    Edmund Burke e la cultura politica dell’illuminismo scozzese

    This paper reconstructs the presence of the political languages of the Scottish Enlightenment in Burke’s thinking, and points out the ways in which they were refashioned and differently used. It shows how Burke subverted the triangle between commerce, sociability and liberty, non only as far as the historical sequences of the Enlightenment progress of civil society were concerned, but also for their moral value. In particular, he denied that the development of the commercial society could bring about its own moral principles (like in Hume’s and Smith’s conception). On the contrary he emphasized that, without the glue of the aristocratic and hierarchical values of honour and religion, commerce could result in nothing else than disgregation. The judgment on the French Revolution belongs just to this “counter-history” of civil society, paradoxically set forth with the theoretical tools provided by the Scottish Enlightenment.Il presente saggio ricostruisce la presenza nel pensiero di Burke di linguaggi politici elaborati dagli illuministi scozzesi e ne misura la rielaborazione e il differente utilizzo. Mostra come, nella triangolazione tra commercio, sociabilità e libertà, Burke abbia operato una sovversione non solo delle sequenze storiche che per gli illuministi costituivano il progresso della società civile, ma anche del loro valore morale. In particolare ha negato che lo sviluppo della società commerciale potesse produrre autonomi princìpi morali (come nella visione di Hume e Smith), ma anzi ha sottolineato che, senza il collante dei valori aristocratici e gerarchici dell’onore e della religione, il commercio abbandonato a se stesso non poteva avere altro che esiti di disgregazione. La valutazione della Rivoluzione francese si inserisce esattamente in questa “controstoria” della società civile, paradossalmente formulata attraverso gli strumenti teorici elaborati dall’illuminismo scozzese

    Burke does not reject constitutional innovation in itself, so he is not technically a “reactionary”, like Bonald and de Maistre, nor does he reject the specific and plural rights that can emerge from the historical “experience” of the nation, but only an “absolutist” idea of politics, to which he opposes the limits of its connatural logic, that of social ties handed down to us by tradition (which as such is in itself also a continually manipulable “myth”) and he responded to the revolt on the part of the British colonies overseas by proposing the moderate and integrative (therefore conservative, but liberal) solution that was the Commonwealth. In this sense, he is a forerunner of the thinking of Hannah Arendt and Jakob Talmon on “totalitarian democracy” in the twentieth century. To read him today thus means vaccinating oneself not only against revolutionary ‘”enthusiasm”, that can often – going against the original intentions – “produce monsters”, but also the pitfalls of purely technocratic Europeanism.Burke non respinge l’innovazione costituzionale in se stessa, dunque non è tecnicamente un “reazionario”, come Bonald e de Maistre, e nemmeno i diritti specifici e plurali che emergessero dal “vissuto” storico della Nazione, ma solo l’idea “assoluta” della politica, cui oppone la logica dei suoi limiti connaturali, quella dei legami sociali consegnatici dalla tradizione (che come tale è in sé anch’essa un “mito” continuamente manipolabile) e alla rivolta delle colonie britanniche di oltreoceano aveva del resto risposto proponendo la soluzione, certo moderata e integratrice (dunque conservatrice, ma liberale), del Commonwealth. In questo senso, egli è un anticipatore delle riflessioni novecentesche di Hannah Arendt e Jakob Talmon sulla”democrazia totalitaria”. Leggerlo oggi vuole dunque dire anche vaccinarsi dall’“entusiasmo” rivoluzionario, che spesso – contro le intenzioni di partenza – può “generare mostri” e dalle insidie dell’europeismo solo tecnocratico

    By claiming the existence of a « Judiciary Power », French Revolutionary People wanted to pre- vent the Executive Power (i.e. the King between 1789 and 1792) from appointing the Judges and managing the Courts. However, the relations between Executive and Judiciary Power were not abolished, as it is proved by the survival of a Ministry of Justice and of assistants of the public prosecutor appointed by the Executive. During the Revolution, the pressure grows on the judges and courts from the Committees of the Convention, then from those of the Executive Directoire. How to interpret this failure of the Judiciary Power and the permanent link, from then to nowadays, between the Executive Power and the judges in France?En consacrant l’existence d’un «Pouvoir judiciaire», les révolutionnaires français ont voulu écar- ter le Pouvoir Exécutif (le roi de 1789 à 1792) de la désignation des juges comme du fonctionnement des tribunaux. Pourtant tous les liens n’ont pas été rompus entre l’Exécutif et le Judiciaire, comme en témoigne le maintien d’un ministère de la Justice et d’agents du ministère public nommés par l’Exécutif. L’évolution sous la Révolution a conduit à multiplier les pressions sur les juges et les tribunaux venant des comités de la Convention puis du Directoire Exécutif.     Interpreting the Australian Constitution: Express Provisions and Unexpressed General Principles

    Il disaccordo all’interno della High Court of Australia (Alta Corte d’Australia) concernente il metodo corretto per interpretare la Costituzione concerneva inizialmente la legittimità di attuare principi generali inespressi che potevano probabilmente essere dedotti dai provvedimenti espressi. Questo al tempo fu percepito come comportante un disaccordo tra gli approcci britannici e americani all’interpretazione. Questo articolo descrive quell’iniziale disaccordo, come venne risolto nel caso epocale Engineers (1920), e come il disaccordo riemerse in casi successivi, particolarmente in quelli decisi negli ultimi venti anni.  Disagreement within the High Court of Australia concerning the proper method for interpret- ing the Constitution initially concerned the legitimacy of enforcing general unexpressed principles that could arguably be inferred from express provisions. This was perceived at the time to involve a disagreement between British and American approaches to interpretation. This article describes that initial disagreement, how it was resolved in the landmark Engineers’ case (1920), and how the disagreement re-emerged in later cases, particularly ones decided over the last twenty years

    Questo articolo provvederà uno sguardo storico sull’interpretazione e reinterpretazione del capitolo III della Costituzione del Commonwealth da parte dell’High Court of Australia (Alta Corte D’Australia) relativamente alle sue implicazioni per le Corti statali. Iniziando con un quadro generale del testo costituzionale, analizzerà l’approccio della Corte al capitolo III che porta alla decisione devastante in Kable e il provvedimento in corso della Corte significativo per le frasi costituzionali come “Corte di uno Stato” e “Corte Suprema di uno Stato”. Sulla base di alcune discussioni comparative, rifletterà sul processo costituzionale attraverso il quale interpretazioni radicali possono diventare luoghi comuni e ortodossia accettata.    This article will provide a historical gaze over the High Court of Australia’s interpretation and re-interpretation of Chapter III of the Commonwealth Constitution in terms of its implications for State Courts. Beginning with the framing of the constitutional text, it will survey the Court’s approach to Chapter III leading up to the seismic decision in Kable and the Court’s ongoing provision of mean- ing to constitutional phrases such as “Court of a State” and “Supreme Court of any State”. With some comparative discussion, it will reflect on the constitutional process by which radical interpretations can become commonplace and accepted orthodoxy

    Cittadinanza e ordine territoriale: un itinerario a partire dal caso dei postnati (1608)

    This article investigates the conceptualization of political space as a territorial order at the origins of the modern state and its connection to the discourse on citizenship. By drawing on the discussion of the jurist Edward Coke in the famous Calvin’s case (1608), the analysis focuses on the bond that the legal reasoning builds between the principle of jus soli and the rule of conquest governing the expansion of common law. Although a wide-ranging legal and political literature referred to Calvin’s case with regards to the debates about citizenship, the interconnection between these two juridical principles has rarely been directly addressed. By adopting such an approach, the article sheds light on two critical issues in the construction of the territorial order of citizenship. First of all, it investigates the artificial character that modern political space necessarily acquires in the light of its representation as an homogeneous and conceptually unified space. In order to do so, the article critically addresses the literature which appealed to ‘natural law’ as the founding principle of jus soli, and focuses on the reformulation of the medieval theory of sovereignty around the figures of the King’s two bodies. Secondly, the analysis shows how modern territorial order has expanded through ‘oppositions’ and through the projecting beyond the boundaries constructed around the homogeneous and unified space of the ‘subject’ destined to become ‘citizen’.Quest’articolo propone una riflessione sull’intreccio tra il discorso sulla cittadinanza e la costruzione della spazialità politica come ordine territoriale alle origini della modernità. Prendendo le mosse dalla discussione del giurista Edward Coke sul caso Calvin del 1608, l’analisi mette a fuoco il legame che l’argomentazione giuridica stabilisce tra il principio dello jus soli e la regola di conquista che ha governato l’espansione della common law. Seppure una vasta letteratura abbia fatto riferimento al caso Calvin in relazione al dibattito politico e giuridico sulla cittadinanza, raramente viene messa in luce la connessione tra questi due principi giuridici. L’approccio proposto evidenzia due questioni centrali nella costruzione dell’ordine territoriale della cittadinanza. In primo luogo, viene messo a fuoco il carattere artificiale che lo spazio politico moderno acquisisce in ragione della sua concettualizzazione come spazio omogeneo e unitario. Da questo punto di vista, l’articolo pone criticamente in questione la letteratura che ha chiamato in causa il diritto naturale come principio fondativo dello jus soli e concentra, invece, la propria analisi sui passaggi che hanno portato a una riformulazione della dottrina medioevale della sovranità basata sulla finzione dei due corpi del re. In secondo luogo, il percorso di riflessione proposto mostra come l’ordine territoriale moderno sia stato costruito per opposizioni, e come la sua espansione sia avvenuta tramite la proiezione all’esterno dei confini eretti a protezione dello spazio omogeneo del suddito destinato a diventare cittadino

Romagnosi è stato uno studioso policromo, che ha avanzato una concezione della conoscenza e della scienza di tipo unitario e che a livello sistemico ha cercato, sulla base di cerchi concentrici, di svilupparla in maniera coerente. In occasione del 250 anniversario della sua nascita, l’A. ne evidenzia il ruolo di ponte di collegamento tra il razionalismo settecentesco e il romanticismo ottocentesco, mettendo in risalto sia il suo programma giuridico volto alla difesa del diritto sulla base di principi e di valori corrispondenti al grado di incivilimento umano, sia l’interesse per la storia comparata (in senso diacronico e sincronico), per le scienze politiche e per la scienza in generale, che sembrano essere contrarie allo specialismo contemporaneo

    The essay analyzes the impact of the Italian model on the unification of Germany and the political and cultural transfers between the two countries between 1840 and 1870, focusing on the reception of the “moderate” current of the Italian Risorgimento by the forces of German liberalism which opted for a ‘small-german’ solution of the German question. Liberal public opinion in Germany after 1840 had a different perspective on Italy than in the decade before, what can be explained by the constitutional history of Germany. The accumulation of contradictions at the beginning of the 1840s, culminating in the revolution of 1848/49, made a gradual affirmation of liberal and constitutional principles impossibile: in such a context the german liberals were increasingly attracted by the formation of a moderate, antirevolutionary liberal movement in Italy. German liberalism welcomed this tendency, represented by Gioberti, Balbo, Mamiani, Bianchini and above all by Massimo D’Azeglio, as a sign of growing political maturity. After the revolution, German liberalism inevitably had to cope with the new experience of failure, a severe restriction of political spaces, a period of political repression and dramatic economic and social change. Liberalism started to adapt his ideas to the Zeitgeist right from the beginning of the decade. The problems mentioned had a decisive impact on the process of redefining liberal political thought in terms of Realpolitik in the years after the revolution. It doesn’t come as a surprise that in this context the liberal sectors of public opinion in Germany were in favour of Piedmont and Cavour. Doubtless the events of 1859 and 1860 had a stimulating and illuminating effect on public opinion in Germany. In Prussia the Italian model did prepare the ground for an alliance between Bismarck and the national movement. But this alliance has other roots as well. It is based on the anti-french myth of the anti-napoleonic Befreiungskriege and on the more recent turn to Realpolitik of the 1840’s which gained momentum after the failed revolution of 1848.Il saggio analizza l’impatto del modello italiano sull’unificazione della Germania e gli scambi politici e culturali tra i due paesi fra il 1840 e il 1870, focalizzando l’attenzione sulla recezione della corrente “moderata” del Risorgimento italiano da parte delle forze del liberalismo tedesco che optarono per una soluzione ‘piccolo-tedesca’ della questione tedesca. In Germania la pubblica opinione liberale aveva dopo il 1840 una prospettiva sull’Italia differente da quella del decennio precedente, cosa che può essere spiegata con la storia costituzionale della Germania. L’accumulo di contraddizioni all’inizio degli anni ’40 dell’Ottocento, culminanti nella rivoluzione del 1848/49, rese impossibile una gradua- le affermazione di principi liberali e costituzionali: in tale contesto i liberali tedeschi erano attratti in modo crescente dalla formazione di un movimento liberale, moderato e antirivoluzionario, in Italia. Il liberalismo tedesco accolse con favore questa tendenza rappresentata da Gioberti, Balbo, Mamiani, Bianchini e sopra tutti gli altri D’Azeglio, come un segno di crescente maturità politica. Dopo la rivoluzione, il liberalismo tedesco dovette inevitabilmente confrontarsi con la nuova esperienza del fallimento, una pesante restrizione degli spazi politici, un periodo di repressione politica e di drammatici cambiamenti economici e sociali. Il liberalismo iniziò ad adattare le sue idee allo Zeitgeist direttamente dall’inizio del decennio. I problemi menzionati ebbero un impatto decisivo sul processo di ridefinizione del pensiero politico liberale in termini di Realpolitik negli anni successivi alla rivoluzione. Non è una sorpresa che in questo contesto i settori liberali dell’opinione pubblica in Germania erano a favore del Piemonte e di Cavour. Senza dubbio gli eventi del 1859 e 1860 ebbero un effetto stimolante e illuminante sulla pubblica opinione in Germania. In Prussia il modello italiano preparò il terreno per l’alleanza tra Bismarck e il movimento nazionale. Ma questa alleanza aveva anche altre radici.     Our present understanding of “public law” is conditioned above all by its opposing concept, "private law". In the Middle Ages both spheres were still substantially undivided. It follows that a definition of public law for this period can be achieved only by studying certain individual institutions. Included among these are the "leges fundamentales" of the Holy Roman Empire. For the Empire's complex structure these constituted a foundation of monarchical statehood which had the character of constitutional law. For the historian, therefore, the concepts of "leges fundamentales", "ius publicum", "constitution", "state", and "contract" must be investigated in order to follow the lines of continuity in public law back into the Middle Ages. The starting point of such a study is the turn of the 16th and 17th centuries, when the "ius publicum" became an independent discipline at German universities.La comprensione attuale del “diritto pubblico” è condizionata soprattutto dal suo concetto opposto: “diritto privato”. Nel Medioevo le due sfere erano ancora sostanzialmente indivise. Ne consegue che la definizione di diritto pubblico per questo periodo può essere raggiunta solo studiando alcuni singoli istituti. Inclusi fra loro ci sono le “leges fundamentales” del Sacro Romano Impero. Per la complessa struttura dell’Impero esse costituirono un fondamento del potere statuale monarchico che aveva i tratti del diritto costituzionale. Per lo storico, dunque, i concetti di "leges fundamentales", "ius publicum", "costituzione", "stato" e "contratto" devono essere investigati per seguire le linee di continuità del diritto pubblico nel Medioevo. Il punto di partenza di tale studio è la svolta dei secoli XVI e XVII, quando lo “ius publicum” divenne una disciplina indipendente nelle università tedesche
