperazione e di autoregolazione per mezzo dell’identificazione generale dei consociati in un progetto politico e istituzionale comune. Nella Scienza della Legislazione Filangieri si mostra persuaso che senza questo fondamento sociale nessun diritto possa essere attuato e nel contempo individua in una nuova educazione giuridica l’elemento decisivo per realizzare quel passaggio cruciale che trasforma una comunità in una società. La forma mentis dei giuristi di Antico Regime era ancora impregnata delle vetuste strutture del diritto comune e qualsiasi riforma doveva essere preceduta da una nuova formazione giuridica per superare quella obsoleta e statica mentalità e farla evolvere in una visione nella quale il diritto non fosse più considerato un ordine ontico ma un ordinamento dinamico. Questo è il significato più importante insito già nel titolo dell’opera filangieriana: occorreva passare dalla medievale Scientia Juris, imperniata sulla mediazione patriarcale dei togati che si ritenevano ispirati dal munus divino, a una scienza empirica del diritto che sapesse conferire alla legislazione la capacità di scendere nei rivoli carsici del corpo sociale. Per questo il contributo di Filangieri fu tra i più importanti e decisivi nella lotta per l’affermazione della democrazia giuridica moderna
